events in the past 24 hours, it has turned to something darker and weirder, carnival, grow tfi the case of the former breitbart reporter versus corey lewandowski took a dramatic turned to. the campaign manager was charged with one count of simple battery in jupiter, florida, which produced this footage. you can see him. see what it looks like after we zoom in. again, you see michelle fields, there in the yellow, next to trump, with liewandowski grabbe with his right hand causing her to turn and step back, and that probable cause exists to charge corey lewandowski.

the trump campaign responded almost immediately with a statement saying, quote, mr. lewandowski is innocent of this charge, and looks forward to his day in court. he is confident he will be exonerated. trump took to twitter, including one that said, wow, corey lewandowski, my campaign manager and a very decent man was just charged with assaulting a reporter. look at tapes. nothing there. then while campaigning in wisconsin, ted cruz was asked for his reaction to all of this. he did not hesitate to lash out at the trump campaign. >> it's a very sad development. and this is the consequence of the culture of the trump campaign. the abusive culture, when you have campaign that is built on personal insults, on attacks, and now physical violence. that has no place in a political campaign. it has no place in our democracy. >> and moments ago, donald trump defended lewandowski in front of

cameras the only way trump could have done it, a press conference from his parked private jet in janesville, wisconsin. >> i know it would be easy for me to discard people. i don't discard people. i stay with people. that's why i stay with this country. that's why i stay with a lot of people that are treated unfairly. that's one of the reasons i'm the front-runner by a lot. if you look at that tape, he was very, very seriously maligned. it's very unfair. >> it's only an allegation, but what does it say about the campaign? >> i think it says nothing about the campaign. if you look at it, he was trying to block her. that's the way i would view it. she is grabbing me and asking questions. she thought she was supposed to answer questions. the press conference lasted for about 45 minutes, he was leaving and she runs up, and you could see. there are pictures where i could show you some, i actually have some in the other room there are picture where is she is grabbing my arm and i'm going like this trying to get her off. i think it's a disgrace that

something like that could take place, and i'll stick by people. i know it's probably not politically good for me to do, but when somebody is maligned so unfairly like that, i will stick by them. >> will his position change at all? >> i hope not. it's very unfair. it's an unfair thing to a person. i was watching some of the television coverage and a lot of people on television, how could somebody be charged for that. again, they see it. i'm the one that gave the tapes. they were from me. they see it. they see what took place. it's so minor. if you look at her initial statements, before she knew we had tapes of her, she was talking about being dragged down, something to that effect. she changed her tone a little bit. >> extraordinary circumstances, and neither of us have seen in our careers. charged with assault campaign manager. what are the legal and political implications for the trump campaign. >> i want to pause for a moment

and reflect on that in and of t itself. dick morris got involved with a toe sucking incident. that was as weird as anything, and kind of burlesque. this is different. allegation of violence here. charge of assault. i'm not a lawyer. i don't know what's going to happen with corey lewandowski. we're going to talk to a lawyer later on, but just on the legal level, politics now, the legal level, problematic, huge. >> innocent until proven guilty, like every american. trump is standing by his campaign manager. in any other campaign, any other business, at a minimum, would he take a leave of absence. at a minimum. trump doesn't play by the rules. in this case, it is dangerous for him, he is in a contested situation with ted cruz and john kasich. trouble with female voters, and there is no escaping the

symbolism here. >> that's the politics, right. you have situation where donald trump is getting a hit for the heidi cruz photograph that he re-tweeted, for the notion that he has a problem with women that's getting worst and worst and worst, and now to have your campaign manager, innocent or guilty, charged with assault of a female reporter, compounds a horrible narrative for him. allows ted cruz to get an offense in a powerful way and raises deep doubts for donald trump going forward whether this is the kind of thing if he were the republican nominee. >> even with the presumption of innocence, and people see the video in action, even with the presumption of innocence, this a dangerous move for donald trump to make. >> you can have the presumption of in know sense, but we can't remember in the past any campaign being charged let alone being guilty of assault of a reporter. the cruz campaign as i said before, dealing with its own reality drama. "the national enquirer" saying he had extra marital affairs

