earlier this morning trump responded to bush's attacks on good morning america. >> he heard jeb bush yesterday. you are not a conservative. you are more democrat than republican. this is all personal. is he drawing blood? >> well i think he had really no choice. he's doing very poorly in the polls. he's a very low energy kind of guy and he had to do something so they are spending a lot of money on ads. and you know he has a lot of money from the hedge fund guys from the special interests, from lobbyists. he raised over a hundred million dollars. so they control him totally. >> donald trump came out swinging for bush ever since he announced his candidacy. bush tried to ignore the businessman turned baby kisser. but now bush realizes he

sit idle on the side lines. >> yes they broke the law but it is not a felony. it is a -- it is an act of love. >> bush is on defense for promoting compassion. trump's ad received criticism for context manipulation. but it remains undeniable in its effectiveness. anyone who listened to bush's full statement knows he didn't advocate for a welcome mat. >> i'm going to say this and it will be on tape. and so be it. they crossed the border because they had no other means to work to be able to provide for their family. yes they broke the law. but it is not a felony. it is a -- it is an act of love. >> jeb bush's words were mischaracterized but trump was able to flip the conversation with just 15 seconds of video. >> you stand by the fact that you believe that many immigrants come here out of an act of love.

thank you all for being here. joan, let me start with you. this is a tricky game for bush in attacking trump, isn't it? >> it is. i mean, it is very hard to get into a war of insults with donald trump and and to one up him. i think he made a good point. i too thought that was a good ad. but the power comes in watching the whole thing. and trump's ad power comes in the ugliness. it is quick you get in and out. and it is more in tune. and i think jeb bush is undertaking a risky strategy. but when you are sinking in the polls what else do you do? >> right. >> i think he was counciled to stay staitesman like and presidential and stay out of it and that wasn't working so he's going to try there. >> all of his ads are getting buzz and he released another one last night. here it is. >> we recognize the commitment of someone who has devoted her life to public service. i want to say thank you to both

secretary clinton and to president clinton. >> what did that make hillary clinton to the bush family. >> my sister-in-law. >> now, april, everything about that ad is completely out of context. but does context even matter to trump sporters? >> well really context doesn't matter to anyone i think on the republican side. because donald trump had the clintons at his wedding. so -- and i mean again, and jonathan i talked to you about this. i was at a fundraiser in new york in trump tower years ago where donald trump was there for new york congressman ed towns and bill clinton and hillary with are there and donald trump was there. he wants to make it look like the bushes are very close to the clintons, which they are. but at the same time he has a relationship. and secretary clinton can say that, you know, it wasn't that close. but, you know, for her to go to the wedding. but there was somewhat of a relationship. so i think donald trump is actually throwing himself under the bus trying to throw the

bushes under the bus. >> henry, flash and fast response drives trump's campaign. but my question here is, will this carry over to the general election? >> i think it will carry over to the general election. let's call that ad what it is, it is racist. by that i mean the instagram that donald trump put out about jeb bush. it is basically flashing images of brown skin latinos in an effort to scare white voters. that is disgusting. it has no place in american politics. what is unfortunate is that jeb bush responded not by calling that ad what it is. but he responded by calling donald trump a liberal. whether he's liberal or not, that is not the issue. the issue is that he has dragged the republican party into this racist swamp. and republican leaders, including jeb bush, won't take the steps necessary to pull themselves out and to disown donald trump. >> you know joan, speaking of,

you know, jeb bush trying to characterize donald trump as a liberal. on tuesday he went on fox and tried to knock down the idea that he's a washington outsider. let's listen to this. >> that little ad was just a complete mischaracterization of my thinking. it is almost as though donald trump is acting like a washington politician. that is what they do. >> is this going to work? >> no. >> is that going work for jeb bush. >> that's stupid. i agree with henry. i wish he had just gone out and called it racist and spoke from a point of passion and morality about why the ad was so disgusting but he didn't. and now trying to portray himself. his father was president. his brother was president. his grandfather was a senator. but he's a washington outsider. and also, i have the say i think that trump is also hitting a nerve with this stuff about hedge fund guys and lobbyists. you know, his super pac being basically bought and owned by

