assuming that the government remains open, it would be my intention to proceed the legislation that would address daca, border security, and related issues. it is also my intention to take up legislation regarding increase defense spending, disaster relief, and other important matters. the shut down should stop today. >> now, after mcconnell's announcement. the number two republican told reporters he was optimistic about the vote happening tomorrow at noon. while chuck schumer says as of right now he went to the microphone after, no agreement has been reached. take a listen. >> i am happy to continue my discussion with the majority leader about reopening the government. we have had several conversations. talks will continue. we have yet to reach an

agreement on a path forward that would be acceptable for both sides. >> all right. let's go to capitolill. correspondent. holding a marathon here. watching what's happening. i know you have a very important discussion ahead you. senator jeff flake took to the floor. >> that's right. it's very gracious of you to share a few minutes of your shows time with us. senator flake did come over here. to explain a bit of this. you have been you've told me described it as shuttle diplomacy. you lindsey graham saying you'll side with the majority leader. what does this mean? >> one he agreed to move the date up. so it's a week sooner. >> a week of the government funding? >> we agreed to that. it will be on the eighth of february. when the cr runs out.

he agreed to move to an immigration bill if we don't reach agreement by that time on daca and other immigration related issues. >> you think that's a significa significant commitment? >> i do. i received a commitment on the tax bill to move to immigration. it was always conditional. on or it became conditional on the president's supporting that proposal. and we just haven't seen the white house settle on any proposal. so the majority leader wasn't going to move forward. this now we're regardless of what the white house is going to say we're going to be the senate. we'll move ahead and we'll deal with the house and the white house. >> where do you think democrats are right now. is chuck schumer happy with this? is his caucu happy? >> they would have liked more of a commitment. proceed. to bill. >> that would be vote on a bill essentially the senate floor would take a procedural step in public before february 8?

>> the problem with that unless you finish the immigration bill before february 8. when we have to deal with the next shut down february 8 that kicks the bill off the senate calendar. and you can only bring it back -- if you have consent. we want to be able to start the immigration bill and finish the immigration bill. that will give us time. >> what does that mean for where schumer is going to talk to members of his caucus. is it your sense they'll be receptive and the government will open tomorrow? >> i think some will. some will remain reluctant. five democrats voted to keep the government open. so. >> you mean seven more? >> i believe that's the number. we voted to have the shorter time frame. we'll vote yes. we believe the commitment is significant. and i hope that we have an enough to open the government back up. >> behind the scenes are democrats feeling the pressure?

are they taking the blame for the shut down? >> i don't know. the both sides have been saying we're getting the better of that. nobody wants to toast it when it really matters. the first of the week. when it really on the weekend, the affects are muted. on monday they start to be felt. i don't know that anybody really wants to test that. for any side to say the other side is going to get the blame i don't think they really know. >> do you know where the president is? has anybody talked to him about support going forward in this way? >> the important of this is regardless of where the president is, we'll move ahead. we'd like to work out a deal with the president. before the eighth. that would be best. and put that deal on the senate floor. but if that can't happen we're not going to say we can't move. what we don't want to do with regard to daca is get all the way to march 5. where you have to jam some solution through. >> at that point kids are losing jobs and losing status.

>> that's correct. and what would likely happen at that point is legislative equal to daca. which would be constitutional. it wouldn't be anymore certain for the kids. it would be another several months or year or two with this status without knowing if they can ever become citizens. what happens to their parents and other things. >> if the senate is able to pass an immigration bill, is there any guarantee it can pass in the house? what does the house need? do they need the president to sign on. >> the president needs to sign on. if the senate passes legislation with 60 or 70 votes it has to be 60 to pass. we can get more than that. i believe the president will say what he did in that famous meeting thag we had a couple weeks ago, i'll sign it. i'm flexible here. and i think that if he gets behind it the house can pass it as well. >> do you think steven miller and john kelly will blow this up before noon tomorrow? >> i think there are certain