with five women. amateur sleuths, trying to find a smoking gun and reporters on the campaign trail are asking him point-blank whether such infidelities are true. mark, again, we just talked about how ted cruz could benefit from the trump situation, but what are the political implications of this story. >> we're going to go back to the corey lewandowski, so people don't think we're finished with it. ted cruz now, i believe, his campaign the question doesn't come up any more. having dodge the the question about marital infidelity, he is done talking about it. we'll see. they're all doing a cnn town hall tonight. it puts his campaign on pins and needles and he has to hope that he can do well enough in wisconsin and beyond that the page turns. but he is amongst the first candidates to be asked about this in a long while. >> a delicate subject,

in the state, and it comes hours after the news that his campaign manager, corey lewandowski was charged with simple battery in florida, stemming from an incident with a reporter with breitbart.com. we're going to listen in. >> look, he certainly can't endorse me after what i did to him in the race, right. but look at this. by the summer of 2015, wisconsin was facing a $2.2 billion, two year budget deficit. that's terrible of the by the way, this isn't trump. this is out of books. total state debt is $45 billion. maybe somebody is going tell me that's wrong, but again, $45 billion, very high. one of the higher ones. 20,000 fewer people in labor force in wisconsin than seven years ago. even though population has grown by 100,000. so your population is higher, and now i wouldn't have done

this, but when he endorsed cruz, am i going to say he is doing a great job? he is not doing a great job. he comes in his his motorcycle jacket, i love harleys, right, but the motorcycle guys like trump. they really like trump. he doesn't look like a motorcycle guy to me. i'm sorry. i'm sorry. unemployment rate, well, they say, that can't be possible. they have down 20%. that can't be possible. what? is it 20%? effective or regular? i mean, just -- >> effective. >> effective unemployment rate, 20%, out of the big book. 800,000 food stamp recipients. middle class, hit very, very hard due to loss of manufacturing jobs. these are the stats, right. you know about this, right? it goes on and on.

wisconsin has lost 15,000 net jobs to mexico, since nafta. now just so you understand, kasich is running also. he voted for nafta. both of them want tpp. tpp, transpacific partnership, both of them, want trans pacific. that will make nafta look like a baby. and wisconsin will be hit so hard. are you a motorcycle guy, i get, right? do they love trump? i don't know why, i'm not big with the motorcycles. they love trump. i love the disabled veterans and veterans. we're going to take care of our veterans, you know that, right? we're going to take care of our veterans. what is it about trump that they like? seriously, we went to hilton head, we went to different places. there were hundreds, hundreds of bikers out there. beautiful bikes. lots of harleys, right.

dollars. look, i don't know. look, i don't know. so what happened with walker, and i just, we'll finish off with this. he is a nice man. he came up to my office like about a year ago, before i was -- i've been a politician for about what, eight months. i never thought i would be a politician. the last thing i wanted to be was a politician. but i built a great company. i filed papers, every is -- the company is incredible. very little debt. tremendous cash flow. i say that not in a bragging way. i say that because that's the kind of thinking we need, folks. we can't have china ripping us off and mexico and japan, vietnam. we can't have it. we can't have it. they are rips us like they've never ripped anybody before. we've rebuilt china. i mean, we're rebuilding mexico. you look, the other day, you saw a carrier moving down. carrier air-conditioning, i'm not buying them any more. they're moving to mexico. ford moving to mexico.

that was it. i just had my girl find it. she called, she said mr. trump, i just found it. a wonderful woman comes up and i said where is it. she said i think know. she found it under a pile of other plaques. i'm going to try to get it tomorrow. i'm going to be here the whole week. i'm going to be in wisconsin the whole week. because if we win wisconsin, it's like going to be over pretty much over. because we're going to do great. emerson, because emerson poll, emerson poll came out i think i have 67, 68% in new york compared to 10%, and cruz is talking about new york values, new yorkers are no good. i watched new yorkers rebuild the world trade he center. i watched them dying. new yorkers are very good. cruz said they're no good. we're going to do great in new

york, new jersey, chris christie endorsed me. ben carson, sarah palin. sarah palin endorsed me. sheriff joe, from arizona. we love sheriff joe. and you know, with evangelicals, i've had so many ministers, pastors endorse me, and jerry falwell,, jr. endorsed me, it was incredible and we've done so well with the evangelicals, i mean, christians, evangelicals, 've do so well. in fact, in south carolina, when we went to south carolina, that was going to be cruz's territory. hes with going to take it. except we won in a landslide. you know that. he follows me around. i'll tell you. but you were there, right. remember, he was going to win that in a landslide. and then i started speaking. i started talking to people. i started saying, you know, the good and bad and the ugly and we won in a landslide.

