with mexico. a lot happening today. good morning. it is wednesday, march 28. we begin with the latest in the crisis with north korea. as the widely suspected kim jung-un visited china on sunday and left early wednesday local time, it is believed to be kim's first foreign trip since he rose to power back in 2011. his father and grandfather both made several visits to china which is easily north korea's closest and most important ally. according to chinese state media, the, quote, unofficial visit came on the invitation of president xi jinping and the two leaders held talks at the great hall of the people. china state media also says kim says it is our consistent stand to be committed to denuclearization on the peninsula and that it can happen

if south korea and the u.s. respond to our efforts with good will, create and at loss fear of peace and stability while taking progressive measures for the realization of peace. kim also reportedly reiterated his desire to hold a summit with the united states. kim is set to have a superintendent mitt with moon jae-in in anticipate and possible meeting with president trump could potentially happen before the end of may. in a statement press secretary sarah huckabee sanders said that beijing contacted washington on tuesday to brief them on kim's visit and that this is further evidence the maximum pressure campaign is in fact working. the white house is defending the decision to include a question regarding citizenship on the 2020 census. the commerce department announced monday night that it was reinstating the citizen ship question saying the move was being made to help enforce the voting rights act arguing previous census surveys before 1950 consistently asked citizen

shin questions. now, the department says the decision follows a request by the department of justice to add a question on citizenship status. critics were quick to slam the department's justification with civil rights groups having long claimed the question could jeopardize the accuracy of the census. at least 12 blue states including new york and california are suing challenging the trump administration's plan. they argue the move could lead to undocumented immigrants avoiding the census creating an underestimation of the number of residents who live in certain state. that could put billions of dollars of aid at risk. since the figures from the census are used to all low indicate federal money. it is also used to redraw congressional districts, so it can affect the makeup of congress. and despite the concerns, the white house is sticking by its

move. >> what do you say to critics who argue that ultimately this is a way to target immigrants, that it will be fewer resources for immigrant communities? >> once again i would argue that this has been the practice of the united states government, the purpose is to determine individuals that are here. it also helps to comply with the voting rights act. without that information, it is hard to make those determinations and the information has been part of the united states census every time we've had a census since 1965 with the one exception of the 2010 census. >> so despite the white house's claim, the official census has not included the citizenship question since 1950. it has been on other surveys regularly sent to households throughout the year. the constitution does require the government to calculate the number of people living in the u.s. with the census to determine the seats in congress among the states.

and despite repeatedly promising to make mexico pay for his desired border wall, president trump is now floating a new idea. using america's military budget. in a tweet on sunday which he retweeted monday, trump wrote sinksz t since the military is rich again, building a great border wall is all about national defense. two advisers say that the m stands for military and also a report that trump discussed the idea with house speaker paul ryan. the plan would almost certainly require congressional approval if it was even constitutional. yesterday sarah huckabee sanders was asked about the situation, although she didn't have much to add. >> i can't get into the specifics of that at this point, but i can tell you that the continuation of building a wall is ongoing and we'll continue moving forward in that process. >> isn't it true at this point that mexico is not going to pay for that wall? >> i won't go beyond what the

president has already said. i think he still has plans to look at potential ways for that to happen. >> what ways is he considering to have mexico pay for the wall. >> >> when we have an announcement on that, i'll let you know. there has been a joint public statement about respecting the independence of the special counsel. republican thom tillis and chris coons said, quote, we have heard from constituents, republicans, democrats an independents alike who agree that special counsel bob mueller should be able to condition duct his investigation without interference. this should not be a partisan issue. we urge president trump to allow the special counsel to complete its work without impediment which is in the best interests of the american people. the president and of course our nation. they are co-sponsors of the integrity act which would restrict how and why mueller or any similar prosecutor could be fired. this as democrats on the senate

judiciary committee wrote to five officials in the line of scrimmage of succession under rod rosenstein at the department of justice asking them to publicly commit to refuse any order on or request to interfere in the special counsel's investigation. joining us from roll call, thank you for joining us. the news of the census is really breaking yesterday. as we mentioned, the commerce department has agreed to include a citizen ship census status question on the 2020 census. what kind of impact do you think this could have on communitiesing a crocommunities ing across the country? >> there are really two different kinds of impacts. first of all, there is this question that you raised in the open of whether or not it will disadvantage communities with large undocumented populations in terms of their ability to get federal grants for everything

from schooling to law enforcement and the like. and the other question is that the census of course is used for the apportionment of seats in the house of representatives which is to say that when we go to redraw the congressional maps after 2020, you will determine the number of seats that each state has based on the population. and one of the things that might be interesting to see is whether or not there is any sort of effort particularly by the trump administration to use the is the zen ship numbers to determine how many seats should be in each state in congress. >> this is obviously a developing story so we'll have more in the days to come. i want to turn to the news of the border wall and how president trump has floated this idea of the military now paying for the border wall with mexico. how serious is this? >> well, this is a proposal that

