so hopefully we can use this real data to get real solutions. >> benjamin crump, president of the national bar association, thank you. >> i'm jonathan capehart, thanks for joining us. msnbc live continues next. >> right now on msnbc, trump, cruz, palin, rally the right against the iran deal. i'll talk about it with barbara boxer. plus a lester holt exclusive, an emotional interview with survivors of the charleston massacre. and the hero pilot who saved lives in las vegas. and is siri getting a little bit smarter? big news from apple. i'm richard louie. we'll start this hour with the huge fight surrounding the iran nuclear deal. this deal is dominating the political world. late today, a big tea party rally against the deal wrapped up at the capital and some major conservatives voices spoke out, including ted cruz, donald trump, and sarah palin. take a listen. >> this iranian nuclear deal is

catastrophic. >> they rip us off, they take our money, they make us look like fools. we will have so much winning if i get elected that you may get bored with winning. >> only in an orwellian-obama world, full of sprinkly fairy dust, blown from atop his unicorn, as he's peeking through a really pretty pink kaleidoscope, would he ever see victory or safety for america or israel in this treaty. >> but 42 senate democrats backed that plan. that number gives president obama the power to keep the gop from stopping the deal. and today, as republicans rallied against it, hillary clinton explained why she supports it. >> diplomacy is not the pursuit of perfection. it's the balancing of risks, and on balance, the far riskier course right now, would be to walk away.

my approach will be distrust and verify. here's my message to iran's leaders. the united states will never allow you to acquire a nuclear weapon. >> msnbc kasie hunt was at the rally and joins us live from the capital. good day to you, you were there, you heard the cheering. some might asks, what was the mood and what does it say about the tea party and its health? >> richard, good evening. well, this was a raucous tea party crowd. we've seen them in front of the capital many times before, but donald trump did bring out some new faces, along with ted cruz and sarah palin. old and new faces in the tea party movement. you saw a couple things at work here today. the reality is, this issue is going to be with us through the rest of the campaign. it's something that trump has really highlighted with many people feeling angry, and unhappy with the state of the

country where things are going and expressing that in the ways that his slogan frankly says, and this is an issue with iran that plays right into that. and the second piece of it is evangelical voters and the issue of israel. many jewish groups and christians who are concerned the deal undermines the security of israel, that's something that's important to the republican christian voters in a place like iowa, for example, which is a state that cruz and frankly donald trump would need to make a good showing in if they were going to push forward in this, richard. >> kasie, as you know, we're at the number, 42, that's veto-proof for the president. as you were talking to those at the rally and hearing the messages from palin and the rest, what do they hope to accomplish given that, if it stays as it is, nothing can really happen here. >> that's a little bit of what made this so tricky. it's obviously been in the planning for several day upos.

we've only just learned the president will have the veto power. but i did get a chance to catch up with donald trump and ask him why he came today. >> the votes are already there. the president has essentially already won. what are you hoping to accomplish? >> the president has won temporarily. believe me, if i take over, it will be a whole different ball game. >> reporter: and i think that you are hearing there some of the frustration that many establishment republicans and members of congress, even conservative members of congress feel with donald trump's campaign, because that is in many ways, a misunderstanding of what it takes to actually get something done on capitol hill. you've heard mitch mcconnell quoting harry reid, that you neat 60 votes to get anything through. there are a lot of incredulous republicans saying, trump just

doesn't understand exactly how things get done here, richard. >> all right, kasie hunt, thank you so much for that report. >> i want to turn to senator barbara boxer, democrat from california, who publicly supports the iran nuclear deal. thank you for being here, centecenter senator. what's your thought, will they sway any votes, is it even possible? >> i think they could sway them the other way. in all sincerity, i've heard some establishment republicans roll their eyes about this rally. my understanding is, i've seen more people at a congressional baseball games. but 100 countries support this deal, including some of our strongest allies, such as great britain and germany and france and australia and japan and canada, i could go on. and they stand with us.

and essentially, what will happen, if we walk away from this deal is that, iran will build nuclear weapons. we know they have enough material now to build ten. so if somebody says go back and get a better deal, the fact is, it took 20 months to get this deal. the word "deal," the definition, you don't get everything you want, but the choice is either that or a nuclear armed iran right now. iran is a bad actor, we all agree with that. and we're going to be very tough on iran. so the question is, do we want a tough actor with a nuclear weapon or without one? and i think the answer is obvious. and i think that this agreement will stand. >> senator boxer, as you were hearing from kasie hunt, as the presidential candidates were out in the capital today, talking about iran, they were really, perhaps beating the drum that we might hear over the next year.

