church treats women who have had an abortion. good to be with you on this tuesday. i'm francis rivera in for tamron hall. we begin with what could be a new headache for hillary clinton. the state department released a huge new batch of e-mails from her time as secretary of state and some contained now classified information. but the state department says that information was not confidential at the time it was sent. clinton has always insisted she never knowingly sent classified data using her private e-mail. nbc's andrea mitchell is in washington with more on what's exactly in the latest batch of e-mails. >> good morning, francis. this is the story that just won't go away for hillary clinton. and today the largest batch of clinton e-mails yet, more than 7,000 pages released under court order overnight. roughly 125 are now classified, though they weren't at the time they were sent. this time none were top secret, but 125 were classified

confidential in the last few days, including this 2010 e-mail about press reports. the state department was softening the administration's stance in nuclear talks with iran. clinton writes, the wall street journal says it's a reversal of position? >> abedin writes, it's clearly a state issue. it appeared unclear the e-mail address was clinton's, abedin writing, they have no idea it was you. they did caution restraint in discussing anything unclassified in an insecure setting. clinton struggled to set up her ipad, asking an aide how to charge it, later adding, i don't know if i have wi-fi. how do i find out? and some e-mails are clearly not

state secrets. she e-mails a personal assistant for skim milk for tea and the tv schedules for parks and recreation and "the good wife." with a quarter of the e-mails now released, the controversy is taking a political toll. many democrats are nervous about what the fbi may find, and republicans are pouncing on the controversy. as dick cheney did with cnn's jamie gangel. >> i think it was sloppy and unprofessional, that it reflects a lack of understanding about how easy it is for adversaries to tap into communications. >> reporter: meanwhile, clinton's once enormous lead over bernie sanders in iowa has shrunk to 7 points in the most recent poll. closely watching clinton's e-mail troubles, joe biden. i'm told he is now seriously considering a race if he decides he and his family can give it their all given the tragic death of their son beau, and that may be a season where biden's

attributes are matched with the time. francis? >> we have our news nation panel today, philip rucker, and also with me here on set, republican strategist susan del persio. philip, i want to start with you here. no smoking gun and going down in the percentages. >> i think the political problem will be the most lasting in this campaign. i think regardless of the law and whether there are any violations here or not, it's a political headache. people look at this controversy and think, you know, it looks kind of sketchy and then she's hiding some of these e-mails. the e-mails that came out last night were sort of interesting in that it showed you kind of how she and her aides operated within the state department. there was some bad feelings, if

you will, about the obama team that lingered from 2008. there was also a very interesting e-mail from chelsea clinton advising about the haiti recovery efforts, but like you said, no legal smoking gun as of now. >> what could be the most damning is that the state department didn't know and the frustration that the aides showed dealing with that private server here. i also want to ask, so far 13,000 pages from clinton's private server has been added with about 7,000 pages yet to come. >> yeah, this will go on for several months. republicans will want to keep this in the news. i suspect sometime next year there will even be attack ads about the controversy. democrats are very nervous about wait she and her campaign have been handling it. i was out at the dsc meeting last week, and a lot of democratic leaders privately were expressing a lot of concern and frustration, feeling that clinton herself has not put this

issue behind her. >> we've been seeing that concern from susan, your party's candidates, especially when it comes to donald trump. he was the latest to respond here, releasing this tweet saying, this is a very big deal. and also chair reince priebus says she cannot be trusted with the white house. they also say she mishandled classified e-mails here but not with a smoking gun. so how much of this is ammunition the republicans are taking advantage of? >> you started saying is this an e-mail problem or a political problem? a huge political problem 100%, and it will continue to take a toll, because at the end of every month for several months, we'll continue to see donald trump. we don't know yet if there is a legal problem because we don't know what they're finding. these e-mails are the ones she gave the state department, not the things they're looking for