has one immediate problem that the white house would have to figure out a way around and that is that generally speaking unless you are talking about really small amounts of money, the reallocating of funds by an executive agency like the pentagon to do something that the money wasn't provided for requires the consent of the leaders of the armed services and appropriations committees probably in this case. which means as far as i can tell, i think that john mccain who is the armed services chairman in the senate who isn't exactly on the same page as president trump on immigration would probably have to approve the money and right now i don't see that happening. >> yeah, that wouldn't necessarily be an easy approval. thank you so much. appreciate you joining us today. still ahead, new developments overnight in the stormy daniels scandal as her lawyer makes a move to get the president under oath. our legal analyst is here to help break it down. and on the heels of kim

weapon that could be on an icbm, you look at the time line for negotiations, in april conversations with south korean counterparts and in may with trump, if those talks fail, there is an indication that the military option could be very real. and i think that is what everyone here is starting to factor in. yes, this is a significant development that kim jung-un travelled to china. the first time he has been out of this country as leader. he specifically talked about denuclearization, the first time that has been on the table from the north korean leader. so a lot of firsts here. but also a lot of questions about what happens if all of this momentum going toward negotiations, if all of it fails and what the other purpose of this conversation between president trump xi and kim jung-un might have been and that might be a mutual defense treaty if things get kinetic on the peninsula. >> i think everybody understands that you have to be cautious when it comes to the things kim

jung-un is saying. hans nichols for us in seoul. thank you so much. want to bring in now director of the global strategy project. marco, thank you to joining us. what do you make of kim's trip to china? >> if he is to meet with trump, this trip is somewhat inevitable. china remains a lifeline of north korea. north korea wants to press the reset button with china after strained relations in recent years particularly after ballistic testing and also the fact that china has been supporting u.n. economic sanctions which have hit north korea very hard. at the same time, 2340ek wannor ntsith a wants to reassure china. and china wants to maintain its influence and north koreans are also looking for greater economic support from china. so there is a relationship that

goes back decades. obviously north korea cannot survive without china but the north koreans also have their owned agenda. i think they are looking for the grand bargain. although china may not be a direct participant in any meeting, but it is ultimately a guarantor of such an accord as the life line of north korea. >> do you buy kim jung-un's promises that they would accept denuclearization if they got the promised safety, that he would be kept in power especially when we have the "new york times" reporting that we have satellite images showing this nuclear reactor now looking like it is online? the timing for this is pretty interesting. >> his grand bargain all along has been basically the united states removing troops from the peninsula which is unlikely to happen. and secondly for the united states to remove the umbrella of

nuclear deterrence. the first one is not negotiable. i think the second one is not negotiab negotiable. but i think with china he is basically securing their support at least at the official level for matter what and although -- and like i said, it is a very strained relationship between the two. but it is a mutually beneficial one. north korea knows that china for the status quo on the korean peninsula, the existence of the north korea regime serves china as a buffer zone and secondly as a fact that it doesn't want the united states troops ultimately on the peninsula. and if the north korean regime were to collapse, that means an overflow of refugees. so that is leverage that the north koreans have been playing well with the chinese in recent years. >> obviously a developing story here. thank you so much. let's get a check on your weather now with bill karins. bill, you're tracking some storms in texas this morning.

>> yeah, we're starting out with flash flood warnings in areas of austin and san antonio. heavy rain from texas up through areas of kentucky. and we'll watch this throughout the day. as far as bad weather goes and damage potential, life threatening weather goes, today is probably the worst day of the week. so 32 million people at risk of the severe weather. these are the flash flood warnings for austin down to san antonio. and the rest of the region is under flood watches. as far as the radar goes, here is the austin area. this is new braunfels. definitely people up in the middle of the night as the thunderstorms roll through. they are building back to the south of san antonio. we call this training. thunderstorms hitting the same area time after time. so here is the flash flood risk map for today. the blue is marginal. the light blue slight risk. the green is the moderate risk. once you you get in to that green color, that is where the confidence is greater that we will get into flash flood

concussions. a new rule calls for 15 yard penalty and possibly ejection for a player who lowers his head to initiate contact with his helmet. the owners also approved new parameters on what constitutes a catch. players no longer need to maintain control of the ball all the way through the ground. the new rule instead uses three criteria to define a catch, control of the ball, being inbounds and making a football move such as taking a third step. this means that the controversial incompletions like the one involving cowboys receiver dez bryant in a game against the packers back in 2014 and the steelers jesse james against the patriots just last season will be ruled complete passes in the future. as for the on other other changes, the temporary rule that puts the ball at the 25 yard line following a touchback after a kickoff, another authorizing the officiating office to dole

