leaving devastating floods and destruction in its path. one death so far. harvey continues to move across the gulf south as officials warn the worst may not be over yet. >> our biggest concern is the possibility of between and 30 more inches of rain in areas ranging from corpus christi over to houston. >> and as the white house coordinates the federal response, another storm, if you will, brewing on capitol hill after some controversial comments and orders from the commander in chief. we'll have all of that. but we're going to start in texas where tropical storm harvey now is continuing to barrel over the state after making landfall overnight. and so far we know that one approximate earn is dead and at least 12 more are injured. harvey is now packing 70 mile per hour winds a decrease from it'll dangerous 130-mile-per-hour gusts that we were seeing just hours earlier.

search and rescue missions and cleanup efforts are already beginning if parts of the state but officials are warning residents in the area stay safe and stay alert of the rising water levels around them. let's go now straight to victoria texas where is the city is now under a curfew until 6:00 a.m. sunday morning. nbc's catie beck is on the ground watching the latest for us. and catie, really that center, one of those eyes. you standing by some of the devastation right now. >> reporter: absolutely, richard. the devastation can be seen very clearly ner no downtown victoria especially behind me. a carobousel here on a 45-degree angle and that is because a tree was uprooted next to it on the sidewalk and took the car with it. dounld trees are pretty much everywhere here in victoria as well as power lines. you have to be very careful when you're maneuvering the streets because if the streets arpt covered with water, their covered with debris and with trees. joining me now is dee wheeler

she is a neighbor here on this street. you had some pretty extensive damage to your home. >> yes, we did. we had a hundred year old pecan tree fall at the roots across our backyard and into our house. >> were you somewhere state of at the time. >> we were in our base. we have a storm cell ar. >> it's been very, very windy. the winds were unbelievable. we were sitting out there just listening and i know we heard some tornadoes too. so it was pretty scary. >> this house a sentimental value to you. you're saying this is your father's grand mother's house and you were down in the storm cellar. >> we were. and the thing is my husband and i both went through car la so i was five and he was six and so this is the second really category 4 storm we've been through. so pretty nasty. >> it's stuff. it's tough. what is it like inside? you have no power.

are you playing card games? what are you doing. >> actually, right now i was just telling the guys here, i'm charging my phone in my car. it's running in my garage so we can have cell phone power. but otherwise, we're just in there with flashlights and plenty of batteries food and water and everything that we did to prepare. >> are you worried about the next couple days, dee, what's going to happen with this rain. >> yeah, i am. we're lucky because we've got a friend that's bringing us a generator, so we're going to have a generator tonight that we'll be able to at least keep our food and our freezer running. >> thank you so much for sharing that with us. you stay safe and dry and thanks for braifg the elements to talk to us. >> thank you. >> we're going to keep an eye on the conditions here. rain still coming down. not as windy as it was but the flieding is going to continue. >> what does it look like on the floor and the area around you i see some standing water and the

concern of flooding. what are you seeing this? >> yeah. this is not one of the more flooded yargs we've been to today. we have been to areas where there's 12 to 20 inches of water. here on the ground you can see this is just mostly debris. the problem with this debris is it clogs the storm dranls. so on the streets that are really flooded, the debris has clogged the storm drains and then when the water starts to flow it has absolutely nowhere to go. and obviously there's a lot more rainfall to come. so we do expect this flooding to continue. >> thank you so much, catie. we'll be watching, of course, all of that happening literally on the ground with all the water and the saturation there. and we'll get back to you a little bit later in this hour. now to some brand-new video showing a tornado in cypress, texas. tornadoes, that or layer of did he have station. this along the middle and upper texas coast. now let's go just south of where

that tornado happened to rosenberg, texas, an evacuation order was just issued there. nbc's stephanie gosk has been covering harvey for us all throughout the last couple of days. what are the knlz you're seeing there now? >> hey, richard. well, right now the rain has let up for the moment. it's going to come back. i'm standing right at the shore of the bros us river and it's actually the eleventh longest river in the country for a little bit of trivia. right now it's looking pretty dos i'll and officials in rosenberg say don't let that fool you because this river rises quickly and flooded last year, flooded the year before that. and today they were meeting in a council meeting and they were discussing, looking at the levels of the river, watching it rise. and they decided that they needed to change their voluntary evacuation order to a unanimous to her evacuation order for neighborhoods along this river

