it's 5:30 on the east coast, 2:30 out west and this is "way too early." good morning, it's monday, february 15th, i'm sam stein. the body of justice antonin scalia is returning to virginia this morning. a plane landed late last night at dulles international airport. now the influential conservative jurist was discovered dead over the weekend while on retreat in west texas with about 30 other people. he would have been 80 next month. reaction has poured in from all over the world, including from his fellow justices. though they differed ideologi l ideologically, scalia and ruth bader ginsburg were close friends. ginsburg said in a statement they had been, quote, best buddies since their days on the d.c. circuit court and she recalled the opera named after

them righting toward the end of the opera they sing a duet. we are different. we are one. different in our interpretation of written texts. one in our reverence for the constitution and the institution we serve. here they are in a joint interview in 2014. >> you two ever going to agree on big issues? and still maintain the friendship? >> we agree on a whole lot of stuff. we do. ruth is really bad only on the knee-jerk stuff. she is -- she is -- no, she's a really good textualist. and in those things where the text is what she's guided by, she's terrific. she's obviously very smart. and most cases, i think, we're together. >> scalia's death is certain to impact rulings on current high profile cases before the court, likely to draw split 4-4 decisions. and already his death has reframed the presidential race. and sent both parties digging in for a high-stakes senate fight.

president obama has promised to nominate a replacement. though the white house says it will not come this week. senate majority leader mitch mcconnell meanwhile has said there should not be a replacement during the president's final year in office. republican presidential candidates have echoed that position with ted cruz vowing to filibuster any supreme court nominee. president obama puts forth. >> and i don't think the american people want a court that will write the second amendment out of the constitution, all of those are 5-4 issues that are hanging in the balance. >> but the people elected president obama, didn't they? >> they did. but, but, but that -- that was three years ago. and elections have consequences. the people also gave us a republican senate this last election, because they were fed up with barack obama's lawlessness. far too many republicans don't care about the court, don't invest political capital in it, and it's why so many republican nominees have turned out to be disasters. and let me say something in particular to the veterans of the state of south carolina.

to the veterans in south carolina, your second amendment rights are hanging in the balance, justice scalia's, one of his biggest opinion was the heller decision. it was 5-4 upholding the individual right to keep and bear arms. if an additional liberal justice goes to the cot, we're one justice away from the second amendment being written out. and if donald trump becomes president, the second amendment will be written out of the constitution because it is abundantly clear that donald trump is not a conservative. he will not invest the capital to confirm a conservative, and so the result will be the same -- >> he says he will. >> -- whether it's hillary, bernie or donald trump. the second amendment will go away. >> yesterday on "meet the press" when asked if he had his own litmus test for judges, donald trump attacked ted cruz for backing chief justice john roberts. >> look, you never know -- you never know what happens, chuck. you look at where a guy like ted cruz pushed country hard for justice roberts, everyone thought that was wonderful. and justice roberts let everybody down by approving

obamacare. twice. i mean he really did let us down. and that's largely cruz's fault, and the bush fault. because they put the wrong guy in there. that was a shocking decision. >> cruz acknowledged that backing roberts was a mistake saying he would have preferred another nominee but he went along with president bush's choice. and yesterday jeb bush was forced to confront his brother's appointment as president. >> the souter choice was unfortunate. he wandered off into, you know, into the liberal camp for sure. john roberts, i think, can be a defended choice for sure. just, you know, the obamacare decision i was disappointed in. but he's made some really good rulings beyond that. here's the deal, i think the lesson learned is, you pick someone with a proven, long-standing record, a history that you can point too, when he wasn't considered or she wasn't being considered for a nomination of the supreme court. >> the unexpected court vacancy has legal world buzzing

we have destabilized the middle east. >> but so you -- so i mean -- so you still think he should be impeached? >> i think it's my turn. >> you do whatever you want. you call it whatever you want. i want to tell you, they lied. they said there were weapons of mass destruction. there were none. and they knew there were none. there were no weapons of mass destruction. >> okay, all right. >> i'm sick and tired of barack obama blaming my brother for all of the problems that he's had. and frankly, i could care less about the insults that donald trump gives to me. it's blood sport for him. he enjoys it. and i'm glad he's happy about it. but i am sick and tired of him going after my family. my dad is the greatest man alive in my mind.