. welcome back, everything. it is the bottom of the hour. let's start with the top stories. the white house is defending itself over the controversy surrounding the decision to include a question regarding citizen ship on the 2020 on census. the move has drawn sharp criticism and legal action by democrats in some states. kristen women keelker has more. >> reporter: the white house defending its move to bring back this controversial question to the census for the first time since 1950, what is your citizenship. but the move is facing a growing backlash with several democratic state attorneys general poised to sue, they say adding the question could scare off undocumented immigrants from participating, potentially throwing off federal funding including for the elderly, new roads and even job training centers. california's attorney general is leading the fight. >> if you are not counted, then you don't count.

the white house is responding to a new report that president trump has expressed hope that rob porter could return to work in the west wing. porter resigned in february after reports of domestic abuse allegations would i his two ex-wives came to life. president trump has stayed in touch with him according to three people familiar with the conversations. watch this. >> so the "new york times" reported that president trump is still speaking with rob porter and has even talked about bringing him back to the white house. is that true? >> there are no plans for him to come back. they have spoken one time. i'm not aware ever any other conversations beyond that. >> so while the "new york times" says it is not clear how many conversations the president has had with mr. porter, sources tell the paper that calls have reportedly increased in the last few weeks as the number of people the president is close to in the white house has dwindled because of the large number of

staff departures. now the latest moves in the stormy daniels legal case. late yesterday the porn star's attorney filed a motion seeking to depose both the president and his personal lawyer michael cohen. according to the filing, michael avenatti is asking for up to two hours with each defendant as an effort to get them under oath on the $130,000 hush money agreement signed just 11 days before the election. stormy daniels whose real name is stephanie clifford is suing to get the agreement nullified. yesterday the white house was asked about that as well as the president's reluctant to speak or tweet on the matter. >> i'm hoping you can explain why the president's attorney paid stormy daniels $130,000 in the days before the election if her claims were false? >> look, that is a question you would have to ask the president's attorney. i certainly can't speak for him. i can only speak on behalf of the white house. >> to be clear, he continues to deny the fundamental charge that

she has, which is that she had this sexual encounter with him. >> yes, the president has denied those allegations. >> have you sat down with the president to talk about stormy daniels? what has he told you that he wants us to know about this topic? >> as we've addressed on a number of times, the president has denied these allegations. why ha i don't have anything else to add. >> why has he not punched back on this one some. >> i didn't say he punches back on every single topic. if he did, he'd probably be addressing a lot of the stories that you write every minute of every day. he also has a country to run. sometimes he chooses to specifically engage and punch back and sometimes he doesn't. >> why the silence? is someone advising him to be silent? >> i don't think it is silent when the president has addressed this. we've addressed it extensively. there is just nothing else to add. just because you continue to ask the same question over and over and over again didn't mean that we have to keep coming up with

new things to say. we've addressed it extensively. and there is nothing new to add to this conversation. >> neither the white house nor cohen has yet responded to the latest filing. and joining me onset, legal analyst danny analyst, thank you for joining me. let's start with the motion. what opened the door to that? >> now that the case is in federal court, stormy's legal team is asserting that what is called the federal arbitration act applies. all that means is that if the parties are arguing about whether or not it belongs in h arbitration or in court, the court may allow a trial to proceed, a jury trial, and pursuant to that jury trial the parties get, wait for it, discovery. which is, and i've said this many times, potentially devastating to president trump and to michael cohen because they are no ordinary litigants, they have a lot to lose. >> a lot to discover. >> a lot to discover, right.

so if you read the motion, it is expertly written because the arbitration act allows for limited discovery. and that is what they are asking for. no more than two hour of a deposition which is relatively short as far as depositions go. a limited amount of discovery. they are making the case for the court to grant this motion because they are not asking for the sun, moon and stars. they are asking for limited discovery so that they can proceed to a summary jury trial. >> what is the likelihood that the president or michael cohen will subject themselves to this, that they will actually show up? >> they don't have a choice if a court orders it. this is an issue that was resolved 20 or so years ago in jones v clinton where the court concluded the supreme court concluded that if it is not related to official conduct, the president can be dragged into a court proceeding for nonofficial conduct that especially that which preceded his presidency. so i think this is already a

resolve legal issue. if the court decides to order depositions, it can and may very well -- >> do you think they will? >> i think the way that the motion is -- >> and how quickly? >> the rules require that the case proceed to a jury trial quickly on the issue of whether or not there was an agreement to arbitrate. so with that in mind, the court i believe has the power to order depositions and to order them in an expedited fashion especially the way that the daniels team has set up this motion. they have done a very good job. >> i want to talk about the president's silence. he doesn't talk about stormy daniels and vladimir putin. he hasn't been outwardly speaking of this incident at all which is not characteristic of him. is this better for the president from a legal standpoint to not be talking about this at all? >> it is. this is a time to not be on -- if i was advising the president and michael cohen, which i couldn't because there would be a conflict, but this is not the time to make statements.