because now they're certain that it's going to rise and rise significantly and quickly and could be very dangerous for people. but you can see a little bit of what their difficulty is right now, just looking at where i'm standing, looking at the fact that it's not raining here. the river is low, and they are going to peoples homes and saying pack up all your stuff, there's a risk, you have to get out. tough to convince people to do that when they see a storm that's now tropical storm. they see the winds have died down and they think, oh, maybe the danger has passed. their message, the message that is being passed around to people who live there is this is still a dangerous storm and they are in the path of it. richard. >> stephanie gosk not too far outside of houston. one of the concerns flooding. the other tornadoes. and the houston area being right in the heart of that throughout the last 24 hours. thank you so much. meteorologist shanna mendiola also tracking the storm. we had the latest report coming out from noaa the hurricane

center just an hour ago. for those of us just joining us what are some of the taking a ways in terms of the changes hoouf seen coming out of this houston area. >> we've seen those tornado warnings in effect. you see the outer bands of the circulation are driving it a lot of that moist subtropical into those areas like houston and also looking at this all around storm, not moving at all. so from the last check that we had in the positioning, it's not moved. it's stationary. and it's going to go over those same areas for hours and hours on end, and not only that, days on end. so we're talking about a lot of rain on the way. 45 miles northwest of victoria right now is where the center of circulation is and the heaviest part of that storm will be in the northeastern portion of the hurricane, which was a hurricane. now a tropical storm. and again, i think a lot of people are kind of misled because they hear tropical storm, it's weak end, but still the wind is what has gone down. but the rain threat is still going to be up. we're going to watch for that flooding as well. now, the new track shows it

going south as we head into monday. then it goes north all the way through wednesday of next week. the concern with that is the storm is not moving because there's nothing to move it along. we've got a high to the west and a high to the east as well. and with that it's sand wichg harvey right in the middle. there's no steering air to really push this storm along. so for the next several days all the way into next weekend we're going to see rain. so devastating flooding is the biggest concern right now, richard. >> appreciate that. and of course we'll get right back to the breaking news on the ground as well as what shanna is watching from the sky in terms of harvey. but as this was happening, as the news was coming out about harvey, there was also news coming out of washington as well. it was quite the friday night news dump yesterday. the white house removed embattled trump aid sebastian gorka just days after the departure of steve bannon.

the president fulfilled his promise of bang transgender recruits with an official memo. that also cut some health care coverage for active tut transp gender troops. the president pardoned controversial sheriff joe arpaio. he was convicted of ignoring a court order that told him to stop arresting undocumented immigrants. that pardon marching immediate protests with elected officials and latino advocacy groups. congressman roux bin guy yeah goe from arizona. representative, thank you for being with us and you were on the rachel mad dough show yesterday and you were very clear about what you thought this meant and what it meant for this presidency. a day later what are you thinking? >> well, a day later i still am at the same position, that this has been a total misuse of justice. it is a slap at the face at the history of the pardon. and i also think that this is the president trying to lower

the bar for pardons so that he can turn around and start essentially pardoning his krone i didn't see and family members that may been involved in whatever type of collusion with the russians. >> so you believe this is some sort of messaging, that potentially those who are involved with the on going investigation with robert mueller who might be convicted in some way is a message to them? is that what you're saying. >>ible it's a message to them but i also believe in general it's trying to set the precedent that the president will pardon people without going through the proper stems. that's one of the strangest things about this is the president didn't go through the normal routes in terms of issuing the par. there was no recommendation from the department of justice. not only that but joe arpaio had not been gone through sentencing yet. normally when it comes to pardons, there's been a time when people have been pardoned after they sevld their time or they have served their time and it was a total misuse of

justice, for example, people thrown in jail on bad dna testing. >> go ahead, please. >> well, the president stemmed into the middle of a judicial proceeding to pardon sheriff joe arpaio? why did he do that? the president doesn't care about him. to apiece his racist zbleen ohphobic base. two get the media and the public ready that he can just issue these pardons without there being a proper adjudication of justice, particularly when it comes to what i think is going to happen in regards to his family and other people involved with the trump administration. >> and that process as you were beginning to describe, i was just going to jump in and say you normally serve time in prison, you wait five years, you then apply, you then have a review by the justice department office. it's a long, long process. and there's no request in this case. he did not ask for it, at least by what we understand right now in terms of confirmed reports.

