police, they have released dash cam and body cam footage of tuesday's shooting of keith lamont scott. police saying they released portions of the video saying other parts were not relevant. first, we're going to show you the dash cam video that we have our hands on. we want to warn you some of it which we will now show you may be disturbing. >> drop the gun! drop the gun! >> he doesn't have a gun. >> drop the gun! drop the gun!

drop the gun! [ gunshots ] >> keith lamont scott there as you saw on the left hand side just as he was killed. the dash cam video does show the moment when he actually died. msnbc has made the decision not to air that moment. i want to show you new video we got in the last couple of hours. that is the body cam video. no audio in the first 20 to 25 seconds, which may have been omitted. you don't see the moment that scott is shot and killed, but you do see what happens at the end. it is obscured in the video that was released. you see mr. scott standing in one part of that video. then you see him on the ground right now. police say both videos are insufficient to prove that scott

had a gun in his hand. but he might have had one pointing to lab tests. i want to bring in tammy leitner who is on the ground for us in charlotte. this was the question, show us the video. they now have it. what's it in that you've seen it? >> it only gives a partial picture of what happened that night. yes, it does show the shooting, but it does not show the officer that fired that fatal shot. it doesn't show what if anything was in keith lamont scott's hand. taking a look at the dash cam video you can see two officers. they have their guns drawn. they take cover behind a car. scott opens his door. he gets out. he appears to back up and that's when shots are fired. again, it's unclear if he has anything at his hand. looking at the body cam video, you can see the officers, they have their guns drawn. one of the officers tries to break a window with his baton. at one point you can see mr.

scott standing outside of the car. and the next thing you see is him on the ground. even the police chief said today it really is not a complete picture of what happened. >> the footage itself will not create in anyone's mind absolute certainty as to what this case represents and what the outcome should be. the footage only supports all of the other information, physical evidence, the statements from witnesses and officers, and all of the other information, scientific and physical, that create the entire picture. >> so tammy, there's also other evidence that was released. not video. >> right. in addition to the video, they released three pictures. one of them is a gun the police say was loaded and had mr. scott's fingerprints and dna on it. they released a picture of an ankle holster that belonged to him along with a joint.

we're learning a more accurate picture of what happened in those moments leading up to the shooting according to the police department. they said they had two officers in plain clothes in an unmarked vehicle parked there, and they were waiting to serve a warrant on somebody else. that's when mr. scott drove up and parked next to them. the officers say they saw mr. scott rolling a joint. they weren't concerned until they saw he had a gun. they put on marked duty vest. they drove back. that's when they asked mr. scott to get out of the car. >> tammy, reaction from the family. we understand they or their representatives had a chance to take a look at the video before it was released. >> right, right. the attorney for the family says that the family is pleased that the video has been released, but they say they don't believe mr. scott was acting aggressively. they say his hands were at his side, and they to them it still leaves a lot of unanswered

questions. >> when you look at the time frame between mr. scott stepping out of his vehicle to the moment he unfortunately passes away on the pavement, do those actions, do those precious seconds, justify this shooting? that is the most important question that has to be answered. >> as you heard the attorney for the family say, still a lot of unanswered questions, questions that the family would like answered, the community would like answered, and the protesters who are out here tonight would like to hear answered. >> just parts of the video we leased now that we have access to. tammy, thank you so much. i want to move over to tremaine lee live in marshall park following another night of protests. yesterday we did have some activity, tremaine. what does tonight look like

after this new video has been released? >> reporter: surprisingly, you have hundreds of people out here. where you might expect a little more of the anger and outrage that i get when i talk to individuals, you don't necessarily feel that. but the people i spoke to who already felt they didn't trust the police, they don't buy the narrative of the police. they feel this drip, drip of information widens that divide and fuels this kind of mysterious nature around this case. they don't feel that by the police releasing just parts of the video that -- they don't feel like it serves any greater cause. with those people already coming out here believing the police aren't delivering the full truth, it only further cedes that. so far, peaceful of course.

when you speak to individuals who as a whole body, you don't get the sense there's something fueling or something seething just beneath the surface. when you talk to the individuals, they believe today's release of the video coupled with the video released by mr. scott's family that it only widens this divide and widens that feeling that something in this police department, something in this case isn't sitting right with folks beyond the killing. there's the speculation and rumors that kind of filled that space in between that transparency so many people were hoping for this. only kind of made the chasm again a little worse. >> tremaine lee there on the ground watching the community reaction. the fifth night. we hope things do stay calm. for more perspective, i want to bring in mark clackston, jim

cavanau cavanaugh, and karen desoto. we froze certain parts of the video and we zoomed in because the question was whether or not there was in this case a firearm in this case, a handgun, which has now been produced. what we have on the left and the right are free shots, frozen frames, of right and left hands. we don't see much, but do you see anything here because there's that question did mr. scott have a handgun? >> the most significant thing that i can kind of make out on either still shot is it appears to be an ankle holster on the right leg of mr. scott in the shot that has the blue pants themselves. i don't clearly see a firearm being displayed or possessed. i do see something that could resemble an ankle holster on

that right leg. >> we do have the ankle holster, a picture of that too. and this is what -- part of the evidence that was released to us by charlotte police. we've got that picture of it. and putting those two together, jim cavanaugh, do you see anything here that mark hasn't or do you agree with what he's saying? >> no, i agree with mark. certainly, we've both worn ankle holsters over the years. mark has taken guns in and out of them many times. what happens when you pull a gun out of the ankle holster, the pants hang up on the argnkle holster. with the pd releasing the ankle holster picture, it clearly to me looks like the ankle holster. you can't see anything in his hands. i think that's a point well taken by mark and the family's made that point, but i do think that's an ankle holster. it shows up again in the dash cam video.

