say try to carry out several attacks today. one of those shootings caught on camera by an nbc crew. and donald trump one-on-one and showing a softer side. the republican front runner weighing in on the democratic debate. great to have you with us. i'm thomas roberts. we begin with today's turning point where the candidates stand after their first debate. the reviews are in and it was a strong night for hillary clinton. she was confident. she was prepared and took on her lesser known opponents. >> just for the record are you a progressive or moderate? >> i'm a progressive but i'm a progressive who likes to get things done. i know how to find common ground and i know how to stand my ground and i approve that in every position that i've had. >> the debate was more of a mixed bag for clinton's most successful challenger so far. vermont senator bernie sanders was comfortable but clinton quickly put him on the

offensive. >> is bernie sanders tough enough on guns? >> no. not at all. i think we have to look at the fact that we lose 90 people a day from gun violence cht this has gone on too long and it is time the entire country stood up against the nra. the majority of our country -- senator sanders did vote five teams against the brady bill. since passed more than 2 million purchases have been prevented. he also did vote for the immunity provision. i was in the senate at the same time. it wasn't that complicated to me. >> martin o'malley, chaffe and jim web. vice president joe biden told reporters he watched the debate and said i was proud. i thought they all did well. hillary clinton's strong performance and the fact the

joining us millbank of the washington post. thanks for being here. i want to start with you. you wrote a piece about the debate saying that hillary clinton towered over rivals. you say she was a man among boys and that is why the debate was so important for clinton. does today mark a new phase of her campaign? >> i think so. predictions are always perilous but it feels like that was a moment there. in the abstract it looked like her campaign was foundering over the summer with the absence of a real opponent and a lot of bad headlines. when you see her on a stage there you saw the potential alternative candidates and she's the one who looked presidential there. the other ones really didn't. so i think this will probably recalibrate how people are viewing her. her numbers presumably will go

up. dangerous to predict but it does appear that this has solidified her standing and probably really closed whatever window there was for joe biden to get in the race. >> she did seem confident and prepared. one area senator sanders stumbled was in foreign policy at one point. i want to show everybody where that happened. >> senator sanders i want you to respond and get in on this. >> well, i think mr. putin is going to regret what he has done. i think that when he gets into that -- >> he doesn't seem to be the type of guy to regret a lot. >> i think he is already regretting what he did in crimea and what he is doing in ukraine i think he is really regretting the decline of his economy. >> so it didn't seem quick for the senator on the uptick there

to jump in on anderson trying to get him on the record about foreign policy or of vladimir putin. so as dana was saying, is this where we see the contrast where bernie sanders can get thousands but the gravitous is lost with hillary clinton. >> it wasn't clear what happened there. there was not a lot of feeling i think among anyone in las vegas or watching from beyond that hillary clinton was really being challenged by the people on stage. for joe biden he can look at candidates and know he can bring a fiercer challenge but that would mean that he would have to boo be on the attack. it would be a very personal attack campaign and that doesn't seem like something that he wants to do. >> it was secretary clinton who scored cheers slamming the

partisanship that has emerged. take a look. >> i have been as transparent as i know to be turning over 55,000 pages of my e-mails asking th that -- let's point out it is a partisan vehicle as admitted by the house republican majority leader mr. mccarthy to drive down my poll numbers. >> october 22 is the next big day for hillary clinton when it comes to the hearings. is the wind at the back to have mccarthy reveal the intent and the republican staffer that was a part of it coming forward saying that it was targeted? >> well, i think if this is a turning point for clinton as we

have been discussing it will owe as much to kevin mccarthy. i think he really under cut that committee by basically saying what a lot of us had been accusing them of from the beginning and that is basically being a political entity designed to tank hillary clinton. so it was a huge gift to her. shoo eused it to her advantage last night. bernie sanders helped her with that quite a bit. she will be able to use it again when she is before the committee next week and the republicans are in a very difficult position because they can't look like they are aggressively attacking her after what mccarthy did to them. >> who knows what they have lined up. it is potentially an opportunity for home runs based on what mccarthy revealed. waiting for stumbles -- strong