so, then, what does this mean for the judicial process going forward? what does this mean for that important third branch of our government that in this case two republican senators said you shouldn't have short circuit it. what does it mean for their processes going forward? >> well, for one, it actually is going to be debtry mental to a lot of people that are the prosecutors in the democraticpaf justice because if you go through the proper stems, especially these elected officials, now the precedent has been set that all you have to do is be friends or be a good supporter of the president and you will end up getting pardoned. and it is difficult to go after corrupt elected officials and it's even particularly more difficult to go after them when you know that you're not going to have the political back up at the end of the day after you put in all this effort. let's remember how this actually all occurred. the reason why sheriff joe arpaio is where he is because he actually signed a department of justice decree saying he would no longer racially profile

americans and then after that he went and violated for two years that same agreement and in addition tow that, then he bragged about it and then tried to investigate the judge who was trying to enforce it to intimidate him. so this person is not at all a good actor. this has nothing to do with immigration. this has to do with the fact that there was an abuse of power that happened. the department of justice tried to keep this person in check and donald trump just basically went and just backed him up. and it doesn't surprise me. you know, the rule of law exists for everyone but donald trump and his krone i didn't see. and that's the exactly the message that's being sent out to citizens today in arizona and to all these democratic of justice prosecutors who are now fwg to be looking over their shoulder whether or not they should be actually prosecuting political corruption or other politicians because you don't know if you're going to end up going -- you know, getting backed up by your own administration. this was a three to four year investigation that the democratic of justice conducted that just got wiped out. >> and finally, quickly, you

called the president racist yesterday. do you still stand by that statement? >> well, in my defense, i've calling him racist for at least a year. so this is not something new. and absolutely. this is just a further proof of where we're at. this is nothing new about the president. this is the same president that accused five black men of rape and basically led an ad campaign to make sure that they were arrested and potentially not only that but almost put to the electric chair or at least that's what he was advocating. then he coincidentally also against our first black president said that he wasn't even born in the united states. then he says a mexican judge can't be impartial because of his heritage. in addition to the history of them not renting to african americans in new york city. so i'm sorry, at some point when you have so many racist arkts you are a racist. and then to pardon one of the biggest racist in the united states basically a week after

way. i'm still encouraging people to stay at home. i've been out visiting with the mayors no missouri city and the mayor of stafford texas. these are two mayors within my congressional district, and they are in fort bend county. upon talking to them, they're telling me that there has been some damage, but they are also very much worried about the inunaddition that's to come. we understand we're in an erie quiet before a monster arrives. and this storm is a monster. and our hope is that we'll dodge the bullet. but we understand what happens when you get rain that you have to measure with a yardstick ned of a ruler. we understand this is a recipe for people to be hurt. and these mayors are doing all that they can to protect people out in fort been county. >> one of the concerns here is for the most part, if we were to

describe the topography, which you know so well here, representative, it's fairly flat throughout texas and throughout the houston area that we're so concerned about flooding here. and therefore, when you look at the key areas that you're worried about, there are a lot of those triangles that sit right in the middle of houston, those triangles representing worries of flooding. >> absolutely. to add to your information, houston is about 80 feet above sea level. compare this to dallas, which is about 400 feet above sea level and of course galveston, which is where our water drains off into the ocean there, the gulf of mexico. in galveston, they're only about 7 feet above sea level. so we do have terrain that is friendly to flash floods, and we have these flash floods that occur, and they are just what

the name implies. they're floods that appear almost out of nowhere. and if you're caught in the wrong place at the wrong time, you can have your life taken from you. again, we encourage people to be aware and don't go out if you don't have to, because the rain appears to be coming. there is a calm now, but don't assume that we don't have a storm on the way. this is a stealthy, stealthy storm. it seems to be giving us indications that it's over when we know that it's on the way. >> do you have enough help, sir, local, state and federal? >> well, as i said, i visited with the mayors out in missouri city and stafford, texas today. i have visited with mayor sylvester turner, the county judge. i was on a call today with the new administer of fema and a host of others. they all are indicating that they have staged assets appropriately so that when they are needed, they will be

