>> this is richard alexander for chuck todd. welcome to "mtp daily" with election night fast approaching, we are trying to figure out what the final eight-day sprint is going to look like after the shocking announcement they discovered new e-mails potentially related to the investigation into hillary clinton's private server. how bad could the fallout be? the reaction of the polls tells one story and the reaction from democrats tells a different one. according to survey monkey released within the last hour, hillary clinton's six-point lead over donald trump remains virtually unchanged since last week even after the announcement. views of the issue break along partisan lines as you can imagine. just 17% of democrats view the

announcement as an important issue compared to 93% of republicans. 83% of democrats see it as a drakz compa distraction. those numbers seem to confirm what other polls have shown so far. a new "washington post" tracking poll found middle immediate impact in presidential support after james comey's friday no t announcement. they found there is not evidence that the revelations have drastically altered the contours of the election. you wouldn't guess they are stable based on the reaction from democrats. they signal a brewing panic over clinton's cant dasy. the campaign is attacking integrity arguing he bowed to partisan pressure. here's clirnt on with a lighter touch this afternoon. >> i'm sure a lot of you may be asking what this new e-mail story is about & why in the

world the fbi would decide to jump into an election with no evidence of any wrong-doing with just days to go. there is no case here. >> meanwhile the clinton campaign is aggressively looking to turn the page by going nuclear on trump. they unveiled an updated version of the 1964dr warning of a nuclear ka taft rofty. they are going nuclear in their own way. harry reid, the senate's top democrat sent a scathing letter alleging that through your partisan actions, you may have broken the law. this is an explosive charge. there is zero public evidence to support the argument and no evidence they took a direct

related actions or demonstrated personnel intent to impact the election in his official capacity. it's jarring in terms of reed who sang the praises this summer. [inaudible] >> no one can question the integrity and the competency of director comey. we want to dive in and i'm joined by clinton supporter patrick leahy of vermont and the top judiciary and of three senators who received this brief letter. we obtained a copy of it from the justice department. they said we assure you that the department will work closely with the fbi and together

dedicate all necessary resources and take appropriate steps as expeditiously as possible. senator, nice to be with you. i want to start with the letter you received. it was in response to a letter that you and other senators had sent this weekend. asking for more details. are you satisfied with this response? >> that's form letter five. that's like when you place a telephone call to a company and you want a question and they say your call is important to us. please stay on the line and listen to this wonderful music and the next available operator will be with you. >> wasn't it premature for them to say? >> there is the point. it's not just democrats who are concerned. it's democrats and republicans. look at the key republican and democratic members in the

justice department who raise questions why was the long standing practice of the justice department not to release anything like this within 60 days of an election? why was that violated? the former attorney general and a conservative republican said that and attorney general holder and former attorney general holder did. the attorneys general in both republican and democratic -- we should listen to the deputies earns general. and democratic administrations. this is not the policy of the differently justice. >> i want to turn to a letter from harry reid. do you as the top democrat who has oversight over the fbi want an investigation into whether or not the director broke the law as harry reid suggests he may

well have. >> i'm have not seen that letter. >> he said he may have violated the hatch act that bars you from tipping the scales. >> i will have to ask somebody who is an expert on the hatch act. i am not. i know two things. one, hillary clinton will be elected. secondly, this is a mess caused by mr. comey whether intentionally or not. by not following the normal practice of the department of justice. >> do you think he broke the law? >> i think it's incumbent upon him to clear up the mess. i have no idea if he broke the law or not. i'm not accusing him of that. let us know why you did not follow the procedure that both republican and democratic administrations have always followed on a so-called 6th day rule when you announced that we are looking at something. we want you to know about it and

you send that to all the republican chair men in the congress with copies to democrats. that is so strange that both republicans and democrats served said. the resolution is clearing this up as quickly as you can. we are looking at something and we don't know if anything is there or not. they have already gone through and spent thousands of hours and no criminal conduct by mrs. clinton and now he comes up with this. we are looking at somebody else's e-mails. and an investigation of mr. wiener. there may be something there that involves hillary clinton. we don't know if it's serious or not. we want to you know we are looking at it. that is why republicans and democrats have been so critical of this response. they say just clear it up.

