i'm sorry that it ever happened. i'm sorry for mike, i'm sorry for my family, i'm sorry for his family. good morning. i'm dara brown. it's 6:00 a.m. in the east. here is what is happening. out of prison, o.j. simpson released from a nevada prison after serving nine years. where he is heading next and the restrictions he'll face. who is getting help? the latest on the recovery on puerto rico and whether the aid is reaching those who need it the most. presidential visit, what will happen when president trump sees the destruction for himself in two dies. especially after his twitter attack on the san juan mayor. surprise revelation. what the secretary of state said

and what it could mean for rising tensions with north korea. we begin with breaking news. o.j. simpson is a free man, he was released from a nevada prison early this morning. the nevada department of corrections released a photograph of simpson just before his release. in july, the nfl hall of famer won parole after serving nine years of the 33 year sentence for robbery. joe fryer is in las vegas and joe, can you give us the latest? >> reporter: yeah, good morning. this is what you would call the scene of the crime las vegas, and all theories were that o.j. simpson would be transferred from lovelock to here for his release. that is the typical procedure. you return to the county where the crime was committed and meet your parole officer here. but o.j. cin's situation has ne been considered normal. so overnight 12:08 local time, the department of corrections

officials released him directly from lovelock without transferring him to another prison or having him meet with a parole officer during normal business hours during a weekday. it happened again 12:08. they would not say who picked him up or where he's going. what we know is that simpson would like to live in florida. he has friends and family there. in order to move to florida though, he will have to complete some paperwork and as of friday, t department of corrections in florida had not yet accept that had paperwork. so as far as we know right now, o.j. simpson will hahave to sta in never neff. bu nevada. but it probably won't take long before he will be able to move to florida. >> you said that he was released at night. and this is definitely to sort of stay away from media. but now that he last to go to the parole office, has the media frenzy began already?

>> on obviously a lot of media have come to nevada anticipating this. the theory all along was that he would probably be released as early as monday morning. that was based upon the fact that he will probably have to meet with the parole officer, that releases don't typically happen on a weekend. clearly the department of correction credits decis decide differently. they said they made the move to ensure safety and to avoid any sort of incident. with all this media attention, there was always concern that o.j. simpson's release could become a giant spectacle, that there could be a number of reporters, paparazzi and perhaps trying to on follow his car, creating a dangerous simpson not just simpson, but other people on the road. it's always why we knew there was a chance that the department of corrections could change things up and do things in an unconventional manner and that's exactly what they did, they threw the playbook out the

window. lovelock is in such a remote area, there is really no airports nearby, no train stations. they don't like to leave prisoners there. but obviously they knew o.j. simpson had someone to pick him up. typically they don't u't do it weekends. obviously they made special arrangementses to make sure that he still follows the rules. he has to avoid excessive alcohol. he can't have a blood alcohol level of 0.08 or higher. he can't be around weapons or convicted felons or illegal drugs. so on tho those are the conditions of the parole and he will work with parole officers whether in nevada or florida to make sure he's a biding by those rules. if he breaks any of them, he will be right back behind bars. >> we have comments from malcolm laverne who is his attorney. >> mr. simpson will not be hold

without being chained up. and would he have also heae've an iphone. keep in mind nine years ago we were starting to seat birth e t of snooed, but ocial media, but entering a whole new world and something he has to prepare for. no matter where he goes, somebody will take a ikt about and post it on social media. so on he needs to be aware about that and his be affair and just needs to know this is the new reality. >> and we did have comments from the attorney and apparently the attorney was talking to o.j. simpson. what is the consensus on malcolm laverne knowing exactly when o.j. was going to be released and how it would be orchestrated? >> reporter: you he was telling us that as far as he knew that he was still in lovelock. he was right about that. and probably wasn't going to

release too much information because he wanted to keep things safe or perhaps we don't know how much he has been in on all this, but a pretty good assumption he knew all along. someone did pick him up and we don't know who that was. but the assumption is that people close to simpson were aware of the plans but did not share them publicly for the very reason he was released overnight in a remote part of the state. >> joe fryer, thank you so much. we'll turn to our legal analyst joining me by phone. danny, are you surprised that this release happened in the middle of the night? >> no, i'm not. i mean, nevada corrections has a lot of discretion in formulating a resolution that gets o.j. out of prison with the least amount of problems. and in a case like o.j. as with

