janet. what's the reaction been to the lawsuit on the ground and the back and forth now and the push from the state to the doj? >> reporter: well, any conversation, thomas with reaction has to be processed with. this is an election year. if you will notice on this lawsuit, the attorney general is not aparting to it because he's a democrat running for the governor ship against the current governor. this is a little bit of a political story here in north carolina. that had a lot of people thought that the governor might, might use this as the department of justice threat to withhold federal funds as a way to get out gracefully. we are getting this threat and it could cause you money so we are not going to enforce it. that suit being filed is partially financial base. the federal government can now withhold money as it has threaten to do.

we talk about dollars more than $4 billion from the education department to north carolina last year. if you are talking about other businesses, there is a long list of companies from apple to google and papal and to hilton and hyatt that have said, no way, we are not bringing our business there. we condemn this law and it is not the right thing for us. if you talk about the artist from nique jonas there is a lot of debate. another chapter started in march when this bill was passed in a matter of 12 hours and the next chapter will happen in court. >> all this states back to charlotte enacting very open bathroom laws when it comes to how it operates in dealing with the gender neutrality in bathrooms and this is a state's reaction, correct? >> yes. >> so charlotte passed this law

basically protecting transgender people. interesting also, the governor here of north carolina, hp 2 was a reaction to that charlotte law as you indicated. then he said an over reaction, thomas. >> is there anything on the ground there where they have concrete criminal evidence that supports some of the narratives that they would use in a type of stranger danger or a safety precaution that hb 2 demonstrates for the people of north carolina. >> reporter: i sat down with the governor one on one, he did not answer the question. he did answer it to fox news on sunday saying they have no concrete evidence of that. it is a first time we really heard him say there is no precedent in terms of something bad is happening from having this law. >> janet, standby when we are awaiting for the governor to come. the governor did give a statement to fox news just the

of north carolina. i know they put out a statement about this. from a legal perspective do they have standing to push back on what the hdoj to have on them. >> we filed it immediately after the law was passed violating title nine and the equal protection laws. this is a political conversation, there are real people in north carolina, real transgender people that are being harmed everyday by this law. governor pat mccory digs in addition to risk in the $4.5 billion in federal funding and notably the lawsuit he has brought does not include a title nine claim around education and provision. they know that because of a recent decision by the fourth circuit. transgender individuals are suffering and that's a critical part of this decision. >> the legal argument of the civil rights act are transgender

americans considered apart of the civil rights act. >> absolutely. >> i mean -- he makes a claim in his lawsuit that the law clearly established the transgender people are not covered by title seven and referred to title nine as well. of course, it actually coming out strongly in other direction that discrimination against transgender individual for purposes of non discrimination law and that's clear in the cases that come out in the last two decades. >> we know there is only 18 states in the country provides legal protection for gender americans. 32 states allowed for a transgender person to be fired or lose housing if they come out as being transgender. many people do not express that in public for fear of being fired in the workplace. >> jonathan, north carolina is

one of the many states facing this anti-trans jgender type of narratives and bills like this. bh when we think of what's happening in north carolina, is this a government solution to a problem that does not exist or does it need interpretation? >> this goes back to the question that you were asking. janet, you were talking about the governor's conversation on fox news yesterday about whether there are any cases what so ever, i understand the governor is out, tom. >> hold on for me. here we go. >> our nation is dealing with a new, complex and an emotional issue. a bound of expectations of privacy and equality in one of the most private areas of our lives. restrooms, locker rooms or public shower facilities.

this was not a north carolina's state agenda. no one in north carolina was talking about bathroom policy until the charlotte's city council imposed a mandate on private businesses. this mandate required with potential penalty of fine and access to restrooms and locker room and shower facilities be based upon one gender identity or gender expression. a similar policy was rejected just months earlier by the voters of houston texas by 61% of the vote. this caused major private concerns of male entering female facilities.

