a black man in the back. but the family of walter scott says it's not over. ♪ good morning. it's tuesday, december 6th. i'm ali velshi alongside louis burgdorf and casey hunt. unearthed recording shedding new light on a history of investigations into the oakland warehouse where at least 36 people were killed. following one of the deadliest u.s. building fires in the last half century. at the time of the blaze, a probe of the facility was still pending as the city dealt with a complaint alleging an interior building structure, illegal interior building structure. the warehouse had been converted without permits into an artists' collective dubbed the ghost ship. the latest complaint was one of at least ten against the site

since the current owners bought the property in 1997. that's according to city records obtained by nbc news. despite the series of complaints, the warehouse remained open and as the death toll climbs following friday night's fire, the alameda county district attorney announced yesterday that it is still too early to determine whether criminal charges will be filed. she said possible charges could range from involuntary manslaughter to murder. the city has also released the names of ten more of the victims of the warehouse fire. as we learn more about the lives lost, among those confirmed dead are 31-year-old jennifer tanaway, 25-year-old nick hall, all from california. the couple that run the warehouse derrick almana and wife allison discussed their decision to leave the facility before the dance party that took place on friday night. >> that night i was just exhausted.

exhausted. i wanted to get my kids out of there and i said to everybody, everybody's got this, right? we lay our heads down every night in this place. there's no way we would have invited anybody in there without feeling like we were inviting them into our home. and it was our home. >> emotions over this warehouse fire boiled over during a vigil for the victims last night. people gathered for a candlelight ceremony. they began to shout down the city's mayor, libby schaaf, with boos and calls to resign. schaff base faced backlash after she addressed code violations in the wake of the blaze rather than discussing the city's shortage of affordable housing. president obama has offered his prayers to the victims' families and the city and has promised full cooperation from federal agencies. vice president biden isn't ready to shut the door on his political career just yet.

whatever the case may be, the call broke nearly four decades of diplomatic precedent in america's relationship with china. nbc news confirms former republican senate leader bob dole arranged the call with taiwanese president tsai ing-wen. "the wall street journal" reported it saying the controversial call went beyond pleasantries and included a discussion about china and the stability in the region. sourcing a person familiar with the conversation. on friday trump emphasized the point that the president of taiwan "called me." while vice president-elect pence said the call had no policy implications trump slammed the chinese government for manipulating their currency over taxing american products and for military buildup in the south china sea. meanwhile former secretary of state henry kissinger will meet with the president-elect at trump tower today. kissinger's the original architect of the u.s./china policy, just back from a visit with beijing where he met with president xi. yesterday he spoke about how the

chinese viewed trump's call. >> at this moment, i've been very impressed by the calm reaction of the chinese leadership. which asserts a determination to see whether a calm dialogue can be developed. >> kissinger also said that the u.s. opening up to china has always been based on the premise of a one-china policy. former vice president and climate activist al gore met with donald trump and his daughter ivanka at trump tower yesterday. didn't want to go into detail but gore placed ivanka's commitment to the issue of cly the mat change. >> the bulk of the time was with president-elect donald trump. i found it an extremely interesting conversation. and to be continued.

sources say former governor jon huntsman is not in serious contention to lead the state department and never was according to sources. they also say retired general david petraeus is no longer a serious candidate either. former new york city mayor rudy giuliani is fading as a candidate for the nomination as well. sources with knowledge of the president-elect trump's thinking say that the transition team search for a secretary of state is wide open with his former rival and 2012 republican nominee mitt romney back at the top of the list. trump will be meeting with exxonmobil ceo rex tillerson at traur. sources say the president-elect is intrigued with his vast knowledge of the world. once primary rivals, donald trump is nominating ben carson to be the secretary of housing and urban development. trump brutally mocked carson on the campaign trail, but the neurosurgeon turned into one of his top surrogates. and even after it emerges that carson was the top choice for the job at hud, it wasn't clear carson actually wanted to take the job. in november, armstrong williams,

his business manager, told "the hill," "dr. carson feels he has no government experience, he's never run a federal agency, and the last thing he would want to do was take a position that would cripple the presidency." pretty strong words. williams yesterday doubled down and said even though it was carson's preference to stay in private industry, he had been called to serve. >> he has a lot of technical experience in areas in housing. he understands much more than you can imagine about finance and zoning and tax laws and banking policies, urban planning, and anti-discrimination laws. dr. carson's position was that he preferred that mr. trump could find someone that could fit the role of what he wanted, he would have preferred to stay in private industry. but that's not what mr. trump wanted. he wanted dr. carson in his cabinet and he's going to have to serve. >> as you might expect carson was something of a controversial choice.

