business practices. adding for the fuel for a search for a third party alternative. a new poll shows hillary clinton up four points over donald trump just outside the margin of error. when you include gary johnson and green party candidate jill stein, clinton's lead over trump shrinks to only two points, a virtual tie. and then the mystery man, david french, a writer and iraq war veteran touted by the never trump movement. joining me now hallie jackson, chrkristen welker in newark, ne jersey, for a clinton event next hour, and msnbc chief legal correspondent ari melbourne for the latest details on the court documents released on the class action lawsuit. hallie, first to you. you were a big player in the news conference yesterday. unanswered questions about trump university as well as his attack on the federal judge overseeing that case. >> reporter: are and a couple topics on that, andrea, because

when donald trump was holding that, as you called it contentious, combative here at trump tower, we were start iingo get our first look at documents that were being unsealed by the court in that lawsuit brought by students who were alleging fraud here. and some of those documents reveal instructions for salespeople trying to sell the course, that they should suggest potential customers rely heavily on credit card debt, on retirement funds to help pay for the course, some quotes we're seeing now, rm toer managers talking about how they believe the course was preying on the elderly and the uneducated. trump not answering questions but taking aim at that judge. he was on his list of people he was railing against. one of the questions was fellow republicans like mitt romney, susana martinez, how he plans to

bring the country together even as he slams conservative writer bill kristol who has been trying to recruit somebody for some kind of an independent bid. and on that topic i had the opportunity to ask trump why he's so concerned about an independent challenger when trump flirted with that independent bid. trump brushed it off saying an independent cannot win and now word of a potential new challenger, david french, played a little bit of sound from his wife in the introduction here. here is more of what she had to say about her husband's potential run to take on donald trump. >> i'm not sure. i really don't know what goes into it. it's not like we've sat around trying to get to the oval office or any political position ever. we're honored to be considered. i don't know if it's a probable decision. i just really don't know. >> reporter: french getting

reaction from former nominee mitt romney tweeting he believes french is honorable, patriotic and intelligent and he looks forward to hearing what he has to say. obviously, andrea, all of it a real long shot to try to mound some kind of an independent challenge to take on trump. >> with trump university, still all of those unanswered questions to say nothing of the attack on the judge. you've been digging through these documents. what are the big takeaways from the way they were trying to recruit students. this is a for profit university which under new york attorney general rules, at least they've filed suit saying it's not a real university and this was all during the housing crash, the recession from 2007 to 2009. >> it's certainly not a university and what is revealed is it's not only the customers suing and want their money back but some former employees who have damn iing accusations abou

how it ran. in this newly unsealed declaration, i resigned my position because i believe trump u. was engaging in misleading, fraudulent conduct. the elite program would have had to pay using disability income and taking out a loan. trump u. reprimanded me for not trying harder to sell the program to this couple. jason nicholas, a former trump employee as well says salespeople told customers how donald trump buys property with little or no money down. this was not true. trump u. did not teach donald trump's real estate investment secrets or how he evaluated properties. look, i can tell you also from the trump side of things directly on some of that controversy there, andrea, we have mark who directed the initiative and says, hey, the script used by mr. nicholas makes no statements about

trump's hand-picked experts nor about mr. trump's secrets. andrea, no surprise that there's going to be debate in an open and ongoing lawsuit about the facts. that's what the case will resolve and that will not be done until after the election in november. it's a larger question of what is donald trump's actual record and do his own statements or some say exaggerations differ with what other people experienced when they got involved in his companies. >> and still to come is, of course, the expected matchup with hillary clinton. she, kristen welker, heading to california and bill clinton for the duration of this it period until the election on tuesday. they are expecting a much tighter race. their own polling, i'm told, shows it's in single digits. >> reporter: it is a much tighter race than they were expecting and that's why secretary clinton canceled one of her events.