is this then an issue that will further invigorate the right as we've seen today there on the steps of the capitol? >> that's a great question. the right is already invigorated. let's be clear. they want to defund planned parenthood, they want to repeal obamacare, they want to kill this deal. they are already invigorated. but the american people will get invigorated, because it's either this or another war in the middle east. if you look at the voices for the most part, who are cheering against president obama's agreement here, they're the same voices that brought us the iraq war. it's the dick cheney, all these folks who said, oh, it will be great. prime minister netanyahu, he gave a great speech here, the bottom line is, he said the iraq war would be great for israel, and the positive reverberations would be felt over the entire middle east.

we lost 4,000 people. we had tens of thousands of injuries. we all know the lasting disaster of that war, the cost, in addition to the human lives. so the fact of the matter is, we've been down this road and we know, anyone who says, go get a better deal, none of the countries of the world agree with that. we will be isolated. iran will build the nuclear weapons and there will be a war. and that's the way it is, because we cannot stand by and allow them to have a nuclear weapon. everyone seems to agree on this point. >> taking this back home and how it will be debated in a long presidential election here, another issue that resonates, certainly from your home state of keafcalifornia, which has th largest immigrant population in the country, close to 1 in 3 are immigrants, many latino, many asian pacific islander, immigrants in your state. as we look to 2016, which republican presidential candidate you think here is

closer to the view of the voters in your state? we've certainly heard from trump. we've also heard from bush as well. >> hillary clinton is my candidate. i'm not going to -- >> is she a republican now? >> that was a joke. i said hillary clinton is my candidate and i'm not going to speak to which one of the republicans are good on this issue. because none of them, as far as i know, have said they want a path to citizenship. the fact of the matter is, i'm a daughter of an immigrant mother. i can tell you this. my mother kissed the ground in this country every single day. when she died, i found her citizenship certificate wrapped in saran wrap with her jewelry. now, immigrants are what drive this nation forward. and i don't think there's any doubt about it. that the democratic candidate is going to be strong for a good plan for immigration, with a path to citizenship for the people who pay their fines and

get in line and all the rest of it, and we will not take in those who have committed crimes. we have the positive approach, and frankly, a long time ago, really two years ago, the senate in a bipartisan fashion passed immigration reform. it's the best thing we can do for our economy. it's the best thing we can do for our families. it's the best thing we can do for our nation. there's no question about it. and i will tell you, whether -- i heard jeb bush say anchor babies, i've heard somebody else say, kick them all out, deport them. this is ridiculous. and the insults that are being hurled by the republican candidate, all of them, toward so many people, including women and immigrants, it just goes on and on. i really am looking forward to this campaign as it gets narrower and it gets focused on who will fight for our families. and to me, it's the democrats.

and i hope it will be hillary clinton who will be leading us. >> senator barbara boxer, thank you very much for your time this afternoon. >> thanks. now the latest on that dramatic plane fire in las vegas. the ntsb, dispatching four investigators to look at what caused the engineer failure on a british airways flight to london. the hero pilot told nbc news, it's safe to say, i'm finished flying. the 42-year veteran was due to retire next week. he issued a mayday call as that plane was just about to take off. >> mayday, mayday, request fire services. >> speed bird 2276, heavy fire services are on the way. >> speed bird 2276 heavy, we are evacuating on the runway. we i have fire, repeat, we are evacuating. >> hanky saying, he's no hero here, but he playsed his crew.

i know the papers at home are saying, no, he's a hero. but we have to remember, there are two other pilots and cabin crew, they all behaved very, very well. and it's a team work. it's not just one person. i think that should be emphasized. >> henkey's daughters also speaking out, posting on facebook that papa bear was, quote, safe, and wanting to come home. to one of the year's most closely watched consumer events, the day apple rolls out a new gizmo. today the company, a new iphone, an apple watch and the apple pencil, a style us for the new ipad pro. also a big update on the apple tv. apple ceo tim cook saying the future of tv is apps. >> thank you. it really is the golden age of television. our vision for tv is simple.

and perhaps a little provocative. we believe the future of television is apps. >> scott cohn joins us right now. cook is sounding a lot like netflix. i think netflix might agree with that too, as well as several other providers would agree with that too, that it is in apps. i think part of the news, we saw apple stock go down 2%. it sunk today after they came out with these announcements. so the question might be, ho hum. >> well, not exactly. first of all, it was down roughly in line with the rest of the stock market, a little bit more than the overall market, but still it was a down day on wall street. but there's also this old saying in wall street that you buy the rumors, sell the news, and nowhere is that more operative

than during apple product announcements, where people get all caught up in the anticipation of the announcement, and then apple does what it basically says it's going to do, and they sell. so apple did the things that were telegraphed. you talked about the apple tv, the new ipad pro which is clearly aimed at pushing that device more to businesses, and also the new iphone 6 s and 6 s plus, to keep that vital franchise of apple's going and vital. >> as we watch, the apple watch, that was the big announcement we saw in the last year. but the question is, how well are they doing in sales? and yet again, we have not got any numbers regarding how well it's done. >> that's right. and you know, the official reason for that is that they want -- they have so much to announce on the other products