on the scrub server. the other problem we now know is she had her server backed up in some bathroom in denver, which there is no way, even if you could say hillary clinton married to bill clinton, their house is secure, they did everything there. you have what turned out to be classified information on a server in denver. the issue there is she says, well, i never accepted anything that was classified, i never got any classified e-mails. but she should well know that unclassified e-mails could easily turn into classified e-mails and that those were being housed on that sefrver in denver. this is a big problem that can be parsed out, and if republicans are smart, they'll let a lot of findings in the press come out and then start separating the arguments. >> interesting, though, when it comes to the timing on the republican side speaking to you about this and ben carson. he has to be looking at the latest poll. the monmouth poll at the

university of iowa showing ben carson tied with donald trump among gop. carly fiorina 10%, ted cruz 9%. we're seeing more of a surge from the anti-establishments saying politics as usual. >> and they said do you want a washington insider or a washington outsider, and it was overwhelming 2-3 they wanted a washington outsider. what you also see reflected in that poll is the complete collapse of scott walker. he went from 22 to 7, and it looks like ben carson picked up some of that. interesting enough to compare him with trump, carson is doing a lot better at 30 to 19 against donald trump which shows maybe trump's message is not settling very well with women. >> i want to ask you about ben carson. really strong numbers in iowa. we know he is always referencing his christian faith there.

we're talking about iowa when it comes to the iowa caucus here, but can that translate nationally in a surge? >> i don't know. he's always done well in iowa. he has a lot of organizers there on the ground. he does particularly well with the evangelical communities, the home schoolers. those are big voting groups in iowa. they are not big voting groups in new hampshire, for example, or in some of the other states that are going to determine the nomination. so, you know, i don't know if he's going to be able to grow nationally the same way that donald trump has, but i would go back to that earlier point about anti-establishment. these candidates leading are not just anti-establishment, they're anti-politician. they've never served in government before, and there was another poll by the des moines register over the weekend that showed that voters actually preferred a candidate who had no government experience over somebody who did. >> donald trump, speaking of an outsider here, and jeb bush taking aim at each other with new videos. first trump targeted jeb bush on

immigration and then bush fired back at trump showing the illegal immigrant path. >> yes, they broke the law, but it's not a felony. it's an act of love. >> i've lived in new york city and manhattan all my life, so my views are a little different than if i lived in iowa. >> possible birth abortion? >> i am pro choice in every respect. as far as single payer, it works in canada, it works incredibly well in scotland. >> we're seeing attacks from donald trump against jeb bush, but can that backfire and actually help bush, and should he be look being at ben carson with those numbers in iowa surging? >> it seems we fast track the way campaigns work.

we have two well-known names, trump and bush. they're locked by celebrity and one by family name. trump has been unrelentless in going after mr. bush. so he had to push back, and this was a good ad to push back in. now he's going to work to define mr. trump as a new york liberal. so we'll see how it plays out, but that's what the game is now. frankly, it's also the first time we see bush fighting back in his own words instead of just letting his spokesperson do it. we saw that today in an early entry. >> september is over, and it may change things now. appreciate you being here. >> thank you. developing now, we are keeping an eye on the markets after u.s. stocks plunged at the opening bell this hour. an hour ago the dow was down over 400 points. take a look now. down about 319, 318. cnbc's brian sullivan joins me now. brian, what's going on here?

can we attribute this to china fears once again? >> you can attribute part of it, francis, to china certainly, but i want to remind viewers that china's economy has been slowing down for four years and the stock market thhas surged durin that time. of course, stock prices fell and we're at about 320 points in the dow, going back to construction territory, for being more than 10% off our highs. you got oil down as well, energy being a growth economy in the united states for a couple years. lower oil prices probably also dragging down stocks. keep in mind, though, china is not the only major economy in the world to be concerned about. the brazilian economy is in recession. they're sinking. canada, our biggest trading partner, by the way. canada, not china, is number one. they are actually in recession as well by some measures. so there is a lot of global concerns that is causing a drag on our stock market. >> we're watching there and over

