a big pharma boss facing time in the big house. tonight why many says karma. plus this. >> there was stories about what happened. >> star wars was already a force at the box office even before the official opening. we are live with theaters doors for one of the most anticipated movie openings ever. good thursday evening. thanks so much for being with us. i'm erika hill in new york. we begin with the breaking news out of california. for the first time, charges filed in connection with the san bernardino shootings that killed 14 people earlier this month. federal prosecutors have charged markez with three counts including conspiring to commit counts of terrorism with farook, one of the two shooters. they describe him as a long term friend of farook. he bought the assault rifles used during the mass shooting. we begin our coverage with

morgan bradford. morgan, good evening. >> good evening, erika. here outside the federal courthouse in riverside, california, i was just inside the courtroom where inrik inrika markez is expected to appear in moments to face criminal charges. the charges are based on his guns, marriage and terrorism. when it comes to the guns he's been charged as making a purchase. he purchased two of the five firearms that farook used. he said in the documents he purchased them because he would appear white as opposed to middle eastern like farook. when it comes to the marriage, federal prosecutors are looking into immigration fraud. he married a russian immigrant who was a member of farook's extended family. when it comes to the terror charges, harsh view of the planned attacks he had. there was two attacks he planned

in 2011, one of which was to bomb the community college he and farook attended. one was to bomb a stretch of freeway. they chose this because there were no exit lanes. the plan was to bomb this so no one was escape and farook was to go shoot inside the individual cars while markez was parked on a hill shooting with a rifle. he's expected to face the charges any moment and walk inside the courtroom. >> chilling details. mar morgan, thank you. news of the charges comes on the heels of obama after meeting with his national security team. >> we are in a new phase of terrorism including loan actors and small groups of terrorist like those in san bernardino. because they are smaller, often self-initiating, self-motivating, they're harder to detect. that makes it harder to prevent.

but just as the threat evolves, so do we. we're constantly adapting and improving and upping our game getting better. >> kristin welker is live at the white house with more on the president and what he was saying today trying to calm the nerves of the american public. good evening. >> erika, good everyoning. that's what the president was trying to do. he said that intelligence officials have no information of any specific or credible threat. he argued that his administration is on top of the fight against isis as you know. he's come under heavy criticism for not being tough enough. he's had a full court press this week. he was briefed at the pentagon and at the counter terrorism center today. his message is that the u.s. is on top of it. take a look at what the u.s. had to say today. >> they can't defeat us on the

battlefield but they can lead us to ways that would under mind what this country is all about. that's what we have to guard against. we have do remind ourselves when we stay true to values. >> two weeks ago he spoke from the oval office about this and was also forceful at the pentagon and the other part of this message they stepped up their fight against isis launching close to 9,000 air strikes taking out more isis leaders and more isis fighters than ever before and again, that's in part aimed at fighting his critics who say he hasn't done enough. tomorrow, the final part of the press before he heads on vacation. he's going to meet privately with the families of the san bernardino victims. we don't expect him to make remarks after that. he'll be consoler and chief. hoping to send a broader message

to the rest of the nation he's on top of this as he heads to vacation. >> kristin, thank you. i want to bring in brian levin. also, director of the center for the study of hate and extremism. nice to have you back with us tonight. >> thank you. >> as we look at what we are seeing and hearing and learning today, one of the other things that president obama said today was the san bernardinos describing them as self-initiating and self-moting. how does this change the way this country tackles terror? >> well, i think this is something that we've been watching for a while just evolve. interestingly enough, the complaint shows that farook read -- who was basically internet radicalizer 2.0. not the 1.0 who came previous but 2.0 and not the 3.0 of isis.

what we're seeing is someone these are people inspired by the ideology but it's copyrighted. markez wanted to commit attacks a few years ago. there's a conspiracy to commit terrorism charge there and a conspiracy requires an agreement between two or more people to commit a crime even if the crime never occurs plus an overt or identifiable step towards the furtherens of the crime. there's other things as well, the weapons used by farook in his attack in our community. >> also, the charge of defrauding immigration authorities by entering into what the epidemic says was a shammed marriage.

you bring up the interesting point about ideology not being copyrighted. that also brings up the point of how this is so difficult to track down and go after people if they are self-radicalizing or meeting with a neighbor who inspires them to do something. >> absolutely. i'm curious to know where he was reading his material. was it from a group called revolution muslim which was around for a few years and was tied to about 30-40% of the terrorist attacks and plots in the united states from 2009 through 2011 or was it somewhere else? in other words, this buffet of vile extremism can be ladled from a variety of different vessels on that table. this is something i think is interesting and what it shows is the united states has been doing very well with prefbting tventi mass attacks al qaeda wants to

