it's tuesday, january 30th. we begin this morning with republican members of the house intelligence committee who have voted to release a controversial and classified memo that party members claim shows corruption in the fbi that is, quote, worse than watergate. but democrats argue the memo is reckless and full of cze cherry-picked facts. >> reporter: the mystery over a secret memo, the latest flash point. so what's in the memo? only a few lawmakers know for sure. >> transparency is a good thing. >> republicans say the memo details abuses by the justice department, that the agencies acted inappropriately when requesting surveillance words for the president's campaign team.

justice department said would be extraordinarily reckless to release. >> thanks to peter alexander for that report. i'm not sure about a lot of clarity. >> not much clarity at all. more details are emerging about fbi director andrew mccabe. the "new york times" reporting that according to two people close to mccabe, he felt pressured to leave by fbi direct director christopher wray. when the bureau was investigating both headquarter had headquarter's e-mail use and the trump campaign's connections to russia. the report is expected to address whether mccabe should have recused himself from the clinton investigate because of his wife's failed state senate campaign which received support from clinton allies. a former law enforcement official close to mccabe told the times that wray suggested

moved mccabe into about another job, which would have been a demotion. mccabe was removed from the bureau according to reports. director wray's memo said, quote, my conviction to adhering to process is similarly matched to my conviction holing people accountable. i will not be swayed by political or other pressure in in my decision making. >> however, some republicans have called attention to how intelligence committee chairman devin nunes memo. ohio republican jim jordan told msnbc yesterday that its contents could have influenced deputy director mccabe's exit. >> fbi director wray revealed the memo yesterday and then is today suddenly he's stepping down. so there may be something to it. i simply don't know. >> you've seen the memo. is andrew mccabe named in it? >> i can't tell you that until

it goes public. >> but you seem to imply that he is named if you're saying that -- >> all i'm saying is those two things happened. is there some relation? there may be, there may be. >> while wray saw the memo, the justice department did not have the ability to review it before the vote. and the concerns with the memo had not been alleviated. nbc news learned of an exchange between andrew mccabe and president trump. president trump called mccabe, then acting director, demand canning to know why comey had been allowed to fly on an fbi plane after he was dismissed. comey was fired may 9th of last year. pootage showed him boarding a plane from los angeles to washington, d.c. after having received word that he had been dismissed. during their phone call, mccabe told the president he had not been asked to authorize comey's plight, but if anybody had

asked, he would have approved it. that's according to three people familiar with this call. the president was silent for a moment and then turned on mccabe, suggesting he ask his wife how it feels to be a loser, an apparent reference to a failed campaign for state office. mccabe replied, okay, sir, and the president then hung up the phone. a white house official who would not speak on the record disputed the call. >> in the past, trump has reportedly asked mccabe how he voted in the 2016 elections and asked about campaign donations his wife received from an ally. sarah huckabee sanders said mccabe was not involved in the decision to step down. >> i can tell you none of this decision was made by the white house. any specifics, i will refer you to the fbi. >> you say the white house was not involved in the decision, but clearly the president seemed to be involved in a public

relations campaign against mccabe. >> look, the president stands by his previous comments. >> you say definitively the president did not play a role in andrew mccabe stepping down? >> yes. i can tel say the president wasn't a part of this decision-making process and we would refer you to the fbi where christopher wray serves as the director. >> and is with president trump's first state of the union just hours away, he's told reporters that his address will stress bipartisanship on capitol hill. >> mr. president, how is the speech coming? how is the state of the union coming? >> it's coming along good, we covered it, working hard on a lot of territory including our great success with the tax cut and the markets. for many years, for many, many years they've been talking immigration, they never got anything done. we're going to get something

done. we hope. it's going to be bipartisan. >> his call for bipartisanship comes as the clock is runninging out for lawmakers to reach an agreement on immigration before the february deadline. white house officials say that trump did a run through of his address in the room yesterday afternoon. >> all eyes tonight will be on the state of the union. apparently none were done on the tickets. you can see they call it the state of the uniom. several lawmakers, including marco rubio had some fun with the misspelling. a scattered showers with the office at arms said the error has been corrected and new tickets are now being distributed. it's not the first time there has been a high profile spelling mistake during trump's time in office. you may recall this one. this regarding twister, though. examples include promoting the possibility of a lasting peach

in the middle east, twice calling the president's plane air force once and misspelling an ambassador's name in his official announcement and adding a bunch of letters to west virginia. >> all right. there's going to be five democratic responses tonight to president trump's state of the union. just five. representative joe kenyon of massachusetts will deliver the official democratic response and elizabeth guzman is set to deliver the official spanish version. representative maxine waters from california will give her own response, the beginning of a special while former counselman donna edwards will give remarks on the progressive group of working family.