that's all we are asking. >> one democrat who has not been critical is the president. they are describing comey as a man of integrity and said the president does not believe he is strategizing to benefit one candidate or political party. do you think he is intentionally trying to rig the system? >> i have known jim comey for a long time and always considered him a professional and a man of integrity. but even a person of integrity can make a bad mistake. he made a bad mistake by not following the normal procedures of the department of justice. procedures followed by both republican and democratic administrations on something like this not to be releasing -- especially if you haven't finished an investigation to be releasing it just before an election. >> do you think this threatens hillary clinton's chances to win

the election? >> no. hillary clinton will win the election and she should. look at who she is running against. a man who is not suitable to be president. >> what is the tangible impact? will it affect your colleagues in the senate or the democrats trying to take over republican seats? is that the biggest risk for democrats? >> i have no idea. i'm up for reelection next week. i assume it's not going to affect it. >> you are less vulnerable than others. there are other races. >> the four people running against me say i am terribly vulnerable and that's why they are running against me. >> fair enough. has the clinton campaign poisoned its relationship. if she is to win this election, she will have to work with the director, james comey. you heard it called unprecedented and suggesting the letter is overblown. what do you say?

>> mrs. clinton is a very professional person. i have seen her work very well with both republicans and democrats, including people who have been very critical of her in the past. as president she will try to do the same and knows that the country has been divided during this campaign. i suspect she will want to bring the country back together. that's what i would urge her to do and not to look for who do we get because of something they did to me, but rather how do we work for the sake of the country. >> let me ask you a final question in switching gears. republicans appear to be gearing up to block a clinton supreme court nomination if she does win. ted cruz said there is precedent for a court. will you be satisfied with that? your reaction to that proposal. >> they also said when justice scalia died that we never have a nomination hearing and a vote in

a presidential election year. we have done that 12 times and the democrats were in control of the senate. there was a republican president and we gave her a unanimous vote to the nominee in the final year of his presidency. it is politicizing the federal bench. the federal bench should be outside of politics. it is wrong and people agree it is wrong. not to have a hearing and if there are any other vacancies no matter who is president. >> we appreciate your time. we want to turn to the other side. i am joined by aj delgado who is a senior adviser. was it a mistake for donald trump and his allies to go after the fbi director so aggressively in the past? trump said it was part of a experience covering up clinton's

crimes. they called comey on the show a parasite on the american people. how can you ask voters to trust your judgment or trust the judgment of a man who you were going after for a lack of judgment a matter of days ago. >> he did err in what he did in july and a statement he put out with the litany of things hillary clinton did wrong and laws she broke and to say i am not going to recommend prosecution. we applaud that he is now seemingly doing the right thing. those two are not inconsistent. >> he said the information in the e-mails will be devastating. do you have evidence that would demonstrate that would be devastating? >> we are not claiming. we have evidence. >> he was claiming it will be devastating. >> common sense will you it will be. i don't think he would have acted in this way. >> even the director and the fbi

information said they are just beginning the review they had not started until last night and they made no public statements and acknowledged they could be duplicates or duds. would that be a huge concern for the american public. there is classified information on a weiener laptop? >> based on what? >> you have to ask them. >> loose likely. the fact that there is likely doesn't mean that. >> i don't believe there would be such an investigation going on. the reopening of the investigation if they didn't have reason to believe on the laptop and as an american voter, not as an adviser, i want to know if that's how badly she handled classified information and it ended up on anthony wiener's laptop. is that the person we are going to elect to handle the classified information? >> we have a right to see what's in the information.