night last night because of the two full hours of this debate. you write no one mentioned his name. where does this leave the vice president. what are his options and how much time before he needs to say the nomination is in good hands? i support hillary clinton? >> he has been struggling with this emotionally for the last several months and that thunderstorm primary thing to make up his mind on. there is a political calendar unfolding very quickly. he has to think about filing deadlines and those start to show up at the end of the month with georgia and michigan. he will need to be running a campaign if he is going to be running for president. there is also the factor that his authenticity is one of his great strengths. it has been a great strength politically. he has to be wary of people feeling like maybe he is just

calculating on what he is doing based on clinton's performances and at the committee. people have said it seems like we will have a decision maybe put off until next week. the time just gets short. you don't need sources better than looking at a calendar to know that the clock is ticking and he doesn't have a lot of time. >> look at this based on the first debate and the benghazi hearing. at what point does it seem as if joe biden is waiting for clinton to crumble and the democratic party to say we need you. >> the problem is there was sort of a window for him maybe in august or september when there was a clamor for biden. that clamor has died down. certainly joe biden can join the race. he is not doing it to fill some sort of vacuum. there is not a sense that hillary clinton is tanking and needs to be replaced. so he can run.

vice president joe biden has not said whether he will run or not for president. it is biden still making the headlines. today hillary clinton was asked if he hoped biden would run? >> i'm not hoping anything about that. i really respect and admire the vice president. he has been a friend and a colleague of mine for a long time. he has to make up his own mind. what i know is i have to run my campaign no matter who else is in the race. and so i am just going to give him the space that he needs to try to resolve this in his own mind. >> so we wait to see if biden will jump in. coming up the other side of this race and katie tur, the new

we are continuing to follow developing story in jerusalem. the country is in the middle of deadly rash of attacks. people shooting, tabbistabbing trying to run over citizens. israel deployed hundreds of troops to beef up security. cameras caught security forces shooting and killing a man who was running towards a check point at the damascus gate.

israeli police say he had a knife and tried to stab a security officer by rushing them. >> good evening from outside the damascus gate here in the old city of jerusalem. not far away that israeli police. the 19-year-old palestinian. what we witnessed earlier was what we had seen throughout the course of early mornings. israeli security forces standing here as they are positioned all around stopping and searching and checking id. it was around 3:00 p.m. local time that a man tried to break through the check point running down the stairs here carrying a knife. he was also dressed in camouflage gear. that man was content on

attacking the israeli police positioned outside. he was shot and killed instantly. across town there was also another attack, also a palestinian man attacking an elderly jewish woman. she was injured but not in critical condition. that man was also shot and killed. two incidents on a day that israel had deployed hundreds of additional security personnel around the city and the country setting up check points and closures. the palestinian authority saying it is israel's responsibility for the latest round of violence. today a palestinian man, a 27-year-old palestinian was buried in the city of bethlehem. he was shot and killed by israeli security forces during demonstrations that occurred yesterday. many of the restrictive measures placed on places like the old city here in jerusalem have been

the triggering point. israel says it is under a wave of terrorist attack, both sides blaming each other for the latest round of violence that has claimed dozens of lives on the palestinian side and eight on the israeli side so far. >> thank you very much. a landmark jury decision that could change how guns are sold in this country. could it impact legislation, as well? it's the continuing case of she said/she said. a fight within the democratic party over how often the 20 16 candidates should debate. is it hurting the candidates? stay with us.

it can seriously effect how guns are sold in this country after nine hours of deliberation a jury on tuesday decided a gun store was negligent in selling a gun used to shoot and seriously injure two police officers in

2009. both officers were shot in the face by an 18-year-old man who was not able to buy a gun for himself because of his age. he had a friend buy the gun for him in an illegal purchase. surveillance video from inside that store shows the shooter was there while his friend filled out the paperwork purchasing the weapon. the jury ordered badger guns to pay nearly $6 million saying they should have questioned the sale of that weapon. joining me now is chief legal correspondent. this is interesting because so many people are watching this observing how this was going to come down. what is the ripple effect? >> this is only the second time in the past ten years that we have seen this kind of legal claim actually reach a jury. the main point being somebody committed a crime with this gun. they are first the most responsible but is there criminal liability and on this case on a negligence standard that you should have known.