although house speaker paul ryan called him "a shining example of overcoming poverty" and head he will psaid he will put the focu on dignity rather than dependance. senator lindsey graham called him "guided by strong conservative principles." senator mcconnell said little about carson's qualifications and democrats were much more direct. nancy pelosi called him "a disconcerting and disturbingly unqualified choice." chuck schumer said, "someone who is as anti-government as him is a strange fit for housing secretary, to say the least." senator sherrod brown of ohio said, "cities coping with crumbling infrastructure and families struggling to afford overhead can't afford a hud secretary whose spokesman said he doesn't believe he's up for the job." after a month-long trial which included testimony from 55 witnesses the prosecution of michael slager has ended.

missed opportunity to remind the good officers that put on that badge that they aren't michael slager. he may have delayed justice. but he did not escape it. we all saw what he did. we all saw what happened. >> slager will also appear in federal court next year on civil rights violation charges. a pennsylvania judge has ruled that damaging testimony bill cosby gave in an accuser's lawsuit can be used in his criminal sexual assault trial against him. the 79-year-old acknowledged in the 2006 deposition that he had given young women drugs or alcohol before sexual encounters. a former temple university employee andrea constand says she was drugged and molested and hers is the only criminal case against cosby. he has denied any wrongdoing and has called the sen countencount consensual. prosecutors are hoping to put up to 13 of cosby's accusers on the

♪ welcome back. i'm ali velshi. wake up, shake that sleep out of your head, your eyes, i'm here with louis burgdorf and casey hutt. it is the bottom hour. let's start with this morning's top stories. prosecutors in south carolina plan to retry the murder case against michael slager after the jury deadlocked and the judge declared a mistrial. there were signs that the jury was having trouble reaching a unanimous decision when a dissenting juror sent a note friday saying they couldn't convict the defendant without a reasonable doubt. video from april 2015 shows slager shooting walter scott multiple times in the back.

slager claims he was in total fear of his life and he shot in self-defense. the georgia father convicted of murdering his son by leaving him in a hot car has been sentenced to life in prison without parole. last month a jury found 35-year-old justin ross harris intentionally left his 22-month-old son cooper in his car for hours while he went to work. the prosecution argued harris left his son to die to free himself from parental responsibility. and a spokesman for the prime minister of japan says shinzo abe will not apologize for the attack on pearl harbor when he visits the hawaii naval base later this month. abe will become the first sitting japanese prime minister to visit pearl harbor coinciding with the 75th anniversary of the attacks that brought the u.s. into world war ii. now you'll remember president obama became the first sitting president to visit the hiroshima memorial earlier this yearmarking the 1945 nuclear bombing that resulted in japan's

surrender. he also didn't apologize. unearthed records shedding new light on a history of investigations into the oakland warehouse where 36 people were killed following one of the deadliest building fires in the u.s. in the last half century. a criminal investigation is open and it's possible charges will be filed. but the alameda county district attorney says it's still too early to say what will happen. nbc's stephanie gosk has more on the conditions that played a role in this tragedy. >> reporter: as firefighters continue the grim search for remains, anger builds. how did this happen? who was responsible? documents obtained by nbc news show nine complaints against the property since 1999. including two as recently as last month. citing a ton of garbage piling up. an illegal interior building structure. officials say they were looking into it. >> we had an inspector attempt to enter the building. and at that time was not able to secure access to the building. >> reporter: the warehouse was

not supposed to have residents but it had dozens. including nikki kelber. she says there were rules. no candles, no smoking, and concerns about fire. >> if your ideal situation is living in a warehouse versus living on the street, you're going to live in that warehouse. >> reporter: john is a retired san francisco fire captain. he says fire inspectors can get overwhelmed in a city like oakland where real estate prices have led to unofficial living space popping up all over. in a place like oakland that's a big job. >> it's a huge job. the single most important thing isn't the inspection itself, it's the follow-up. >> reporter: the owner has not been seen in public. records show she opens at least eight properties in the county. in a statement the family says, we are also trying to figure out what's going on like everybody else. we're sorry to hear about the tragedy. our condolences go out to family and friends. the couple who ran the property say they are being unfairly blamed. >> a lot of people have turned their backs on us.

