both sides this morning. i want to start with nbc's hallie jackson. hallie walk us through this. we heard what donald trump said at the podium during his rally yesterday. but what's he saying about all this now? >> reporter: he's being obviously questioned about this pretty intensely just because this comment was taken by a lot of folks, interpreted as a kind of assassination joke or death threat in the words of elizabeth warren. others are saying it's clear donald trump was talking about the political power of gun rights advocates. let's get right to what donald trump himself had to say when pressed by an interview. i want you to listen to this exchange. >> the second amendment people have tremendous power because they're so united. >> i've seen statements from democrats so far who have equated it to condoning violence. not what that was? >> no, this is political power.

>> reporter: so you hear him saying there, this is political power that he's talking about. trump's also tweeting overnight about this saying, the media, desperate to distract from clinton's anti-second amendment stance, i said pro-second amendment citizens must get out and vote to save our constitution. trump is doing what he often does in these controversial situations. number one, he and his team blaming democrats can for spinning what they believe are talking points. and number two, going after the media for being, quote, unquote, dishonest. for a lot of folks, particularly people on clinton's team, they believe this is a serious serious threat. you've heard clinton's campaign manager come out and say what donald trump is saying is simply dangerous. this is simple. her running mate tim -- tim kaine saying donald trump is trying to push violence here.

your intention was clear. you're trying to walk it back now. the question is how does he do? that's what we're seeing today as the campaign is pushing back on this criticism. >> it comes as no surprise that hillary clinton's campaign would pounce on this. on monday donald trump was on message on his economic plan. he himself went off script yesterday with this comment whatever it meant. what does he have to do today to get back on? >> reporter: it's funny. i had one republican operative text me and say why is it so hard for donald trump to just talk about the economy and not get off track on these comments? so, yes, when you talk politically, the campaign wants to see donald trump getting back on track, focusing on the economy and going after hillary clinton. number one, i think you'll see trump's allies going after clinton for that moment that came out this week when she was at a rally outside orlando where the father of the man who killed 49 people at pulse nightclub in

orlando was essentially right behind her sitting at the event. the clinton campaign saying he was not an invited guest, that they weren't aware of his presence until afterwards. i think you're going to see his team going after that and on her new e-mail controversy as well. i think he'll continue to face questions about this second amendment remark. we'll see what he says when he addresses audiences in va irgin and florida. >> we have to focus, though, on hillary clinton's reaction. as hallie mentioned, a fierce response from that clinton campaign and her supporters pouring over mr. trump's comments. her running mate tim kaine said he, quote, couldn't believe he said it, referencing donald trump. former arizona congresswoman gabby giffords said we must draw

a line. elizabeth warren calling trump a pathetic coward. and the daughter of martin luther king, jr. called trump's comments distasteful, disturbing and dangerous. kristin no surprise, team clinton is all over this. what are they telling you specifically? >> reporter: let me tell you what we are hearing from her campaign manager, really some of the strongest language of all of those quotes that you read. he said, quote, this is simply. what trump is saying is dangerous. a person seeking to be the president of the united states should not suggest violence in any way. i think her sur garogates are gg to hold trump accountable for his words. the question is, will secretary clinton weigh in?

she got a number of questions about this yesterday. she didn't respond. it's still under discussion, quite frankly, because you have so many voices condemning what trump said. it's not only the substance. democrats, surrogates and also some republicans are raising a broader point, which is that if you are running for the highest office in the land, you can't joke about these things. you simply cannot. that is their perspective. and i think that's the message you're going to hear. of course, this comes as secretary clinton is opening up some leads in these critical battleground states. in iowa she's leading by four points and a 10-point lead in pennsylvania. >> even though donald trump on some level has handed her a gift with this comment, because team clinton wants to focus on this, we have to talk about these e-mails that have come out and the ties between hillary clinton's state department and the clinton foundation, an issue that has been plaguing her for

years. it's back. >> reporter: it certainly has. this is 44 new e-mails that hasn't previously been viewed by the public and they do raise questions about the connection between secretary clinton's state department and the clinton foundation, including some communications between top aides at both places in which the clinton foundation has asked for some of their top donors to be put in contact with ambassadors, frem for example. one of the points they make is, look, none of these e-mails involve secretary clinton. quote, neither of these e-mails involve the secretary or relate to the foundation's work. they are communications between her aides and the president's personal aide. the clinton campaign going to try to turn the page here in iowa. but this is something that continues to over shadow her campaign. >> without a doubt. thank you, kristin welker for

