it's tuesday, october 24. i'm ayman mohyeldin. along sigh yasmin vossoughian and louis burgdorf. little by little starting to learn more about what happened in fatal ambush in nigh jersey three weeks ago. three military officials that have been briefed on the incident now tell nbc news that an emerging theory among investigators from the pentagon is that the patrol may have been set up by terrorists who are ticked off in a meeting between the patrol and elders in the village. contains sympathetic and local isis affiliates. those members are believed to hold up the control of the ambush assemble. these types of meetings are routine according to officials. not clear if this part of the meeting was part of the original patrol or had prior approval. yesterday the chairman of checkpoint chief of staff gave an update on the investigation is. >> more importantly we owe the families of the fallen more information.

that's what the investigation is designed to identify. include the mission of, did our forces have adequate intelligence, equipment and training. was there preassessment of the threat in the area accurate. how did u.s. forces become separated during the engagement, specifically sergeant johnson and why did it take time and recover sergeant johnson. >> later tried to clarify questions from the widow of sergeant johnson. >> i want to know why it took them 48 hours to find my husband. why couldn't i see my husband. every time i asked to see my husband, they wouldn't let me. i don't know how he got killed. where he got killed or anything. i don't know that part. they've never told me. that's what i've been trying to find ever since day one. since october 4. >> three u.s. soldiers who were

black congress who requested an apology for chief of staff john kelly. wrongly accused federico wilson of boasting. footage of the event proved kelly wrong. white house stood by him. wilson is responding to the details of the conversation. said yesterday wilsowilson's ac of the call was accurate. joining us now is deputy news desk. david, good morning to you. in the wake of the niger investigation, senator john mccain is calling for a new debate on the war powers act. a lot of members of congress saying they didn't know there were so many u.s. soldiers in places like niger and elsewhere around the world. we know there have been previous attempts at trying to have that conversation. those have fallen flat. given that everything else we've talked about over the past several months that's on the agenda for the senate, how likely are we going to see congress debate this issue any time soon.

>> it's going to be very difficult to get this to move forward and senator tim kaine was one of the main people pushing for this said we are not setting a timeline. not saying it's by the end of this yore. we're still using authorization for 2001 to justify military actions around the world. we really need to get this up-to-date. obviously senator mccain is making it was on his priorities. president trump is not opposing it. he would rather do tax reform. >> let's switch gears and talk about tax reform. president heading to capitol hill to meet with senate republicans. at the top of the agenda, of course, tax reform. we' what's the latest. >> reporter: one thing we're hearing is that people want clarity from the president. he said he wants a whole host of things. is he really just focusing on tax reform. duds he want congress to take up a number of other issues simultaneously. where is he at on health care.

that's been clear. the main thing we're hearing is people want more clarity. >> let me ask you quickly about ivanka trump. she's been hitting the road to hit the child care aspect. do you consider her an effective salesperson or does the white house consider her to be an effective salesperson. >> the white house certainly does. you remember she got the keynote address at the republican convention. they view her as somebody who can kind of cut through and put a more sympathetic light on the things her father is trying to do. the problem is their main selling point is this is for the middle classes, not for the wealthy people. you could certainly make the argument that sending out someone who lives on park avenue and is very wealthy along with the treasury secretary and other architects of the plan who tend to be quite wealthy themselves, are they the best people for this, perhaps not. we'll see what the response to her is. >> we'll see how that goes. live for us in washington, thank

you. disaster relief bill passed by the house cleared on the senate side of things. procedural vote passed the legislation 79-16. setting the stage for a final vote likely taking place later today. the bill would provide $36.5 billion for relief for recent hurricanes as well as wildfire recovery efforts out west. $5 billion of that measure's total could be used to assist puerto rico in the aftermath of hurricane maria. more than one month since that storm tore through the alooisla president trump's personal lawyer michael cohen is set to appear before the house intel committee later today. investigators continue to probe into russia's involvement in the 2016 presidential election. a former executive. involved to build a trump tower

welcome back, everybody. new fallout over former fox news host bill o'reilly. o'reilly is speaking out in the wake of that "new york times" report on the agreement as some of his former fox colleagues weigh in about the matter of the alleged account. nbc news has more. >> i have been in the broadcast business for 43 years. 12 different companies. never one time was there any complaint filed against me. >> bill o'reilly on defense after a bombshell "new york times" report saying he reached

a $32 million sexual harassment settlement in january with a fox news analyst. times also reporting a month later 21st century fox renewed the anchor's contract. 21st century fox says it knew of the settlement, but not the details. fired o'reilly after being made aware of other allegations last spring. taken steps to change leadership. >> o'reilly's suggestion that no one ever complained about his behavior is false. i know because i complained. >> megyn kelly shared an e-mail she wrote in november 2016. complaining that o'reilly was shaming women into shutting the hell up and noting history of harassment of women. >> this must stop. the abuse of women, the shaming of them, the threatening of the retaliation, the silencing of them after the fact. it has to stop. >> o'reilly responded to kelly. >> she didn't file the

into the senate chamber. dave, good to talk to you once again this morning. coming from the white house, a lot. according to the bill and support or lack thereof for it. where do we stand on health care right now. >> trump was for this deal before he was against it. he switched back and forth from the days after it was announced. now he said he would like to make it stronger. my colleague is here. they don't want to negotiate with trump. they said he had his chance to participate in the negotiations early on. now they've reached a deal and have the votes. most of them are democratic votes. mitch mcconnell doesn't seem to want to bring up the deal until president trump is on board. >> let's switch gears for a moment. talk about democrats in 2018. politico has been reporting therein been some early fund raising figures coming in from house democratic candidates. at least 162 candidates to be precise and about 82 republican house districts. they've raised apparently more than over $100,000 each.

curious to get your thoughts on what kind of message does that bode for republicans. should that be worried? >> they should be worried. i think these are pretty startling numbers. seeing democrats who are long from becoming the nominee raising incumbents from their party. pretty unusual. shows grassroots enshothusiasen or opposition to republicans. one comment the republican national committee has deep pockets. they're going to have something to say about the fundraising disparity. >> you had a sander style candidate run against a clinton style candidate. the clinton endorsed candidate, he won and so now he's up and he was supposed to be the electable