>> in due course. as hillary clinton demands in the middle of this investigation, comey has no op obication to release this. >> they wanted a quick resolution to this. kellyanne conway said we are not going force their hand. they should take their time. the thought that the vacuum of information benefits donald trump better? >> there is no strategy other than respecting the process and the way it plays out. none of us has a right to say you need to let me know right now what you have on me. that doesn't exist in the political or investigative process of any kind. he will take his time to review the e-mails and his staff will in due course and we will find out what's in them. we are in this mess not as senator leahy said. we are in this mess because of hillary clinton lying and breaking the law and concealing the information. all to be so ironic and call are

for transparency. bleached e-mails and destroyed her staff and now she wants transparency? the irony is not lost on the american public. >> all the points drum makes on the campaign trail. what would restore your confidence and in director jim comey? >> i think we are seeing him do the right thing now. >> if he determines and in nothing changes, there was no recommendation to pursue the charges in the past if he is to come out and determine they didn't find information, would your confidence be restored? >> as a lawyer, i respect him, but i think he should have recommended prosecution. she broke several laws including code 1924 and how she handled the storage of it. and many others do agree. loretta lynch may not agree with me, but independents and democrats agree to hillary

clinton did break the law. >> how do combat charges of hypocrisy after the alleged conduct given the fact that news week said the following. trump's companies have destroyed or hitten thousands of e-mails and digital records and paper documents demanded in proceedings often in defiance of court orders. a lot of people may say that seems like the circumstance. >> i noticed that. this is silly, peter. those are from a private company that were not stored long enough. we are talking about e-mails concerning classified information that affect the safety of and you i and the viewers. how you can compare this is downright ridiculous and insulting to our intelligence. >> the bottom line, are you satisfied and is the fbi still rigged? >> i think mr. trump is being vindicated and the system whether you are a bernie sanders

likely voters. at the start of last week, the possibility of a democratic pave, but now not only is the control of the house more and more like a fantasy, they are back to looking more like a jump ball. we want to get to our panel. the deputy editor for "the washington post." robert is an msnbc contributor and senior adviser to george w. bush and senior washington correspondent for politico and all of those waking up early. to you quickly and the conversation with senator leahy. he said he is not worried about the chances of being elected, but this was a bad mistake by comey. a lot of democrats have been saying by redirecting the focus and trying to change the conversation to make it about james comby and not hillary clinton.

>> this was a pivot. the senator had a little bit softer language. harry reid went with a letter. they tried to push back and try wanted to hit donald trump and talking to him and talking about how comby is politicizing this and not about the fact that there is another scandal with the clinton campaign. >> let's talk about how this letter is helping down ballot republicans and the whole situation right now. they have been looking for a lifeline and they have a decent one. here's a look at where senate races are most likely to flip parties. how likely is it that the democrats can take control of the senate given what we have witnessed over the course of the last 72 or so hours? >> before the e-mail scandal broke, more than a 50% chance that democrats yield and now

less than 50%. does this just energize the republicans who may have been staying home because they were not satisfied by their nominee? a lot of republicans out there are not enthusiastic and donald trump is not your candidate. harrisburg and those are the supporters out there. and if they feel energized and pat toomey can get to the energiz energized it could help us.

i'm not sure it will be a landslide sweep, but i think it might be just a little bit of push to get republicans to the finish line. not at the top, but on the down ballot candidates. >> hillary clinton played this and i want to play part of what she said. >> i think most people have decided a long time ago what they think about all of this. now what people are focused on is choosing the next candidate and commander in chief of the united states of america. is she right about that? have they made up their mind about the issue? >> yes, but that doesn't answer the question or explain why the campaign is so upset about this episode which they obviously