this morning the department of justice released a scathing new report on its probe into the baltimore police department, the report which stems from the death of freddie gray finds that baltimore police routinely violates the constitutional rights of its residents. pete williams is in baltimore following the story. what more does this report tell us about the police department and specifically how many officers or leaders were involved? >> reporter: well, it doesn't name names, stephanie, so that's impossible to say. while this report was a year in the making, the justice department looked at six years worth of records. and what they find is that in the scathing report that baltimore police routinely target african-americans disproportionately, stopping them, frisking them and even arresting them on groundless basis with no provocation at all. it said over 300,000 pedestrians were stopped over this period with no suspicion of law

breaking, especially concentrated in african-american communities. they say one man in his mid 50s was stopped 30 separate times and questioned and searched and frisked and never received even so much as a ticket. they said this partly stems from a decision in the '90s by baltimore police to adopt a zero tolerance program to stop people were loitering or gathering on the streets or refusing to talk to officers. and they say the other problem here is that baltimore police are encouraged to jack up their arrest numbers because justice department officials said that if they didn't they risked their promotions. it also says the baltimore police tend to use excessive force, they use it against people who are not a danger or a threat to the community or police officers. and they say the police department lacks an effective method to train police and also to supervise them properly and investigate complaints. this was asked for by the city. the city of baltimore asked for this justice department

we're missing the point of the election. >> without a doubt we need to be talking about that. what do you make of the republicans that we are seeing? this morning a republican congressman from the state of connecticut said, i can't support donald trump. the 50 national security experts who are members of the gop who earlier this week said this man is simply too dangerous? those people, one would argue, are of their right mind. >> well, i'm not saying they're not of their right mind but i think we have vested interests. i think they're part of the establishment. as a republican, the republicans during the midterms, they rose up and said, please go to washington and stop what's going on . the republican party has become very similar to the democratic party. they're part of the establishment. the koch brothers which i'm sure you've spoken about, supposedly conservative individuals. they're not backing donald

trump. think about this. hillary clinton, if she becomes president, they'll lose their power structure. there is something about donald trump that frightens the koch procedu brothe brothers. >> without a doubt his demeanor is anti-establishment. but when i look at those economic advisors donald trump has chosen, you've got washington establishment people and wall street giants. how is that anti-establishment? >> there are still a lot of details that have to be hashed out. looks much better than what's being offered on the other side. the economy isn't doing well. people are looking for somebody who has some answers. now, will his plan work? it's something different than what's happening. just being anti-establishment is not going to get you elected because you're not going to solve the real problems that are part of the life of people here

newly released e-mails are once again putting hillary clinton on the defense. this morning dozens of previously undisclosed e-mails show conversations between officials at clinton's state department and her family's charitable foundation. some messages show clinton foundation executives asking specifically for contacts to american diplomats on behalf of billionaire donors. in another the foundation appeared to push aides to then secretary of state to find a job for an associate. joining me now is howard dean. governor, good morning. >> six term. >> six term. my mistake. help me out here. how has this latest e-mail story not another contradiction from what hillary clinton has said in the past that we're going to be a clear line between her state department and the foundation. this was a concern before she even became secretary of state. >> we need to take a look at

what was said. but it doesn't sound to me like this is any different business than every administration has done. people are always -- the issue is not that somebody asked somebody to be placed in a job. that happens in both republican and democratic administrations routinely. the question is did they get the job. and if so, what was the quid pro quo? we have a long way to go before we figure out if this is significant. it turns out that nothing so far has been significant. director comey said there was no compromise of national intelligence, there was no classified information, that hillary clinton was truthful. again, my suspicion is this is just another right wing judicial watch kind of document dump. let's see. we're willing to certainly look at it openly and figure it out. >> as the "new york times" reports today, when secretary comey was questioned last month, he was asked twice about the clinton foundation and looking at those e-mails and he declined to answer.

is he going to have to answer those questions now? >> again, without actually seeing the e-mails, which of course i haven't done, i don't know what the answer to that question is. but again, this is, you know -- i mean, what about people's jobs, what about healthcare, what about education, what about the defense of the united states of america? the reason we have these things is because people on the right and people who like donald trump keep raising these issues because they have no other issues they want to talk about. they don't know anything about jobs or defense or education. all they can do is try to whack hillary. i'm not terribly sympathetic to that approach to running for president. >> people care so much about the economy, about education, entitlement reform, national security. but one issue that plagues hillary clinton, so many americans are frustrated with the gridlock in washington, with the d.c. establishment. when something like this keeps bubbling up that's around trustworthiness and the way in which she does business, this plagues her.