and while -- while donald trump was building a reality tv show, my brother was building a security apparatus to keep us safe. and i'm proud of what he did. >> the world trade center came down during your brother's reign. remember that. >> hold on. >> let me finish. he had the gall to go after my mother. >> that's not keeping us safe. >> i won the lottery when i was born 63 years ago, looked up and saw my mom. my mom is the strongest woman i know. >> she should be running. >> those two just don't like each other. jeb bush will rally with his brother today in north charleston. it is the 43rd president's first public campaign event. but bush was not the only candidate to clash with trump on saturday night. ted cruz did, as well, and op the topic of abortion. >> i like donald. he is an amazing entertainer. but his policies for most of his life -- >> thank you very much, i appreciate that. >> for most of his life, his policies have been very, very liberal. for most of his life, he has described himself as very pro-choice. and as a supporter of partial birth abortion.

right now today as a candidate, he supports federal taxpayer funding for planned parenthood. >> you are the single biggest liar. >> all right. >> this guy lied. let me just tell you, this guy lied about ben carson when he took votes away from ben carson in iowa. and he just continues. and today, we had robo calls saying donald trump is not going to run in south carolina where i'm leading by a lot. i'm not going to run. vote for ted cruz. this is the same thing he did to ben carson. this guy will say anything. nasty guy. >> it is fairly remarkable to see donald defending ben after he called him pathological and compared him to a child molester. both of which were offensive and wrong. but let me say -- >> i just -- >> -- donald didn't disagree with the substance that he supports taxpayer funding for planned parenthood. >> where did i support it? >> you supported it when we were battling over defunding planned parenthood. you -- >> that's a lot of nonsense. >> -- planned parenthood does

wonderful things. >> it does do wonderful things but not as it relates to abortion. they do -- >> what are the wonderful things it does? >> there are wonderful things having to do with women's health. >> you see you and i disagree with that. >> well, they don't -- those two don't like each other either. let's turn now to the democrats, and a new cbs/yougov tracking poll which shows hillary clinton with a 19-point lead over bernie sanders. that is a three-point swing in sanders favor since last month. meanwhile sanders drew an estimated 18,000 people to an event in denver, colorado, on saturday, telling the audience there that he believes he has a, quote, real shot at winning the upcoming contest in nevada and south carolina. the day before, sanders was in minnesota, for a forum on race and economics. he then came about a month after he said he would not support represent rations for african-americans. and the question and answer portion produced a number of heated exchanges including this one. >> so the question specifically, my black son, okay, i know

you're scared to say black, i know you're scared to say reparations because it seems -- >> oh, ma'am, i don't think that's fair. we have the highest rate of childhood poverty of any major country on earth. especially within the african-american community. so what i -- i said black 50 times. all right. that's the 51st time. all right? but it is -- but this is a national issue. all right? so what we want, and what i believe we should do, all right, is to invest most heavily in those communities most in need. >> meanwhile, the two democratic candidates crossed paths at the same baptist church in las vegas yesterday. and both tried to build support from the african-american community ahead of saturday night's nevada caucuses. clinton brought along congressman and civil rights icon john lewis who told the church that clinton was, quote, ready to be president day one. and during her remarks to the congregation, clinton repeated a

he started serving a 19-month sentence for bribery and obstruction of justice, making him the first israeli premier to be imprisoned. meanwhile israeli police say five palestinians were killed yesterday while attempting to carry out attacks against israelis. there were four separate incidents of violence, and one of those incidents, two palestinians were fatally shot after firing automatic weapons at israeli security forces. according to the associated press, in the last five months, 27 israelis have been killed in attacks, 162 palestinians have been killed by israeli fire. and, pope francis is in mexico this morning as part of a five-day trip to the country. he held mass in one of mexico's poorest and most dangerous cities. nbc's anne thompson reports. >> reporter: pope francis went to the poor, the city of ecatepec notorious for its crime. francis rode through the streets given a makeover by reformed criminals. more appropriate for the occasion.