developing now, a showdown is intensifying in kentucky where a county clerk is defying a federal judge's order that she must begin issuing marriage licenses to same-sex couples, an order the supreme court refused to block last night. this was the scene as a crowd gathered at rowan county clerk kim davis' office this morning to see if she would finally begin issuing the licenses. a heated confrontation ensued as she continued to deny licenses to couples. >> you're telling us we're second class citizens, is what you're doing. you're saying we're not worth the same rights as you are. why are you not issuing marriage licenses? >> under authority. >> whose authority? >> under god's authority. >> you can call police. i pay your salary! >> her refusal in that

confrontation came just hours after the supreme court, in a brief one-line decision, rejected her appeal. davis claimed she, quote, hold an undisputed seriously held belief that marriage is a union between a man and a woman. it's the first major legal battle to reach the supreme court since the landmark decision back in june that same-sex marriage is a constitutional right. nbc justice correspondent pete williams joins me now. pete, with this high court ruling, does she have any other options? >> reporter: well, the options now are from the other side, really, because right now the lawyers for the couples who are seeking marriage licenses have gone back to the federal judge who last month ordered her to issue these licenses, and they're now ask the judge to hold her in contempt of court. they say they don't want to see her go to jail, but here's how they end their request. they say, we don't seek to compel davis' compliance through incarceration since she continues to collect compensation from the state for her duties. they urged the court to impose

financial penalties sufficiently serious and increasingly onerous to compel her immediate compliance. so the judge is going to have to decide what to do about that. he'll probably ask for the other side to respond. we're told he's going to have a conference call with the lawyers involved here. he could have a hearing, or he could act based on the record before him now. if she's found in contempt of court, the judge has the option of either ordering her to go to jail until she agrees to comply, or fining her, and that's where it stands right now. now, separately, the county attorney had referred to the state a misconduct charge, but the state hasn't taken any action on that that we know of yet. so the action right now seems to be back in federal court on whether to hold her in contempt. >> now, pete, will she be required to actually appear in court, or can the judge just simply rule? >> good question. i'm not sure what the rule is there in that part of kentucky, but normally speaking, a defendant held in contempt does appear, but i don't know whether

live morning broadcast on wdbj in virginia last week. family, friends and colleagues have gathered inside the first baptist church in roanoke for what's being called a celebration of adam ward's life. it will be followed by a public service. both ward and alison parker were remembered in a larger interfaith service on sunday. president obama will hike the massive arctic glacier. it's one of the reasons for his trip to highlight the effects of climate change. glaciers have been disappearing which experts have been attributing to climate change. president obama forcefully called on politicians and world leaders to act boldly. >> the time to plead ignorance is surely past. notices who want to i those who want to ignore the science are increasingly alone. they are on their own shrinking island. if we were to abandon our course of action, if we stop trying to

build a clean energy economy and reduce carbon pollution, if we do nothing to keep glaciers from melting faster and oceans from rising faster and forests from burning faster and storms from growing stronger, we will condemn our children to a planet beyond their capacity to repair. >> host of nbc's "running wild" will serve as the president's guide as he hikes the glacier, and later in the day he will tour the canon by boat. chris jansing joins us live in alaska. chris, another gorgeous setting behind you. what is the president going to do today to highlight climate change? >> there is no doubt about the glacier being one of those dramatic symbols about what climate change has done here. in fact, there are actually signs along the way where the president will hike that show you how quickly that glacier has retreated. a couple days ago we were out on another glacier, and a woman who has worked here with her husband

giving glacier tours for 20 years was saying that while she has gradually seen that change, it's been dramatic over the last couple years. one of the things the president pointed out yesterday in that speech in which he was very passionate and did a lot of ad libing aft ilibbing to some natives, there is a temperature change here more than anywhere else in the country, so toephe wanted to show dramatically how temperature change is affecting alaska, what's known as the front lines of the climate change debate. he says he is using this as no more than a prop, but this is the lead-up for the president to a big national conference in paris where they hope to come to some climate agreements, and in fact, a number of people who will be there was at this state glacier conference yesterday. francis? >> the president is going to meet up with bear grills at the