our state legislature believes this was an unnecessary government over reached into the private sector imposing regulations and impacting one's personal privacy. the state's legislature also believe that guidelines need to be put in place because of this new public topic. for government buildings and our schools and rest stops to ensure privacy and expectation privacy for everyone. now, just five days ago, the u.s. department of justice sent letters to my office, the department of public safety which reports this governor and to the university system suggesting that having government employs used the bathroom and locker room or shower facility that corresponds to their biological sex is in conflict with federal policy. the department of justice asked

all parties to set aside their constitutional duties and refuse to follow or enforce our state law. this was a substantial request with very serious implications and the u.s. government gave us a mirror three business days to respond to this letter. we ask on friday that the department of justice for additional time. we ask for additional two weeks but they refused unless i make a statement where i would publicly agree with their interpretation of federal law. and if i did, i would give me one additional week to respond. i could not agree to that because i do not agree with their interpretation of federal law. that is why the morning, i have asked a federal court to clarify what the law actually is.

now, i anticipate our own legislature, other private sector entities from throughout the united states, and possibly other states to join us in seeking this clarification because this is not just a north carolina issue. this is now a national issue and an issue that imposes new law on every private sector employers throughout the united states of america with over 15 employees. we believe a court rather than a federal agency should tell our state or nation and employers across the country what the law requires. let me say something, our nation is one nation especially when it comes to fighting discrimination which i support wholeheartedly.

ultimately, i think it is time for the u.s. congress to bring clarity to our national anti-description provisions under title seven and title nine. let me repeat that one more time to all our representatives and the leaders of both the republican and democratic parties in congress. ultimately, i think it is time for the u.s. congress to bring clarity to our national anti-discrimination provisions under title seven and title nine. now, right now, the obama administration is by passing congress by attempting to rewrite the law and set basic restroom policies and locker room policies for public and private employers across the country and not just north carolina. i am still asking the north carolina legislatures to reinstate the ability to sue for

him to agree with their interpretation of federal law. he also gave the out line of time, three business days for him to do so. and, now in the mix is the funding, north carolina's education, the state will get or may not get because of what hb 2 of the law that went in effect in north carolina in the spring means. there is legal battle going back and forth. the state has pushed back the department of justice say they're filing on the grounds of civil rights act, it is not appropriate. our msnbc's chief correspondence is joining me now. let's talk about the interpretation of federal law. in april, the fourth circuit ruled on a case in virginia. the fourth circuit oversees north carolina. is there legal standing on a doj perspective on what this bathroom needs.

headline coming out of press conference here is north carolina is doubling down on the approach here. this is of course as you reported something that got to a climax because of the department pushing explicitly to north carolina. this has been the obama doj's position for sometimes dating back to 2014 where eric holde, o of course, the predecessor said the government wants to treat the transgenders as a protected class. that now applies here in the transgender context. the other big thing of fact checking of what we heard just now, what we are hearing from governor pat mccory is a narrative or a story where he was responding to local development in his state and a local ordinance that he disagreed with regard to whether

between gender identity or critical identity. >> we are talking about these laws, we are not talking about getting rid of gender bathrooms all together. what we are saying, transgender women are allowed to go to the women's bathroom. all charlotte did was say you cannot discriminate against people because they are gay or transgender. the law that mandates the discrimination. a transgender person who has a gender identity that deferred from the sex that they were assigned at first. it does not have anything to do. all they're doing in the bathroom is going to the bathroom. it does not increase public safety incidents and never led to some sort of mid foul play in the bathroom because you decided as a government to protect transgender people. this is a myth and a confusion. >> standby for me.

party, hillary clinton is going to stay exactly where she needs to stay, talking about the things that matter to american people. she said as much herself in that interview clip you just played. i believe her strength and her ability to attract women is going to be her continued push for the things that matter to us. we don't necessarily care about what donald trump has to say about hillary clinton. what we care about is what this next president is going to do to advance the interests that we all care so very much about. we don't want to see our candidate getting down into the mud with donald trump on issues like this that don't matter. he's trying very hard to divert attention from his failed record on women and to somehow heap upon her the idea she is a person who is antagonistic to women's values. we've listened and watched donald trump for a very long time. we know where he stands. we know hillary clinton is our