commit but we're having a more difficult time stopping these long wolfes and this is the type of stuff i testified before congress in october. our biggest threat. when i was doing that, someone from our own community was plotting against us. >> it's chilling where the information is coming from. we're learning much of it was al qaeda. we're told he was reading inspire magazine which is the publication of al qaeda in the arabian peninsula. as all of this is happening and we're learning about these charges today, the first charges in these shootings, do you anticipate this will also be a window into further information about how exactly the decision within the meaning of penal code section made to carry out these attacks at this particular time and place? >> yes. and what's interesting, these complaints can always be amended later and they write that in there. it says that markez was not really connected, at least, saying he knew about this current attack but what's

interesting here and by the way, i think this is something that your viewers might find fascinating. since 2001, the justice department decided that intradetermining plots was more important than prosecuting plots after they come to. we're seeing charges like lying to federal agents which wasn't in this one. a conspiracy charge is one of the most poplar we're seeing. the government is much more concerned with stopping these attacks than prosecuting them afterwards and it's part of a strategy that's existed for the last 14-15 years now. >> in terms of stopping attacks and shifting gears, we learned today major theme parks across the country have said they're going to now put in metal detecto detectors. a, will that be effective and b, what is the message it sends? >> we should have done it years

respect there's a weird narrative. >> do you think the republican party is getting to the point, sam, where they have accepted the fact there's a very real possibility donald trump could be their nominee and are they coalescing behind him? >> well, i don't know they're coalescing behind him quiet yet. i think it would be trump or cruz and that's scary for a lot of people. we're get into the realization he's not going away. >> for a while the talk was about whether or not trump could peel off and make a run for it. now we're hearing the rumblings

jeb bush wouldn't support him and now there's questions whether or not jeb bush could mount on independent campaign. >> his voters are going to come out like jim web that could run together. i think donald trump has an excellence chance of running as an independent. if the republican establishment keeps trying to have meetings in washington trying to figure out what to do with the broker convention, the thing about the republican establishment is they tried so hard to prevent a donald trump like thing from happening. they've tried to stop pop ewe lichl. they cut the number of debates in half. they didn't want to see the tea party rise or the paul ryan movement. when you tap down speech and

feeling and sentiment on the republican party, especially right now, your going to get the populist backlash. >> it automatically brings up the question of is this handing more votes to the democrats? >> it's taking votes away from the republicans. it's not necessarily giving more votes to the democrats, but yeah, of course, an independent bid would favor the democratic candidate. let me just say, i don't think it's a question of the establishment clamping down the republican base. i think it's a question of who the republican party has become or what it has become. you see the independent moderate who picks sarah palin. and you see myitt romney but he never tacks back to the center. through the summer into the fall of 2012, i think this is a progression that's happening in

the word karma is getting a lot of play this thursday after a man known for raising the price of a poplar life saving drug, some 5,000% was arrested on several charges this morning including security fraud. 32-year-old martin is accused of organize straiting a triif he can -- trifecta of lies. he operated his companies like a ponzie scheme. these are not connected to the price hike from earlier this year. the bbc at one point asking whether he was the most hated man in nerk. as you can see they didn't think much of him either. for more on the case, here's nbcs dominique chew.

>> erika, this time things have moved beyond words and getting arrested by the fbi and getting led away by hand cuffs. he was led away and released on $5 million bail. as part of the release, he has surrendered his passport and his travels will be restricted to the southern and eastern districts of new york. in addition, he's not going to be allowed to have any contact with his former taern nor will he be allowed to have any contact with current or former employees of his old hedge fund, msnbc capitol or retro fin. the only former employees he can have contact with are those who currently work for this current accompany touring pharmaceuticals. this is all tied to allegations made by the securities and exchange commission that they were partied to widespread conduct.

among the allegations he made material misrepresentations to investors and potential investors about his fun and when he was ceo of retro fin he made the accompany fund legal settlements with disgruntled investors in his hedge fund. using accompany funds to pay off investors. the accompany did fire their ceo in 2014. the 22-page inindictment is failed with a host of more complexed details on the multiple counts being addressed. erika, it started off with an uproar of hiking a price to paying $2 million of the sole accompany of the latest album to a host of public displays of explicit language to now this. the next court appearance is next month on january 20th. so the saga continues. back over to you. >> thank you. up next, will social media be

correspondent. there was so much outrage on capitol hill from both sides of the aisle. let's take a listen to what was said and we'll look at more. >> it's being reported this morning, i think msnbc that has early as 2011 homeland security was preparing to check social media and yet homeland security decided that was a bad idea. they made the wrong call. they made the really wrong call. >> i think if someone is implying for citizenship to the united states it is entirely reasonable we ask for their social employ employer are -- do not give the united states more rights than american citizens have. if you're an american citizen

you seek a job in the private sector or in my office, we're going to look at your social med media. >> you're shaking your head at that as you're listening. so you uncover this memo from 2011 which is we heard at the time the administration decided no, we don't need to vet social med media, how did all that go down? >> you see the memb row on the screen. three pages. this went through the full procedural review in 2010, 2011. officials basically saying can we find a way to look somewhat at social media for visa vetting. the dhs wallet did not do that. here we are with a lot more interest in this with people asking why. as you point out, it's not san bernardino would have been preve

prevented. it's not a specific issue with the particular people that came over but everyone's talking about this for a good reason. we found while a lot of people found this was a good idea it was not made into policy. >> but why wasn't it made into policy? >> that's the question. we don't know. we had an official say everyone was in e agreement and it went back. one of the things that's complicated is privacy law and old preinternet rules are what binds the government. if they're foreign and abroad we don't have to worry. >> who at this point in the world has the expectation of privacy. you're putting it out there for everyone to see. does privacy legislation in this case even come into play? >> it can come into play in this weird way. these rules are uniform.