we won the ooevangelicals. it's been an amazing time. i'm here to talk to the people of wisconsin. i have friends in wisconsin. i've been here before. it's an incredible place. but it's a place that has problems. but you have governor that has you convinced that it doesn't have problems. now, i remember when he was on the campaign trail, i was so nice to him. i said how can i hit him, i'm not going to hit him, i'm not going to hit him. i hit jeb instead, right. i hit rand. rand, rand. and i hit a lot of people. they all went down. wouldn't it be nice to have a president that could with his mouth, make things happen that are positive. you know, but it's not with the mouth. it's really with the mouth, the heart, and the brain. remember the brain. i have a lot of friends that they're good with the mouth but not good with the brain, and it

all doesn't work, okay. we had an interesting thing today. a poll came out, a nationwide poll, a great poll. it was trump 48, it was an nbc poll, trump 48, i think cruz was second in the 20s, mid something, and kasich was way down. so what happened is they show the poll. it was an nbc poll. they call it nbc monkey poll. it was on the "today" show. morning joe said that's great. that's a good poll. i've been at 42, 44, 45. how do you get 45 when you have seven people. he hasn't cracked 50. how do you crack 50 when you have all these people running. i'm at 48, way ahead of anybody else nationwide. an they showed hillary clinton, her's is close. she has a little probably. bigger problem with e-mails than she does with bernie to be honest with you. she should have. her bigger problems will be with

e-mails. we'll find out how honest our country is, right. but she has a close race. they put her poll up, big letters, and then they said, and donald trump is winning. that was it. they didn't say -- they didn't put numbers up. they didn't say -- >> you have been watching our news coverage, rally, first in wisconsin, key state there with the primary. just a week away, we ducked in to see if donald trump was going to make any remarks about the big news of the day, the arrest of his campaign manager on battery charges. he is not speaking about that. we're going to return to our regularly scheduled program, "with all due respect." i'm ari melber. we'll talk more about the corey lewandowski in just a moment, but the primary next tuesday, republicans and democrats were in wisconsin today, fanning out across the state ahead of tuesday's big showdown for both parties. john and i are just off the plane back from wisconsin.

one thing was very clear to us, while we were there. talking to people in both parties, both front-runners, hillary clinton and donald trump, could lose in the badger state on tuesday, and may be by a lot. ted cruz held rallies in brookfield and cedar burg and scheduled to join in milwaukee this evening. the real news of the day in the race, the republican side, came first thing this morning, when governor scott walker talked to radio host charlie sykes to explain why he decided to endorse his former rival, the texas senator. >> i wanted to make sure that i was supporting someone. i wasn't against something or against someone. but rather, being for something, just as i've said many times in campaigns for governor. i want to be for something. and after a lot of time looking at speeches, looking at the records, looking at what the candidates not only say but what they've done in the past, it was an easy call for me to support

ted cruz. >> later in the show, we'll talk to radio man mr. sykes about his interview he did with donald trump that people are still talking about and we'll talk to him about the state of play. how much is the walker endorsement going to matter for ted cruz? >> he is a very popular governor. >> with republicans. >> with republicans in the republican primary. he is veryopular in wisconsin. it's the most important endorsement in the state. the momentum is with cruz. you and i over the last 24 to 48 hours, talked to a lot of republicans that cruz is on ot path to winning any way. but the walker endorsement will give him that extra boost of momentum. again, a lot of craziness in the atmosphere, as we can see with lewandowski, the allegations of infidelity, but it's good for ted cruz. >> if trump is dealing still with the fallout of lewandowski being charged and loses his primary and potentially loses it big, it's going to create a very

