presidential candidates to sign. it requires them to endorse the eventual nominee and not seek a third party run. he was the only one to say he would at last debate. >> the republican party has been treating me fairly. all i ask is fairness. in terms of victory, that would be the best path to victory. we're going to make a decision soon. i think a lot of people will be very happy. >> bottom line, who would be the better president, jeb bush or hillary clinton? >> i go with a republican. >> attacks continue to fly in the primary. jeb bush is launching a false strategy of taking down trump. yesterday his campaign put out online quiz that hits trump for advocating hillary clinton negotiated a deal with iran and mocks fear of germs.

he worked on her 2008 campaign and at the state department. he's identified in digital records as the person that set up her e-mail is server in 2009. he will refuse to testify. the clinton campaign said they urged him to testify. reuters reports so far they found 87 e-mail threads with e-mail information. this sort of information must be classified from the start and handled through secure channels. a new poll suggests hillary clinton's image is still on the decline. "the washington post" poll shows 53% view clinton unfavorable. that's the highest unfavorable since 2008. the poll shows four in ten respondents had an unfavorable

review. she remains widely unpopular among democrats. her favorability in her own party is 80%, ten points higher than joe biden. speaking of the vice president, he spoke at length about education and community colleges as a whole. at one point he couldn't help but crack a joke about the elephant in the room. >> let me say to all of those of you that graduated from high school and had took some time to get back. it takes a lot of courage when you've been out of school two, four, six, eight years to say you know, i'm going back. i'm going back. people who aren't willing to risk fail aing never succeed. it's amazing at the pressure

to northern illinois the man hunt continues for three suspects wanted in connection with the shooting death of a police officer. multiple helicopters and 50 police dogs were released yesterday at the spot the police officer's body was found. so far the search comes up empty. in fox lake, a vigil to honor the fallen officer. >> he was my best friend, hero, the love of my life for 26.5 years. he was my rock as much as i was his rock. every night he came home to me. >> such a sad story will there. meanwhile in baltimore, big win for prosecutor miss the freddie gray case. the charges dismissed against six officers that pleaded not

guilty in the 25-year-old's death in police custody. the judge ruled the officers will be tried separately given the wide range of charges. he also tried to get the attorney general remove ed from the case likening the quotes she made as a pep rally for pay back. that motion was denied. the next step is have the trial moved out of baltimore, discussed next week. county clerk from kentucky is expected in court this morning for refusal to grant licenses to same-sex marriage couples. she says it goes against her religious believes. >> there is a country clerk showing more courage, conviction and better understand happening of the constitution than virtually any elected official in america, than virtually any

candidate for president, and certainly more than many of the people who run our government in washington. i thank god for kim davis. i hope more americans stand with her. >> i don't think anybody should have to choose following their conscious, religious beliefs g giving up their job or financial sanction. it's wrong to force business owners in government. whether florists, musicians, and others. keep your job and follow your conscious. >> while i disagree with the court's decision, their actions are clear. in this particular case, this woman needs to make a decision of conscious. is she prepared to continue to work for the government, be paid for by the government in which she needs to execute the government's will or she feels so strongly she wants to sever employment with the government and seek employment elsewhere

where her religious liberties will be paramount over duties as a government employee. let's turn to business. volatility was the name of the game on wall street. stocks surged 2% in wednesday's trading after two day losing streak. jeff joins us live from london. good morning. >> hi louis. this is becoming the new normal. couple weeks of this volatility. to be honest, nobody thinks it will stop here. reasons remain the same as we've seen. dramatic declines in energy price. as far as china is concerned, we're worried how this economic slowdown is going to impact corporate profits. look at a company like gm for for example that makes a significant chunk of profit from chie ana, you have to see a the markets are trying to understand how much of impact on u.s. economy the china slow down will

have. volatility set to continue from here. back to you. >> there's a big jobs report out tomorrow. how do you think it will impact the fed rate increase? >> the irony of course is even as we have the market declines, better data coming out of north america. the jobs report wasn't far off the money. that was mine. we had a beige book on economic conditions that was good. the analysts have pencilled in 220,000 job gains in tomorrow's payrolls. if we get that number, it will be interesting to see how the market reacts. they'll figure the fed is running out of excuses not to lift off on first interest rate move in ages. so that's what the markets will be focused on when we get the jobs number tomorrow. back to you. >> thanks so much. still ahead on "way too early." >> i found the disease no one

it softened the script to avoid protest from the nfl. according to new york times, e-mails from the sony hack show the studio executives discuss altering the film to portray it as a quote whistle blower. sony said quote anyone who sees the movie will know it never compromises the integrity and power of the real story. it's reported jeb bush is set to be one of the guest on stephen colbert hosting of the late night show. bush's campaign is using the appearance as a fund-raiser asking supporters to donate $3 to win a raffle to win a trip to see it in person. >> the contest is a great thing, but here'ses the thing. no one from the wam pain asked me if it was okay with me to raise money off my first show. where's my cut of that sweet 3
