of this? >> to be clear right now, the white house is lurching from one crisis to another. a memo kept by james comey. we're told he kept memos after every phone and in personal conversation -- person conversation he had with the president. this one says the president asking him to back off of the investigation of michael flynn. the white house is pushing back on that vigorously. they say it is not truthful or accurate. they say at no time would or has the president doesasked for an investigation to be shut down, but it was striking in a conversation that i had here earlier today, they did not deny the memo exists, but they say this is simply the way the president speaks. not that he was trying to shut down an investigation, but he

was trying to express his personal affinity to james comey for michael flynn saying don't pile on her, and they are trying to push back the idea that james comey sat on this information saying if he had it for so long, why didn't he communicate it to the acting fbi director who testified about this last week saying tlfls here was no effort impede the investigation. was he keeping memos because he was trying to write a book or advance an investigation? >> a quick question about the fact that netanyahu spoke with the president, is there any readout yet on that important conversation as the president did reveal classified information to the republicans. >> the white house has publicly not provided any readout. it was a senior aide here who confirmed to me it was a

takers, but did he notes from that meeting. >> but when i was a child i believed in the tooth fairy too, but i assume they made a full recording of it. but it's just like the president kept the american press out of his meeting because he did not want to be seen with the ambassador after all of his meetings with the leading to the firing of general flynn. he says even though i was under oath, i gave you the wrong facts, so they did not want american facts in there. you saw it on every single newspaper in our country, they shipped that around the world. again, it's a case, amateur hour at the white house, and the

but that's not how we do it in america. we have to come back to american values. >> thank you so much, senator, i know you have to go vote. thank you for taking time to be with us. now let's take a deeper dive into the legal issues. justice and security analyst matt miller who served as chief spokesman and pete williams, our own correspondent. thank you, both. let's take a big view now, take a step back, there is a lot of murkiness about this. we know what james comey has supposedly written. we have not seen the memos ourself, neither has the "new york times," but they were read in part to the reporters of the "new york times." a lot more questions to be annalsed. >> they will want to see the memos, talk to mr. comey. they asked him for any other memos he wrote about his interactions with the president. we'll see how the government responds to these. if there is an assertion of privilege or if they just turn

them over. but there are all of these requests now for him to appear. since he was fired he made the decision not to say anything in public. he already said no to one request to talk about the russia investigation. i don't know what his response will be to this one. i know he is eager to tell his story at some point whether he thinks this is the point now or if he wants to wait till later i don't know yet. >> you were predicting last week there would be memos because of the way fbi agents and career people operated. it is to write a memo after something this critical. why did the president, you think, is there any way town fer from what the president did asking attorney general sessions and others from the justice department to leave that meeting.

rob rosenstein i guess it was, to leave that meeting and speak one on one with james comey. >> it is a very good question and if a prosecutor was going to make an obstruction of justice case, that is one thing that you would say the president was trying to conce his acons. he knew what he was doing flwas inappropriate and he didn't want any witnesses. we're going to see what jim comey's take is on this. we know there are other memos. is rod rosinstein and state's attorney general sessions going to allow these to be turned over to congress. i think the political pressure in this instance, given this goes to personally a hugely inappropriate act by the president, i think it will be very difficult for them to assert those privileges.

>> and they proceeded that critical offense meeting and it was the day after mike flynn was fire fire. >> i think the first respond is to resist turning it over to congress. the justice department hates to share with congress and they never like to change that long standing thing. they may may put up a fight. i suppose in theory they could also exert sective privilege. and the question is suppose the conclusion is that the president did obstruct justice. and there is a wide divergence of the lawyers and the prosecutors that prosecuted these cases about whether or not

there is, a lot of it has to do with the president's intent, and they may be doing it for this guy that got canned. so it will be up to congress and it is the longstanding view that you cannot prosecute a sitting president. >> it becomes a decision for an independent council or more likely a commission if they go that route. >> as pete says, a sitting president cannot be diindicted. the final decision on that is the supreme court. but i don't think the way it is currently constituted will bring a case against the president. it is the only thing in theory you can see a special prosecutor bringing. it is the kind of thing you would see from congress. i think one of the questions that people asked about jim

comey, why didn't he tell the president this is inappropriate. one of the unanswered questions is whether or not jim comey was trying to build an obstruction of justice case against the president. if he thought the best course of action would be to record them in case they were useful. probably not in a criminal indictment, but to turn them over to congress in impeachment hearings. >> does that create motivation questions about his impartiality. >> they didn't want to get involved because of how it may affect them. >> coming up, fight or flight? are republicans digging in to back president trump or are they ready to break ranks.

