good morning, everyone. it is monday, august 27. i'm ayman mohyeldin. yasmin and louis have the day off. we are getting new information this morning about yesterday's deadly mass shooting at a video game tournament in jacksonville, florida. according to the jacksonville sheriff's police, three people are dead including the gunman. 11 others were injured. the shooting happened around 1:30 p.m. in a pizza restaurant along the city's water front. it all unfolded during a purported livestream of a "madden '19." tournament. a warning to our viewers. the audio you are about to hear which is believed to be from the moments the shooting began may be disturbing. the video remains unconfirmed by law enforcement. >> a lot of good games going on. >> it is going to be hard to get them on live. >> it is not a tough out. not an easy out. we just heard gunshots. the first time we thought it was a balloon popping and then we heard multiple pop, pop, pops and we realized it was gunshots and took off running. >> authorities identified the suspected gunman as 24-year-old david cass of baltimore, maryland. federal agents have been searching his home in that state. the jacksonville sheriff's office declined to discuss a possible motive, but said that he was in jacksonville for the video game competition. one of the two victims has been identified as 22-year-old elijah clane of california. a statement was putting out saying his happy smile and compassion invoked a similar attitude in others. switching gears as the country and the world continues to pay tribute to senator john mccain following his death after a battle with brain cancer, as plans to honor his life and legacy take shape. arizona's governor announced mccain will lie in state at the

arizona capital on wednesday on what would have been the senator's 82nd birthday. a private ceremony will be held that morning followed by a public viewing that afternoon and evening. senator mccain's funeral is set to be held thursday morning at north phoenix baptist church. his body will be transported from arizona to the u.s. capitol in washington, d.c. where he will lie in state on friday. that honor has been bestowed on only 32 other people includes presidents lincoln, tass, kennedy, ford and reagan. on saturday mccain will be tale from the capitol to a second funeral service at the cathedral. according to mccain's website, that private service will be limited to family, friends, congressional colleagues, staff and u.s. and international leaders, though it will be live streamed. mccain's body will then be taken to the u.s. naval academy in annapolis, maryland on sunday to be buried at the cemetery following a private memorial

service. one person not expected to be in attendance at the ceremonies, pruchlt. sources close to senator mccain told nbc in may that the white house was informed by his camp mccain did not want the president to attend his funeral, instead asking for vice president mike pence to come. mccain and trump had a bitter relationship over the last several years. former presidents obama and george w. bush are among those expected to speak at mccain's funeral in washington, d.c. congressional leaders spent much of the weekend remembering senator mccain as senator minority leader chuck schumer takes steps to enshrine the republican's legacy on capitol hill. he will seek to name the russell building, the oldest office building, in honor of his late k colleague. it was named after a leader in opposition to the civil rights movement and a strong supporter for segregation for decades. in announcing the move, the sen,

the united states and the world are lesser places without john mccain. meanwhile, jeff flake says he is on board with the minority leader's plan. >> i hope to be the first republican co-sponsor. i think that that's a fitting tribute. he had his office there during his entire time, including right now, right near my office. so i think that that's a very fitting tribu fitting. >> "the washington post" reports president trump nixed a statement that praised john mccain. press secretary sarah huckabee sanders and other aides advocated for an official statement that gave the decorated vietnam war and called him a hero according to current and former officials. instead trump preferred to send a tweet saying, my deepest sympathy goes out to the family of senator john mccain. our harlts aearts and prayers a

you. trump's instagram posted those comments alongside not a photo of senator mccain but rather himself. white house officials including the first lady and national security advisor sent messages praising the senator's legacy. joining me, jill colvin. good to have you with us. the phone we have chief white house correspondent for the times, peter baker. thank you for getting up this early as well. one word used to describe senator mccain among democrats and republicans alike is a hero. why haven't we heard president trump called him a hero even after his death? let me begin with you, jill? >> they have had a very tense relation sh relationship as mccain was one of the few republican senators more than happy to criticize the president, most recently in one of his last acts of public speaking criticizing the press conference between president trump and vladimir putin this summer in helsinki. we all remember the president

had a notable moment on the campaign trail when he was asked about john mccain and said he was not a hero because he was captured. this is a relationship that was very hostile between the two of them. mccain aides scribbled it descrt a relationship at all. the president held resentment and it has not changed with the senator's death. >> what does it say about the late senator who asked two men who held the highest office in the land, former presidents barack obama and george w. bush, to eulogize him but not is the current president in attendance? >> it is a remarkable thing. it obviously speaks to senator mccain's character that he was able to move past the competition he had with george w. bush and barack obama and show them great respect as presidents, and he wanted them to come and eulogize him.