are. a lot of people have already decided that they can't support hillary clinton because of the e-mails and a lot of people decided that whether or not they think it's serious they are going to support hillary clinton none the less. for that group of undecided voters and that group of voters that might just be so disgusted with the two candidates that they are staying home rather than hauling themselves to the polls to vote for a candidate they don't like could be problematic and it's not going to determine the out come, but it does have a bad effect. >> barbara boxer said it was a betrayal and do you think it has been a watershed moment? >> it was an october mistake by director comey. i have to say i am waiting for the november surprise. i really wanted to talk about the january fallout and the event that hillary clinton is

elected president. she will have to deal with james comey as fbi director. he has years to go in his term and presidents work with fbi directors different than than they used to. the fbi before 9/11 was law enforcement and now it's a counter terrorism agency and involved in the war on terror. this is not good for a relationship to start this way between a presint and her fbi director if she is elected. >> quickly on the idea of down ballot republicans and those who have been impacted and damaged. he said he advised clinton if she asked him and pitching himself as a bipartisan figure. a lot of americans will hear that as a shocking statement as one of the loudest voices against president obama for the last eight years.

he was nervous about his reelectability chances and this is coming prettyilate. there is eight days left. they basically said the numbers were the same. there hasn't been a big impact and if there is a drag on that and if republicans can figure out what the turn out machine is in terms of getting their base energized. >> we will check in with you in a bit. we were talking about the last time michigan went republican and it was in 1988. that was not ronald reagan. it was george h.w. bush who won the white house that year. the middle of the road strategy. will it be enough to help him hang on to his senate seat? we'll be right back on "mtp daily"

others have it 1345u8er and others have toomey up by a little. thedom line is that it's close enough that either can still pull it out and on friday i heard from one republican and one democrat, each with a lot of experience saying this is the kind of thing that shrimps the margin. given how close the senate race is. >> it will energize the republicans that may have stayed home. what's the stake? >> it could energize republicans or if it discourages democrats who may normally turn out as being concerned on the democratic side about trying to match the turn out in philadelphia in areas that came out for president obama. neither of these two candidates have a huge profile in the state. i think a lot will be tied to the margin. >> let me play a moment from the debate last week. >> this was pat toomey acknowledging the flaws and

laying out actions that trump would take as president that he seemed to like a week ago. take a listen. >> the dilemma is this. sdruchl a badly flawed candidate as i said, but if he were president, he would sign a bill repealing obamacare that we need and restore sanctions on iran which we badly need. there is this dilemma. >> does that count as an endorsement, the noncommittal position that plays with voters? how are they viewing it? >> it doesn't count as an endorsement because if you ask is he endorsing donald trump, he will say he has not endorsed donald trump and not real it out. the only person he ruled out endorsing is hillary clinton. he is walking the fine line and it's a challenge for a republican in pennsylvania of trying to appeal to the moderate voters without offending the people on the right who are in the rest of the state.

when i hear from people about the issue, i hear from the people who are trump voter who is are angry at him who i hear from the moderate voters. >> toomey has not com paped with trump and campaigned with four senators in the last week. senator cassidy as well. is is it a big deal that he would be a check and is that a winning strategy? >> he thinks it is and part of that is that we see that hillary clinton has her own popularity problems. he is trying to tell the voter who is may not like clinton if you vote for her, you can cross over and vote for me and we will have balance next year. that's really his hope and his path to victory who depend on getting the cross over voters. even with the e-mail issue, most people think she will win the state and he will need her voters to cross over to support him as well. >> part of the reason why he is quoting ed rendell. appreciate your time. still ahead in the headlines

no audit on this. they don't make decisions that fast. not before the election. >> you will not see donald trump's tax returns. it's one of the huge headlines after the comey bombshell and that brings us back to the lid. ruth marcus and robert train ham and robert palmer. let me start with the trump campaign slamming the clintons for transparency, about but we will not see tax returns. could this set a new precedent for future campaigns? >> i hope not, but i think it already has. this is a terrible development and a really good question when they are due. he professes to want to give them and a different excuse. that's the story that has been under covered every week. it's especially that voters and