>> what do you expect to hear from democrats in those five responses to the state of the union? >> uniom. >> yes, according to the sergeant of arms. so many different responses. is there going to be a central theme or are you going to start hearing every one of these groups who have their own agenda in the response? >> you know, it's going to be interesting. representative kennedy is an interesting choice to give the official english language democratic response. representative kennedy, despite being in congress for several years, has a low profile, a somewhat centrist voting record on issues such as marijuana reform. so it's going to be interesting to see who really gets the headline out of the democratic responses. maxine waters is very colorful an tag insist towards president trump.

it's possible they will over-shadow representative kennedy's official response here. >> i wonder if they're going to drown each other out. >> someone on my show on sunday said the dmgs missed a moment where they could have chosen a rising star amongst women. >> someone to showcase. >> exactly. i want to turn back to the memo now. there seem to be some real urgency on the part of some house republicans to get it out there. why? do we have a sense of if and how the this might change the course of the russia investigation, at that if at all? >> what we know is it's about 3 1/2 pages. we don't know a whole lot more beyond that. reference congressmen have been reading this in a secure room in the capital complex. they describe it as as alarming, a terrible abuse of power. whether or not it is depend on whether you're a democrat or a republican. democrats say it's a very misleading document.

i attempted to find some bipartisanship because usually surveillance is a bipartisan issue. but a congressman who i talked to who is usually very active and concerned about surveillance issues, she agreed with the leadership that had it's misleading in her words. so it will she interesting to see what's in this document. >> and to that point, let me ask you quickly, because i know that you have a new piece up about the former democratic senator who made the pentagon papers back in the day. he's actually advocating for the release of this memo. what's his argument for that? >> it's a principled argument that's not specific to this one document. he says that members of congress, under the constitution, have immunity to release to the public what they feel is in the public interest. and that if republicans are voting to release this, as they did in the committee yesterday, it would be, quote, a cowardis

the abrupt departure of the fbi director andrew mccabe. >> mccabe has been involved in the ongoing tensions between the president and the fbi. >> ayman, it was widely expected andrew mccabe would be stepping down as the fbi deputy director when he became eligible for retirement in march. so this sudden departure catches the rank and pifile by surprise. two factors are behind andrew mccabe's decision to step down as deputy director. first, wariness and criticism from president trump. those tensions flared the night the president fired james comey who was out of town. he watched comey return to washington on a government plane. >> the president called fuming that comey would be allowed to take this plane home after being fired. then he suggested to mccabe he

committee's attention a week ago when we first took up the majority memo. and that is we need to be concerned with mott just what happens during this presidency, but the lasting damage that may be done to these institutions. >> and congressman mike conoway, the republican's head of the russia probe pushed back, but also said an investigation is necessary. >> congressman schiff said you guys are now formally investigating the doj and the -- >> no. you'll understand exactly what's going on. >> former white house chief strategist steve bannon is set to return to capitol hill tomorrow. bannon will testify before the house intel committee for the second time after lawmakers said he failed to answer some of their questions during his testimony earlier this month. bannon refused to answer lawmakers questions about his

time at the white house or during transition after president trump reportedly ordered bannon to limit his testimony. however, chief of staff john kelly denies that he invoked executive privilege while speaking to lawmakers. the "l.a. times" reports an emergency appeal was tiled with the supreme court by pennsylvania republicans seeking to block a ruling from their state's high court ordering congressional districts be redrawn on the grounds that they were created to favor the gop. now, the brief was filed with justice samuel alito who reviews emergency appeals for pennsylvania and two other states. justice alito could have chosen to deny the appeal if he thought it was unlikely his colleagues would actually grant it. the morning call reports the secretaries of state from alabama, arizona, south carolina

