good morning i'm dara brown. breaking overnight, overruled. camille cosby, the wife of bill cosby, is being forced to testify under oath later this morning. late sunday night a massachusetts federal judge denied an emergency motion to delay the deposition of bill cosby's wife. compelling her to answer questions related to sexual assault allegations against her husband. this is the latest of several motions lawyers for mrs. cosby have lost, seeking to dismiss demands she be deposed in the civil case against her husband, in which seven women claim he defamed them by denying their sexual assault allegations. mr. cosby has repeatedly denied the allegations made by dozens of women accusing him of sexual misconduct, or assault dating back to the 1960s. he has counter sued the seven women, suing them in massachusetts, claiming they defamed his character. it was a whirlwind weekend for the presidential candidates. but a close finish in nevada and a tight fight for second in south carolina.

in the end, hillary clinton and donald trump took the top spots in their respective races. the south carolina win rockets donald trump ahead with 67 delegates. ted cruz and marco rubio a distant second and third. for the democrat, hillary clinton gained 22 delegates in nevada, giving her 67, to bernie sanders' 52. and now the democrats gear up for the south carolina primary, where clinton leads sanders by 29 points going into saturday's match-up. and crossing paths, the republicans head to nevada for tomorrow's caucuses. most national polls show trump in front by a large margin. but the latest nbc news/"wall street journal" poll shows cruz edging the donald out by two points. all are trying to position themselves best this week, because looming large is next week's super tuesday. where 13 states hold toefr 1,000 delegates on both sides. jeb bush is the latest casualty following south carolina's heated race. but marco rubio received a shot of adrenaline, edging out fellow

senator ted cruz by a razor-thin 1% and getting the endorsement of nevada senator dean heller. but donald trump topped them all. nbc's katy tur has the latest. >> it's beautiful. >> reporter: donald trump's grip on the nomination is getting tighter. and he knows it. bragging to a crowd of more than 5,000 in atlanta. >> we won with everything. tall people, short people, fat people, skinny people. just won. >> reporter: trump sweeping all of south carolina's congressional districts. banking all of the state's 50 delegates. despite marco rubio's high profile endorsements, and ted cruz's focus on evangelicals. a voting bloc trump clinched 34% to cruz's 26%. exit polls showing that like in new hampshire the majority of trump's voters decided on him months ago. meaning his myriad of controversies and outrageous statements just didn't matter. and neither do his inconsistencies, flip-flopping again, republican hot button issues like funding planned

parenthood. >> planned parenthood does a lot of good -- a really good job in a lot of different areas. but not on abortion. so i'm not going to fund it if it's doing the abortion. i am not going to fund it. >> that same exit polling showed that nearly half of south carolina voters did not decide until the last minute, and they mostly did not decide for donald trump. that means going forward since the field is winnowing he's going to have to gain not just maintain support. and if this crowd here in georgia is any indication the campaign is confident they will be able to do that. >> that was katy tur reporting. hillary clinton held on to a thin margin in nevada against bernie sanders. the campaign instagramed this photo, captioned a quiet moment before taking the stage. but after that it was anything but quiet. and nbc's kristen welker has more. >> reporter: hillary clinton riding a wave of fresh momentum. >> is this a great night or what? >> reporter: after a decisive victory in critical nevada. >> some may have doubted us, but we never doubted each other! >> reporter: for bernie sanders,

the loss is a big blow. courting african-american voters at a baptist church in south carolina. >> brothers and sisters, we can do a lot better. >> reporter: and it was black voters who largely delivered clinton's victory. choosing here by a whopping 76% to 22%, after she aggressively engaged them. and rallying with congressman jim clyburn. and morgan freeman. who released a new ad. >> just like she's always stood with us. >> reporter: but there were also obstacles that she must overcome. latinos chose sanders by single digits and younger voters picked the vermont senator by 72%. >> we will do well when young people and working-class people come out. >> reporter: both candidates now looking forward to south carolina, where clinton has a big lead, and super tuesday, when 12 states will be in place. >> if she wins big in south carolina, as some people think she will do, then she's going to have tremendous momentum going in to next weekend, and the super tuesday states. and so i think it's just a real