reporters who have the capacity to plow through them get to see the tax returns and i wonder if we don't need a law so we don't have this in the future presidential robert, curious yo this. it's donald trump who's been doing the plowing through, basically plowing through the questions from reporters, suggesting that president presidents suggest that he should be providing this information and transparency, ultimately would answer a lot of questions. >> peter, i think everything about this presidential campaign is going to get tossed out the window in terms of precedent. i do not think that future presidential candidates will abide by donald trump's wishes, if you will. i think that future presidential candidates will continue the 40-year-old tradition of releasing their tax returns, even if they are under audit fwhkding richard nixon, who was under audit 40 years ago. everything about donald trump is so unorthodox. i think come the 2020 presidential cycle, when we get there, i think there's going to be a reset but tton on so many different things in terms of transparency. and lastly, i don't think there

should be a law about this, but with all due respect to everyone out in the media, including myself, we didn't fact check enough about donald trump during the primary process, so again, i do think we're going to have a reset button here. >> the fact checking on charitable giving, there has been a lot of yeoman's work done about this, david fahrenthold at ana's "the washington post," has led the way on this issue. but it's challenging, we all concede, without tax returns, that would resolve all of this stuff right now. nonetheless, the sort of magnum opus by "the washington post" over the course of the weekend, another story that has been in some ways oversthhadowed here, demonstrated another story that donald trump sort of boasted about and hyped up his charitable giving, but there's no proof that much of it ever occurred. >> absolutely. i think this is one of the most undercovered stories of last week, and certainly, david fahrenthold of "the post" has been doing the work day in and day out, and sort of digging, that takes a lot of time and

effort, even if you did have the tax returns, but since he doesn't, you have to really be an investigative journalist. and i think it's one of those things where he says he's doing all these good works in terms of donald trump sayingti ining i'm to these different charities and doing all these good things, but when it comes down to it, he's done none of it. and that's something we would be talking about a lot more if this fbi revelation and the comey investigation wasn't released. >> according to the report, trump's biggest ever gift was used to renovate a fountain outside the windows of trump's plaza hotel. what do you make of this story and what it says about the republican nominee? >> convenient, isn't it? if you were asking me, look, i think david fahrenthold's reporting has been phenomenal, all along about the absence of charitable contributions by

trump himself. the use of other people's money to donate in the name of his charity. and the apparent misuse of charitable donations, including for political contributions and to pay legal settlements to settle cases against trump or his properties. so this was just the culmination of that. and it was overshadowed, unfortunately, so, by the comey news, though, for obvious reasons. >> and robert, your thoughts on this, as well? i want to get your take on this. obviously, transparency, we traditionally say, can only help somebody. in this case, the opposite may be his best asset. >> yeah, there's no doubt about it, there's a lot of head scratching when it comes to donald trump's foundation. a lot of head scratching when it comes to, how come we weren't talking about this during the primary? i assume that the 16 other people that were running for president on the republican side were doing some opposite research on their opponents on the republican side. and how come this stuff wasn't leaked out back then? i guess my question simply is, i

think mr. fahrenthold has done a financial job of covering this stuff now. but how come we weren't talking about this and uncovering this stuff a year ago, when, in fact, there were a lot of people out there that were saying, this man is not qualified to be president. how can this be, that he continues to make these insinuations out there and there's no fact checking? that's my question. >> one other insinuation donald trump has made is that the system is rigged. he points to what happened most recently at cnn, courtesy of wikileaks. today we're learning there's a new e-mail that suggests that the interim chair, donna brazile, may have been providing on a second occasion a question to the clinton campaign to take place at one of their forums that happened in flint, michigan. it's worth noting, donna brazile tells nbc news that she denies this the ever took place. cnn says it was uncomfortable with what we have learned about her interactions with the clinton campaign while she was a cnn contributor. they accepted her resignation as a contributor on october 14th,