there. investigators say the theory has been proven to be a hoax. the judge has ordered welch be held until a preliminary hearing on thursday. donald trump returns to north carolina today. it's the second stop on his thank you tour of america. while general james mattis is expected to be introduced as his choice for secretary of defense and we're expecting more announcements this week. mattis' confirmation means that congress has to pass a waiver because civilian control of the military requires seven years out of uniform before he's able to take the job. house leaders are thinking about adding a measure to an upcoming spending bill to make sure mattis' confirmation doesn't hit speed bumps. meetings are continuing in trump tower to fill the thousands of administration jobs that are going to be open. yesterday what's known as the plum book was released online. it's a purple book with 9,000 job listings. you can read some of them at greatagain.gov. one of the people who could be looking to fill a cabinet position, democratic senator joe

manchin of west virginia under consideration for energy secretary. he talked to trump saying he was "humbled and honored" to share his views with the president-elect. manchin has at times been seen as a flight risk from the democratic party. he as moderate democrat from that state. hill democrats are also concerned trump may try to appoint senator heidi heitkamp of north dakota to an administration post. her seat would be filled by a republican governor and could weaken the democrats' stronghold in the senate even further. new york city mayor de blasio is asking the federal government to help cover the cost of keeping president-elect donald trump safe as he prepares to enter the white house. the mayor announced he sent a letter to president obama seeking $35 million. the money would help cover security between november 8th and january 20th when donald trump officially takes office. since last month's election, there's been an nypd detail at

trump tower where the president-elect has been working on his transition. it's still unclear how much it will cost new york city to protect the president-elect and his family after inauguration day. his wife melania and their son barron plan to stay in manhattan until the end of his school year at least. one of hillary clinton's top allies david brock is calling for an independent audit of the democrats' effort in the 2016 election cycle. while speaking at a conference of democratic lawmakers and liberal organizers yesterday, brock took the party to task over their performance this fall. at the same time, he also urged restraint. >> so how did we get here? what on earth happened? it's essential that we in the democratic party resist the impulse toward hyperbolic reactions and knee-jerk overcorrections. everyone needs to take a deep breath. we need to proceed cautiously and not rush to issue overly broad indictments of our party's candidates, messages or strategies. democrats aren't suffering from

an identity crisis. but the truth is our party does face a crisis of competence at all levels. progressive politics in america is an organizational disaster. we can't have a coherent or effective roadmap forward unless and until we have a mutual understanding of what happened last cycle and an accepted conclusion of where we can do better and how. >> brock urged his party to move forward and organize saying they cannot afford to waste time. a republican member of the electoral college from texas says he will not be casting one of his state's 38 electoral votes for president-elect donald trump. because, he says, trump "shows daily that he's not qualified for the office." in an op ed for this morning's "new york times" christopher suprin writes "the election of the next president is not yet a done deal. electors of conscience can still do the right thing for the good of the country. i owe no debt to a party.

i owe a debt to my children to leave them a nation they can trust." suprin is a paramedic who was one of the first responders who rushed to the pentagon on 9/11. he wris trump lacks the foreign policy experience to serve as commander in chief and does not encourage civil discourse but chooses to stoke fear and create outrage. the electoral college meets on december 19th. nearly a month after election day, north carolina governor pat mccrory has conceded defeat. as of now democratic challenger roy cooper leads by more than 10,000 votes according to the state election board. and yesterday mccrory had this to say. >> during this wonderful season, it's also time to celebrate our democratic brothers and respect what i see to be the all-time outcome of the closest north carolina governors race in modern history. despite continued questions that should be answered regarding the

they are using high-tech sensors and artificial intelligence to skip that checkout line altogether. because they're allowing you to use a phone that you can scan on a kiosk when you enter the store and then an app automatically detects what you are buying. and then it sends the bill directly to your amazon account. so you don't even have to wait in pesky lines. right now this is being tried out in that concept convenience store in seattle which is currently just open to employees, but reports in "the wall street journal" suggest there could be at least two other formats tested including a larger store and pickup points for your groceries and other items. and overall they say amazon could envision more than 2,000 grocery outlets so look out for developments there. elsewhere in tech, youtube, facebook, twitter, microsoft teaming up to weed out extremism on their sites with so-called hashes that in effect are digital fingerprints on videos and photos flagged as extremist and then removed.