you were doing the play by play as i was watching you on air over the last two days. is this a step forward based on what you saw from mcconnell just within the last hour? >> absolutely is a stech forward. even the speech from mcconnell alone is a marked change in tone. every speech since the lead up to this shut down really almost starting on thursday, has been to throw democrats under the bus. and the blame chuck schumer for choosing this path. while he lays the blame for the shut down on the feet of the democratic lead. this is the first time he gave thim a an off ramp. here's what i'm willing to do differently than before the shut down started to make it end. there was a concern among republicans by giving up anything to democrats that you would be essentially encouraging this type of tactic used in the fump. democrats could say we'll with hold votes for anything dwoent like to get what we want going

forward. they didn't want to see a give away by the majority leader. mitch mcconnell says i'll commit to dealing with these things on the floor of the senate. not with a specific bill. not to attach them to things that have to pass but to say i'm willing to let the senate be the senate. and discuss these issues. the question that hangs before us now rk hangs before senate democrats, is that in of itself good enough. or between tonight and noon tomorrow. or as far as they want to take this. do they need to extract a similar concession from speaker ryan that he would take up the same issues. from president trump that he would be will be to support them. they need to see the gram durbin immigration bill. that theyan sign onto. that will be the big question over the next 14 hours. the math is impossible now. my brain is fried.

between this moment and the noon vote. tomorrow at 10:00 a.m. is a good spot to circle. the democrats will meet. and at the same time at least scheduled right now the bipartisan group of senators who we have been watching over the last two days they're going to meet to talk about this. if they're going to be the six or seven democratic votes that jeff flake was talking about, they'll come out of the bipartisan meeting. i don't expect to see the harris the murphy, warrens, of the democratic party decide this is good enough. there maybe moderate democrats who say enough is enough. and we want to work on this in good faith with the republicans going forward. we'll find out tomorrow. >> your math is spotless. 14 hours. despite staring at the camera for many more on that. jeff, to you on this. you heard what casey was asking senator flake. if it comes down to the house, if the senate does move forward with what the mitch mcconnell just described on the floor

about an hour ago, will it be a president donald trump that needs to get behind this before the house signs off on what mcconnell is suggests? >> you have democrats even some republicans to include at one point. senate majority leader saying he didn't know what the president would agree to. or the point what he would sign of on. of course we know the president has his own hard line views on immigration and tonight senior administration officials tells nbc news the senior policy advisor steven miller as well as the president's chief of staff have worked together in lock step finding common cause and trying to torpedo the immigration deal that senate democratic leader thought he walked away with on friday. when he left the white house lunch meeting on friday. so that's what we're waiting to see. how receptive people in president trumps orbit might be

to the broad out loin ot deal coming together. on the hill. the president has been criticized for being a passive player in this. the view we're getting from white house officials is today in particular the president really wanted to give senators time and space to hash out this deal. and he would weigh in on the back end. >> as has been said. will the tuesday the thursday donald trump show up. in this case will the monday donald trump be different than the other two. jeff, on this very point then, any indication in terms of response from the white house as you look at the residents to your side. are the lights on? >> from my vantage point i can't tell. the president has spent much of the day here at the white house monitoring the developments. but again, we haven't seen him all weekend. apart from some photographs the white house took and released. we hen't sn o heard from him. besides getting a peek into his

mind b twitter. who knows what the senate is set to vote tomorrow at noon. i'm sure we'll get tweets from the president before then. question is, how much of a complicating factor is the president in this deal as it sort of comes together. >> all right. jeff and gar ret. thank you so much. we have many more questions and nuances to what will be happening in 14 hours. let's bring fl democratic congressman of california. on the house side. you have been part of the discussion going back and forth. as you look over to the other house the senate, what is your reflection here on what may have happened and what will happen in the next 14 hours? >> i think we're getting a lot closer. now there's a commitment to finally get this issue of immigration large and small to the daca as well as the larger immigration issues on the floor

of the senate. that's good. i think they'll need to go further. clearly this is going to be negotiated first in the senate. the big question that i have is what can you get through the house? the house is a very conservative operation. trying to put together some folks on the house and some of those that are interested in the daca deal. to try to talk early on about what is the art of the possible here. >> what is the art of the possible, sir? >> we'll see. there were three different plans that have been put together over the last several months. if you lock at the plans and lay them out, you'll find there are opportunities. you take a little from one plan and some from the other and the daca piece. i think we can get there. i really do. we have to. the public really needs to deal with it. we have to get this government funded. >> as it stands, let's put in