press conference today. what did he talk about? >> he's actually said the president has seen "running wild" with bear grills. there is a lot of joking about the president's survival techniques. he obviously had a few chances to survive the washington maelstrom. i talked to him yesterday and he said the president wanted to push the envelope, that there were a number of things that bear grylls suggested that he turned down for the secret service. there is a couple hikes. there is a half mile hike on the lower part of the exit glacier and there is a very scenic hike on the upper part, so we'll see exactly what adventure awaits the president, but according to josh, he's game. >> the eu goiare you going alon

now, two things that are exactly the same have have never been more different. ge software. get connected. get insights. get optimized. we are getting breaking news just in regarding the kentucky clerk who has been refusing to issue marriage licenses to same-sex couples. she has been called for a federal court hearing on thursday morning. pete williams joins me on this. she still refuses to issue licenses after the supreme court blocked that as well, pete. >> reporter: well, francis, you asked me a few minutes ago whether if there was a contempt hearing, she would have to appear. we now have the answer from the federal judge. she's been ordered to appear 11:00 a.m. on thursday at a hearing on whether she should be held in contempt of court, and the judge ordered not only her but also the deputy clerks in her office to appear. they all have to be in federal court for this contempt hearing.

this follows a conference call with lawyers for both sides in this case that ended just a short time ago. it's interesting the judge has acted so quickly here. of course, it was this judge's order last month that said she had to start issuing marriage licenses. that was appealed to the sixth circuit, and when she lost there, she asked the supreme court to step in, and it declined. so now she's out of legal options to try to fight this order that she has to issue licenses. she's still refusing to do it, and the federal judge says come in on thursday morning and explain why she shouldn't be held in contempt. i should make one more point here, though, i think. the question here of whether she can have a religious objection to refuse to carry out part of her official duties, that issue is still before the courts. she's appealing the judge's order that says she has to do this. the merits of her case itself will still continue to work through the courts. all these being litigated right now is the order that while that

case is on appeal, she has to issue the licenses. she has said that she won't do it while her case is on appeal, but she's run out of options to try to fight that particular order. >> very quickly, pete, i'm curious. if this hearing is on thursday, does that mean she's going to report to work every day until then and continue to deny these licenses? >> we don't know yet. we believe she's going to issue a statement shortly. that's what we're told. we'll see shortly what she's going to do. there is no contempt order against her now. >> right. it remains to be seen if that will be the case on thursday when she appears to court. pete williams, thanks again for that update on the breaking news. two officials in southern california arrested more than 200 undocumented immigrants with criminal records last week. in an operation officials are calling it the most successful four-day sweep of its kind in the region. the sweep was conducted by the nationals fugitive operations program which are responsible for finding at-large criminals for deportation.

the majority of the 244 people arrested had at least one felony conviction on their record, and 191 of those arrested were originally from mexico. and there were also immigrants from 21 other countries, including peru, thailand and france. well, this follows a similar month-long sting in june that ended with 280 arrests across six midwestern states. joining me now is usa today reporter alan gomez. alan, good to have you here. when you have ice saying 66% of those arrested had criminal records, felony convictions like child rape crimes or murders, the rest had misdemeanors, what happens to these immigrants? are they deported immediate snl. >> over half of them get deported, most of them have orders ready to get out of here. what we're seeing in these raids

was very different than what we saw under president bush. back then there were these big work site raids where they would go in and sweep up a large number of undocumented immigrants at work sites and deport them whether they had criminal records or not. what ice is trying to do under the obama administration is really target people who have criminal records. you know, there was some concern that this raid in l.a. was sort of a direct response to what we saw with the undocumented immigrant that killed the young lady in san francisco a couple months ago. >> kate steinly. >> exactly. absolutely not. this sting has been planned for months, and they've been doing this for many, many months. it is not a direct response to that shooting, but it is a response to some of these policies in the sanctuary cities that are not assisting the feds to pick up these undocumented immigrants, forcing them to do more of these raids. >> it's interesting how the l.a.

