and king james officially backs hillary clinton. this is mtp daily and starts right now. welcome to mtp daily. i'm kristen welker in washington for chuck todd. as we've said, it's finally october and we have a surprise for the week of donald trump, which didn't let up over the weekend with one negative headline after another. starting on saturday night when "the new york times" dropped this, obtaining his 1990 tax releases, and showed that he could have avoided legally paying any taxes for 18 years. more on the story. >> as a businessman and real estate developer i have legally used the tax laws to my benefit. and to the benefit of my

company. my investors and my employees. i mean, honestly, i have brilliantly -- i have brilliantly used those laws. i have often said on the campaign trail that i have a fiduciary responsibility to pay no more tax than is legally required like anybody else. or -- put another way, to pay as little tax as legally possible. >> but the times story was not the only negative headline about trump this weekend. "the associated press" said he regularly demeaned women on the set of the apprentice. he was received a receive and

desist letter. meanwhile, while that times story was posted on saturday trump was on stage at a rally in pennsylvania just a day or so after a late-night off message tweet storm took hold of the news cycle. trump was off prompter again. >> here is a woman, she is supposed to fight all of these different things, and she can't make it 15 feet to her car. give me a break, give me a break. give me a break! i have a great temperament. i have, in my opinion -- it's like one of my stronger things. i have a winning temperament. she could be crazy, she could actually be crazy. hillary clinton's only loyalty is to her financial contributors

and to herself. i don't even think she is loyal to bill if you want to know the truth. and really, folks, really, why should she be, right? why should she be? >> his surrogates were left to defend his words and tax returns on sunday, clearly laying out the talking points, calling trump a quote genius, for working the laws to benefit himself and his company. but the clinton campaign was not letting this story go, hitting the rally this afternoon. >> doesn't look like he paid a dime of federal income tax for almost 20 years. the whole story tells us everything we need to know about how trump does business. after he made all of those bad bets and lost all that money, he didn't lift a finger to help and protect his employees. they all got hammered.

while he was business with his accou accountants trying to figure out how he could live like a billionaire. in the debate, he said it was smart to avoid paying taxes. yesterday his campaign was bragging it makes him a genius. here is my question, what kind of genius loses a billion dollars? >> so while the spin cycle is in full swing, it could be up to his runningmate to shift the divide. we're joined by the senior adviser to the trump campaign, sarah, thank you for joining us, as always appreciate it. >> great to be here. >> so i want to get your reaction to what we just heard from donald trump on the campaign -- she he is essential

attiat i -- patting himself on the back for not paying taxes, and hillary clinton saying what kind of genius doesn't pay taxes? >> he not only fought his way back, one thing americans love about donald trump, he is a fighter. he lost money but came back. he made billions a second time, not once, but twice, he has been extremely successful in business after the recession in the '90s. he rebounded and fought his way back better than ever. hillary clinton's problem, she never created any jobs outside of government. while donald trump in contrast created tens of thousands of jobs in the many years he has been in business. i put his record up against hillary clinton's record any day in terms of creating jobs and

growing the economy. >> to lose nearly a billion dollars in one year, he is touting himself as somebody who is going to further help the economy. and i guess doesn't that raise questions about his ability to do that? i mean, the american public doesn't want to suffer another loss before having a big comeback, right? >> i think we've already suffered a big loss, we have had obama and clinton in power for so long, we've already hit that place. now we need donald trump to grow our economy. hillary clinton has grown the government. and that is not the answer, we absolutely have to have somebody to come in and shake things up, grow the economy through business and not through government. >> and the counterargument would be that the economy has improved since barack obama took office. i think they would argue that point. but from the perspective of the taxes, those who live this ohio

and other parts of the rust belt do you have concerns there is a tone deafness there, because those people are paying their taxes, they don't get to write off huge losses and not paying their taxes. >> look, if there is anybody those people should be angry at, it should be hillary clinton. those people helped write the tax laws, donald trump as a businessman followed the law. so if there is any blame to go around hillary clinton should be their number one target and i hope they put their focus on that. that is why we need donald trump. he understands the system better and knows how to come in and fix it so that it helps all americans. hillary clinton is the one to blame here and i hope they know that. >> sarah if you're saying that the law is unfair, then would donald trump be able to get rid of that loophole that allowed him to file that huge loss, and essentially not paying any taxes for it. >> look, i didn't necessarily