i am told there will be no shortage of attacks for donald trump. this tight race in california, senator sanders hasn't left california. he's poured almost all of his resources into this state. if after california no one has enough pledge delegates that super delegates should consider coming over to his side. that's a really tough argument to make. secretary clinton wants to win in california because that would like ly take away one of the lat remaining arguments to stay in the race. she goes out west where you will be covering her. back to you. >> not exactly a household name, in fact, barely known outconservative republican circles, so could he be the right to challenge in a thr

that's true and i think we're going to see more third party independent votes this time than we've seen in a long time partly because two of our candidates, donald trump and bernie sanders, spent much of their campaigns discrediting the two political parties saying it's a rigged system, the parties are corrupt. so you'll have a certain number of people out there that think they can't vote for the repub c republican or democratic nominee. whether or not anybody gets to a position where they can challenge and potentially beat the two nominees, there's not a candidate yet. we just saw in his polling gary johnson the libertarians take roughly equally from both democrats and republicans. david french will be aimed explicitly at taking votes of republicans away from donald trump. >> and that would argue for the libertarian ticket right now. the most experienced and also

credible choices on the libertarian ticket. >> it's likely to be the most experienced ticket on the field. both republicans who represented democratic states. i don't know governor johnson. >> former ambassador. >> former ambassador and they've got a very strong appeal. they are social liberals and economic conservatives and there's been an argument for a long time that's exactly the familiar la to win in this country. i certainly think they're going to do better than in the past. it raises a very important issue, andrea, what is the commission on presidential debates going to do? stick with their 15% threshold in the polls that says a cann candidate has to have 15% in order to be included in the debates, has to be fairly recent or close up to the approach of the debates or open it up and say this is a unique year and we

have two of the most unpopular nominees we've ever had. i think that is a big issue. >> david french was saying this weekend why not mitt romney when he was on with joy-ann reid. why not mitt romney? is there any way -- and i saw the interview this saturday and it was an impassioned explanation and defense for his big attack on donald trump, how strongly he feels and he would write in a candidate. you've known the man so well. is there any way given this appeal because he's not going to attract koch brothers money and big money. >> i really don't know the answer to that. i would rather doubt it. he's a person of great conscience and great ability. be a fantastic president and i think he would make it a genuine

three-person race. it would be a genuine three-person race as opposed to running a spoiler campaign. but i don't know if he has any intention. he's also a very serious and organized person. he knows it's getting late in the game. >> one quick question, the continued attacks on republicans like governor martinez by donald trump, how is that going to hurt his attempt to do the near impossible, to raise $1 billion in three months? >> he's managed to unite the republican party because of some polls that have come out since he secured the nomination that surprised everybody short of virtually tied race. as we get closer to the fall campaign, hillary clinton will get a boost out of securing her nomination if she does. the attacks will weigh on him more seriously and we'll face the real demographic issue, can we increase the republican share of the vote with hispanics, with asians, african-americans, with

have been arguing that super delegates should vote the way the states go. you've won 20 states. you hope to win california. so your basic argument is that it as california goes, so should go the super delegates from that state? >> well, i think our basic argument is really just a fact that the way to win the detective nomination during the primary season is to get 226 pledge delegates. bernie is right. it doesn't look like either one of them will be able to reach that threshold after all the primaries are taken. then it goes to the convention and then at the convention the super delegates weigh in. our concern -- i've heard chris matthews and others say we're going to call it at 5:00. well, that's not okay especially when montana and north dakota is

still voting and it's not factually correct. unless he says ichl out of the race, there is not a democratic nominee until the convention. >> if you lose california, and we've been reporting it is really close. i would say almost a tie according to my information based on the clinton campaign's polling and other polling, and we'll have more polling later today at 5:00, that said we don't know what that poll will show. >> i'll watch. >> it's going to be very close a according to all the indicators. and does that mean if it doesn't go your way, bernie sanders' way, will he then throw in the towel? >> you know, he's said all along he's staying in until the convention. i think that you're watching -- i think the media is much more concerned about this than either

candidate or democrats. i saw a poll that pointed out 56% of the democrats themselves wanted bernie to stay in the race. in california it helps because there's a contest there and that will bring out democrats to vote. it won't bring out republicans and that will help in how the democratic race shapes up for the general because they have this whole thing the top two vote getters go against each other. we'll see a lot of democrats going against each other and republicans want have a chance. i think you're not seeing either secretary clinton or bernie going after each other in negative ways. you haven't seen that this entire race. we're talking about ideas, still fighting for the ideas. he still wants to see a $15 minimum wage, end fracking. there's a number of things that he wants to make sure are in the platform and hopefully be the

