there is no room for the members of the ku klux klan or for races like david duke. >> there was gentle advice, invoking the democratic senator robert byrd of west virginia who died in 2010. >> the right answer to this is this country does not discriminate. no president, no officer of this country should hold office, treating people differently because of the color of their skip or where they came from. that kind of thing. we believe in equality and fair treatment. that's the moral principle we adhere to. i hope he makes that clear. >> clear robert byrd, hillary
2:35 am
clinton are -- >> what are you saying about robert byrd? >> well, he endorsed barack obama. no one asked him to disavow that endorsement. >> you're comparing robert byrd to david duke, are you really? >> we're talking about a klansman -- >> that's a real smear. >> david duke denounced the kkk a long time ago too. >> now to the democrats where 878 pledged dell gots are at stake today. that's more than a third needed to clinch the nomination. it's going to be a steep climb for senator bernie sanders. because of hillary clinton's massive lead among superdelegates the total count headed into the contest is clinton 519, sanders 86. the clinton camp is spending around $6.4 million across all 11 states voting today. while sanders is on the airwaves in just five states. recent polling shows clinton leading by anywhere between 20
2:36 am
and 50 points in each of the southern contests today, but other polls suggests sanders can pick off some states in the northeast and midwest. a new monmouth poll out of oklahoma has him ahead by five points and a new poll shows the one in massachusetts a dead heat and that's where he held his final pre super tuesday rally last night. >> you know what, i look around this crowd tonight. i think we're going to win here. when we began, we 45dz -- we had no money, we had no political organization and people outside of new england didn't know who bernie sanders was and we were taking on perhaps one of the best known people in this country. somebody who had been anointed by the establishment as the democratic nominee.
2:37 am
well, a lot has changed in the last ten months. >> no matter the outcome today, sanders has the war chest to fight on. the $21 million he took in in january was the most raised of any presidential candidate in the entire field. and yesterday, his campaign announced that they doubled that total in the month of february raising more than $41 million. the clinton campaign meanwhile is already looking past today's super tuesday contest to a possible general election match-up with donald trump. a front page story in this morning's "new york times" details the clinton machine strategy to take down the republican front-runner should he become if nominee. it has three major thrusts portray him as a heartless business man who worked against the interest of the working class voters he appeals to, broadcast the degrading comments
2:38 am
he made against women and show he is unsuited to be commander in chief. and clinton's pivot towards the general was on display again yesterday. she hold four events in virginia and in massachusetts. and at all four, she used her new line of attack against trump's trademark slogan. >> america never stopped being great. we have to make america whole. i really regret the language that is being used by republicans. scapegoating people, finger pointing, blaming. that is not how we should behave toward one another, when you have somebody running for president who is insulting people. insulting their religion. i'll tell you that makes a hard job even harder. i have to tell you, i'm looking forward to those debates. because at some point, you can't

just say whatever pops into your head if you want to be the president of the united states of america. >> the state department has completed releasing the trove of e-mails it was given from hillary clinton's private server. the last batch of the more than 50,000 pages was release yesterday making the final deadline. in total, more than 2,000 of the documents have been retroactively upgraded to varying levels of confidentiality including 22 labeled at the highest level. but "the new york times" reports of the four e-mails that prompted the referral to the fbi, only one has now been classified as top secret. none of the e-mails in the archive had classification markings when they were originally sent or received. this morning a 14-year-old is facing charges after opening fire on his class mates inside an ohio school. the teenaged gunman from

madison, ohio, is in custody right now. two students were listed in stable condition after sustaining gunshot wounds. two other students were also injured in the chaos. >> there's a shooting! >> okay. >> got a gun. he started shooting people. >> how many were shot? >> i'm not sure. he pulled out a gun. he started shooting. >> officials say after opening fire in the cafeteria, the shooter ran from the school, dropping his weapon. police were able to trace his scent using dogs and he was taken into custody near school grounds. according to the nbc affiliate in cincinnati, authorities have an idea for the motive, but have not released details yet. all four injured students are expected to be okay. for just the sixth time a navy s.e.a.l. gets the military award. byers was sent to rescue a

doctor in 2012. they encountered the enemy gun fire almost immediately. president obama described the harrowing scene yesterday at the white house. >> they moved under the cover of darkness on that cold, december night. through the mountains, down rocky trails for hours. they found their target and moved in quickly and quietly. then when they were less than a hundred feet from the building a guard came out and the bullets started flying. it was over almost as soon as it began. and just minutes by going after those guards ed saved the lives of several teammates and that hostage. >> chief byers enlisted in 1998 and he has been deployed 11 times overseas. still ahead on "way too early," today, apple and the fbi go head to head on capitol hill but already apple has won a major victory in a similar legal battle. plus, in tearful testimony sports reporter erin andrews talks about the video she says has not just damaged her career, but changed her life.

cnbc's julia chatterley joins us live from london for more. julia, it's a mixed bag. what are you hearing from investors? >> good morning, jonathan. you're right it's a mixed bag. some of the slight bounce-back that we saw in february for u.s. stocks fizzled yesterday. the dow and the nasdaq posting three straight months of losses but the dow managing to rise and i think a lot of investors now wondering whether or not february represents some kind of change in sentiment and actually it's time perhaps to go bargain hunting in u.s. stocks here. what's critical of course is the oil market and what we saw in february again was a price rise in oil overall. that's the first time since october of last year. so that could be critical. but overall, look to gold. the safest asset. that rallied 10% last month. so investors still very uncertain. now, a little less uncertainty for apple. they defeated the u.s. government in a ruling in -- over unlocking the iphone in an