times says ice calls it the most successful sweep of its time, but crime involving immigrants is up. quote, one of the challenges we're facing is because of state law and local policies. more individuals who are potentially deportable with criminal histories rk released on the street instead of being turpd over to ice. i think to infer from the sweep that potentially foreign nationals are committing more crimes is flawed. what are they saying there? >> i found nothing to indicate they commit crimes at a higher level than the local population, but before you had local officials, local jails handing over undocumented immigrants who had any kind of criminal history over to the feds, so that was a pretty easy transition. now that a lot of places aren't cooperating with the feds and handing over the people they've arrested on these local charges

to immigration officials, it's forcing ice to go out and get them. they create a lot of task force, they work a lot in these big regional sweeps so they can kind of concentrate their limited manpower and go after people in specific areas for these short three, four, five-day sweeps. >> immigration reporter alan. thank you. ben carson has other things going for him that could make him even mora peeling to iowa's conservative voters. plus, jeb bush held a town hall with students in miami. what he had to say about guns in schools that's making headlines. more on donald trump's new attack ad that some are comparing to the infamous really important ad from 1988. joining me now, senior political editor mark murray. mark, always good to see you and hear from you. let's start with ben carson. we talked about him yesterday surging in the polls, and today some insight on his secret to success describing him in a way as anti-trump, but also when

he's talking about his faith and making repeated references to that, that's also helping to give him his bump. tell us when he could really be more of a player in iowa and outside. >> that's right, francis. i think there are two explanations for ben carson's appeal right now. one is that outsider status. he shares it with donald trump and even carly fiorina who is in third place of yesterday's monmouth poll in iowa. the other thing that separates ben carson from donald trump and fiorina is his christian faith which he made specific references to. it was just last month's republican debate in cleveland where he was talking about his faith and how it actually guides his tax policy when it comes to tithing. it's important to note that iowa, the caucuses on the republican side, have a disproportionate share of evangelical christian voters, so that combination outsider status plus being a christian conservative is a potentially

big boost for him in iowa in the next few months. >> now a lot of attention being paid to jeb bush. he is in miami today where he held a town hall with high school students, and one of the students had a question about gun control. let's listen to that. >> my question for you is mass shootings have increased over the past several years. do you think there should be stricter gun laws, and would it be beneficial for teachers to carry guns during school hours? >> wow, that's a controversial subject. what do you guys do here? no packing? i don't think that ought to be a national, you know, the federal government shouldn't be involved in gun laws. >> referring to his packing, and knowing these kind of missteps in the past, is this another one that could hurt him? >> i didn't take it that way. i took it as a joke, he was trying to make light of the image of teachers packing heat.

but it really does show you the political divide between democrats and republicans on the issue of guns, jeb bush saying i don't think there should be national laws restricting guns or even regulating guns. that is a republican answer to the question. you're seeing democrats, including hillary clinton always talk about having stricter gun laws. so i think this kind of is the perfect divide between republicans and democrats on this issue. >> i'm curious to see what, if anything, donald trump will use from that just because of the ongoing feud between the two of them, bush and trump. especially when it comes on the video side. trump released that video slamming bush for his act of love comment, and then some say the spot is reminiscent of the horton ad that helped bush's father. that was in 1988, if you remember. then bush slammed trump on twitter for donating, quote, to sanctuary cities supporting nancy pelosi. right now you see the back and forth, a lot it have on social media, a lot of it on tweets, a