any celebrity, the rule book is always thrown out the window. so i'm sure they had a nice meeting and decided he's no ordinary parolee, so we need to get him out in a safe way. and this didn't violate any of the rules of his parole in letting him out early. it's just a procedural thing and it really is a smart choice given that it minimized the amount of paparazzi, the amount of problems that could result. the main thing that the board of corrections is going to be concerned about is that he reports, he complies with the conditions. the fact that they may have changed the rules for his release, not a big deal. >> and what kind of restrictions would o.j. simpson be facing in this new life? >> in nevada, all parolees face similar conditions. because o.j.'s crime was not one of drugs or alcohol, it's not surprising that he is allowed to

drink, just not to excess. although 0.08 is a very, very low standard. these are standard conditions. no firearms, no associating with known felons a s or criminals. you give up the same rights of the fourth amendment that the rest of us have, a parole officer need only have a reasonable suspicion and they can search you anytime anyplace for anything. and that is one of the rights you give up as a parolee. and of course if you viviolate, you could be right back in prison for the rest of your original term. >> and it says he has five years of parole now. can in a that be cut for good behavior or will that stay for five years? >> it's likely to stay. he will have to report and actually five years is a pretty light number. so the only thing that could really happen is that it could

be extended in that if he violates, he could be right back in prison. as could any parolee who violates. >> and what is your opinion, how difficult do you think this will be for o.j. simpson to adjust to life now especially with social media? i mean people will be taking pictures everywhere. he is a rather notorious figure here. how will he be able to adjust? >> well, this is a common issue for any parolee who gets out of prison after being in for a decade or more is that life has moved on without them and it's almost like a time capsule. they are stepping out into a world that they no longer ri recognize. it's a challenge to find employment. they certainly aren't efficient in word or excel that employers are looking for. fortunately for o.j., he will have more of a plan, more resources than the average parolee.

so o.j. is going to have an easier time adjusting than most parolees and people who leave prison after close to a decade. >> and what about o.j. simpson possibly getting a job? we know there is a civil suit where he would have to pay the goldmans for the civil suit that took place for the trial of 1995. so how would that work if he were to get a job? >> he's not likely to to get a j job. he doesn't have to. in nevada the fact that he is considered retired, although ordinarily there is a requirement that you seek employment, being retired is considered employment. that satisfies that condition. so o.j. doesn't have to work at least as far as the nevada parole -- or department of corrections is concerned. but he does -- he may want to make some money and that has always been a legal issue, how does he generate income without it being attached as assets by the gold man family who has a judgment against him.

and there are ways of doing that. some of them involve -- may involve the laws in florida which are liberal when it -- or i should say very protective of people's assets in conditions like this. but it is a bit of a mine field for o.j. to navigate, although he is not required to work as a condition of his parole. >> danny, thank you so much for weighing in. we appreciate it. we turn now to politics and president trump who returns from a working weekend in new jersey today amid an ongoing fooud feud with t with the mayor of san juan. the president tweeted saying results of recovery efforts will speak much louder in an complaints by san juan a mayor, doing everything we can to help great people of pr. president trump also telling the people of puerto rico don't believe the fake news. here is the mayor in an interview about the barrage eof

happening now in spain, this is a live picture of people v e vote. but there has been unrest in barcelona as police and protesters have clashed. police seized balanlot boxes to enforce a court order. protest torceetesters have been. matt bradley is joining us. what are you seeing there? >> reporter: good morning. we've been seeing very he dramaticismages all around barcelona this morning. we've been driving around the city. dramatic in the sense that of course thousands and thousands of people lined up waiting to cast their ballots. but also some very dramatic scenes of what you could consider to be police brutally, police taking matters in to their own hands, taking ballot boxes and ballots. and fighting back against the voting public who are just trying to cast their ballots.

ballots in their favor because remember, it's only a narrow majority of this country who is actually against independence. it's really not all that popular. there is a rs is a vocal minori favor of seceding from spain. so they are hoping that it will tip the balance in their favor and this anger at the spanish government will last long after the referendum is done voting today. >> were the police prepared for this, were they aware that this was going to be such a large scene at the voting lines? >> reporter: they absolutely were. and that is why the police -- national police are different than the local police. there is a local police here known as mosas and they actually entered a lot of the polling stations, they talked to people and they are much loved here especially after a terror attack that killed about a dozen people several weeks ago.

turning now to the tensions between the u.s. and north korea. the trump administration acknowledged it is in direct contact with the north over its missile and nuclear tests. secretary of state rex tillerson made the revelations during his visit to china. the two countries have been trading public threats with the north declaring its missiles can reach the u.s. and president trump vowing to o, quote, total sgr destroy north korea. joining me now, colonel jack jacobs.