say the law is unfair, donald trump followed the law. if people d't like it, hillary clinton is the one people should be angry at. donald trump pofollowed the law he didn't break it. unlike hillary clinton who probably broke the law, if anybody should be upset it should be at her complete record in government. >> just to be fair, there is no indication she has broken a law, and never been accused of actually breaking the law. this is putting increased pressure on him to release his tax returns, sarah, to answer some of the questions about his release over the weekend. should he now release his taxes? >> look, i think the answer is the same i've given on this show and many others and donald trump has given thousands of times, the minute the audit is complete he will release the tax returns. and until that happens, i don't think he should do that. >> i know that is the answer you

guys give, but the irs says there is no reason he can't release his returns just because he is under audit, plenty of people do. so shouldn't he take this opportunity to answer questions about whether or not he paid taxes and for how many years and how much he has given to charity? shouldn't he take this moment to release this information to the public? >> look, i think he is transparent, forgive me if i'm not like some of the other people out there that actually trust the irs. as a conservative, i think the irs has a pretty rocky track record. so i'm not sure they're exactly the people whose advice i would follow when it comes to how conservatives and republicans should react in releasing their tax returns. but again, i think he has been very transparent by doing the financial disclosure that shows a ton of business. he has a much more complicated

tax return than the average person and i think he has to protect that while he is in the middle of this audit. >> all right, and sarah, let me get your reaction on this issue. he sent the trump campaign a cease and desist issue, forcing them to stop accepting donations. your reaction to that, and does it create new questions about this foundation and how it's run? >> look, with an ongoing legal investigation there is certainly not a place i can comment on that. but i do know they're in full cooperation with the authorities. but i think it's interesting given this gentleman's timing and frankly his alliance with the clintons. and frankly, weand frankly, the is a lot to be said for that. i know they have done everything within their power to follow everything within the letter of the law.

they have a lot of much smarter people than myself working on it. i am confident they're doing everything within the letter of the law. >> we have a variety of new polls showing that secretary clinton seems to have gotten a post-debate bounce, she is up five points with a four-point bump since last time the poll was taken. and in a two-way race, she is up 51 to 45, coming after a really tough stretch for donald trump. of course he had that debate performance on monday with the tweet back and forth with ms. universe. and then the 3:00 a.m. tweet storm, and over the weekend we saw him lash out at secretary clinton, mock her for being ill. accuse her of all sorts of things. does he need to get back on track and how are you advising him to do that? >> look, i think donald trump

had a great night last week, and we'll have another great night with pence i believe. when we talk about national security the two issues that americans care about the most. donald trump is winning. people trust him on those two issues the most. and if we can stay focused on those, donald trump is winning. hillary clinton has no credibility on the economy -- >> sarah, really because we're almost out of time. i hear what you're saying, but a lot of times supporters say he has gotten off message, we want him to talk about the economy and create jobs. and instead he is having a fight with the former ms. universe, as one of his top advisers. are you telling him to get back on message? >> look, i don't think we got off message, hillary clinton brought it up. i think we addressed it. i think it's fair to say it's time to move on. hopefully we can focus on the issues that americans are staying up late at night worried about. and let's focus on the economy

and national security and i hope we have a real policy debate tomorrow night. and if we do, i have no doubt that governor pence will do very well. we'll see a huge bump after that. >> thank you very much, secretary, we appreciate it. and joining me now, jennifer granholm, thank you for joining us. >> great to be here. >> let me get your action, there is a lot to cover. donald trump is making the point that no american pays more in taxes than they want to. and that is true. what do you make of his argument, the clinton campaign, obviously you guys are trying to spin it up and keep it going in the news cycle. at some point is well a valid point there that well, most americans don't want to pay more than they have to? >> i totally get that. donald trump has been tweeting half of americans don't pay their taxes when there is a big deficit. the question is for everyday