big business. i mean, not to say donald trump isn't the avatar of big business. but i think that is a really effective hit too. >> april, i'm going to ask you something here. as joan was talking and henry was talking, made me think of the timidity of the republican party. no one will call the instagram racist. and i recall during the republican debate last month when there was all of sort of the woman bashing that happened there on that stage with a comment about rosie o'donnell. and then the back and forth with megyn kelly in the days after, no one in the republican party on that stage or after said anything about the misogyny that took place. >>many -ists out there. sexist, racist. especially as they have a female candidate rising in the numbers

of carly fiorina after that first debate. but the issue is, you know, when it comes to the issue of race, it is a real thing. and to actually tell people, you know, we're going the put you out of this country or, you know, we're going to build a wall. we're going to make your country build a wall. and telling the univision reporter to go back to univision. that is basically saying go back to mexico. and when crow start talking about one group of people, you start talking about another. so we're just wondering how far this is going to go before they are going to cry foul. >> at what -- you know, you sort of took the question right out of my mouth. and i've been writing about this for years. where is the grown up within the republican party. because there used to be grown ups in the republican party who put a stop to this. >> it was wise previewis a couple of weeks ago. >> jeb bush is polling third behind trump and carson. fiorina is just one percentage point away from him.

what is the cause for the rise of the political outsider in the republican party? >> you know this is a really interesting phenomenon. and i think there are a couple of pieces to it. certainly at this point jeb bush is really looking very close to a third tier candidate. he's got 100 million dollars in the bank. it will be interesting to see how he spends that. but what happened here i think is that donald trump has provided something that hasn't been available before in the republican party, which is someone whose willing to support social security, stands for apparently universal healthcare. but also is quite racist. and so this is an interesting combination. i don't know if it's replicable for other candidates but he's laid it out. where the kind of dog whistle racism that had been present in the party before is now not dog whistle. it is being exposed by their leading candidate. and unfortunately that has exposed i think more broadly in

the party a problem around race. so i'm not sure that what's bringing ben carson up is what's bringing donald trump up. i think those are maybe two different things. i think for ben carson it really is this outsider status and really a rejection of trump, of rubio and of walker. so those leading -- those candidates who are supposed to lead are way behind. and i think the republican party has a lot of thinking to do about what that means. why their messages are not sticking with voters. >> a rejection of rubio and walker. but joan, what about chris christie and rand paul? there was a time when they were considered top tier candidates. >> right. >> everyone was trying to figure who among this big batch of, you know, sitting members of congress and governors and -- >> and senators -- >> -- and senators. and look at them. they are way down there at the bottom. lindsey graham, zero. bobby jindal, zero.

governor pataki, zero. >> -- and i was shocked that he ran. except i think he thought he could rehabilitate himself. rand paul is another matter. he just keeps getting in his own way. and he was the one who tried to take on trump. and at the debate. and he looked like a pech lent little kid. so it is hard for that issue to rise. i want to go back to there being a grown up in the republican party. mitt romney is telling friends he doesn't like the rise of donald trump and concerned about the campaign. and i just want to remind everybody mitt romney trekked to new york, kissed the ring, had a big fundraiser with him in las vegas when he was doubling and

tripling down on his birther garbage against the president. and when ron was asking to repudiate he was saying well i don't agree with everything my friends say but he's good people. and now he's upset? so many people who are upset with him really are complicit in his rise. >> and look at after the 2012 election there are a lot of things in there, precipitations for fixing this problem that the republican party has and almost as soon as it went out it went on the shelf and gathered dust. >> number one was immigration. don't upset latinos. and boy, they blew that one up. >> kaboom. henry fernandez, thanks for your time. april and joan are going to stay with us. ahead this hour, more fallout from the latest clinton e-mail release. and later, new details out of kentucky, where a county clerk says she's putting the law of the supreme being over the ruling of the supreme court. stay tuned.

hasn't said whether he'll run in 2016, but one senator is already supporting him. delaware's junior senator chris kuhn who holds the seat vacated by biden, explains why he supports the vice president for president on cnn this morning. >> as someone who is from delaware and who really kmiers the vice president. and think -- i think he's is the best and strongest voice for america's middle class and most seasoned on foreign policy and national security in the administration. >> he's also come out in favor of the administration's nuclear deal with iran. as to whether or not biden will enter the race is still anybody's guess. but he does have one high profile appearance on his calendar. a september 10th appearance on the late show with stephen colbert. stay tuned.