former intelligence committee invited james comey to testify in a open hearing. it including a memo -- >> joining me is mark warner, can you tell us what you're hearing back from comey. why has the meeting not happened yet. >> i think it is very understandable after the week that jim comey had last week. that he wanted to take a few days to clear his head, and i have a high level of expectation, high expectation that he will appear before the senate in an open hearing and tell his viside of the story. but i think that the real thing that the american public wants to hear is they want to hear from jim comey and they want to hear from him in an open

hearing, and the senate intel committee, as long as he gets a chance to make his case. >> if this becomes a he said he said because there was only two people in the room, how do you get the white house's version of what happened, how do you find out if there are white house tapes. >> let's go way back to last thursday and friday when the president changed his story about why comey was fired, because of the activities with the investigation of hillary clinton, and then the president said there may be secret tapes, and the white house refused to tell anyone in the pss if the tapes exist or not. if a president has secret tapes, that normally does not end up in a very good spot.

we will continue to pursue that. then, this week the president may have relayed inappropriate information to the russians, and there is a question of or trans that meeting? and now we have in the last 24 hours indications that jim comey, and this is very believable about jim comey, after he had any meeting would take meticulous notes. i believe if he took notes that were coincident with that alleged meeting with the president, and they are anything close to what the press has reported, then we have really broken into a new realm in this whole investigation. . >> have you asked andrew mccabe, the acting fbi director, for those memos? >> we have asked him for those memos and any other documents he may have relevant to exchanges between comey and the president and relevant to our russian investigation. >> have you asked the white house for any tapes or any

notes? >> we are in the process of trying to find out whether the white house has any of those documents or tapes, as well. we have not -- i don't believe we have yet formally requested that. but that will be in process shortly. >> the meeting that this refers to happened the day after mike flynn was fired. do you have concerns that the president, after a national security meeting, a homeland security meeting, asked the others, including the attorney general, to leave and met one on one with james comey, was that appropriate? >> andrea, we have seen throughout this investigation a series of dots that seem to be connected. or i've used the analogy a lot of smoke. whatever analogy we want to use, i want to give this president and the white house the benefit of the doubt. but that benefit of the doubt only goes as far as them being forthcoming with tapes, with transcripts, with the truth.

and so far at least we have -- i'm not sure we have gotten the full truth, at least from the white house. >> whom are you dealing with in the white house, the general counsel? >> chairman burr has had a number of conversations i know with the general counsel. but i'm not going to get into the particulars between the committee and the white house. >> you met with the deputy attorney general rod rosenstein who is handling the russian probe because of the recusal of the attorney general. you met with him last week along with senator burr. did he give you assurances that everything is going to proceed and be above board? >> well, i'm not going to comment on the specifics of that private conversation with the deppky attorney general. i do know he's coming back tomorrow afternoon. and a whole lot of members -- every answer doesn't necessarily have to be classified -- are going to ask him the same questions i asked last week and they'll make their own judgment about how tainted or not he and

some of the other people who have been affiliated with the trump administration may be in terms of overseeing this investigation. one of the things that didn't get that much attention last week was that acting director mccabe, a career guy at the fbi, said that the fbi will not succumb to political pressure, that they have put all the resources needed into this investigation, and they're going to follow the truth, no matter what. >> how do you roncile mabe saying there has been no interference in the flynn investation with the comey notes and memos, which indicate his concerns that there are interference from the president himself? >> well, that's one of the things we need to ask jim comey. but it could clearly be the case that acting director mccabe may or may not have been aware of the comey memos. but i'm going to trust -- again, i'm going to trust acting director mccabe until i can't trust him. so far he's been a straight

shooter and he seemed to have steely determination that he and the men and women of the fbi are not going to be intimidated and follow the facts. >> general mccaster said everything the president told the russians was appropriate. how do you reconcile that with the fact that the white house is continuing to ask "the washington post" and others who have information about that classified source not to public everything that we know? >> to me, it seems very curious to say the least, that there's still attempts from this white house to rein in the press from publishing all the information that the president relayed to the russians. what makes it further outrageous is you have russian media in that meeting but not american media. and now you have vladamir putin in what is frankly an insulting gesture offering to provide

russian intelligence about what took place in that meeting. as if anybody in this town, democrat or republican, would believe that. >> do you think there's any possibility that they bugged that meeting? >> andrea, a week ago i said i didn't think there was anything this administration could do that would surprise me. and then they fire jim comey. so i'm not going to say -- i'm not going to speculate on what may be in the realm of possibility or not. i know that normal administrations are very careful about what kind of cameras, other devices are taken into the oval office. but i'm not going to speculate. i do know this, if there are any kind of transcripts out of that meeting, ultimately we in congress are going to have to take a look at it. >> you've got a lot on your plate. thanks for taking a moment to talk to us. thank you.
