want to see him shake up the status quo? >> who says he is firing aggressive tweets. thanks. we have to turn now to the parents of two americans that were killed in the attack in benghazi. they have filed a wrongful death lawsuit. the parents of smith and woods claim in a lawsuit that clinton's use contributed to the attacks. pete williams has been following the story for us. what can you tell us specifically about this lawsuit? >> it is a wrongful death lawsuit. it has claims of defamation here. the claim is that hillary clinton's use of a private e-mail server exposed classified information. from there on there's a bit of conjecture here. it is highly probable that u.s. ambassador christopher stevens,

that that information found its way into the hands of foreign powers and another bit of conjecture and from there it found its hands into terrorists who planned that you are attack and for that reason it should be a wrongful death lawsuit against secretary clinton. they also claim that's reason for defamation, after he was killed they said the attacks were basically provoked by you tube video. they say she knew at the time it was islamic terrorism. she has said that she never said that. they say by making those statements she is defaming them. we should probably point out that the fbi investigation did not conclude that her e-mail server was hacked by a foreign government. what the fbi said is they found signs of attempted hacking but they could never prove it actually happened. >> thank you. we have to focus on hillary and her campaign as she faces

this lawsuit for her actions her campaign is focusing on this presidential race holding campaign events throughout the state of florida and taking aim at donald trump. she is following her campaign. i want to stay in benghazi. how is her campaign reacting to this lawsuit? >> reporter: i'll read you a part of a state that was released. they say while no one can imagine the pain of the brave americans there have been nine different investigations. no one has found any evidence of any wrong doing on the part of hillary clinton. so they are stressing there have been all of these investigations and essentially they haven't turned occupy any wrong doing on the part of secretary clinton. democrats pointing to the fact it was filed by someone who has filed a number of suits against the clintons in the past. there is a sense it could be a

that a basket on the ride tipped sending the kids falling at least 30 feet to the ground. it is after a kansas city water park that killed a ten-year-old. blake, what's the status of these three kids? >> reporter: well, we just learned from police that one of the little girls is in intensive care unit and the other two are speaking. initially they said all three were alert. one girl is in the icu so her injuries appear to be more serious than we thought. it appears one of those carts tipped over and the girls fell 35 to 45 feet, which is about the height of a three story building, onto the ground. they were rushed to the hospital and they are being treated. all of the mechanical rides have

been shut down in greenville, tennessee while they explore what exactly went wrong. here in kansas they are dealing with a similar investigation after a ten-year-old boy died there on sunday. in this case police have not said very much. it is local police who are leading the investigation. they have not come out with a big press conference for what that think has happened. they only released one press release last night saying the boy died of a severe neck injury. what we gather, that giant drop right there, he was in a raft with two adults. you can see a hump where it goes up there. that is where the boy flew out of the raft and hit a protective netting and apparently severely injured his neck and died. that investigation is underway here. there are talks of a lawsuit. that boy's family is not talking to the media.

former establishment. the speech was very similar to something we could have got from paul ryan. >> he is making a clean break in a number of ways, whether it's foreign policy, economic policy, trade policy, and i also suspect that this is a man who likes to bargain and make deals. he even says so. so i would think of this in some cases as opens positions. i think it was very good that some of these proposals in the economic speech, i mean there were several, abolished the inheritance tax, simplyification of the tax code, deregulation at least as it applies to real businesses which is where the real jobs are created. these are important aspects for creating jobs. we have had a sluggish commitec

more revenue, there's still another play here, and that would be a speech i would recommend on cutting waste, fraud and abuse. in other words, there are two sides of the ledger, and let's talk a little bit more about how bad the federal government is operating. how inefficiently, how expensively. >> when you talk about regulation, though, and what needs to be cut, the fact that this speech last night appeared to really reduce regulation, it was a lack of regulation that caused much of that financial crisis, wouldn't you say? >> there are some lessons that have been learned. there were some good decisions made. and there were some bad decisions made. i think, though, we need to look forward and not backward. and it's not all or nothing. i mean, this is not as simple as you and i are trying to make it when the short time we have. and definitely over time, we have seen lower rates simplification, fewer regulations. and you can go in and figure out which ones are good and which ones are bad regulations. there ought to be a forensic

audit of the whole federal budget and tax system. it would be a wonderful thing for him to propose in his first week in office and i think that's entirely possible that he can win. i think that the early reporting on polls and battleground states and national polls are virtually irrelevant. this is early august, people aren't paying attention. and the fact is, it's early october, much more interesting. >> just before we go, what makes you think people aren't paying attention? there's a whole lot of attention going on here. >> no, the attention is among folks like you and me. most people on vacation taking care of their families, trying to figure out how to make next year proper profitable than this year, and this is -- it's still early. there are late deciders, we have seen that cycle after cycle, last 72 hours, a lot of people switching their minds or making up their minds in the first place. so i would look at battleground state polls in early to mid october, to be a much more valid indicator of where we might be
