2:30 am
good morning everyone. it is monday, december 21st. i'm shia russell. we'll have all of that and unforgettable moment at miss universe. breaking news out of las vegas, one person was killed and at least 26 others injured, a driver plowed into pedestrians twice last night on a crowded sidewalk in what police say may have been an intentional act, this all happened on the vegas strip near the miss universe pagea pageant. police say at least six of the injured are in critical condition. for tourists nearby, what they saw was hard to believe. >> just suddenly saw like people flying in the air because the car hit them and it was like a bowling ball hitting pins and people falling. he's a physician so i told him just stop and he just parked
2:31 am
right at the turning towards the paris hotel and just put the hazard lights on and ran to help the victims. >> i went into my doctor mode. i wasn't think being anything else rather than to help the people. >> for a minute you think that it's some kind of show because you're in vegas and there's like, because how can a carb driving on the walkway? >> unbelievable. the driver is a woman in her 20s who had a 3-year-old toddler in the vehicle at the time. she left the scene but was taken into custody shortly afterward. both were not injured. the third democratic debate was in front of a fraction of the crowd from the most recent republican debate. hillary clinton, bernie sanders and martin o'malley squared off on foreign policy, gun control and more in new hampshire saturday night. donald trump was referenced nine times throughout the night. the only gop candidate to be called out, on the topic of isis, hillary clinton called trump the terror group's best recur