and arkansas all supported a brief supporting the emergency request arguing that redistricting would be disruptive and confusing to voters. congressman rodney f if relinghuysen will not seek re-election. the congressman is chairman of the powerful house appropriations committee. the 11-term congressman faced a tough re-election and republicans long worried that he will retire. he is the eighth house republican committee chair who has decided to retire or run for a different office this election season. overall, the number of house republicans decline to go run for re-election has hit a record level this year, totalling 33 in what is shaping up to be a challenging midterm election year for republicans amid the continued retirement elections. a growing amount of data suggesting that the midterm elections may result in democrats taking control of the house of representatives from republicans, but a democratic

takeover appears to be harder to achieve. you have andrew mccabe stepping aside, now the house is focused on rosenstein. a lot of liberties the president seems to have taken. should the democrats manage to win back the house if not the senate, what is the likelihood they will seek impeachment here? >> there's an absolute certainty that many of them would. there were 58 democratic members of the house who voted in december to impeach president trump. that's -- impeachment resolution did not cite high crimes and misdemeanors. the if democrats were to pick up more seats, there will be more movement from that. one of the greatest impediments to impeachment is democrats would get president mike pence

if they impeached trump and that's a prospect that democrats certainly would not look forward to. >> let's switch gears and talk about andrew economic kab. obviously, that is the question everybody is talking about in washington, d.c., was he forced out, why did he suddenly designed to resign. it was seen as obviously an abrupt departure. everyone knew he was expected to resign in mid march, but it came at a time when it's surrounding this memo, the inspector general's report. what are you hearing? >> his retirement was anticipated in march, anyhow. the fbi director christopher wray seemed to hint yesterday in a message to fbi staff that this had some involvement with an upcoming justice department inspector general report. the inspector general is well respected. he is an an equal opportunity muck racker. so it's certainly possible that

welcome back. let's turn to business ahead of what is expected to be an economic state of the union address. budget experts are anticipating a record deficit as the dow dropped 177 points. cnbc's joumanna bercetche joins us with more. what kind of impact is the state of the union going to have on the markets? >> good morning, lewis. starting with the stock market.

it was the biggest decline in five months, pulled down by c caterpillar and apple. apple down as it was looking to half the production of the iphone x. the s&p 500 is up 7% for the year so far the best year since 1989 for equity markets. lots of things to focus on this week. the fomc on wednesday and lots of earnings to watch out for today. mcdonald's earnings, hopefully lewis's big mac consumption will give the earnings a bit of a boost. the focus on the state of the union will the state of the economy and the health of the economy. gdp numbers last friday came in slightly lower than expectations, but still hanging around the 2.6 mark. >> how did you know i like big macs? i can't get a break in london. google's self-driving car is ramping up plans to launch its

service. with a new partnership with chrysler. exciting stuff, driverless cars. >> waymo said they are partnering up with chrysler pacifica, releasing a fleet of self-driving minivans later in the year. they haven't said how many cars are in the minivan fleet. but the expectations for it to be somewhere around the 10,000 mark so those will be in the markets very soon. and of course, this comes at a time when there's lots of competition about the self-driving vehicle capacity with, the likes of general motors and ford also coming into the race as well. that's it for me. >> i don't feel comfortable with a self-driving car. i don't think i'm there yet. >> if you have a self-driving car then you could eat more big macs, while you're in the car. >> yes. >> joumanna bercetche live from london, thank you so much. let's talk about this story, this is a story that's gone viral on social media. the u.s. military announced they will begin reviewing its

deadlines for the use of wireless devices at military facilities after an online interactive fitness tracking map was revealing a lot of the positions of what was believed to be u.s. military personnel positions around the world. it is being described as a security oversight. the global heat map published by gps tracking company strava, showed where fitness app users were located. as you can imagine, a lot of people working out staying in shape, while highlighting the locations and layouts of u.s. military bases in some of the most dangerous and remote parts of the world. including places like afghanistan. i know that some people tracked as well in syria. now the pentagon is weighing in on all of this. saying its policy on fitness trackers will be reviewed. strava says the company takes the safety of their community absolutely seriously.