fall out from this week's state department e-mail dump continues for hillary clinton. the washington post reports clinton wrote and sent at least six e-mails using her private server that contained what officials now say is classified information. it is important to note government officials deemed the e-mails classified after clinton left her post as secretary of state. these six e-mails are important because they suggest clinton's role in sending classified material went beyond receiving notes written by others. for more let me bring in joan walsh and msnbc political analyst. and april ryan -- >> american urban radio networks. >> and carol olynyk. i think there are three parts to this story. first the use of the private server in itself and whether that was proper or -- improper or unprecedented.

second, the way the information in the federal government is overclassified or reclassified all the time. and third, how can clinton actually put this controversy behind her? >> carol, how often is information reclassified within the federal government and why? >> i think that your question has sort of two parts. not just the "and/why" part. things are upgraded in classification, especially as they are about to be released and then this very specific setting which is hillary clinton's unusual trove of work e-mails turned over to the state now being released as part of a court-ordered public records release. and what the state department is doing is going through each of them and trying to determine "are these things secret?" are they confidential? do they meet a test of being classified in a way that would

harm national security, for example, if they were released? and in at least six cases hillary clinton wrote e-mails that appear to have contained information that was classified. including when she wrote them. for example, i see -- sorry, intelligence community officials who have said to us, these e-mails were discussions about foreign officials. so those private conversations that our government has with those foreign officials would naturally be classified when she was discussing them. >> if the information wasn't classified at the time it was sent, should clinton be blamed? now, i know carol just talked about, you know, one particular e-mail where state department has determined that the information is classified. but i guess it gets down to my question is if the then secretary sent e-mails where the information at the time wasn't

classified and now it's been classified -- determined classified -- >> how is she at fault? >> how is she at fault? >> right. this is also complicated because even if she had used an official state.gov e-mail and never brought this server to our consciousness she would still be technically i don't know about in trouble. but she still would be doing the wrong thing by not using the special ways to pass classified information. right? so it is not even about the server. however i appreciate whether carol said but there is disagreement about whether she should have known that stuff is classified. and the truth is it wasn't classified when she sent it. and when she made her statement "i did not send classified information" she didn't know this would be officially classified after the fact after she made that statement. to there is just this element of ground hog day here that i don't think how she put this is behind her. because every time she -- every time he's e-mails are released,

we're going to have more that were reretroactively marked classified. unless the media gets skeptical about it. >> and how should clinton go about putting this behind her? can she even? >> one way to definitely putter behind her is for this whole thing to be looked at and deemed whatever it is going to be deemed by the investigators who are looking at it. but the next thing she has to do -- and i think we're going to start seeing it come this fall -- we're going to watch her come out of i guess you would say, not hibernation but out of the shadows of herself. and go on television. i've heard shes going to go on to ellen degeneres and be herself and who she is. as she's still losing ground on this because of this the trust issue. so he's goi she's going to recreate herself i'm hearing in the next couple

of months as the tv shows are now off of summer break and going back into live shows. >> you know carol, part of the problem here is this is -- the questions are simple. the explanations are so complicated. and so. >> i agree. >> -- i wonder if you think or even in answer to my question earlier in the way you answered it sort of exemplified how complicated this is. do you think clinton is doing a good enough job explaining how this information was released, how it's reclassified and how she got herself into this mess in the first place? >> i'm so glad you brought that up, jonathan. i think it perfectly explains what is going on here. both sides -- and remember this ultimately is a political battle, where one side wants their candidate not to be viewed as irresponsible with sensitive information. and one side wants hillary clinton very much to look like she let the crown jewels out of the front door to north korea and to russia.

and the truth is somewhere in the middle. but everyone is using this complex language to discuss it so they can, i think a lot of both sides are obfuscating and making it less easy to understand. reporters are using the technical language because we also want to be accurate. but i'll tell you this, this phrase retroactively classify i find troubling. because many of the conversations that were had at the time appear to have been classified then, meaning they were sensitive. they involved our private conversations of our state department with foreign diplomats. and those are things we don't want to share with the public or with our enemies who could hack into a non government server or even a government non-classified network. >> but obviously -- >> so that's first. the second thing so complicated about this is the use of the phrase "i never sent or received classified information."