it's clear the ankle holster is there, and it's sort of acting as if you would have drawn a weapon. i'm sure they'll be able to enhance that, close in on that ankle holster, and see if it is an empty ankle holster. >> karen desoto, they're saying officer vincent, the one who shot scott, said this. officer vincent perceived mr. scott's actions as an imminent threat to officers. you saw the video and the pieces we've shown in total there. what do you make of the statement plus what was released here? >> obviously, the videos are not that great. they're very grainy. you can't see what's going on. a lot of times you rely on the statements of the police

officers. unfortunately, in this case the community is upset because they don't believe those type of statements. they don't believe the statements of how the scene was reported. therefore there's a lot of information missing. however, what i can tell you is that police officers have to make split second decisions, so i know there's been a lot of talk about mental capacity and officers should be trained, but really they only have a couple seconds to make a judgment call. whether the gun is up, down, or in a holster, police officers are given the privilege of making judgment calls in this these situations as horrific as it is. >> i have to disagree. i have to take issue with that. the issue is not mere possession of a firearm. that in and of itself does not give you the justification in the use of deadly force. >> a gun is pretty important element. wouldn't you agree?

>> let's get back to the gun. it is an important element, but let's get back to the gun. in order for a police officer to be justified in using deadly force, it takes more than mere possession. it requires that the firearm itself is used, displayed in a way that can cause serious injury or death to the police officer or another individual. >> so it being in your hand and accessible and ready to shoot, would that be justifiable? >> those are additional elements that you're adding into it, but what i'm talking about is just possession. if you want to give the fact -- if you want to accept that he possessed a firearm, if you want to accept the fact that he possessed marijuana, those things within themselves are not justification for use of deadly physical force, and that is the issue that many people have and the concerns that people are expressing. you can't justify the use of deadly physical force in killing individuals because --

>> it has to be the totality of the situation, right? >> absolutely. >> the totality of all the facts and all the elements. obviously, having a gun is not just enough. it's time, time of day, are they making furtive movements are they sweating, is it in a high violence area. these are all factors that you take into consideration. he is right about the mere possession. but if you have a gun, that is something that is a deadly weapon. it can kill you, and a police officer has to act fast. i think we can all agree on that. >> jim, you can reflect on both what karen and mark was saying, but when you look at the two pictures, do they seem to match here? >> yes, they do. i think mark is right. karen is right as well. they described it appropriately. just a comment to richard about the gun. that's a 380 colt mustang pistol. it's a very small gun.

you can see it in the photograph on the street. looks like the crime scene photograph from the scene. >> with the measurement device next to it, right. >> the right. the hammer is cocked and the safety is off. just the picture -- i'm just telling you about what is in the picture. the hammer is back and the safety's off. just watching the dash cam video i think there's some points that could be made by either side. you don't see his hands come up and point the gun. that's a salient fact. the officers have going to have to describe what they saw. when i watched that as he backed up, i got that gut feeling -- and mark knows what i'm talking about -- like i was back on the job. when he started backing up to take the cover away from the two officer behind the pickup truck. if i was one of the officers behind the pickup truck, i could feel he was backing to take my cover away, so they really gave me a bad feeling. split seconds are important here. i'm not saying there was justification, but he was backing up to take your cover

away. we saw that dallas officer killed when his cover was taken away on that video. there's a lot of tension in the air. whether it's justified or not, i think the investigation has to take its full course. >> there are so much more that all three of you know. of course, we have more video that we have not seen yet. that is from the two other body cams in addition to that. we don't have that. this is just a part of the pieces of video that they have released so far. thank you for staying with us tonight. we just got in this new stuff. i appreciate it. we also have breaking news in washington state this hour. there is a manhunt for a man suspected of carrying out a deadly shooting spree. now in custody. more on that. but authorities say as of right now there's no evidence to prove this was an act of terror. joining me again tonight jim cavanaugh. what do you make of the circumstances here of this shooting spree and this new news that we have of that suspect being caught? >> well, i think he was probably id'd from the photographs the police released. probably got a boat load of tips. you know, one of the facts in the case, richard, was he was coming into the mall. he didn't have a visible gun, so he either retrieved that gun that he'd already hidden or he had it on his back. if you'll notice in some of the photographs, he has a sling on that gun. and he has baggy dark clothes. he could have put that gun with the muzzle down on a sling tucked inside the baggy pants. when he walked into the front door, at first it looks like he has no weapon.