the surveillance video that showed those two young men it shows essentially that one was highly interested in the purchase. they actually went outside at one point because there wasn't enough money. there is a little bit of that footage and the state forms that they are required to fill out at one point they acknowledge this is purchased for another person and then changed it when the sales clerk basically said you can't do that. this is common sense. the point of those forms is not that youclude with the store to get around them. the point is to stop that purchase that is not allowed. this is rare because of a federal law that makes it harder to go to court. >> some of the stipulations of that law really prohibits these suits from coming forward against dealers and companies unless the dealer sells the gun to a person who intends to use

it for harm. another law regarding gun sales was also violated. >> that would be another reason that you could go forward. >> or manufacturing defect cause harm. >> those are basically the only ways that you can get around what congress did and this is a brief subject in the debate last night. congress basically at the urging of the nra and gun manufacturers saying we don't want people to just go to court over these issues. this goes to one of the key debates in gun control, people who have guns and are on the second amendment side feel strongly that there is a desire to take their guns away or limit access to fire arms. this would be an argument on the other side of it that this kind of law has nothing to do with lawful use of guns but rather whether when they are literally unlawful, whether there is anyone you can hold to account or whether you have a free flow of guns and not hold dealers to

accountability. i would note from what we learned about badger guns they were highly and unusually irresponsible. do you want to do something about that or not? >> we have as you point out last night this being a large topic during the debates. we have bernie sanders who did vote for the lawful commerce in arms act talking about prosecuting gun owners. >> for example, do i think that a gun shop is in the state of vermont that sells legally a gun to somebody and that somebody goes out and does something crazy that that gun shop owner should be held responsible? i don't. >> so this is a hot potato for the campaign. and hillary clinton was able to really put sanders on the defensive when asked is he strong enough on guns she said no emphatically. how did they move this forward so that we do have the

conversation about second amendment rights but try to avoid how easy and negligent something like this is especially with case law now reflecting a jury decision? >> this is where the law meets the politics because this is a case that makes the point that i think some gun control advocates have been pushing which is the defendants here aren't people who lawfully purchase guns. the defendants are the gun shop for not exercising basic care and diligence you want. i think for the gun control folks it allows you to take a moderate position. don't sell guns to criminals, a fairly common sense position and say that you, then, are in this case to the left of bernie sanders when this is one issue out of many. i think where we talk about the law and the second amendment folks successful is turning the debates back into don't take my

gun away. if you grew up in a gun owning household that argument resonates. this is about whether businesses are going to be held accountable when they aren't responsible. >> so badger guns, the business in question here put a statement out to the milwaukee journal sentinel saying significant legal issues were decided in the case that impacted the evidence the jury was permitted to consider and the legal standards they were told to apply. we will appeal. how do you think that will go? >> they will be able to make the appeal. we don't know whether it will be heard. it doesn't usually go this far. they do have the argument that we haven't tested these issues and should be able to. it's pretty standard to appeal something like this when it is that costly. doesn't mean it will automatically go farther than this. >> judgment of $6 million. thank you, sir. appreciate it.

kornacki. >> are you saying she was told that you communicated she would be welcome as long as she didn't say anything else about the desire for more debates? >> she was not uninvited. it was made clear that between our staffs that the important thing is during this debate that we focus on our candidates and not on process. ultimately she decided not to come because she agreed that she would likely be a distraction. >> with me now are ed ran dell and victoria francesco as the former leader i want to ask you how often were you publically out of step with your dnc vice chair? >> actually, thomas, a few times. there was not a vice chair, we had two cochairs at the time.

