a new tell all book from a former white house aide could be creating hush money headache for the president. omarosa claims she was offered 15,000 per month in hush money to keep quiet about the white house. here to break down the legal implications of the claim and much more is prosecutor doug burns. good morning. >> good morning, dara. >> they say it was a nondisclosure agreement attached to the deal after she was fired from her role at the white house. is this standard or hush money? >> a nondisclosure agreement, they come in different forms. they have a unilateral one, they have one with both sides and ones with more people involved with a period of time attached to it and what can or cannot be disclosed. as far as the chronology of the question, i don't think there's a huge distinction qualifying it
4:14 am
as hush money, necessarily. i mean, again, it's hard to break down the claim. you need a lot more information. i suspect there will be more analysis on whether it's true or not. make no mistake, you have the legal discussion. i said this many times, dara, and the public relations. public relations wise, it's an attempt to shoe horn it into a stormy daniels type thing. >> what differentiates this from stormy daniels and karen mcdougal? >> i don't think there's a huge distinction. both were nondisclosures that went forward and i don't really think it's that big of a difference. here, they didn't enter into it, basically. >> president trump's lawyers are negotiating with robert mueller's team for a sit-down between the special counsel and the president. the public discrepancies could be part of a problem.
4:15 am
let's take a listen. >> are you going talk to mueller? >> i'm looking forward to it. >> do you have a date set? >> there's no obstruction. >> we are going to be the laughingstock of lawyers if we let him testify. >> i will say this. i would love to speak, i would love to. nobody wants to speak more than me. >> because of them, we don't want him to testify. they are not fair. >> i have always wanted to do an interview because, look, there's been no collusion. there's been no talk of russia. >> you couldn't put a lawyer on the show that wants to keep his license to get him to testify. >> go in, talk to robert mueller and tell the truth. >> i wouldn't be an attorney if i did that. >> would you be willing to speak under oath? >> 100%. >> a lot of back and forth. what is the public disagreement with the president and his team
4:16 am
do for the defense? >> what they are trying to do, honestly, it is straight forward. they are setting up the public relations and interaction and the public relations on law is the president saying i want to go in 100%. i want to speak. but, it's my mean lawyers who are preventing me from doing this. grudgingly, kicking and screaming, i'm going to seed to them and not do it. that's the narrative they are creating, plain and simple. you have heard all kind of legal experts and they are right. i'm not quick to jump in, it's a perjury trap and all that. the reality is given the back and forth, it would not be a good idea for him to do it. he is not going to do it in my crystal ball opinion. he is going to blame it on the lawyers. >> is the legal team trying to run down the clock so it is a political chip as we get closer to the midterm elections? >> i heard that discussed earlier. i don't disagree. there's an issue about the
4:17 am
november midterm elections and the chronology of the investigation and that. that's right. the other thing that you asked me before that is interesting, will he subpoena him? that's an open question. i really don't think he will, actually. >> we'll talk about the subpoena. if he has to subpoena president trump, would supreme court justice neil gorsuch have to recuse himself from the case? >> that's a very interesting question. gorsuch, in the sense that formally from a legal ethics standpoint, there's no formal reason to recuse himself because this person appointed him. on the cavanagh one, interesting because he has written a lot about executive authority and the president. so, you could make a claim that maybe he should recuse himself if it got down to that. i think formally, with both of them, the answer is no. as i said with cavanagh, it might be more compelling.
4:18 am
>> doug, what do you think is better, to sit down with mueller or have him subpoenaed? >> from the standpoint of the defense, you mean? no, at this point, it's clear he shouldn't voluntarily sit down. that forces the hand with the subpoena. as you have heard people say, and they are right, it sets up a legal showdown and tracks back to your question a minute ago into the midterm elections. mueller may walk away from that. the better course is to simply, ultimately not agree, use the pr spin, i wanted to go in, my lawyer said not, i am going to follow them. >> we'll see how it plays out. great to have you on. >> my pleasure. new reaction to michael avenue -- avanatti's advice. >> the trouble with facts. a late night take.