nominee to carry it out. we won't know that unless someone reaches the number on tuesday. >> what about jerry brown's endorsement? it was certainly grudging, less than ringing but saying that he believes that hillary clinton is the best alternative to beat donald trump and donald trump would be a dangerous alte alternative. that had to be a disappointment to you. >> we hadn't met with governor brown nor asked his endorsement. we're used to having governors and senators and congressmen vote for or endorse secretary clinton. we've accepted that. he's the antiestablishment candidate but he's won 20 states. so the people have disagreed often. it's what it is. >> but you and your husband are suggesting that -- you're suggesting jerry brown is an

establishment candidate? >> no, no, no. >> he's hardly that. >> no, but i think there is a lot of pressure on officeholders to support secretary clinton and that's fine. i do take issue with his analysis. i think bernie is the better person to go against donald trump and all the polls keep on showing that. bernie is the only one with a favorable rating. he has 37% unfavorable. donald trump has 59%. he does well among independence and that makes a difference. he in vermont has taken away a number of republican votes. >> do you really think governor jerry brown is responding to pressure? >> no, no, no. i'm saying that i have trouble with his analysis, the reasoning that he raised.

governor brown is entitled to his own opinion and we respect that. there's no problem but what i do have concern about is the media saying, really from day one, andrea, that the race was over, that really there wasn't any chance. a lot of states have proven they disagree. bernie's won 20. we expect to win at least half of the states in this country and then it goes to the convention and super delegates. we don't agree with idea but we respect. they will take into account all the factors and make the decisions themselves and we'll respect that. >> and how would you feel if someone who shares a lot of your husband's views, elizabeth warren, ends up on a kikt with hillary clinton? >> i think a lot of people are

spokesman for the u.s. led coalition against isis. thank you very much for joining us. the current situation in fallujah and the estimate of the number of children, how do we know how many children are there and what is their status now? >> thanks for having me on. i appreciate the opportunity to join you today. the city of fallujah has been surrounded and are attacking to try to get into the city proper. they've been fating in the y suburbs for the last week. fallujah has been under control of isis for the last two years. there's a very stiff defense, a very stiff resistance that they've been fighting against in the last three days and it's been some very significant fighting, heavy machine guns, mines, artillery, all of this making the fight very slow and

methodical to get in. the coalition supporting are both concerned about the civilians inside the city. we've seen the estimates of the numbers all the way up to perhaps $50,000 to $100 thousand. we really don't know exactly how many are in the city but we're trying to very carefully apply firepower to make sure that when we shoot as an isil target, an isis target, we are not causing any collateral damage. >> now what do you expect from isis or isil, as you refer to them, if the iraqi forces and u.s. air support helps them and the iranian backed militias gain ground, will they re-create, will they retaliate against the civilians? what would be the m.o., do you think, of the bad guys?

>> well, actually that's exactly what we're looking for now. we've certainly seen where they'll fight to the last fighter, where they've run away when they know they're going to lose the city. we're waiting to figure that out. we're looking carefully at how they behave. if resistance lightens up, they might be leaving. if the fighting gets even slower and tougher, they may be deciding to fight to the last man. using human shields, using trickery and putting civilians at risk, none of this is beyond them. they're all possibility as we go forward. >> and how difficult, colonel, is it for us to be in this coalition, unlikely coalition, if you will, with the iran iian backed militia? >> to be accurate we are not backing the shia, iranian-backed

jr. and editor jean cummings. chris, we've heard sanders now say don't count the super delegates until we persuade some to join our camp. i think that's the thinking. they don't count until they count. >> well, i listened to your interview with jane sanders. she's right. the clip you played, she's technically correct. there isn't a nominee until the convention. that said, argument that you have to get over the threshold in pledge delegates only is something they're making up as a hurdle. the truth of the matter whether you like super delegates or hate them, they're part of the math of this election and one other thing i'll add to the point of persuading super delegates, this has been the sanders campaign m.o. and strategy for a couple

weeks now. they have persuaded a total of zero super delegates. you would be talking about whole scale deflections from hillary clinton that i just don't see. >> well, unless there's an earthquake and the earthquake would be california. what are the chances, it's a very close race according to everything we've been able to ascertain. i'm heading out there today hillary clinton is heading out there. bill clinton will be there for the next couple of days as well. so they career clearly see something happening here because, perry, this is not a campaign that calls audibles. they don't turn on a dime. they don't even have some of these events set up. >> a campaign you thought was stronger and i do think it if sanders were to win california it may give him a further argument to continue beyond this point. the party will be really strong. that's what jerry browne was doing this week saying this