problem for bernie sanders. >> that was nbc's kristen welker. and uber has confirmed that jason brian dalton, the man accused of saturday's deadly shooting spree in kalamazoo, michigan, was a driver for the company. in a statement, uber says it is, quote, horrified and heartbroken, and that they did a background check and police confirm dalton did not have a criminal record. one man, identified only by his first name derrick, says he rode with dalton after the shooting began, but before he was arrested. >> he kind of jokingly said to the driver, you're not the shooter, are you? and he gave -- he gave me some sort of a no response, like he shook his head or he said no, and i said, are you sure? and he said -- he said, he said yeah, i'm not -- no, i'm not. i'm just -- i'm just tired. and we proceeded to have a pretty normal conversation. >> authorities say there is no obvious motive for the shooting.

police have recovered a 9 millimeter handgun and other evidence from dalton's car and home which they say tie him to the shootings. in total six people were killed. a 14-year-old girl was originally pronounced dead for more than an hour when she suddenly squeezed her mother's hand just as doctors were preparing to remove her organs for donation. she was rushed into surgery. now to the latest in the standoff between apple and the fbi over apple's refusal to help investigators gain access to the iphone of one of the san bernardino shooters. last night, fbi director james comey released a statement defending his agency's request saying, quote, we simply want the chance with a search warrant to try to get the terrorist's passcode without the phone essentially self-destructing, and without it taking a decade to guess correctly. that's it. we don't want to break anyone's encryption or set a master key loose on the land. adding, maybe the phone holds the clue to finding more terrorists. maybe it doesn't. but we can't look the survivors in the eye or ourselves in the

mirror, if we don't follow this lead. apple said it would not comply with a court order to help investigators access encrypted data on the phone, arguing it would endanger the privacy of millions of its customers. meanwhile, reuters is reporting some victims of the december 2nd attack plan to file a legal brief in support of the government's request. 14 people were killed, and 22 others were wounded in the mass shooting. well, hollywood is suffering from a stunning lack of diversity in tv and film roles, according to a new study from the university of southern california. researchers looked at more than 100 films, and 300 series from 2014 and 2015 and they found female characters filled only 28.7% in speaking roles in the films, but only 18% of all films and series were gender balanced. 28.3% of speaking characters in films and series were minorities. and only 2% of speaking characters were identified as lgbt. let's get down to business

with cnbc's landen dowdy. good morning, landon. >> hi there, dara. the markets could start out the week on a positive note today after stocks posted their best week of the year. oil prices may still be in focus for investors, crude is higher today. above $30 a barrel. and traders will be watching reports on housing, the consumer, and gdp this week, as well as earnings from several big retailers, such as target and home depot. a new survey shows the average price of gas has dropped five cents in the past two weeks to $1.77 a gallon but it's the lowest in more than seven years. and 56 cents lower than a year ago. and analysts chalk that mainly up to weaker oil prices although they think higher demand for gas could lead to higher prices at the pump. meanwhile, visa wants to turn your car into a mobile payment platform. it's unveiled a new app today to let drivers pay for gas and parking from behind the wheel. the app can point you to the nearest gas station and calculate how much it will take to fill up. dara, back over to you. >> landon, thanks so much. now in sports, it was one of the

welcome back to "first look." this is a really quiet week after a quiet weekend. we're going to see a lot of rain and we have a big storm late in the week but it's not going to

