plus, donald trump responds to the fbi's decision not to recommend charges against his rival. all while continuing to battle allegations of anti-semitism. we'll tell you who is coming to his defense. and breaking news, olympian oscar pistorius learns that he's heading to prison after shooting and killing his girlfriend in 2013. it's 5:30 on the east coast, 2:30 out west and this is "way too early." all right, good morning, it's wednesday, july 6th, and i'm sam stein. the fbi delivered a blistering report yesterday on hillary clinton's use of private e-mail while secretary of state. calling her actions extremely careless, and directly contradicting several of her explanations for how her private system worked. but in a dramatic news conference by the fbi's director

james comey, he also recommended that clinton not be charged with a crime. and that has left top congressional republicans deeply unsatisfied. on tuesday evening, the speaker of the house, paul ryan, said he wanted penalties against clinton, and the hearing into the investigation led by comey. >> we're going to have hearings, jason chaffetz, chairman of the government oversight committee is going to be calling up james comey to ask questions. he didn't answer any questions with the press. and our judicialry committee sent a number of questions. >> do you think he caved to political pressure? >> i don't know the answer to that question. i don't know, you know, i'll take him at his word. but what i don't really understand is, after he lists this laundry list of violations, he comes to that conclusion. i think she clearly said things that were not true, and he basically gave us that. i think we need to know more, quite frankly. >> ryan's appearance came after the surprise press conference from the fbi director in which he delivered both a critique of hillary clinton's handling of classified information as

secretary of state, and a rebuke of her staff for a failure to fully account for work dr. related e-mails lost due to her private account. >> although we did not find clear evidence that secretary clinton or her colleagues intended to violate laws governing the handling of classified information, there is evidence that they were extremely careless in their handling of very sensitive, highly classified information. seven e-mail chains concern matters that were classified at the top secret, special access program at the time they were sent and received. those chains involve secretary clinton, both sending e-mails about those matters, and receiving e-mails about those same matters. there is evidence to support a conclusion that any reasonable person in secretary clinton's position, or in the position of those with whom she was corresponding with those matters, should have known that an unclassified system was no place for that conversation. none of these e-mails should

have been on any kind of unclassified system. but their presence is especially concerning because all of these e-mails were housed on unclassified personal servers, not even supported by full-time security staff, like those found at agencies and departments of the united states government or even with a commercial e-mail service like gmail. it's also important to say something about the marking of classified information. only a very small number of the e-mails here containing classified information were markings that indicated the presence of classified information. but even if information is not marked classified in an e-mail, participants who know or should know that the subject matter is classified, are still obligated to protect it. although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a