lot of it on ininstagram. do you expect that to spill onto a bigger area soon? >> oh, absolutely, and they'll be on the tv screen. now that it's summertime, people aren't preparing these big, expensive tv ad buys, particularly those attacking others, until we get to the late fall. i would expect november, december, january to be the time that every iowa tv set has full contrast ads. there will be bio spots and positive ones as well, but the time where the big attacks are going to occur on the front-runners and everyone else are in the months ahead. >> it could be used as material for the very ads we'll see down the road. mark murray as always, thank you very much. still to come, pope francis announces a major shift in the way the catholic church treats women who have had an abortion. why now, and is this a permanent change or only temporary? ago, they lifted the ban of excommunication imposed on the penetant. it depends on the amp bishop of each diocese. >> so they can decide if they want to do it past december 8, just to clarify? >> correct. in my diocese, it has no effect. every priest can dissolve it and has been able to for 20 years. what the holy father has done is extend it to the whole church and actually offered -- it's quite extraordinary -- because the society of st. pius the 10th do not have the faculty to absolve. he has even granted this faculty to them and allowing those priests to also lift the ban of excommunication. so it's quite an extraordinary announcement. >> it is a shift there. we're talking about women who have had abortions, but does it

apply to those who have had abortion providers as well? >> in this case the letter doesn't state that, it speaks only of women who have had abortions. in my own diocese, it applies to anyone who has assisted in the act of abortion. so for myself it has no effect, but i'm not really sure. according to the letter, you can only absolve the women who have had the abortion. >> it seems like the letter of inclusion seems to have more potency. he says they should be more tolerant of gay priests saying, quote, who am i to judge. is he trying to bring back and have a sense of unifying those catholics who have been os tra sized from the church and bringing them back to the holy faith? >> pope francis is a man of forgiveness. he wants all of us to go to the peripheries. he lives out the message of

jesus where jesus says in the gospels, i have come to save everyone so that no one can be lost. and the holy father is really that -- you see this tremendous pass to reca pastoral activity of his. he wants no one to be lost, everyone to be safe and everyone to be welcome. he has reached out to non-catholics, he's reached out to gays and lesbians. he's even reached out to tran ve vestites. >> is there a concern for the more conservative catholics that they may not want to see this movement by the pope? >> i can answer for -- myself, i'm a fairly conservative priest, but to me the words of jesus are the words of jesus. we should reach out to everyone, everyone should be welcome in the church. you know, as famously said by flannery o'conno'connoo'connor,

thing is we include everyone. everyone, come in. >> is that what we're expected to hear in the united states, in d.c., new york and philly when he visits? >> absolutely. he is always talking about the periphery. today's letter is about the periphery. he's always talking about the dignity and respect that should be afforded to every human being. there he's shown kissing a baby. this letter is no different. this letter falls on the world day of prayer for all creation. what is the highest form of creation but the human person making the human likeness of god? he's an extraordinary man. i think that the work of the holy spirit is still evident in the church. it's beautiful that he welcomes everyone and wants everyone to be brought in. he's the true image of the shepherd that jesus talks about in the gospel. leads the 99, goes into the wilderness and finds that one lamb and brings him back.

. if you thought the recent hack of ashley madison meant the end of the cheating website you might be wrong. the company says despite the massive leak of customer information the site is exploding with hundreds of thousands of new users signing up just this past week. nbc's stephanie gosk has the update. >> reporter: 32 million users promised discrete affairs, were instead completely exposed. their personal info including names, e-mails, and sexual preferences, plastered online by hackers promising to teached a dull churers and ashley madison a lea lesson. and still, parent company says the website is thriving. recent media reports predicting the imminent demise of ashley madison are greatly exaggerated. read a statement released monday. this past week alone, hundreds of thousands of new users signed up including nearly 90,000 women. the company denied a recent

media report that many of their female profiles are bogus. but the numbers are difficult to verify. >> i don't know that they have a method for determining when someone signs up for an account, whether they're male or female, unless it's a paid credit card that they've verified as a legitimate card. people can sign up for ashley madison accounts with no verification whatsoever. >> reporter: just a day after news reports appeared claiming josh duggar had opened an account on the website he admitted he was unfaithful to his wife. while other users are harder to identify. there is no way to know if the e-mails used in profiles are legitima legitimate. according to the associated press more than 10,000 users appear to be u.s. government employees. others revealed including celebrities and a few members of the clergy. investigators say the revelations may have led to cases of online blackmail and possibly two suicides. >> the social impact behind this leak, we're talking at families, we're talking about their children, we're talking about