you didn't send information that you labeled classified. and the truth is on this private server no one could have marked their information classified. that is the responsibility of the person who writes the e-mail. so when secretary clinton or one of her aids wroet an e-mail that contained classified information it was their job to mark it classified and to do so on a classified network. that didn't happen according to the state department or more importantly according to the intelligence community auditors who looked at some of these e-mails. >> and to part of the point you were making i advise everybody to lookem up our colleague's column from last week where he talked about the fact that despite all of these systems in place to safeguard classified information, that in order to get information quickly to principles and get answers back people find all sorts of ways to

expanded. >> today police are expanding the scope of the man hunt for three men accuse of gunning down a police officer in suburban chicago. >> this is an ongoing investigation. we've been following up on leads since yesterday. >> more than 400 local, state and federal officers have been a part of the search for three suspects described only as two white and one black men, who allegedly shot and killed fox lake lieutenant charles j. gliniewicz. investigators say gliniewicz was responding to a suspicious activity call early tuesday when back up arrived. they found gliniewicz did, at the time his service revolver and other gear missing. >> officer is down. >> the murder has rocked this community of about 10,000. >> he'd always be on my street. he'd always stop and say hi. >> he was a mentor to young residents in fox lake. a husband and father of four. he apparently planned to retire a month ago but was persuaded to

stay on the force a bit longer. >> it is just very sad. senseless. >> emotions that drive the officers and federal agents searching around the clock for his killers. >> tenacious. they are focused. energetic. and they know exactly what their mission is. >> a mission that is personal for this force and their mourning community. >> joining me now from fox lake, illinois is msnbc reporter adam reiss. what is the latest on the search? >> jonathan, good evening. there are a hundred investigators on the case right now. they are canvassing the area. they are also in the police department behind me looking into the leads, tips and also importantly social media. any one tip, could be a small tip, could solve this case. the commander spoke a little while ago and here is what he had to say. >> we're relying on the public

too. many of these cases, not just officer-involved homicides, but cases -- homicides in general are greatly assisted by public information. and all it takes is one tip or good lead to break a case wide open. so we're vetting through these right now. we've got hundreds of those coming in. >> now all we know right now, two white men, one black man. that is all with i know. it is possible they know more. they are looking into the forensics at the scene. they recanvassed the scene this afternoon looking for possible dna and also looking at video, surveillance video, whether from businesses, residences, even possibly dash cam video from the scene. and also of course eye witnesses here in the community. did anybody see anything out of place? three guys going into that area where they shouldn't have been or even coming out. so any little tip. any little piece of the puzzle could solve this for them right now jonathan. >> and you said possibly the

county clerk's off in kentucky was much like yesterday's. as she again refused to deny a marriage license to a gay couple. on monday the court denied her a stay that she issue marriage licenses to all eligible couples. it was her last legal resort but she has continued to not issue marriage licenses. >> why are you not issuing marriage licenses. >> because i'm not. >> under whose authority. >> under god's authority. >> she says she's exercising her first amendment right to freedom. >> my name affixed would violate my conscience. it is not a light issue for me. it is a heaven or held decision. kim davis's personal definition of marriage is coming under

scrutiny as she continues to deny the right to others. as first reported by buzz feed, davis is on her fourth marriage after the first three ended in divorce. the fact was confirmed by her lawyer. meanwhile more than 100 miles south another kentucky county clerk is standing with kim davis. casey county clerk says he will not issue marriage licenses. he plans to bike across the state in support of kim davis, calling the publicity surrounding her is the, quote, public prosecution of a christian. the clerk for whitley county is also refusing to issue marriage licenses. i'm joined by evan --. >> a supreme court decision that was hard fought. you were right there on the front lines to win that. how big a deal is this? how big a deal is kim davis in the overall story? >> well the threat to the rule

of law if we start allowing any individual to impose their personal view as a get out of job free card is very real and needs to be dealt with and taken seriously. but when we look at the big picture this is completely an anomaly and really a side show to the big story which is that america that is taken another important civil rights step forward. the country has embraced it. even those who don't fully agree are 99.999% following the law which is the way we operate in the united states. i think it is important we deal with this kind of threat to the rule of law but we also need to keep some proportion and not give her and the organization that is pushing her what they want, which is the magnitude of this side show eclipsing the civil rights transformation that our country has made. >> chris, can anyone force this clerk or the other clerks i talked about to follow the law? historically we've seen federal troops take part in integration.