it's not a big deal. i think this is easily resolvable. >> was it as divisive as something as accusing of limiting debates? >> reince priebus limited the number of debates on the republican calendar. he said we are not going to have as many debates as 2012. we limited the number of debates. i think what debbie has done is put a temporary limit on the number of debates. let's assume this remains competitive and out of the five candidates three go through iowa, new hampshire, nevada, south carolina. as we get into other states there will be debates. when barack obama and hillary clinton faced off in '08 i wonder how many debates were scheduled this time of year or

to learn about an o'malley, a web or a chaffe? >> i do think the other candidates would get better as they went along but hillary clinton has such an advantage among those candidates in terms of experience and time and being on the debate stage where i think she would if anything get a lock on that advantage with the other candidates. one i'm noticing isn't just the number of debates but the lack of transparency that suddenly where did the six come from? who was it that came together and decided that it is going to be six and not ten and not 12? this is the transparency and it is interesting to see minorities and i think this is the face we start to see in the dnc. >> it is fascinating to watch

>> your take aways how different he was in this sit down from your last one and his points about bernie sanders paling her out about e-mails? >> it was almost like i sat down with a completely different person. he was not combative. he really wasn't swiping at his opponents much. it was a kinder, gentler donald trump almost like a politician. >> so someone who has been out on the campaign. >> he has been doing it for 118 days now. he has 118 days to go before february 1 when new hampshire and iowa vote. i think it is interesting that he is starting to take on bernie sanders. he released an attack ad on him today. i asked whether or not he thought bernie sanders did a good job being magnanimous last night. here is what he had to say. >> bernie had a moment when he

right now in the republican party one big looming decision could define years to come. the weight of the gop elephant sits on congressman paul ryan's shoulders as he is pressed to run to become the next speaker of the house. congressman kevin mccarthy was the clear favorite and backed out amid pressure from the conservative wing. everybody is focused on paul ryan but he is not sure he wants that job. the next big question becomes if not ryan who is it? the latest person to throw their name in the ring, congressman ryan of montana. he says he is what the party needs, someone to fix what he calls the leadership crisis. he joins a growing list of republicans who say that they are interested in the job.

joining me now political respondent luke rusert. lawmakers in the middle of the break, how do you expect it to play out when they come back especially calculations of paul ryan trying to come to decision? >> all indications are that paul ryan would likely make the decision next week while he is in d.c. especially if he was to announce he would run for it. when members are back in their home districts they tend to hear from most conservative constituents, many of whom are probably critical of paul ryan right now. so in terms of ryan thinking their team is going to let this week play out and let the sort of dust settle a little bit and then go in next week and talk to members and still gauge where they are but ryan will not run for speaker unless there is a

clear pathway 218 votes. >> it is odd to think that the republicans have a house majority yet they don't have a deep bench or any bench at all if congressman ryan says no. what is left to be done and who is left to lead? >> i don't know that that's fair to say they don't have a deep bench. i think there are a lot of people hoping and are sort of putting their eggs in the paul ryan basket. knowing paul i wouldn't be surprised if he is spending some time hunting this week while back in the district and spending time on his own really giving very serious consideration to this. i don't think it is somebody only in congress for ten months. i think there are other capable individuals. i think close to him are

probably evaluating how they could get to the votes that they need without having a brawl. >> who are the capable people that you think of if paul ryan is a no and if we talk about this being capable and that they are not going to get knee capped? >> there are so many that i think it would be unfair to speculate. there are over 200 republican members of the house. there are committee chairs, people that have very distinguished careers and great reputations. right now i think people are keeping their powder dry until they get a decision from paul. i do think he would be a consensus choice and somebody that republicans could rally behind. >> how do you think someone other than ryan can approach a group of representatives that are less than willing to listen to someone who would be more

moderate in leadership? >> i think it's very difficult. i think that the reason why there is such pressure being applied recognize now by john boehner and a lot of establishment people as well as conservative members who may not want to support paul ryan but feel he is the best choice but after paul ryan there is no plan c. you saw the folks on the screen right there. none of them had the name recognition and the respect within the conservative movement that paul ryan has. so if paul ryan does take a pass on this you are going to see a varied group of individuals, none that has a clear pathway to 218 votes. as one member said to me today that would be very chaotic because they don't have the deep bench that is applicable to this rule specifically. this person becomes the head of the gop in the house of representatives. they have to ufund raise every week and be on tv. it is not a role that goes to a
