north korea. we begin with breaking news, o.j. simpson is a free man. he was released from a nevada prison early this morning. the nevada department of corrections released a photograph of simpson just before his release. back in july, the nfl hall of famer won parole after serving nine years of a 33 year sentence for robbery. joe fryer is in las vegas and joe, you've been covering this story since he's been out. tell us the latest. all right wh >> reporter: o.j. simpson was released just minutes after midnight on october 1st, the first day he was eligible for parole. he was released from lovelock correctional center which is where he has been essentially living for the past nine years. all of this is highly unusual. typically a parolee first of all wouldn't be releasted at lovelock because it's a very rural area. typically they don't release inmates there because there is nowhere near an airport, no

where near a rail line. but he knew he had someone to pick him up. also typically he would have to return to the las vegas area and be processed at a parole office here in las vegas but it became clear that the department of corrections was concerned about what would happen if o.j. simpson was released under these normal circumstances, if he went to the parole office on a weekday during normal business hours and there was media, paparazzi and of course members of the public and what would happen when he went on the road and started driving, what if people started following him. and the dweepartment of corrections said public safety was the number one reason why o.j. simpson was released in this unconventional manner. they wanted to avoid any dangerous incident. and it worked out well because no one was there to see o.j.

simpson leave and at this point it's unclear exactly where he is going. on saturday we spoke with o.j. simpson's toirn heattorney and d about how simpson plans to deal with some of the issues in life once he's out from behind bars. take a listen. >> mr. simpson is not going doing hold up in a rule. ooerm that is one extreme. however he won't be out every day going out to parties, going all these things. he's a 70-year-old man and i think he will do what 70-year-old men do which is live a retiree's life, golf and lay very, very low because he's learned some big lessons over the last decade for his misstep in las vegas. >> reporter: now that simpson is out of prison, laverne says he wants to enjoy some of the simple pleasures. so some of the first things he's sxepg expected to do, have a nice male, stamal meal, stake or seafood.

he might buy an iphone. but above all, he wants to spend time with family and friends. he wants for move to florida. his attorney says he guarantees that that is what will happen. at last check the department of corrections in florida had not yet received the necessary paperwork that must be processed for simpson to move there, but that is expected to happen fairly quickly. >> joe fryer, liver for for uss vegas. thank you. our legal analyst is joining me. danny, we heard joe say 12:08 he was released. are you surprised that this happened in the middle of the night? >> not particularly. whenever in the case of celebrities, the parole board and courts take the normal rule book and they throw it out the window because there are certainly special reasons why they might release o.j. early.

and i say earl li because ty be normal procedure is to transport him to the county where he he offended to then release him. but this is very unusual, but it's understandable given that he is a high profile defendant, a high profile parolee. this is very common. our corrections system routinely treats celebrities differently than the rest of the inmates. they might move them to a separate area which i understand they did with o.j. on. they might keep them separated from other inmates. so this is not that unusual. it doesn't change the fact that o.j. must comply with the conditions ever his parole or he will find himself back behind bars very soon if he does not. >> and what are those conditions of his parole? >> standard restrictions include consumption of alcohol. there is some wiggle room there, but his crime sgn involve drugs

and alcohol, so he is allowed to consume up to 0.08. dui lawyers will tell that you that is barely a drink depending on your body weight. but some of the other conditions can be really burdensome. and one of those is that parolees don't have the same fourth amendment rights that you and i have. they can be searched at virtually anytime by their parole officer on just reasonable suspicion, which legally means just about anything that the parole agent can think of. they have to report in person to their parole officer periodically. sometimes they have to be monitored with an ankle brace let's. that's what the florida a.g. use like to see happen. but there are a number of different conditions they have to comply with, which is why for many without resources and unable to work, they quickly

find themselves right back in court and possibly prison. >> danny, cevallos, thank you so much. we turn now to politics and a live picture of the white house. president trump returns from a working weekend in new jersey today am mid an ongoing feud with the mayor of san juan. the president took to twirts last night to ramp up the attacks he started yesterday morning. in one tweet saying results of recovery efforts will speak much louder than complaints by san juan mayor. doing everything we can to help the great people of pr. president trump also telling the people of puerto rico don't believer the fake news. here is mayor cruz in an interview last night about that barrage of early morning trump tweets when trump accused her of politicizing maria's devastation. >> i have no time for small politics or comments that really don't add to the situation. senator marco rubio sent representatives to here.

so he's not a democrat. and i just think he's looking for an excuse for things that are not going well.leitner sat the mayor. and this back and forth has been going on for a couple of days now. has there been any direct communications between the mayor and president trump? >> reporter: not that we know of. and the mayor has been a very outspoken advocate for the people here in puerto rico. she's even gone out on rescues. we were there when she was going door to door asking people if they needed to leave their home, if they needed help, water, food. so she has really been fighting for the people of puerto rico to get resources here and just a couple days ago she went so far as pleading for resources. and that may have been what triggered this tweet storm from donald trump. let's listen to what she had to say. >> you know, i have no time for petty comments. i have no time for -- i'm

telling you this with a smile. i have no time for anything that is not the main agenda which is saving lives. and i will do what i have to do and i will say what i have to say in order for the message to get through. >> reporter: i've spent a lot of time with the mayor since i've been here and part of the reason she is so passionate in fighting for the people here is because things are not changing fast enough, not for the people of puerto rico. the conditions are still very dramatic here. long lines for gas still, people still waiting two, three, four, five hours for gas, not all of the gas stations are open. as far as food, we spoke with one man yesterday, a 16-year-old who drove 90 minutes with his mom to find a grocery store that was open and once people get inside, a lot of the shelves are bayer on oig, there are no frozen foods, no refrigerated foods, no milk, no ice. and what can goods there are,