different kind of atmosphere that he has faced in the entire campaign t could be what we have discussed, his first moment. >> another example of a republican governor, midwestern state, in theory, should be john kasich best friend, somebody walker could have given him a huge boost, a real conservative. instead, he turns away from his fellow governor and endorsed ted cruz. if it hadn't happened so many ty times, it would be baffling he is a great retail politician. >> a political consultant field for his state. he understands a lot of stuff. . all righ all right, turning to brooklyn-ite, sanders campaigned in appleton this morning, west allis later. narrow sanders victory and a huge sanders victory.

>> let's not rule out hillary clinton could win the state. you and i went to an event last night of hers that did not suggest that she was doing boffo in the state. >> the boys and girls club in milwaukee, the place she should be doing strongest, did not even fill the gym. >> maybe 300 people, being generous. >> bernie sanders 3,000 in appleton. >> if sanders wins by a little bit, he'll get momentum going into new york. if he wins big, it will give him a lot of momentum. it will beg the question, why is she not doing better in that state. >> well, and look, the argument is now, that the correct argument, the delegate math favors hillary clinton. >> by a lot. >> sanders needs to win big states about i big margins if he is going to close the gap. this a big state. if he winless s by a big margin will raise the question, he might be able to repeat it in new york, california, new jersey, that suddenly opens the

door to sanders being able to get back in the game. >> the clinton people have been down-playing chances as we talked about, the sanders people basically making a must win state, big win for him there, gives him momentum coming into new york. the clinton people will say it's another diverse state. it's a somewhat diverse state. labor, and the economy is not as bad as it has been in michigan. it will show a certain resonance for him and winning one-on-one showdown in a one state contest is a big deal. >> if hillary clinton had won michigan, she wouldn't have been talking about its lack of diversity, and the demographics are very similar, so. all right, secretary clinton held a forum on gun violence in milwaukee this morning, one of three campaign events she held in wisconsin today. but now she is getting out of dodge. she is going to come here to gothham city in harlem. down-playing her chances and she'll get a real challenge here

in new york. where is bill? what are the clintons up to in wisconsin. he has nothing scheduled there. normally, even when the staff says you cannot win the state, they fight like crazy, keeping the margin down. we have both said it's important. why are the clintons not in wisconsin the rest of the week. >> we both had the same reaction in clinton land a few days ago, we might lose wisconsin. hey they're spinning it, setting themselves for a come back victory. we think they're destined to lose, and how big is the margin. the fact that bill clinton isn't going there at all, they not only think they're going to lose, but lose by a big margin and no point in deploying him there in a wasted effort. >> if you try hard to win and still get blown out, that happened in new hampshire, it is tough to me to understand bill clinton, though not fighting. any state he won in the general election is a state feels like is his and he can turn it around. he has done an event in new york. she is does an event. i sis spect they're basically

saying cut the losses in wisconsin. hope nobody notices on tuesday. hope it's overshadowed by the republican race and shore up new york. sanders win in wisconsin is a big deal, but if she blows him out of new york, she is back without the momentum heading to the northeastern states. >> she has a big lead in new york, he was born in brooklyn, elected senator twice from the state. a while ago, but she is -- she should win the state. i think the one place where they are spinning is by suggesting that they think is going to be super hyper come competitive. they feel she has a hold on the state that she does not in wisconsin at all. >> big or small margin in wisconsin, win in new york and shut the thing down, because again, her delegate lead is very, very tough. >> large and daunting, and that's the pledged delegates, not including the super delegates. up next, donald trump's campaign manager.