writing that we will discuss this very issue of immigration. daca as well as chain migration and others. the wall for instance. that will lay out a day by day or date by date schedule. and put in black and white. is that enough you think for the folks on the other side of the aisle? >> there's certainly a big improvement from where we are today. there's a big question mark. it's on 1,600 pennsylvania avenue. where's the president on this? he better be signing that document. because that has been one of the real fault lines in the entire negotiation process. >> your belief here is in other words for this whatever bill comes to pass and hits the house, that tts going to need donald trump to come down the president and say i support this coming over from the senate. and maybe rank and file republicans on the house will then sign off. that's what you're saying? >> i think it will be important. he said he would take the heat. well, he's going to have to be a

leader. otherwise you have very conservative folks and people that are heated on this entire immigration issue over in the house of representatives. so that is a problem first the senate. the senate should be very aware of the mistake the house made. the house republicans did not negotiate, did not negotiate with the democrats at all on this continuing resolution. so it went ore to the senate. really without any democratic support. we don't need that coming back to the house. we have to have an early discussion. make sure there's some sign off among some of the key players in the house of representatives on the republican side. >> what are some of the discussions that have led up to what happened? the last hour that you're aware of. what are the nuances of the detail going back and forth. from right to left or within the two representative parties in the house. >> well, i just really can't tell you that. i can kind of guess about what's going on.

obviously there's 20 senators that were working together. their working on some detail that important. at the top leadership level. i think it's a matter of nailing down some of the detail. so there's assurance this will be a vote. and clear out lines on what will be in that. >> is this enough? putting in schedule would you vote for this? >> we don't know exactly what it is. i really want this over. this is a very serious problem. in california we have people dying because of the flu. and at the same time we have the center for disease control shut down. we know there's some 40 clinics throughout california that are not going to be operating. they're the ones that will be the first receivers as the flu begins to hit my state. that's one of many problems we have to get the government back operating. >> so you'll wait to get more detail? you cannot support it based on what you have heard so far. putting this in the schedule

government shutdown. just in the last hour we have had a new development. that's mitch mcconnell coming to the floor. suggesting a again a new oion here perhaps the democrats agreeing to it at the moment. chuck schumer saying no that's not what we want at this time. we'll have to wait until tomorrow. the 1:00 a.m. original vote that was to happen in the senate is

moved to noon tomorrow. about 14 hours of digestion on both sides to determine of this new wrinkle. will work for both sides. let's bring in now lee ann kald well. capitol hill reporter. and michael steel. former press secretary for john baner. let's start with you. give us what the wrinkle is. is it a big enough wrinkle for the democrats? >> i think that even though the senate adjourned today with no finality. no kout come. the government will enter the third day of shutd down. thst still a little bit of progress being made. the reason that schumer objected to holding a vote tonight. he needs to talk to his fellow democrats to see if this proposal is okay. and if this is enough for them. if they can try to squeeze out a little bit more from the majority leader. between now and tomorrow.

senate democrats are holding a conference a caucus meeting tomorrow morning. to discuss. i'm talking to senate democratic aids and they say they don't know exactly what is in the pill bill yet. or in the proposal. the so called deal. they want to learn more. and they're not yet willing to go along with it. until they learn the details and hear directly from their leader. >> michael, did this surprise you? i laid out how we origin hi had a calendar of what we thought was going to happen and it changed. you were watching this unfold. were you surprised by mitch mcconnell and what he offered up? >> no. this may not yet be the beginning of the end. it's the end of the beginning. they're talking and making progress. they don't have an agreement yet. but the republicans are starting to come back on board. we'll see what the democrats join in as well. this sort of agreement to push

the deadline by a period of hours makes it seem as though they're not there yet. but we could very well head towards reopening the government at noon tomorrow. >> part of the move potentially here, is that we were facing hundreds of thousands of people waiting for that 1:00 a.m. vote. we're talking about federal employees. some state employees affected too because of a pass through federal funding and want to get it done earlier so folks could go to sleep. as you look at what the next step is, noon tomorrow, what's going to happen between now and then? >> well, first i want to say i have federal employee friends when are texts me all night. >> i bet. >> what's going to happen, do i go to work tomorrow? as of now they don't. what happens between now and then. they'll go home and sleep. first of all. it's been a long weekend. a long week. people are tired. eating a lot of bad food.