she can't seem to get away from it. >> the reason she can't get away from it is because the republicans and the right wingers keep bringing it up. unlike trump, hillary has a record of working constructively with. republicans. she was in the senate for eight years. she actually did get a lot done working with republicans. and she was criticized for that by bernie sanders and others. but the truth is if you want to get anything done in government, the two parties are going to have to work with each other. we're not all going to get everything we want and we're all going to get some things we want. i think we need to restore government to where people do work with each other. i can't imagine donald trump working with anybody. that's why i think hillary clinton is going to win the election. >> the america we're living in right now is a dangerous one. there are many scared americans. on monday the father of that orlando shooter was sitting behind hillary clinton at a rally. late last night a campaign spokesperson came out and said, clinton disavows his support.

donald trump is trying to change the rhetoric. sharing his plans for the economy, focusing on tax >> when i look at these trade deals, it's so sad. where we lose $800 billion, billion with a b, it's actually amazing our country keeps going. >> joining me now, cnbc senior contributor and adviser to the trump campaign, larry kudlow. you helped put together donald trump's economic plan. you were on flaen with him. he delivered the speech monday which many conservatives liked. >> home run, home run. >> and then tuesday, i don't know, you could say he hit a foul ball. what was your take on the second amendment comment? >> well, i'm not sure i understood it. i'm not sure what the context was. i don't think he was inciting violence. i've read that in the papers. i think he was just saying the

second amendment supporters which is the gun people are going to fight like hell to stop a hillary judicial opinion if it ever came down to that. that's my reading of it. i don't think there was anything much additional stuff really to it. >> the question for many undecided voters, people who sit in the middle, who is the real donald trump, the speech he gave which you helped him write on monday, was sort of this garden variety, mitt romney could have given the speech, paul ryan could have given the speech. >> no. >> why? >> it was really a much deeper, larger-scope speech. i'm proud of him in this respect. here is what we've never done before. we've never slashed business tax rates the way trump is doing it. large c corps, have never done that. in my view at least n the view of many economists, it tease high business tax that makes compare ka america

uncompetitive. we have to incentivize with lower tax rates. it's probably the single biggest obstacle to growth right now, really. >> listen, i'm with you. if we don't get the trillions of dollars sitting overseas here and those companies manufacturing -- >> right. >> but free trade. you also for years have said free trade, that's the path to growth. you've got a candidate who is saying no way, jose. >> i like free trade. i'm a free trader. i've had my differences with mr. trump on free trade. in the area of small improvements, we did have him insert a very important line where he said there are many benefits to trade. he's put that in. >> okay. you think he could change his tune? >> i think he's moderating his position. i think he's saying i'm for trade. trade helps americans. that's an important line.

on the other hand, and i agree with him on a lot of this, when you make a trade deal, you've got to enforce it. if you break the rules, a/k/a china and a few others, you have to have sanctions or some enforcement mechanism because parts of america are damaged when these trade deals run awry. i know last winter, protectionist rhetoric was very harsh, very upsetting to many people. a all i can say is he is now i think pulling back. he is indicating he is for trade. but it's got to be the right kind of trade deal to help america. michigan and a lot of these industrial states have been hurt by trade deals. there's no question about it. we've got to help them one way or another. one way to help them, get a better deal? the author of "the art of the deal" is supposed to be the guy that can make a better deal. i know it's just one sentence. >> so you're saying there's progress. >> trade is good. trade is good. >> let's talk about things he's

prioritizing. in terms of simplifying the tax code, of all the issues that playing america, why is it death tax, estate tax, this is what you want to talk about? have an entitlement reform. >> he may get to entitlement conform. >> what concerns people, talking about death tax, that's the priority? >> you should see the polls on death tax. you your small farmers, small businessmen and women, small shopkeepers. i'm telling you, they don't want to build up an estate over, whatever, 40 or 50 years. it's already taxed as income. it's already taxed as cap gains, already taxed as dividends. they don't want to tax it a fifth time to pass along to their heirs. >> given the millions of people suffering in the us. when you look at gdp numbers, underemployment, death tax should be at the top of his liss snt. >> it's not the top of the list. come on. the top of the list is the large scale business tax cut which republicans have never done on business. look, i'm a reagan guy.

we didn't get to business, never did. the business tax rate up until a few years ago is 50%. worldwide about 25. he wants to go to 15. large and small. i have been pushing that for years. he's gone ahead and done it. that's really the key part of this deal. the other thing is, on the personal tax rates, he agrees with kevin brady and paul ryan, this is very interesting. it was this unusual show of trumpian unity with the republican house caucus. he said you've got a good plan, we'll have our plan. on personal rates we agree, and i believe we can make a deal. the kudlow vision here always has been this, be close to the house plan. if you win, during the transition you'll bridge the differences and be ready to pass immediate legislation through reconciliation, 51 votes in the senate by next february. that assumes they win. i understand that. but i think he's made great