available to us. the plan seems to be there. the question is can we implement it. if we can,ible that we will do a good job and we'll prevent a lot of loss. my hope is that we'll be able to follow through. but there is one aspect of this that you can't plan for and that is the unpredictable. these storms sometimes will show up where you don't expect them, areas that haven't flooded before may flood. we may have tornadoic activity that we can't anticipate. last night i went out at about 3:00 a.m. because my emergency warning system on my television kept going off repeatedly. so i went out to just take a look and found that there was some activity, but this wasn't until this morning that i saw the actual damage that was done. and it was awesome. it was something that i would not wish upon even my enemies. so my hope is that people will listen when there are these warnings, that they will stay

welcome back to our breaking news coverage. i'm richard louie at nbc news headquarters in new york city. now it has literally come to a stop dumping rain on the texas coast, not moving but basically a fire hose sitting above the state. rainfall totals already reaching way over 20 inches in some areas. >> our primary concern remains dramatic flooding and our biggest concern is the possibility of between 20 and 30 more inches of rain in areas ranging from corpus christi over to houston. >> the danger remains. and that's why the coast guard warns the public to stay safe, not to get in the water. so far they have rescued 15

people aboard boards in distress. now, the city of corpus christi is giving its residents the okay to return to their home, but they are warning them, boil your water before you use it. meteorologist shanna mendiola tracking the storm for us. it's a new spaghetti, if you will, in terms of where this storm, this tropical storm is moving. >> yeah. you feel, it's not moving very much at all. we took a look at this in the last half-hour and the track remains the same. the last update shows really no movement in the storm for the next few days. you can see it does take a turn to the southeast, weakens to a low but then makes a northerly turn and kind of stays in the general direction of texas here around gonzalez, la grang, all the way through austin. getting that rain all the way through wednesdays. so several days of rain. we can't tell you enough, this is going to be a dangerous situation with about 40 inches of rain possible by the time we hit even thursday hf next week. until we get a steering mechanism to move it along we

won't get it moving very far at all. we're lacking at the storm. the track staying in the same general direction for the next few days ahead. the rain victoria getting inundated with rain in the next few days and houston, an area that is again the fourth largest city in the nation getting all this rain here. close to the amounts of rain that they get within one year by the time we hit thursday of this week. so, again, several days of rain. even looking at hurricane watches in that area. we're monitoring the situation and we'll have another update in the next half-hour. >> all right. thank you so much. administration nbc meteorologist. i want to bring in joe fryer. as you know so well the issue there is low lying area, city, and that's a concern when we talk about flooding that shanna was just telling us about. . >> can you guys hear me? hello. i'm here. joe fryer, can you hear me? this is richard louie. >> yeah, can you hear me?

>> he's there in galveston, texas. we may be having some communication issues. can you hear me? >> yes, i hear you. >> this is richard louie in new york and i was just saying you're in that important city as we look at galveston, not only because of its history, but because of flooding and its low lying. >> yeah. that's right. here in galveston right now. first of all, to set the scene it's about as nice as we've seen it the last few hours. there's been sort of a break, a little bit of a breath of fresh air for people here. a far cry when it was raining sideways relentlessly. for several hours we were under a floosh flood warning at that time. and anywhere from 2 to 6 inches of rain fell in a 24 hour period in this county. so now those waters are receding a little bit, but it did rain quite a bit. we did see some flooding especially approximate in the downtown galveston area with some cars up to the tire levels up to the doors. and we still saw some cars and trucks trying to drive through

that water which is always a risky endeavor. it's one thing city officials don't want people to do. it creates wakes that can then get pushed into the neighborhoods and make the flooding situation even worse. right now they're worried about what's still to come here. they know there's going to be a lot of rain from this slow moving system over the coming days and eventually that system is actually going to move closer and closer to galveston, which means is the rain is only going to grow more intense. richard. >> a little bit of a reprieve, but as you so well noted, there's more to come. all right. let's now go to the ceo for the texas gulf coast region of the american red cross, david brady. thanks for joining us. and the important role that you play in disasters are to help the folks that need help. >> for the red cross our strategy is prepare, respond, recover. we spent last week really working on the prepare part and