great to have you here. secretary of state rex tillerson says that theist has several channels open for pyongyang. what does it mean and talk about the potential impact. >> well, tim sallerson said tha have both indirect through china and perhaps other channels. an direct channels. and what has gotten everybody excited is the fact that we're talking or suggesting that we are speaking directly to the north koreans. the problem with talking about the talks in public is that it makes it extremely difficult then to actually conduct negotiations. so that is the first problem. second, it makes it extremely difficult in dealing with our allies. there is an election taking place in japan and this talk about grekt discussidirect disc north korea has fueled a glal f

great deal of speculation inside japan and making it a lot easier foropponents to gain the upper hand in the election. so talking about discussions in public is probably not the way to conduct diplomacy if you want any diplomacy to be successful. >> colonel, have we seen these direct channels with previous administrations? >> yeah, we have. we've spoken indirectly many times. we've spoken directly several times with the north koreans. most notably back during the carter era when direct talks with north korea seemed to overt the possibility that the korean war would start again. but we've never had direct talks with mr. kim, this mr. kim before, and the suggestion that we're actually talking directly to the kim regime, this kim regime, means that this question

now is public and they will have to be further disclosures from the administration that the talks are ongoing, what the subject matter is and how far we're progressing. and if we don't do inthat, then there will be concern that whatever discussions we're having with the north koreans has broken down which will make the situation worse than it was when it started. >> north korea's state news agency has called the effort he's effort to impose sanctions few tile, vowing the country will become a state nuclear force. does that leave no room for gosh yas ghoesh yags sgls ? >> no, it doesn't. public pronouncements are one thing. don't forget that a proflot of discussions is for necessary tick consumption. when the kim regime not just launches missiles or conducts underground ters b grounground

threatens the united states and when the president of the united states threatens north korea publicly, a lot of that is for public consumption. so it's important to remember that no matter what happened behind closed doors, a lot of the public discussion is just for the consumption of the united states and north korean populouses and not only that, those of allies as well including on the one hand japan and the other china. >> let's talk about china for a second because north korea conducts about 9 on 0% of its foreign trade with china. and cutting these ties would cripple their economy. so what is stopping china from doing that? >> a couple of things. first of all, china does not want any conflagration on on the korean peninsula because among other things the complete sgrugs destruction of the economic relationship would drive millions of refugees across the river into china and the chai

niz would ha chinese would have to deal with it. and second, any danydy munition power on the kim regime would mean that for china, the united states would gain the upper hand in controlling the korean peninsula and more than almost anything else, that is what the chinese to not want. they don't want a free korean peninsula that includes north korea because it means the united states will control that area. >> and colonel, how do you assess the harsh rhetoric of president trump's tweets against word that there are actually back channel talks going on? he did didn't seem th it doesn't seem that the two would fit. >> no, it does and that's why it makes it extremely difficult when you have a public pronounce mts th chlt that in fact we're actually having discussions with north korea. remember however that the president when he was campaigning before the election

talked about how on he was going to have direct talks with kim, that he, trump, was a great deal maker and that they would have a discussion over a hamburger. that was a long, long time ago. the reality of the situation is that any discussions that we have, anybody has, in the diplomatic arena are best conducted behind he closclosed because otherwise you have a hard time discussing anything without actually discussing the terms and once you discuss the terms, it's sdikdifficult or impossible to have a meaningful -- a useful result. so talking with north korea, great idea. keeping your mouth shut about it, an even better idea. >> with these talks, do you think it would be possible to actually have these talks come to some sort of fruition before the u.n. sanctions take hold. >> oh, not at all.

37 past the hour, here's what we're monitoring. after nine years, o.j. simpson is a free man. he was released there a northern nevada prison about an hour and a halving a go and thago. we have no word on where he is headed. the nfl hall of farm wof famer e in july.lowing this breaking story. joe, what can you tell us about why o.j. simpson was released in the middle of the night? >> reporter: bottom rooline is department of corrections said it did it out of a matter of public safety. it wanted to make sure there were no incidents especially with all the media attention. a lot of the media has arrived here in the las vegas area. why is that? typically in this situation someone who was convicted of a crime in las vegas, no appear what prison they served at, they would be transferred back to

this area to a prison about 45 minutes from here called high desert and then moved from there to the parole office in this county where the crime took place here in las vegas. and then be released from that parole office. so everybody was preparing for that normal situation. but we also always knew the department of corrections could change it up because of the high media interest. they wanted to avoid a situation where perhaps a lot of reporter, paparazzi and even members of the public could see o.j. simpson where he was driving to, creating havoc on the roads, prapgs held k perhaps helicopters up above. so a, he was released in lovelock which is a rural area. and it happened overnight and a on weekend. we spoke on saturday with simpson's attorney here in las vegas, malcolm laverne.