citizens in ohio and michigan, so who is paying to donald trump's secret service right now? it's not him. it's you. who is paying for the airports that his jet lands at, or the streets that he rolls on, or the police officers that are securing trump tower? who is paying for that? he is not paying for that. we are paying for that. there is a fairness issue very important. plus, you raise the issue with sarah with the losses, if he wants to run like he wants to, you see the losses the voters should take into account. you ask about releasing the taxes, have him release the ones that are not under audit then. >> do you think you guys are going to increase the pressure? >> well, the taxes issue is very important, especially in light of his own tax plan. he doesn't propose to fix the problem, he is talking about

giving more taxes cuts to those at the very top. that is a comparison point they will raise at the debate. but i think we'll absolutely continue to push it. >> let's talk about the challenges for secretary clinton who is in ohio today. again, we just got a new round of polls and actually we see that donald trump has a pretty healthy lead in ohio, 47-42% in a four-way race. can she still win this? and -- he has a healthy lead there. >> yeah, he does have a healthy lead. and today she was talking about economic patriotism. and this goes right to donald trump, too. the very people in ohio that he is trying to woo are the same types of people he jilted in his business. in michigan, when you talk about out-sourcing, those are fighting words. he has out-sourced his business. so the same arguments she was making today about profit

sharing and inclusive economy, those are policies with very specific issues how she is going to raise income. >> let me ask you wi-- about th audio that was released, where she talked about living in basements. if you're a millennial sitting on the fence -- >> it doesn't make it that much -- >> if you listen to that tape she was emphasizing, she was saying that millennials a s are frustrate. she want a good paying job. that is why democrats should be elected. she has a specific plan to do that. that is a nothing burger, which they ended up having to change their headline on. it was an uncharacteristic way

of sympathizing with -- >> some of the holdouts, who were really seriously thinking of voting for gary johnson says it goes back to a trust issue. you heard about e-mails, is it too late for her to restore that trust and why hasn't she been able to do that? why is she struggling? >> she is struggling because of course republicans have spent millions against her. it's been effective. yes, she has to continue to earn their vote every single day. but bringing out people like barack obama, and melissa obama, and elizabeth warren, and continually saying a vote for gary johnson is a vote for her. do they know the full record of gary johnson, do they know he wants to privatize social security? that he doesn't think there

should be a role -- she has plans for all of those. >> and donald trump is signaling that he is going to get a lot more personal. he did it this weekend. >> he is crazy for do it. >> what does she need to do? what would you advise her to do? >> it's obviously not a strategy that has worked for him. if you look at the polls out today -- >> they energize his base to get out in big numbers. >> it's not going to energize women, you look at what he did with the apprentice, i know you will talk about that at some point. it's creepy that he is ogling employees, alicia machado was an employee. that does not energize women. it gets dads mad. he is obsessed with women's looks. that is a bad strategy for him and a bad strategy for him to

frankly of being a big beneficiary of the laws. but i'm working for you now, i'm not working for trump. >> donald trump unveiled his story on the tax code, but still did not reveal if he will release his taxes. documents showed a $916 million loss in 1990 tax filings. let's talk about the taxes, the documents are just part of his 1995 returns. trump's former accountant now retired pointed out the elements he had to modify on the documents themselves. the experts said trump legally may have paid no federal income tax for 18 years. but there is no indication he to followed through. we know he didn't pay taxes while trying to obtain a casino license.

documents claim he likely didn't pay taxes in '94, '93, and ''91 al also. specifics on his debt, we don't know charitable giving and other deductions, so let get perspective from the tax experts. the professor teaches at usc school of law. thank you. >> i just laid out the loss we learned about from his 1995 tax filings. so what can we infer about that and what donald trump did after declaring that massive loss? >> well, $916 million is a really big loss. you don't lose that kind of money just by mismanaging a casino for a couple of years. the loss almost certainly had to relate to the many real estate properties that he invested in,

in the late-80s, and early-90s, that did spectacularly bad, in order to sell pennies on the dollar to satisfy his lenders when he went through a de facto bankruptcy proceeding out of court to satisfy his lenders. so he lost money in perspective to the investments he made. but the real trick was the billion or so that he lost was really other people's money. and what is ironic here is he lost other people's money with respect to the real estate investments he made, but then he ends up with the large tax deductions to carry forward and to use for his income in years and years to come. >> i think a lot of people are scratching their heads about how this could be possible. so can you help us understand