now we're in that respond part. what we're hearing is that people are very anxious, new hampshire. they want to know what to do. those people who are nervous about potential flooding want to know where they can go and get shelter. so we've got a lot of folks who are right now, especially in the greater houston area in that anxiety point and wondering what's going to happen. >> we're looking at some of those pictures from galveston as well as other parts around houston. there's victoria. flooding. that's the concern. what are you hearing in terms of flooding? >> yeah. that is the number one concern for this storm, and it's been the number one concern for -- since about wednesday when we really started to see this thing kick up as it came out of mexico. and that is the number one concern here. and as you guys know, we've had some really big challenges in the last few years with flooding, well, really going back to 2001 with allison. flooding has been a challenge here. we've made a lot of great infrastructure changes in our community in the last three years, but this is still going

to be a challenge. and people who live in low lying areas need to be aware of that and flood plains need to be aware of that. we're setting up our shelters in hopes that we are in the right areas to help those people get out of the flood plains and out of the flooded areas, but right now we advice them that if they are in their homes, they need to stay there snl they know it's safe to leave. >> yeah. and you brought up 2001. an unfortunate reminder for people today. 22 people died because of flooding during that storm. thank you so much. david brady there from the red cross. thank you so much. >> thank you. i appreciate the opportunity. >> you bet. still ahead, as a major hurricane was approaching landfall last night, president trump chose that very same time to make good on promises of his campaign. we'll talk about what the timing of these major decision mean for his administration. and at a stand still, not moving basically. tropical storm harvey, slow movement here. it could define the extent of its damage. we'll get more on that. jett & the blackhearts] ♪ who can turn the world on with her smile? ♪

the first responders just couldn't get to in time and at least 12 people were injured here in the rock port area. now, we have been going to several different cities throughout texas throughout the morning. it was actually tough to get here this morning. thankfully some of the roads had opened up. and as you can see we're getting a break in the rain here, but as you've been reporting, others parts of the state are getting hit with torrential downpours and we expect the flooding threat to continue for several more days. what we can tell you here in rock port, some incredible stories emerging, including one was a hotel. a group of several dozen mostly storm chasers and members of the media who were at this hotel, the fir fairfield in in rock port braved the storm overnight. and the entire side of the building collapsed. it was just ripped off. we just got a tour of that hotel and we were able to go to the

fourth floor. we were able to look outside and see the ocean from the fourth floor. the manager said they were just grateful to be alive. another one we spoke with, she decided to stick around and decided not to evacuate. and she lost her home. she braved the storm with her sister and her boyfriend. thankfully they both survived. but she was able to get her children to safer ground in austin. so certainly a very difficult time for these folks. fk's governor greg abbott says that more than a thousand people are involved in search and rescues operations, but, richard, again, 12 people injured here in rock port. there is feerars, though, that that number could grow as authorities continue these search and rescue operations for quite a lot longer. >> an entire wall just gone. what an amazing sight that must have been on the fourth floor and it's good to see no reports

it noi has become a regular occurrence. the friday night news dump as it's been called. while many americans were focusing on hurricane harvey there were a lot of headlines coming out of washington, d.c. first off, president trump issued his official ban on transgender troops in the military. he pardoned controversial former arizona sheriff joe arpaio. that's two. and then three, to round out the trifecta, the departure of controversial trump adviser sebastian gorka. joining us now aaron mcpeak with the independent journal review, kathryn with the "washington post" and former federal prosecutor. thank you all three.

amongst all of the concern we have about tropical storm harvey, formerly, of course, the hurricane within the last 24 hours, this was happening, and not to make any comparison of what is more severe, but this happening on a friday night. and kathryn, the timing that americans are putting those two together as there's a hugh man terry concern, right, and a major state of our country, yet we have these three announcementsment this president, what do you make of his decision on timing? >> i think some of these announcements he wanted to bury from most of the public that the expectation that his base would find them out. you can't hide a story like the joe arpaio pardon. and it's infuriating. everything you learn about him just reveals something even worse and more monstrous. people know the headline thing like racial profiling, but when you see stories about all the other terrible things that he's done, including having his deputies not investigate like