they'll also protect u.s. residents and americans who are vetted. the question is do you want to set up something more complicated that's more invasive for people abroad than in the u.s. a lot of them say it sounds like common sense. this goes to how to government works and doesn't work. a lot of times we hear about ideology and politics. our reporting doesn't reflect there's an idea logical wall doing this but a bureaucratic wall. they were upset and saying we've been pushing this for years. i also got a response from dhs and they pointed out they've been experiencing and have pilot programs to add social media and they're not banning it in any way. that is people can take it on their own to do it. it's not a part of the checklist right now. this is one of the hard questions we've got to ask which is if it isn't working how do you want to fix it?

i will say at the level of the obama administration they've been defensive on the issues. >> coming out today and saying we're looking at fixing it and every aspect, do you have a sense of what they're looking at and can change? >> what they seem to be suggesting with the pilot programs and with some of this they want to at least find a way to incorporate social media to priority reviews, so basically to people for sub si tif reasons are a higher priority because they may be related to a threat level. this is a common sense thing.

it's a big question and the privacy component doesn't bare itself out. in fairness. part of your reporting seems critical of dhs. they said it's not like you can flip a switch and look at the digital footprint of the 17 plus million people coming out of the country on visas and waivers and all the rest. there's a tactical question. this is the hard question for people at home saying come on, fix it. do you want to spend the money for what the federal employees remember. do you want to spend to have more security and assurances that we're doing this right? it will take more money and staff. >> interesting how it often comes back to that doesn't it. it always comes down to the bottom line. appreciate it. coming up, another white house official caught using his personal e-mail for official business. wife secretary of defense ash carter says he did it and why he's also saying it's just a big mistake. plus a new earth. could it be possible another

candidates square off in the crucial state of new hampshire this saturday. clinton is flying high in the latest democratic polls this week. they have her increasing her lead over bernie sanders now leading him by nine point ins iowa. is the vermont senator still within striking distance of clinton? today he landed a 70,000 member strong endorsement. clinton still leads sanders when it comes to organized labor with 18 national labor unions and alliances endorsing her. joining me now senior editor of msnbc.com, washington post columnist and msnbc contributor. this is the second democratic debate in a row that's late saturday night. beth, talk about great planning if you want a lot of people to tune in. >> yeah, and the last one was on a saturday night too and it didn't get anywhere near the ratings that republicans have

gotten. and it's the one right before christmas. it's going to diminish the viewership even more. >> there's also been criticism about the lack of debates in general for democrats. >> i think it's a specific matter, they should have had more. debates are a good form. they put the argument in a digestible form for a lot of people. i think it's a political matter. it cuts both ways. on the one hand, debates are propaganda for your party. if you only watch for republican debates, you think president obama is the worst president since franklin pierce or james buchanan and hillary clinton is darth vader. getting more of the democratic argument out there is a good thing. on the other hand, the republicans are doing a really good job hurting themselves and the rule is when the enemy is defeating itself don't get in

the way. maybe hanging back and letting donald trump dominate the discussion isn't such a bad strategy for democrats. in works both ways. i wish they had more debates in times more people would watch them. >> what has to happen saturday night for us to see a bit of a shift in the standings for the democrats? >> don't forget sanders is doing well in the polls. they had a poll showing him 10 points ahead of clinton. he's from vermont right next door. that's a familiar face. that's been his strong suit, new hampshire. if he upsets her in new hampshire, that's a big deal. he's gotten great endorsements from the two groups and the communication workers and the liberal democracy from america. he's got great numbers and small contributors as well. he's doing well, the fundamentals of this race haven't changed. she's favored nationally and in most states. a win would be huge. >> where does omally figure into

all this? >> unfortunately, for him not anywhere. he's not a bad candidate. what happened to him is bernie sanders occupied all of the space he hoped to occupy. he was a fiery progressive who has turned on particularly young people. it's extraordinary how many young people he's mobilized. i think overall i agree with beth's assessment. it's hard to see bernie sanders taking the nomination away from hillary clinton. he's very competitive in new hampshire and he's also competitive in iowa. this debate actually matters. hillary clinton doesn't want to have her nose bloodied in one of both of those two contests. >> i would make the case his candidacy matters. he has forced the democratic party and hillary clinton in many ways. they have to be on their feet. >> he represents the left and