that part of this story? do you have to have a massive loss like that to be able to write it off completely? and essentially -- potentially not pay taxes for 18 years? >> well, the only way to know the answer to that for certain, of course, would be the entirety of his tax returns. and if mr. trump thought about things, in fairness to him as well as to us, as well as to the american people he would release the returns to demonstrate that the loss was legitimate. that he did not engage in any shelter or tax schemes. the only way we know that is through returns. but the most plausible reading that you can give based on the small facts we have, we know to be true, he made bad investments in the '80s in atlantic city and elsewhere. he did that with borrowed money that gave him an investment. he was then forced to essentially sell those

properties at pennies on the dollar to satisfy his lenders. that would trigger a loss, and then the lenders then forgive the debt he owed them because they saw there was no possibility of him repaying it. i'm sorry -- so ordinarily, when you lose money like that, and your lenders forgive the debt you would expect to have income from the debt forgiveness. if your credit card debt is forgiven, you have income. but there are special tax rules for real estate, and for insolvent or bankrupted individuals, in which he could have arranged to have the debt forgiven but keep the tax laws on the other. >> all right, i want to play you some comments on the tax laws and then get your reaction on the other side. >> perfect. >> i don't mind sacrificing for

the country to be honest with you. but you do have a problem because half the people don't pay tax, you do have a large percentage of people not paying taxes. you do have a large percentage of people that feel they're entitled. and maybe that is a discussion we should be having. >> it's sort of fascinating, he says it's unfair. but isn't that effectively what happened here? >> yes, it's exactly what happened here. he lost other people's money, and by virtually doing that, claimed a tax loss for himself, and was able to effectively increase the income for the newly reinvented trump as a life-style brand name license all around the world. >> very quickly before i let you go when you look at this filing what is your single biggest takeaway? >> my biggest single takeaway is

so let's bring in our panel, rick tyler, msnbc analyst, thank you all for being here. we have a lot to get to. let's start with this tax story, rick, donald trump woke up to this on saturday. a bit aftof a bombshell. >> look, i don't know any americans who don't try to pay as little as they can. he just needs to explain. the big story is he lost a billionish back in 1995, and clearly has recovered from that. i actually don't think that story is going to have that big a leg. >> really? >> i think that could come out,

people having an effect from that. and there was a guy basically that lost $30,000 as a result of the writeoff. if they start really talking about the small business people that got hurt as a result of him trying to be too clever, that could hurt him. >> and there is no doubt the clinton campaign has run with it. but perry, when you put it in the broader context it's not just the tax story, it's the news about his foundation, his first debate, his fight with ms. universe, this has been a tough stretch for him. >> we have had this information trump's return, he was smart to do so. he was right. now the business looks like, as hillary clinton said. he also doesn't pay taxes. i think it has legs, and it was a story in the post today, people making a point of this story, something they didn't know. this is very easy to explain,

you lost a billion dollars, you don't pay taxes is pretty clear. i'll be curious how mike pence explains it tomorrow, who does pay taxes. >> and challenging headlines, including from the associated press report which said he didn't treat some of the former contestants on the apprentice, making sexist reports. he says there is nothing to do. and it makes it tough for him to gain ground with women voters. >> again, i think he could have told "the new york times" in a very different way. he didn't have to attack "the new york times," basically he was saying the story was wrong. it is drip, drip, drip, and the over-reaction. this is the worst post-debate spin after maybe the rolling

story -- in the polls, we've talked about it in the program, now hillary clinton in some cases in these states, the battleground, she is outside the margin of error. she is getting the ballots because he has had a really, really, really badweek. >> she has gotten a bounce in these polls, post-debate, but the fact with her pneumonia, immediately her poll numbers dropped quickly. this race can change on a dime. we have the audio of her coming out talking about sander's supporters basically living in their basement. >> hillary clinton is disciplined. practicing for this moment. in august when you saw donald trump on message using the te

teleprompter. the moment he feels like somebody is going after him, he goes off script. i think that is part of the problem and again when he talks about the fact that he needs to be the president today because he wants to fix education, infrastructure, and rid of undocumented immigrants, he actually has had no skin in the game, paying taxes to those issues he claims he wants to fix. >> to this point about this leaked audio, she is really struggling with millennials. she is not where barack obama was back in 2012, and struggling h in a state like ohio. >> the idea that people are living in their parents' basements, it's not a compliment. >> he did confirm -- >> the supporters -- >> that is true, i think -- i haven't heard the audio.