400 sex crimes, many against children. you know, trying to frame someone for attempted murder that didn't actually happen. all these other terrible things. you know, if the general public were to actually learn about all of that, they would be infuriated. but his base, who loves joe arpaio and see what they see in trump. someone who is not afraid to crack down on people who don't look like us, for example. they are going to hear about it and they are going to celebrate. so i think that the timing of many of the kinds of announcements were designed to be ignored by post of americans, but celebrated and savored by his supporters. >> erin, put in context for us, monday, upcoming or the monday after, are these all headlines that we've forgotten again. >> i don't think we're going to be forgetting about them any time soon. i think the effect of the friday news isn't the sames it used to be because of social media and the 24 hour news cycle. we'll continue to talk about

them and they'll get a lot of talk tomorrow on the sunday morning programs an i think we'll talk about them all throughout next week. so i think it was the attempt to bury the stories as katherine mentioned, yes, but i think these are going to be another few stories that are going to hurt the trump administration and his agenda going forward. >> one of the things that i've just mentioned of that tri fecta, ronaldo, is the president moved forward in a pardon process and short circuited it. what does that mean going forward for pardons that the president might be doing? >> well, what it suggests is that the president is going to be aggressive about the use of the pardon power. i mean typically there is an office of the pardon attorney in the justice department, who is atypical matter would carefully review pardon requests and usually somebody has to be incarcerated for years and they consider many factors. here the president just went and spoke off the cuff at an arizona rally and then a day later or

two days later, decided, yeah, i'm going to pardon this guy. it just shows there may be more pardons to come, particularly in the russia investigation. >> in the russia investigation, and that is been some of the accusation here, katherine, i was speaking earlier with ruben gallego, a democratic congressman saying this is just what might be a hint of the future. potentially a signal to those who might be involved as ronaldo was intimated, maybe be prosecuted. >> if you are someone thinking about flipping on trump, and cooperating with mueller's investigation or any of the various congressional investigations that are going on, you would be comforted by the fact that trump has yesterday rewarded one of his most loyal soldiers. right. joe arpaio was an early endorsered of donald trump and he seems to be being rewarded for that decision.

that said, i think you could also see in this decision to pardon joe arpaio, the idea that trump is projected that -- that you could read into the biography of this sheriff. that are how trump sees himself. military parades and someone who thinks that racial profiling -- people who don't like racial profiling are just too politically correct. and this is someone who likes to jail journalisms. so he's done a lot of things to go after his political enemies that trump has sort of seemed envious of in some ways. so maybe part of this decision was about sending a signal to the people who have been supportive of trump. the others supportive of trump and some of this about flattering himself. >> katherine and erin and ronaldo, sorry for the compressed time. it is one of the breaking news day. i appreciate you all three stopping by. >> thanks.

the city of houston under a flash flood warning. six and a half million people in the metropolitan area, tropical harvey expected to dump a histor historic amount of rain in the area. the national weather service warning of flooding. joining us nous stephanie abrams. tell us what you are seeing and it looks like of course the headline is lots of water. >> we have yet to see the water here, richard. first we are on the buffalo bayou and water has not risen up to the sabine bridge. this bayou is 53 miles long. and the water shed is 500 square miles. so that -- any tributary within 500 square miles is going to come into this bayou. 3.83 inches and that bumped up us to the wettest weather in august but we are in a dry slot. here is a story -- we've had -- a lot of people just taking dogs

for walks on this sidewalk. doing bike rides and night time things, but here is what is going to happen. if we get one of the bands to come set up over this area or one of the tributy. this is really what i like to call a now casting scenario. as this meanders around over the next several days an we could have rain here through thursday, because of its just slowly meandering around, it could rain out. where that rain falls, we can't tell you that right now. for instance, with tropical storm allison which everyone remembers from 2001, the only tropical storm to have its name retired, it rained out on the northeast side of town, what if this time around it rains out on the south side of town. during allison, i dent have a whole lot, i wouldn't worry. we can't do that because we can't say exactly where the bands will set up at this time. >> stephanie, quickly, the big