bit by the mayor of san juan who had talked about needing supplies, particularly water, food, fuel, basic resources. the president likes to say he is a counterpuncher. he had also gone after puerto rico earlier in the week. i think what is going on here you have a federal response that the president believes is r robust. there is a diskeblgisconnect be that and the ability of the people of san juan to get the resources that they need. so i think these are different perspectives. the one on the ground is that there are people as the mayor said dying and the one from the president that there is some massive federal response going on. >> and sean, weigh in here. do these attacks seem different to you? >> this is certainly very different from the way that other previous presidents and other political leaders have handled a situation like that. when you have a natural

disaster. a lot of people have struck a nerve. president is basically putting pressure on democrats to speak out against him. so i think that has rubbed people the wrong way because this is usually a situation where you see politicians in both parties say we won't entalk about democrat, republican or otherwise. >> and jonathan, what do you expect this trip to puerto rico tuesday will look like for the president? >> it's hard to on tell. i mean it's not clear to me that he will be welcomed with open arms.tell. i mean it's not clear to me that he will be welcomed with open arms. it will be interesting to see what that does look like. the prtd planned his trip in a way that he thought would have the least disrupg for ttion for

people of puerto rico and him going down there is a symbol of the attention that the government is paying to puerto rico and i think will be taken by some as a commitment to ensure that the recovery is as smooth and full as possible. >> sean, one of your colleagues writes about the response to puerto rico and the attack against mayor cruz in isn't article titled the past week showed trump is struggling to be the president he promised. how is this week different than the previous bad weeks? >> i think he has struggled on a number of different fronts. you have a special election in alabama this week where his candidate not only loses, but loses pretty handily to somebody who ran as more of a trump style candidate, an outside, and somebody who had the support of a lot of trump's former colleagues and associates, people like steve bannon his

former cheech strateief strateg. on top of that, you have the comments from the president about the national an them in the nfl in which he was continuing to talk about last night. so that raises questions about how much attention he is even giving to puerto rico right now. so i think when you look at the last seven days, you look at the kind of comments that we've seen from the president, you know, these things really are sort of at odds with some of the rhetoric that he put out there as a candidate where he said that he would stand up for the every man, he would fight for average people and he's out there picking these culture war fights and he's out there raising he questions about whether his administration is providing anned adequate sporsr to a horrible disaster. >> and you bring up a good point because i don't know than, i want to ask you, president trump taking to twitter last night to reignite this feud with the nfl saying very important that nfl players stand tomorrow and

always for the playing of our national anthem. respect our flag and our country. jonathan, to y do you get that feels this fight makes him look presidential? >> irm n'm not sure it makes hi look presidential, but at a time where things are going rough with the president and you have so many fellow americans in puerto rico suffering, this is something that i think he believes ignites his base. this is red meat for the 25 or 30% of americans who are diehard trump supporters. and so that cultural conflict i think gives him confidence that he can survive politically, that he can thrive politically. and he wants to make sure that those folks don't leave him, so he reminds them of a fight that they care passionately when. >> and sean, what is your reaction to that? >> i think right now a lot of people when they look at the president's upcoming trip to

puerto rico on tuesday next week will wonder is he going to give a speech that shows that this is where his full attention is or the speech where he diverts to four, five, six other issue, other on different fights that he has been picking. or will it be more of a structured speech that deals specifically with puerto rico and then we'll see does he continue these attacks against the mayor of san juan when he is actually in puerto rico which would be obviously very striking and i think would anger people even more. >> always great to have you both. thank you for joining me this morning. and more breaking news overnight, police in canada are investigating an attack involving a u-haul as an act of terrorism. it happened in edmontonle albe. police say a white chevy ran into a barricade and officer was flown several neafeet.

the driver then attacked the officer with a knife. investigators say the driver intentionally swerved to pedestrians and the suspect was eventually arrested. an iz him slamic state flag was in the car and seized as evidence. next word of u.s. direct contacts with north korea. is this a promising development that could ease the tensions with kim jong-un? military analyst jack jacobs joins us next. on

turning to the rising tenses between the u.s. and north korea. the trump administration revealing it is in grekt contact wi direct contact with the north. rex tillerson made the announcement during his visit to china. the two countries have been trading public threats with the north declaring its missiles can reach the u.s. and president trump vowing to, quote, totally destroy north korea.

joining me now, colonel jack jacobs. what do you make of this new development? >> well, i think secretary tillerson is not skilled enough in the job to avoid making public statements about ongoing negotiations. one of the things that you go if you want successful negotiations is not talk about it in public. if you do talk about it in public, you then are stuck in public positions that are difficult to get out of and especially if what you talk about in public is contrary to other statements that have been made by the government. so if you want successful discussions, it's best to keep them private. >> why would the administration would he veal that it is having direct contact with the north then? >> i think the perception ishe direct contact with the north then? >> i think the perception is the american pin ublic is concerned about north korea and what it might do. it is developing the nuclear

weapons and developing the ability to on deliver them to the united states. there are a lot of public pronouncements on the north korean side.united states. there are a lot of public pronouncements on the north korean side. so i think one of the motivations is to make the american public feel safer and that the administration is in a position to do something positive about the threat from north korea. still even so, it's much better idea if you negotiate and keep it quiet. >> secretary tillerson has been a proceed pponent of uses peace talk but then president trump using terms like rocket man. how does this impact diplomatic efforts? >> it's hard to determine whether the president's continuing use of this method of negotiation, of relationship with our enemies is going to scotch any opportunity that we