he shed a little light on what you can expect now that simpson is a free man. >> he wants for to be with his family. he wants to hug them on the outside. they have been able to come see him in prison. and let me get rid of this myth, he's not in chains when he's in prison. he's not that cshack bled up. he's just like you see him at the parole hearing. neatly pressed, jeans, white sneakers. that's exactly the way he looks every time. and so he can hug lihis family member, they can play games, eat popcorn. that is the experience. so he can do that with the family members for four, five hours on his visitation days. but this is different. he can hug those family members on the outside and that is just a whole big difference and be able to walk with them and go to places with them. he will be able to do all that and that is a big world of

difference. >> reporter: he says o.j. simpson wants to enjoy the simple pleasures now that he is out. having a nice meal, perhaps a steak and seafood. he says he's interested in getting an iphone as well. keep in mind, o.j. simpson went behind bars nine years ago, just when the iphone was getting started, social media was different badge theback then. so he will be entering a world where everyone has a phone posting to social media. he's had that discussion with his attorney. and also realizing that a lot of people will be coming up asking to take selfies and pictures and he needs to know how to handle that. >> and he was released at 12:08 nevada time. how unusual was that and also from where he was to coming to las vegas, how long is this transition going to take? >> reporter: they only different

waste anytime. it's clear that officials here in nevada would like to be done with this and of course we know o.j. simpson would like to move to florida. that is his intention. he has friends there. he has some family there. two of his children are there. at this point, the department of corrections in florida tells us it has not received the paperwork needed to be processed for o.j. simpson to leave nevada and go to florida. whether that has changed over the weekend, we don't know. once that paperwork is received in florida, we expect to be a pretty quick process and he will be able to move there. but until that happen, he will have to stay here in nevada. exactly where that will be, we don't know. who picked him up from prison, dechts ever corrections officials wouldn't say. so he will have some sort of life here in nevada, whether spotted by the public, we will have to wait and see. but the department of corrections will have of course his conditions that he will have to meet whether here

of a prior criminal record although the public may have in their mintds convicted him of a prior crime, he was not convicted. so he was not considered a recidivist. someone of his age is considered statistically not likely to offend again or commit another crime. so he was likely to get released. but at the same time, there were a lot ft of context all issues including his behavior and testimony at pa throle board heg that made it in my opinion a close call. but on the numbers, he was likely to get out. if you a that parole board hearing, i thought it was close call. >> are you surprised the release handled in the middle of the night? >> i'm not. the department of corrections has the discretion to make these decisions. the important on thing going forward is for him to comply with the terms. this is something that there

won't be any bending of the rules for. the fact that they may have released him in the middle of the night, they bend those rules, but going forward complying with the conditions of the parole, those are things that he must do and for many offenders who are released, it's very difficult do becauto do be they don't have the organization and returning to a world that they no longer recognize, they don't have any marketable skills. but o.j. is considered retired. so that will give him a break for any obligation from seeking employment. and he has more resources than your average person who was released after serving 10, maybe more years. by that time, family members, friends, they have dissipated. >> we know o.j. served this time for robbery and other crimes on 12 counts. but will he be dogged by the civil lawsuit that the goldmans

and brown families have against him? >> yes, and i believe it's actually a judgment. so there are a lot of legal wranglings that o.j. has to do anytime he makes any kind of income. i understand florida has some protective laws for people who may have judgments entered against them, but yes, at least as far as requirements for parole, because he is retired, he is not required for-tto seek ploim employment, but if he does, those with judgments against him will certainly seek to attach those wages to satisfy that judgment. >> and what kind of restrictions is o.j. simpson going to face in in new life? >> anyone released on parole in nevada faces a number of different restrictions. they sign a parole agreement. and the standard ones are they lose their same fourth amendment rights that you and i have. a parole a little can search

them at virtually anytime with just reasonable suspicion which is virnltually no suspicion at all. they have fhave to report in an are monitored and in many ways it's a form in-car race but in the real world. if they slight, they can come right back and serve the remainder of their term. you have to be very careful and very organized. and for people who don't have the resources, that is not an easy task. for o.j. it might be easier. but he has a number of rules that he has to comply with. the alcohol alone, on 0.08 is me a drink, sometimes half a drin ge drink depending on your weight. but that is just an example of all the rules. >> and he's on parole now for five years.