with fourth degree criminal conduct in office and two counts of willful neglect of duty in relation to the supervision of nassar who wassen is insiwas en more than 100 years. strampel used his office to sexually prop himself and sexually assault female students while abusing his authority to, quote, solicit, receive and possess pornographic images of women who appear to be msu students. strampel allegedly allowed nassar to continue seeing patients while he was under investigation in 2014 and failed to enforce treatment protocols after nassar was cleared by a flawed investigation. strampel also reportedly stated in the fall of 2016 that he didn't believe the sexual abuse claims against nassar. pretty stunning there. >> unbelievable story there. all right. still ahead, the new report raising questions over the trump

welcome back. let's turn to business. one day after rebounding after a slump, u.s. markets dragged down by tech stock selloff. let's go to london for more. is this the result of facebook and potentially the new kind of regulations that are on the horizon, new scrutiny for tech companies? >> volatility is back in the nasdaq, down almost as much as

4%. declines led by twitter. tesla down 8% and facebook 5%. many are saying that this is position reduction as many people were of course crowded into that sector at the beginning of this year. but many questions remain about whether we'll see more and more regulation in that sector even though many analysts also point out that the fundamentals are still there. just a quick, google and apple grew by $40 billion last year. but the big question is whether or 2409 facebook can turn their story around, the ceo mark zuckerbergs that said that he is happy to testify in front of congress after mounting pressure from lawmakers and the public. and he is expected to be grilled on how the data ended up with third parties and what they actually do with the data that is on their social media platform. it also puts the pressure on google and twitter as well to do the same. the testimony will be april 10 on. >> and tesla is also defending

discussed these issues with the president. he never brings up facebook. he never talks about mark zuckerberg, but he is obsessed, that is a direct quote, obsessed with amazon. he's mused -- he's wondered aloud about using anti trust or competition law to go after amazon. he's talked about changing their tax treatment and it's this sort of ideas he floats continually in meetings but they actually haven't resulted in any plan yet. >> why is the president obsessed with amazon and jeff bezos? what's at the root of all this. >> a lot of different things, but a lot of his wealthy friends tell him that amazon is putting then out of business, that it's killing bricks and mortar retailers and shopping malls and he's got that into his head. he believes that. another thing that he repeats again and again and again in meetings, private meetings is that he believes that u.s. taxpayers and the u.s. postal

service have been subsidizing amazon. he believes they're getting a free ride off the postal service. he sort of flicked at that in a tweet in december where people were confused about what he meant by this tweet saying they should charge -- they should charge amazon more but a source told me that it's been explained to him multiple times that actually the post office makes a lot of money off amazon and it's not true, but he's -- again, he's internalized this idea and believes it. >> he just won't let it go. is there any real action that the president could take to sort of crack down as he wants to do it seems on amazon? >> well, of course there are hypothetical actions but there is nothing in the works or in planning and another thing i should say is that the personal element to this which is jeff bezos, the owner of amazon, he views and obviously jeff bezos owns the washington post which he views as his political weapon so part of this is also wanting

to clip bezos' wings, that's what sources who have spoken to the president say anyway. >> so your sources are telling you that despite this sort of data scandal engulfing facebook right now and cambridge analytica and all that it's not really on the president's radar. why -- why is that? does he feel like if he mentioned cambridge analytica or facebook it delegitimizes the 2016 election and also legitimizes the bob mueller investigation in russia? >> i can't speak to that level of what he feels but certainly the perception of sources who speak to him who say he just never brings it up is twofold. one is that he believes the whole russia investigation is a hoax. that's his words. the second is that he just doesn't really understand the issues at play. he's not tuned into the whole debate over data and information and really he is. i mean, my colleague, one of axios' founders wrote a piece describing trump as a 1950s man and in many ways he is. he sees industry in those terms. he sees, you know, the

smokestacks and heavy industry and you know, the bricks and mortar retailers, groceries, physical mail delivery and those are the industries that amazon is going after and amazon is disrupting more than facebook. so it actually stands to reason that he sees amazon as more of a threat to the america that he understands. >> all right. so the president's not really interested in facebook or cambridge analytica, but facebook not really out of the woods quite yet. what's going on there? >> one other thing we reveal that's coming in the newsletter is that the vice president mike pence is concerned with facebook and google and he believes that they've become dangerously powerful, with control over the media, how the media covers issue, how -- over the advertising industry and over people's data. it's been described to me by sources with direct knowledge that when people have raised the idea of busting up facebook and google he's listened with a very