what is the possibility? will there be any kind of intervention like that? >> yeah. thanks jonathan. i actually just before -- before getting over here published a story about what the next steps are, what could happen. and the truth is that under kentucky law, we're very limited in what could happen. there is no recall of elected officials in kentucky. the governor and attorney general have no authority to remove her. even the official misconduct statute that people have been discussing because of charges that were possible there doesn't have removal from office as a punishment. so the only -- the only real option if she's not willing to resign and if the possibility of contempt action from the court tomorrow doesn't do it is the possibility of impeachment. >> you know evan, i want to stick on this question. and particularly the idea of

sending troops to force an elected official, a local government to comply not only with the law but the supreme court. one, would that even be advisable? >> well i think we're many steps away from sending troops. i mean we're not in this kind of massive resistance situation, that we did see in other turbulent civil rights -- >> 1950s, 1960s. >> yes absolutely. we have one clerk and maybe a couple acting on it and the federal courts have not even begun to fully deploy what is at their disposal, including fines and other measures. but i think we're going to see other steps going forward. i just want to underscore one other thing happening here. which is that not only is she discriminating against gay and lesbian loving and committing couples seeking the freedom to marry. she's punishing the entire

electorate. everybody in this county now cannot get a marriage license because of her personal views and her interposing her ideas on what the law should be in a job she swore to take on. not like people are marching into her home saying put your name on my marriage certificate. she's a clerk. she draws a taxpayer salary and she's punishing the taxpayers because of her personal views. >> i know wie all saw the video of the couple trying to get her to issue them a marriage license and you could watch without your heart being torn out. what advice would you give to couples around the country who might find themselves in that situation. >> let me underscore again how few couples who are finding themselves in that situation. most people follow the law. most americans embrace this and the vast majority supports the freedom to marry. and we've seen an ocean of joy across the country.

that is grand standing by one clerk, make a couple of others for a moment, backed by an antigay, antirule of law organization that is trying to stir up trouble. and we ought to be careful about not giving them what they want, which is more attention and more drama than actually is there. but what i would say to couples is to stand on your rights but keep your sense of proportion. don't let it eclipse your happiness and your day. and also, trust in the rule of law that we are going to be able to move forward. and groups like the aclu and other legal organizations are in court. local attorneys, including couples -- attorney whose litigated the freedom to marry successfully in the supreme court are in court and the courts have yet to finish their work. >> despite what evan just said, chris, i have to ask you. should we expect more road blocks on the way to full marriage equality across the country? >> i think that evan is mostly right. we have a couple of counties in alabama that are doing a very

similar action to what kim davis is doing. that they just aren't issuing licenses at all. but they have a statute that's slightly different. i think the thing to look is tomorrow morning kim davis is going to be in federal court before judge bunning and he is going to consider whether to hold her in contempt for what she's done. and that is going to be a big moment here. >> and one more question for you chris. how much -- are the religious freedom laws that have been popping up in poroposals all around the country, are they more of a threat than what kim davis is doing in one colbeunty kentucky? a. >> i'm not quite sure i can assess what "threats" are because that would depend on your view of what those laws do. but in terms of attention paid and the impact on the number of people obviously the discussion over those laws is far more

president obama scored a big victory this morning on the iran nuclear deal. maryland senator says she'll vote for the deal when the senate begins debate next week. she's the 34th democrat to declare support for the deal. this gives the president enough support to uphold a veto of a resolution of disapproval if passed by republicans. secretary of state john kerry says the plan will block all path ways for iran to obtain a nuclear weapon. former vice president dick cheney doesn't buy it. he said not only will iran be able to keep their capabilities, neighboring countries will arm