they that weren't going to get into sales figures. but you got to believe if they had blockbuster numbers to report, they would report it. tim cook, the ceo, did say there's 97% customer satisfaction with the apple watch, but we don't know what that customer base is. and really all that they unveiled with the apple watch today was cosmetic things. new high-fashion watch bands by hermes, for example, just in time for the holidays. so they're trying to invigorate that, but we'll see how it does. one of the things that was interesting about that was, they spent a great deal of time talking about the use of the apple watch for health care. >> right. >> so a doctor can monitor a patient in realtime. so, yet again, apple, which is so well known for all of its consumer products, trying to more to the enterprise market where it sees growth potential. >> it sees a lot of dollars when we talk about health care.

it's crunch time in congress again. they've got just ten days to figure out how to fund the government and avoid a shutdown. it might not be so easy. some house republicans are threatening to hold up any funding that goes to planned parenthood. the fight is ramping up. today house republicans held a hearing on the controversial planned parenthood videos that critics say were misleading and edited. republican leaders like speaker john boehner have said there will not be a shutdown, but there are new reports that boehner's support is slipping. today he denied that battles with his own party could make it harder to avoid a shutdown. >> no, it does not make it more

difficult. we have widespread support in the conference and i appreciate that. >> joining me now is republican congressman nick mull vainy of south carolina. he's led the charge to defund planned parenthood, circulating a letter that 27 other house republicans have signed on to. congressman, thank you for being here today. do you expect that number to grow from 27? >> we do, richard, i think as of this evening, the number is 30 or 31. we fully expect that to continue to grow this week as we've had a chance now to talk first hand with my colleagues, as we've got back to washington. >> as you well know, if nothing changes in the budget and this continuing resolution, talking about it with planned parenthood, removing the half a billion dollars funding that goes to that organization, and your vote, if it results in a shutdown, will you let that happen to the government, another shutdown? >> again, i think that's a little bit mischaracterized. what we're proposing is to fund all of the government and to simply take the money that's

supposed to go to planned parenthood and move it to other women's health clinics, to spend the exact amount of money that the president wants, to spend it on women's health, just not in organizations that traffic in dead pebaby parts. i think we might have bipartisan support for that. >> if that comes to pass, you will allow that vote to result here in a government shutdown, if the movement of that money doesn't happen as you just described? >> but you've picked your words very carefully. we would pass a bill to fund the government. it would go to the president. he would veto it. so i would ask you, who is shutting the government down? it takes two to tango. the question is, can we find a way to fund all of the government and to fund women's health at the exact level the president wants without giving money to an entity that many people find disgusting. not just republicans saying that. i hear what you're saying, i understand the language that's been used many times before that i've been here in washington.

the truth of the matter is, the house will pass something to fund the government and we'll see what happens. >> planned parenthood saying, this is not disgusting. there are those who do partake of the services who do not agree with that statement. but let's move on for a second. there's a poll that says more voters would blame the gop if it came to a shutdown. a third would blame president obama and democrats in congress for that happening. so as you look at only what is about seven legislative days left before this deadline, is this the right time to stand your ground? it looks like you will and the party, i should say, the republican party might suffer, at least in the polls. >> this is the only time to stand our ground. we have been given very few tools by the constitution to be a check against the administration, against the executive branch and the power of the purse is the biggest one of those. now is the time when that is at play.

the united states is preparing to take a more active role in the migrant kris us overwhelming europe at the moment. government officials saying the u.s. is prepared to increase the number of refugees it resettles here by at least 5,000 next year. meanwhile, this video, as you're seeing s generating new outrage today. it appears to show a hungarian camerawoman today, kicking two

running migrant children fleeing the police, right there. she also appears to trip a man, running with a child in his arms. the woman has reportedly been fired by the private hungarian tv station that was employing her there. joining us on the phone is claudia in budapest. what has been the reaction over this video of this camerawoman? >> reporter: it's been an reaction of outrage in the street. i have spoken to a number of hungaryians at the train station where i spent most of the day. they just couldn't believe it. i showed the video, they were disgusted and ashamed. because it's in the name of hungary. fortunately, there are a lot more people trying to help out these refugees than there are those who try to kick them, that camerawoman tried to do.

the station is quite visual, there are volunteers to distribute food, water, toys for children. we've seen some of these volunteers, also playing ball games with them. so, i've seen a lot more people, trying to help rather than trying to discourage them from running away. >> tells us how emotional this is becoming there in hungary and throughout these parts of europe. and part of that here is the issue about migrants in general, for instance, the prime minister in hungary saying he'll build a wall to stop migrants from crossing into the country. but this is not unique to hungary. talk about how countries in this part of europe are really debating this issue of immigrants and there's anti-migrant, immigrant sentiment that is there.