recru recruiter. >> we also need to make sure the discriminatory messages that trump is sending around the world don't fall on receptive ears. he is becoming isis' best recruiter. they are going to people showing videos of donald trump insulting islam and muslims in order to recruit more radical jihadists. >> it's nonsense, it's just another hillary lie. she lies like crazy about everything, whether it's trips whether where she was being gunned down in a helicopter or an airplane, she's a liar, an everybody knows that. she made this up in thin air. >> clinton was also criticized. >> we now finally are where we need to be. we have a strategy and a commitment to go after isis, which is a danger to us as well as the region. >> secretary clinton -- glsh and finally have a u.n. security council resolution bringing the
2:33 am
world together to go after a political transition in syria. >> she said last night we're finally where we need to be on isis. >> we're not? >> oh my gosh, with dead bodies in paris, with dead bodies in san bernardino, and with no plan from this administration how to deal with it, finally where we need to be? mrs. clinton is mrs. happy talk and she just wants to happy talk her way to the presidency. she is the personification of this administration, are you going to believe me or your lying eyes? so the fact is that that's not where we need to be. >> and one day before the democratic debate defense secretary ash carter made an you an announced visit to a u.s. military post in afghanistan. during a news conference he warned of a growing isis threat. >> we are seeing little nests of isil spring up around the world, including here in afghanistan, and that's an important dimension of the counterterrorism fight here in
2:34 am
afghanistan. >> one other issue, top of mind at the debate a scandal involving bernie sapped,'staff accessing clinton voter information. two staffers have been suspended and the campaign's national data director was fired. the fire wall on a server belonging to a dnc vendor that hosts voter information failed on wednesday. documents reviewed by nbc news appear to show that at least four individuals affiliated with the sanders campaign accessed proprietary clinton material. the national party reacted by shutting off sanders' access to the data. sanders campaign blasted the move as an overreaction saying it would likely cost them $600,000 a day in donations, they even filed a lawsuit on friday setting up a late night court showdown. their access was eventually restored but not before creating some ugly exchanges in an otherwise friendly primary. >> 24 different occasions they downloaded that data and tried to get it on an upper hand over
2:35 am
the clinton campaign through nefarious means. it's unacceptable. they were like kids in a candy store, they had 40 minutes where they ran wild and there was one individual, one staffer from their campaign who first realized it, and extended permissions to three other staffer answer they wept hog wild downloading as much data as they could get in about 25 minutes. >> the leadership of the dnc used this incident to shut down our ability to access our own information, information which is the lifeblood of this campaign. the leadership of the democratic national committee is now actively attempting to undermine our campaign. this is unacceptable. individual leaders of the dnc can support hillary clinton in any way they want, but they are not going to sabotage our campaign one of the strongest grassroot campaigns in modern history. >> and while sanders apologized at the debate and said he's
2:36 am
conducting abindependent investigation he seemed to walk back those comments later sunday. >> as a result of a breach caused by the dnc vendor, not by us, information came into our campaign about the clinton campaign. >> magically came there or you had a staffer that got it? >> yes, that's what -- >> you believe that's the way it came in? okay. >> donald trump here now is continuing to trump at the praise that russian president vladimir putin heaped on him last week. here he is at a rally on saturday in iowa. >> and then they're accusing me, "putin called him brilliant, that's not good." well, you know, isn't it sort of nice if countries are always fighting with, maybe we get along and let them do -- right? if putin likes me and if he thinks i'm a good, smart person, which you know, i hope he believes it, i am. actually he's right, i am brilliant, you know that, right? you know, he feels good about me. i feel frankly good about him.
2:37 am
i think that we can do things with russia that are to our advantage, not -- to our advantage, a mutual advantage, and then i have people, now they're jealous as hell, because he's not mentioning these people. he's not going to mention them. >> trump is also pushing back against the notion that putin has had journalists killed during his tenure. >> when you were pressed about his killing of journalists you said "i think our country does plenty of killing, too." what were you think being there? what killing sanctioned by the u.s. government is like killing journalists? >> well i think number one, i think hillary when she was secretary of state made some horrible, horrible decisions, and thousands and thousands and even hundreds of thousands of people have been killed. as far as the reporters are concerned, obviously i don't want that to happen. i think it's horrible, but in all fairness to putin you're saying he killed people. i haven't seen that. now i, think it would be despicable if that took place but i haven't seen any evidence that he killed anybody in terms of reporters.
2:38 am
>> 2012 republican nominee mitt romney is the one who made the distinction on twitter saying "thug putin kills journalists and opponents, our presidents kill terrorists and enemy combatants." one of other trump's rivals said over the weekend. >> donald trump seemed to be honored by the praise from vladimir putin. >> putin is a person who has killed, he's jailed and murdered journalists, political opponents. >> donald trump when mentioned those journalist kills he said i think our country does plenty of killing also. >> well that, i haven't heard him make that statement, if he did of course it's outrageous. i don't know of a single documented instance in which the president of the united states ordered the assassination of journalists who issue bad coverage of them or taken a different political line. now to the fight between bush and trump. over the weekend, bush made surprising comments about his place in the crowded republican presidential pack and took a shot at the front-runner in what you might call an unguarded moment.
2:39 am
>> six months ago, people thought you were the front-runner. your campaign is not -- >> i hated that. >> you hated being a front-runner? >> i feel much better back here. >> why did you hate being the front-runner? >> because i've always thought that there was going to be a high expectation for me, and i totally get it. >> because? >> because i have a brother that was president and a father that was president and that higher expectation was important to realize so being the front-runner, the other guys dancing through this, i have to earn it. i have higher expectations on me than people have of me so it doesn't bother me a bit that the expectations are high, and i want to win, which means that you garner momentum when it matters. just one other thing i got to get this off my chest, donald trump is a jerk. a guy like that should not be the front-running candidate of our great party. that is not how we win.
2:40 am
i feel better no you. i feel better now. i gave myself therapy there, thank you for allowing moo he to do it. >> trump fired back at family name tweeting "the last thing our country needs is another bush" dumb as a rock" and here's what he said on "meet the press." >> he has 2% in the polls, i have 41% in the latest poll. he has 2%. he's going to be off the stage soon. he's an embarrassment to the bush family and doesn't want to use the bush name which is interesting. jeb is an embarrassment to himself and to his family. >> moving on to other news now. an air france flight en route from the island of mauricias to paris was diverted after a suspicious device was found in the bathroom. it is the fourth flight to be diverted due to bomb threats. kelly cobiella has more. >> reporter: the packed air france boeing 777 from the

holiday day land was supposed to land in paris. the pilots made an emergency landing after a passenger told a flight attendant about a possible bomb in the bathroom. >> the plane just went down slowly, slowly, slowly, so we just realized probably something was wrong. >> they told us that it was a technical problem, just to not make us scared, you know? >> reporter: several other flights scheduled at the airport were diverted or canceled during the emergency but within hours, the ceo of air france announced the suspected explosionive device was a false alarm. he said it was nothing more than cardboard paper and a kitchen timer. since the attacks in paris that killed 130 people in november, four air france flights have been diverted because of bomb threats. >> airline flight crews are always on a very high state of alert, and i think what you would see is a similar response regardless of the tragedies in