but like i said, the senate democrats will gather tomorrow to figure out if this is something they can support. they're talking about dreamers and daca. there's a lot of other issues they want some finality on. or at least a commitment on. that's opioid funding. that is disaster aid. puerto rico aid. health insurance stabilization for the insurance market. there's a whole host of issues that republicans and democrats are haven't agreed on that are outstanding from the past year. and they'll go and huddle and see if this is enough. and if we have to watch a lot of the red state democrats. these group of ten who are up for reelection in 2018 in states trump one. they perhaps get this over the finish line while leaving room for the lib kal senators to not have to vote for it. so i think it's this middle plank e moderates that we'll

have to watch and see if they start breaking. >> by the old numbers. zempb democrats move to the other side on this. michael, who blinked here? who blinked in this back and forth? >> i think the democrats found they were not on as strong a ground as they thought they were. this is aless season republicans learned in 2013. there is overwhelming public support for dealing with the issue created for dreamers. at the same time there's very little support for shutting down the government in attempt to get a resolution on that issue. i think what we'll go back to ultimately is a continuation of the bipartisan talks on immigration reform. a budget deal. and the other issues that she discussed. >> michael steel, lee ann, thank you for staying with us. we are watching the developments there on the hill. cannot appreciate both of your

government shutdown. now as we get closer to a day number three. we have had a development if you're just joining us. at the bottom of the hour. just within the last hour 15 minutes the majority leader in the senate, mitch mcconnell. coming to the floor and offering a new scenario. open the government until february 8th at which time up to the date if the discussion on the issue of the daca was not resolved they would then put it in to calendar. to discuss after the fact. the question is, with all that happening, is that enough to reopen the government? for the hundreds of thousands of

folks that will not go to work tomorrow to go to work on day four. i want to bring in andrew. as mitch mcconnell here came to the floor and offered this up, and you loo at again chuck schumer response. he came to the floor there after and said we're not going to vote an hour later from now. we have to wait until tomorrow. was it because there's an issue of trust? will the democrats, schumer as well as his caucus, will they follow along and go with mitch mcconnell here? >> it is an issue of trust. i thought he immediately objected to having a vote in an hour. he needed to go back and further review this. and they need more time. as a group to decide when they want to take this deal. the big question they'll ask themselves is do they trust mitch mcconnell. to follow through on these cup of promises that he made. in order to start debate on daca

related measures, border security, before february 8. i talked to senator flake earlier tonight, he said a big hiccup was whether they'll deal with government funding at that time. table and immigration resolution and get into immigration after that. which would take time and bring us closer to the march 5 deadline much these are things democrats have to consider. when they decide whether they'll get on board with this tomorrow at noon. >> from what you were able to see, you being right there on the hill here, all we could see from our cameras from the span supplied video. was the republican leadership skruming in the lower right hand side of the skroen. and mitch mcconnell going up and putting o was what just describing. how much outside of the leadership in the senate -- republican leadership -- did he canvas before coming up to the microphone that you know of?

>> met with senator schumer off the senate floor earlier this evening. for a short time. also a group of arpd 22 senators from both parties met earlier in the afternoon to draft what would be a proposal that republicans can talk take to their leaders and democrats can take to their leader. the spoke with the number two republican in the is that the. he shot down the idea of a firm commitment on daca before february 8. he said it gives democrats a political win. and rewards them for having in his view shut down the government. again it will come down to whether democrats trust mitch mcconnell can follow through on this by february 8. he doesn't have a good history of doing that. with the tax bill that senator flake supported. he supported it and it was contingent upon him getting a vote in january on daca. that won't happen. he vented his frusation to me earlier this week.