but it's more speaking to the experience of the millennials, saying you actually have to woo me. for the democratic party, it's a difficult position to be in. >> let's talk about tomorrow's vp debate, the one and only. sit the stakes, rick, is there anything that governor pence can do to change this news cycle? i mean, if he has a solid performance can he get it back on cycle? >> there is no question, i don't think it amounts to very much. we'll probably hear a lot more policy. tim kaine is still probably going to try to make it about trump and make pence defend trump, so pence will probably try to do that about clinton. so you will have a debate by proxy. >> in 2012, i thought in the second debate, and vice president joe biden did it. tim kaine has a lot of material

is look she may not be able to win ohio. >> that's my question. >> she's really far down. and i don't think lebron -- i mean, lebron james is a young black guy, not totally shocking, with all due respect for hillary clinton. i don't think this will be moving the non-college voters in ohio much. i will be surprised -- >> but this is her first visit since labor day. and it felt like the campaign had almost given up on ohio. now they're coming back and making a play for it. do you think she can come back? >> i don't think there's any question about it. people love the cavaliers, they love -- well, the fans and the fans are working class people. and they love lebron james, they brought him to victory, now he's going to try to bring hillary to victory. >> do you think this helps her? >> absolutely. >> well, it's interesting, because obviously this is a cycle that favors outsiders. secretary clinton has gotten a lot of endorsement from political establishment figures, not that lebron james is that. but you wonder how far an endorsement like this really goes, or does she need to just spend a lot of time in ohio --

>> but i think he becomes kind of like a buffer and says, look, trust me on this. because i don't think -- this is -- for a lot of folks in hollywood, it's a very difficult decision for them to put a toe in the water. it actually alienates fans if they choose the wrong pony. the fact that he's doing this, you have to trust me, because i'm trying to shepherd you into something else. that's one of the reasons folk as use surrogates. but when they use hollywood surrogates or celebrity, it's a completely different ball game, because they are basically rolling the dice as well. >> and going back a little bit to the vp debate, i want to talk strategy. a lot of people are making light of the fact that governor pence is going to be out on the campaign trail tonight, a little bit unusual, and of course, we saw that from donald trump, and some people said, he wasn't as prepared as he could have been. it seems that governor pence has been preparing for this, but what do you make of the fact that he's out on the campaign trail? >> i think he is prepared. candidates prepare in different ways. as long as he's prepared -- like, ted cruz used to take the day off before and just relax,

but other people -- i think studying up until the moment of your debate, that's the wrong strong, because you get too overprepared. so he'll do fine. he's been fleerin leadership in congress, a governor in indiana, he's sentenced and experienced in debates. >> in terms of issues, these are two people, tim kaine supported the fastrack authority for tpp. pence has supported tpp in his past. does that issue get neutralized? does iraq get neutralized? they both supported that. what issues do you expect to emerge? >> i would assume they're still trying to focus on 30 years, hillary clinton's been in politics a long life. repeat the trump ideas. even though mike pence has been in politics a long time. i think they'll try to use those same ideas, and i assume tim kaine will barely use mike pence's name, barely. i assume it will be trump this, trump that. >> but the times he will use it is to rib people that trump is

highly anti-choice, anti-lbgt issues, anti-immigration. is going to remind the folks that this election is a very different type of election. he's going to remind folks that you have over 100 generals that are basically supporting hillary clinton, 100 republicans support -- so basically, i think what tim kaine is going to try to do is say, this is not an election as usual. don't think about sitting it out, americans. >> and very quickly, rick, last word to you, can vice presidential debates make a big difference? i mean, is there -- we obviously saw that clip with -- >> no. >> is there somethg that can make a big difference here? >> historically, vice presidential -- even the vice presidential candidates don't make a big difference. debates will get a news cycle out of it, but people vote for president, they don't vote for vice president. >> all right, guys, great conversation. thanks so much for being here. and we will be right back with one more story you might have missed. stay with us.