paris, and elsewhere around the world, the russian metro jet, so i think that they acted in accordance with their training and that training withas in pla long before the most recent terror events. >> reporter: most of the passengers were taken to hotels to wait for flights out of kenya, but a kenyan official said six are being detained for questioning, including the man who reported the suspicious device, all could face criminal charges. the ohm person arrested in connection with the sbesh shootishoo san bernardino shootings is due in court, enrique martinez, former neighbor of farook is facing three charges. one congressman is raising new questions over the fiance visa granted to tashfeen malik, the other shooter. bob goodlad who chairs the house judiciary reviewed the application over the weekend and said it was slopily approved.
2:43 am
he claimed immigration officials failed to obtain the information she met farooq in person. the state department says all of the required procedures were in fact followed. still ahead here, an awkward moment at the miss universe pageant has one contestant named the winner only to have her crown taken away minutes later. everybody's talking about this. plus it was a blast from the past on "saturday night live," tina fey and amy poehler returned with some popular political impersonations. those stories and a check on your weather when "way too early" comes right back. the flu virus.

it's a really big deal. and with fever, aches, and chills, mom knows it needs a big solution: an antiviral. don't kid around with the flu, call your doctor within the first 48 hours of symptoms and ask about prescription tamiflu. attack the flu virus at its source with tamiflu, an antiviral that helps stop it from spreading in the body.
2:45 am
tamiflu in liquid form is fda approved to treat the flu in people two weeks of age and older whose flu symptoms started within the last two days. before taking tamiflu tell your doctor if you're pregnant, nursing, have serious health conditions, or take other medicines. if you develop an allergic reaction, a severe rash, or signs of unusual behavior, stop taking tamiflu and call your doctor immediately. children and adolescents in particular may be at an increased risk of seizures, confusion, or abnormal behavior. the most common side effects are mild to moderate nausea and vomiting. anti-flu? go antiviral with tamiflu. some of these experimentse're notmay not work.il.

of his price hike and over-the-top persona. steve sedgwick joins us live. >> it's interesting, his first interview the "wall street journal" he said it's nothing to do with illegalities or ponzi schemes as the sec and others have said, the fbi have ban cuesing him of a securities fraud trifecta of lies, deceit and greed, their words. he says no, it's about my persona and about the fact i had 50 times price rise on darari and others drugs. oil prices stabilizing today hitting the lowest levels on brent the lowest since 2004. last year the average price was $3.37 a gallon. this year the average price is $2.48 and prices are down as low as $2.06 per gallon. back to you, shiba. thank you, a check on the other head lines and for that we head to the control room and

if it was for the wrong reasons, after dropping a sure touchdown reception on the giants opening drive, beckham put on a performance more fitting for the ring than the football field. he was flagged three times for personal fouls during an ongoing bat well carolina quarterback josh norman and dished out a particularly vicious cheap shot that has many saying should have led to an ejection. after going nearly three quarters without a reception, beckham redeemed himself in the fourth hauling in the game tying touchdown pass to cap a 28-point new york comeback. it wouldn't be enough to disrupt the panthers undefeated season. cam newton tossed five tds in the game marches the panthers into field goal game and 43-yarder sailed but the uprights sealing the three-point victory. >> there's no one defending him by the way. it was embarrassing. >> what was embarrassing? >> beckham. >> what? oh, i'm a fan.
2:56 am
>> even giants fans are embarrassed by it. oh well, we'll see. >> i'm not going on the record with that. >> all right. >> so how is our christmas week looking here, weather wise? >> shorts, t-shirts. it's a slightly ridiculous. this morning still so warm in areas of missouri that we have thunderstorms, today by the way 8:00 p.m. this eastern is when we kick in to officially winter when we hit the winter solstice. hardly any snow on the ground anywhere in the east. for the most part over the next five day this is is the snowfall forecast. the west will be nailed once again, all the mountain areas but that's it. there's little any chance for a brown christmas for many of us. look how warm today, 70 in dallas. 55 in new york, even with clouds. 55 in boston. in new england they were making a ton of snow at the ski resorts hoping to hold onto it for christmas vacation. we have rain on and off all week long tuesday and even wednesday looks like a soaking rain and by the time we get to christmas eve this will be ridiculous. high temperatures in areas like