our first guest tonight is whitney bowen, battery charge case today, against donald trump manager, cloorey lewandowski, whitney, hello. >> hi. >> before we start talking about strategy tactics, what is the legal standard? what does corey lewandowski have to prove to prove himself that he is innocent, given what we know at this moment? >> well, pursuant to our constitution, he doesn't have to prove or disprove anything. it will actually be the burden of the state of florida to prove beyond a reason doubt that each and every element of the offense

of battery occurred and that he committed the off fenense. he will not have any obligation to prove or disprove anything. however, i would expect him and his lawyers to put on a defense to this, and use several different approaches at that. that donald trump is kind of alluded to even already. >> you're right to call me on getting it backward. thank you for doing that. what does the prosecution have to prove on the basis of that videotape? >> well, the charge of battery requires that they prove that either lewandowski actually and intentionally touched, fields against her will without her consent or prove it by showing that lewandowski actually and intention that willy caused bodily harm to fields. they don't have to prove both. i know there has been some tweeting by fields about bruises and such. they don't have to actually even prove that she was hurt. that she was bruised. it really only requires that

there was an actual intentional touching and against her will. that's all they have to prove. >> do you know the prosecutor in this case? >> i do not. >> okay, so i'm just -- i'm just curious, because obviously, you know, we don't want to minimize the complaint that was made and the charge is a serious charge, but obviously unwanted touching of variety of sorts that occurs in florida, in that jurisdiction everyday. so do you think -- do you think, speculate here, that the prosecutor felt because there was a video, high profile, the prosecutor felt he or she had to bring the case, normally it would not be brought under those circumstances? >> i'm not even sure that it would not usually be brought under those circumstances. but i think that it would be foolish of me to say, and not credible, that the politics of this and the huge public spectacle going on with the trump campaign probably didn't play heavily into the impetus of

pursuing those charges. >> if you were his counsel, look, i have to make this go away as quickly as possible, could you plead it out pretty quickly? >> i'm sure he could. i mean, honestly, he -- >> what would he have to plead to, do you think, to get it to go away? >> well, he might not even have to plea. i don't know that jurisdiction's policies about pretrial diversion, but many jurisdictions throughout the state have programs that state attorneys will often refer cases to, such as a misdemeanor battery like this. she would have to involve with the referral, probably include an anger management case, some period of supervision, but at the end of the program, the charges could be dropped. if he is not eligible for that it is very likely, if he has no criminal history, which i'm assuming he does not, withhold of adjudication and court cost, it would be on his record so to

speak, but wouldn't be convicted. >> when you say she would have to agree, is that as a matter of law or just the reality of the prosecutor. >> realty of the prosecution, within state attorney's offices, because of the public policy in terms of not wanting to do things like that in violent crimes that are against the wilf victims. it's not hard and fast by law. >> let me go back to the question i asked before. which was according to you, the standard basically says if he engaged in unwanted touching without her consent, that he can be guilty of battery, right? the video is what it is. you've looked at it, right? so if corey lewandowski called you and said, here is what the video shows, what should my strategy be? is it smart for me, corey lewandowski to go out and say i'm innocent, when at least on the basis you just suggested, it seems hard to claim he is innocent if that's the standard. >> it breaks my criminal defense

heart when i hear about all this tweeting and this talking about it. everyone needs to be quiet. i do victim's advocacy too. even on her part. she probably needs to stop talking about it too, especially in such a public forum. donald trump's comments, as much as it pains me to say this, are not that troubling to me, and i wouldn't be shocked if there was some defense tactic there, in even having him come out and talk about this the way that he has today. i don't like that lewandowski is talking about it. i don't think it helps any statement he makes can be used against him in court. he is a party opponent. >> talk about what you said about trump's comments,y you think they're different than lewandowski's comments? >> well, i think they're din, because i mean, he is -- we can't pretend there is not a political forum and not a greater political discussion. honestly, i don't know it would have been my tactic to allow him

to make comments like that, but truthfully, lewandowski's attorneys probably don't have any control over trump. if they conferred about it, though, i don't think his comments were really that troubling. i tend to agree with him in terms of watching the video. i find it to be a diminis in terms of touching, the amount of people, everyone is running around, chasing after the subject who they want to speak to, but i did not find what appeared on the video to be consistent with what she has said in terms of ending with severe bruises or being pulled down to the ground. trump kind of made comments that i would have expected to make from a court of law if i was representing lewandowski. >> right. >> so it will be interesting. >> that would be the core of your defense, if you were actually the counsel to corey lewandowski, that's how you