susan collins got a promise about votes on affordable care act stabilization bill for the month. and never came to fruition either. mitch mcconnell's promises democrats have to decide whether they'll trust them. >> and will it be put in black and white. really quickly here, who do you think on the democratic side, seven are needed. if this goes up for vote here? >> i think of course you have the moderate senators from red states. up for reelection this year. that are going to vote for any sort of continuing resolution like the one they voted for a couple days ago. you'll see some more moderate senators get on board who i think are getting a little bit skiddish and worried about what the democrats end game here is. with the shut down. i think democrats based on the folks i talk to here are getting worried they might be getting the blame for this shut down in the end. and i think it's going to come down to whether they have the numbers at least among a small

number of democrats. not a majority. but a small number to get them over the 60 vote threshold tomorrow. that will do it. >> thank you,. speaking of who might at least on the left. when we look at the senate. any democratic senator that may move over and support what mitch mcconnell suggested an hour 15 minutes ago. senator jeff of oregon. and you voted no officially. would you vote yes to this? >> it's doubtful right now. because we haven't seen anything that puts any solid foundation under a path way to per sue fairness and justice for the communy members who have had legal status ripped out from under them by president trump. >> you heard what senator mechan mcconnell is suggesting. i will put it on regular order

if we don't come to a solution by february 8. is that enough for you? >> no. it's sure not. there has to be a path way that is nailed down much better. because mcconnell's version of regular order simply means he controls the place and does what he wants. and he is preached about regular order and previously that meant he wouldn't lock up the amendment box to people would have a chance to do amendments. apart from reconciliation which is a different beast. we had no amendments throughout 2017 from the democrats. he's proceeded to just for example, shut down or ability to have a vote a bipartisan vote on keeping the government open for three days during negotiation. he sealed the deal on the trump shut down. and blames democrats when he's the person who made the shut down happen.

so there's very little trust if the old saying goes your word is your bond. we haven't seen mcconnell ever stand up for his promises. >> that's what andrew was saying. tomorrow is the day where hundreds of thousands of federal employees will not be going to work. this is where the rubber really does hit the road for the majorityf feder eloyees and departments we're seeing 50 to 90% of employees not going work and being furloughed tomorrow. what will you say to some of those? i was reading the san antonio express for instance. not from your state. but those who were saying this is two different issues. why are we closing down the government -- what we care about daca as a citizen as a resident of texas. but why are we putting those issues together? that's what some americans are saying. what do you say to them? >> i would say they should be angry with the president.

he bragged about wanting a shut down. he created this. he didn't intervene with mitch mcconnell. let's have a vote to keep it open. mitch mcconnell blocked that and you have to assume therefore that the president was behind blocking it as well. and so they should be upset with this president. and the republican team. which took these issues including our community health centers, funding to take on the opioid epidemic, our chip. things sha should have been before the end of the fiscal year in september. but the republican said it's too important to pursue a health bill that would destroy health care for 30 million americans. and it's too important to have a tax bill to rip off the treasury to give a trillion dollars to rich americans. we won't bother with the general business of governing on health care for the communities. healthcare for the children, and

opid treatment. and enough is enough. the republicans have shut this government down. they're in charge of everything and need to be held accountable. >> senator, as we look at some of the reaction so far, in the headlines and you see them. you're very busy on an evening like this. we appreciate you stopping by. that is i'll go to plit co. they are saying one of the headlines, is that the republicans have been able to stay united in the messaging on this very shut down. are democrats being able to also stay united? is the momentum now shifting toward republicans saying it's a democratic problem. it's there fault. >> well i can't say drt democrats are very good on staying united on messaging. the facts are the facts. the only person who's bragged about a shut down is the president. the only person who said it's a

cool thing is his director of office of management and the budget. the only person who insisted and sealed the deal of the republican head of the senate. to refuse to allow what would have easily pass for a three day continuing resolution. i hope the american people are paying attention to who's in charge, who's causing this to happen and why. please understand that the reason that the republicans want to drive a wedge between this bill and the iss of addressing our community members w have had legal status destroyed by the president, is because they know that if a bill is passed in the senate, that it's standing alone. if thst no path to get through the house to the oval office. it's a very deeply cynical assault on our community members who are legal now. but are losing their legal status with nowhere to go, no

other country, no other language. they're contributing members of the community. it's shameful, terrible act by the republicans against the fellow legal residents. >> as you noted what we'll see exactly hopefully at some point what senator mcconnell is suggesting. in that he will have a scheduled to bring up these related issues to immigration daca. chain migration, etc. the devil is in the detail for both sides of this. when we remove that for a second and we look at the political football, which this is, having the democrats already gotten what they theed for 2018 for june, july, august, post primaries when the members dpo back in a reelection they did stand up for daca. during the continuing resolution debate? >> well, you know, this isn't about positioning forhe election.