be snow or ice so that's great. right now, heaviest rains are down in areas of last, southern saw heading across mississippi. houston the rain is just to your north. the heavy rain shifts east. if you're in mobile, northward, jackson, montgomery, atlanta, birmingham, also, and back up late today into charlotte. that's who's going to get the rainy weather today. the week ahead's going to feature pretty good sized storm developing. the first one here. the second one comes in during the middle of the week. tomorrow we could even deal with severe storms, maybe a few tornadoes and that will be down along the gulf coast. we'll watch you tomorrow. then on wednesday, the severe weather will go up from the mid-atlantic, not so much tornadoes but wind damage throughout. we could have a little bit of snow and ice, areas around indianapolis possibly up around detroit, too, central michigan. so we'll watch you. then at the end of the week everything clears out. temperatures are starting off warm. we just dealt with record highs this week. but we will see behind this storm some colder air towards the weekend in the middle of the country and then heading to the east. but over -- this is the last week of february. this is a week known for some pretty big storms and

snowstorms. but, not cold enough. this is going to be all rain. >> thank you so much, bill. well, passengers on board a minneapolis-bound mega bus, they were forced to evacuate after the bus suddenly burst into flames outside of chicago yesterday afternoon. ironically, lucas peterson, a "new york times" frugal traveler columnist was on board and tweeted a play by play of the journey. which started with an issue causing the bus to turn around. and then five minutes later, a tire blew, forcing the bus to the shoulder. a short time later he tweeted updates. the bus is on fire. then update, the bus exploded. luckily there were no injuries, and mega bus says it is fully cooperating with authorities. erin andrews heads to court this morning for the start of a civil trial against the marriott hotel in nashville relating to a 2008 incident where a man videotaped her undressing through a pooep hole in her hoe teal room. andrews is suing for negligence, emotional distress and invasion of privacy, and is seeking $75 million. david barrett pled guilty to the

now here's your monday morning dish of "scrambled politics." iowa may have needed a coin toss to decide some races between hillary clinton and bernie sanders. well in nevada, at least one caucus site had to use tiebreaker so they did it the only way that sin city can. a game of high card. clinton's side drew an ace while sanders pulled a 6. maybe minnesota caucusgoers will draw straws to decide. ohio governor john kasich may have finished in the south carolina's bottom three but his campaign creatively announced that he had won the governor's bracket. kasich outlasted the other eight past and present governors who once cluttered the list of gop hopefuls. any way to find a silver lining, i suppose. in south carolina, jeb bush pulled in at fourth place and john oliver thinks he might have the same polling in his family. >> i tend to feel bad for jeb bush, because not only did he bring his mum along to help him campaign, just wait until you hear what she said about him.

where jeb bush seemed out of touch and maybe a little bit older he's going to be a good guy. >> okay. let's move on to ted cruz. his momentum may have stalled a little bit because he wasn't able to really secure the votes that he wanted in south carolina where he was expected to really do have well. so, what's going to happen in nevada? >> you know, he has a likability problem. he does very well with people who are very far to the right, very conservative and not very well with almost everybody else. as people look towards the long haul they want somebody who they think can turn over votes and i think that's where marco rubio really did pull ahead. he seems to do well with people who say i want to pick somebody who's going to win. >> we flip-flopped. nevada and south carolina now we're going the other way and we have bernie sanders now going down to carolina for the democrats. it was really close in nevada but might not be so close in south carolina. what's he going to have to do to pull this off? >> the head line number out of nevada for the democrats, bernie sanders got 22% of the black vote, and hillary clinton got 76%. there's a lot more black voters in south carolina and he's going

to have an uphill battle. i'd say he's facing the clinton machine in a way he hasn't yet before. >> that's a really big difference. and hillary clinton said she knows voters question whether she is doing this for the voters or doing it for herself. how is she going to face that challenge when she goes to south carolina? >> you know, i think look for her to convince voters that she's doing this for the working people. she said that a lot in nevada and i think she did it successfully. you saw that very persuasive ad and we played it i think last week here where she had a young latino woman and said i'll do the worrying for you, your parents are undocumented but i'll do the worrying for you. look for more of that. >> jane timm, thank you so much for that. great way to start our monday. >> great to see you. just ahead, the game show jeopardy says no thanks to canadians. plus, danke schon. how chicago plans to celebrate 30 years of "ferris bueller's day off."