>> today the european commission confirmed that the european union wants to redistrict 160,000 of these refugees across the 28 european countries. and each of them will have to take their own share to give them refuge. some european nations, including hungary, the czech republic, and slovakia, reject outright, saying that that kind of system will only inspire more refugees, or more migrants to try to come to europe, and that is the case, of course, of all hungary where the prime minister there is trying to build not only a wall, already built a razor wire fence, to repel what he called an invasion of what he said are muslim migrants, richard. >> okay, nbc's claudio lavanga, thanks so much. kentucky clerk kim davis

plans to continue. >> when miss davis comes back, i'll still issue licenses. >> does that mean you could lose your job? >> i don't know. >> sarah is outside the jail where davis was locked up. >> hi, richard. all eyes will be on kim davis when she returns to work reportedly now on monday morning after being held in contempt of court and spending five nights in jail. now, as part of her release, the judge has ordered her not to interfere with her deputies issuing the marriage licenses, but her attorney says she hasn't indicated she won't interfere with that. >> kim davis is the only person who can decide what kim davis can do. she will not violate the conscience of her core and who she is. >> davis's attorney argue the

licenses aren't valid without her inaugurate, however the county clerk and the governor says the licenses are valid. it's a complicated legal battle here, with no end in sight. >> sarah, thanks so much. it's been a busy day in the fight for the gop nomination. we're looking at live pictures of a ben carson rally in california. carson is also making headlines with his comments about donald trump. until now, the two hopefuls have largely steered clear of attacking each other. but now carson is criticizing trump's immigration plan. >> it sounds really cool, you know, let's just round them all up and send them back. people who say that have no idea what would that entail, in terms of our legal system, the cost -- forget about it. and plus, where are you going to send them? so it's just a double whammy. >> so going after trump there,

how might trump react? he said he's been waiting for carson to throw the first punch. that might be it right there. meanwhile, ted cruz is only getting closer to trump today, holding that joint rally against the iran deal. let's bring in jimmy williams and susan del percio, two friends, good to see you both. >> great to be here. >> start with susan. big crowds for carson, as we've seen in recent times. how worried is trump, if at all? because he's got huge crowds too. >> yeah, and at this point in time, trump is pretty much okay. he's dictating the way this primary's going. i think it will be different now that carson has thrown out a punch. it will be very interesting to see how trump reacts. because one thing that carson has, he has a much stronger support among women. so i think some women are turned off by trump's arrogance and his blow hardness and they like what they're hearing from carson, because he's still an outsider.

i think that's why carly fiorina is doing well. >> is that something carson will go after, the woman vote? >> he doesn't have to go after it. he has a way of being plain-spoken and down to earth, and he doesn't have to yell about it. >> so we're talking about trump going after the counterpunch. jimmy, i want to get your reaction, but let's listen to this first. >> well, i'm much better as a counterpuncher. so i'm hoping for ben to really hit me at some point because i love to counterpunch. he's been very nice to me, he's a really nice guy. but i think i'm probably going to wait. i do have certain things to say, but let's see what happens. >> nice guy so far, but trump saying, i like to counterpunch. i don't know if that's true either. we've certainly seen him take the first swing. >> well, i would suggest that huma abedin didn't throw a punch at him, and he went on the fence and attacked her several friday

nights ago in a very ungentlemanly way. look, i'm going to say something remarkably strange. i may get in trouble for this, i agree with ben carson. he's right about what donald trump is saying about the immigration idea, rounding up 12 million people, how do you do that, blah, blah, blah. susan is also right, i was just down in north carolina, and south carolina, on a week of vacation, talking to lots of republicans, because that's all that's down there, and they all think that trump is fascinating, they don't trust him. they all love ben carson and the fever over ben carson, especially amongst women, was off the charts. it was remarkable to me. >> what was your sense, since you were there? >> first of all, these are republican women. fiorina is simply not up front enough until the next debate for her to be on the radar screen. so they want someone, they see ben carson, as a doctor, calm, cool, collected. he's not your typical politician, same for trump, but again, no one trusts trump, and

i think that's very telling here. what that says to me, trump is speaking to a minority of the minority of republican voters. he's a loud speaker, he's a vocal speaker but i don't know how much longer he can hang on. that opens a window for ben carson in a large way. >> two birds of a feather, ted cruz, donald trump, sim pat co-still working together as they go separate ways. i scratch my head and say, how does it make sense for both of them? is this a game of survivor? they're together now, but later on they'll split. >> could be. right now it's the beginning of the crump robromance. they're kind of loving each other right now. but it's smart for ted cruz. he knew that bringing donald trump on board for this rally would bring the cameras and a lot of press attention, so he gets it. look what happened yesterday