it says he is making a statement, making a statement even in death about the necessity of civility and bipartisanship in american politics today. in a way, it is kind of one last statement about president trump. he is saying now in this moment of his passing that he doesn't approve of the way that trump behaved. he doesn't approve of the way that trump conducts his politics and he prefers the man that beat him to the presidency to the colleagues. >> interesting to hear that chuck schumer wants to rename the oldest senate building, it says a lot it is initiated by somebody from the opposition party, if you will. jill, what are the next steps for this to become a reality? we heard jeff flake say he would be willing to endorse that. >> what we will have to see as members of the senate respond to this. my understanding is the naming of the office building is under the purview of the sen apt which

means they could pass a vote on it. they wouldn't need the president's signature as you need for federal buildings like post offices. this demonstrates, as you said, sort of the bipartisan outpouring of support and sympathy here as the nation stops to mourn the passing much john mccain. i should also note when senator kennedy died, you know, on the anniversary nine years ago, there was an effort to rename one of the conference rooms on the capitol that did not go through. we'll have to see how it develops. >> peter, senator john mccain was a moral towering figure within the gop. he is somebody that as we heard he stood up to president trump, he was critical of his foreign policy, even in the last couple of weeks putting out a statement critical of the helsinki summit where president trump stood alongside russia's vladimir putin. who is likely to fill that role now within the gop, within the senate, that can be a loud and

moral critic of the president when it needs to be? >> well, there really isn't anybody like that left in the senate, at least there won't be after this fall's election. jeff flake who you quoted and bob corker have tennessee have been outspoken in their criticism of president trump, both leaving the senate and not running for election. of those who don't have to run for reelection don't seem to want to be as vocal across the board, individuals like marco rubio and susan collins and a few others who at various moments will say something about the president's policies or behavior that they don't approve of. as a general rule, not willing to be the outspoken voice senator mccain was. even lindsey graham who, you know, senator mccain's supposed best friend and protege and a fellow maverick, has switched from being outspoken about president trump to being one of his, you know, most vocal allies

these days. so it is a republican party that increasingly is trump party, not mccain's party. >> i remember senator john mccain one of the most outspoken critics of so many of the foreign policies and autocrating rulers that we've seen rise in the last couple of years. certainly that will be a position that is missed as well. peter baker, thank you for getting up early for us and joining us on the phone. hopefully we will get you in person there next time, peter. jill colvin, thank you. we will talk to you again in a little bit. it has been confirmed that allen weisselberg was granted immunity during the course of the michael cohen probe. he also testified before the grand jury. a person with knowledge of the matter says that on page 17 of the criminal papers filed in the cohen case, that means according to that document cohen sent an invoice to weisselberg requesting payment, a payment

meant to reimburse cohen for the stormy daniels pay-off. weisselberg sent that invoice to another trump organization executive via e-mail directing him to, quote, please pay from the trust, put retainer for the months of january and february 2017 in the description. weisselberg is a third long-time trump confidante to provide information to investigators regarding the hush money case. president trump took another swing at attorney general jeff sessions on twitter over the weekend. he wrote, jeff sessions said he wouldn't allow politics to influence him only because he doesn't understand what is happening underneath his command position. highly-conflicted bob mueller and his gang of 17 angry democrats are having a field day as real corruption goes untouched. no collusion. last week president trump once again criticized sessions for recusing himself from the russia probe and said sessions never took control of the justice

over time but donald trump and his son continue to say that the then candidate did not know about the meeting when it happened. in the book "fire and fury" the president's former chief strategist opined there was zero chance the president did not know about the meeting. bannon called the meeting tresson us and predicted that don junior would crack like an egg under the pressure from the russia investigation. meanwhile, michael cohen's attorney is backtracking after claiming his client would be willing to tell the special counsel don junior told about the meeting before it happened. cohen told lawmakers on the senate finance committee that the president was unaware of the meeting at the time. cohen's legal team says he stands by his testimony. cohen's lawyer, lanny davis, tells nbc news he takes responsibility for the mistake. new polling shows widespread doubt among the americans when it comes to the president's approach to the special counsel. according to the latest nbc news/"wall street journal" probe, 56% of voters say trump

has not been honest and truthful about the mueller investigation. 38% say trump has been truthful about the probe. the poll asked whether they believe those who pled guilty or were found guilty of crimes signalled only those individuals committed crimes or if trump himself may have participated in wrong doing. on that question, 27% say just the individuals while 40% say the president may be associated with potential wrong doing. 30% say they did not know. meanwhile, trump attorney rudy guilliani once again pushed the special counsel to wrap up his investigation tweeting on saturday, quote, just a few days before 60 day run-up to election. if mueller wants to show he's non-partisan, issue a report on collusion and obstruction. they will show president trump did nothing wrong. then will have to admit you are fair and we will. search and rescue missions continued in hawaii as homeowners and county officials began to mop up from damage

caused by tropical storm lane. though lane weakened over several days from a category five storm, it drenched parts of hawaii with over four feet of rain. several main roads were closed and under water while the deluge of rainfall flowing into the county sewer system triggered three major spills. lingering moisture will produce excessive rainfall in the coming days that could lead to additional flash flooding and landslides. to get a big picture now on the weather forecast, let's bring in meteorologist bonney schneider. bonney. >> good morning, ayman. you are right, hawaii is still facing a threat for rain as the tropical moisture remains. an additional three inches is possible. likely i see the most is for the big island, but things will start to look better for hawaii. in the meantime we are tracking storms in the midwest, and this is definitely bringing about heavy precipitation today in the forecast for minneapolis, a cold front coming through. damaging winds are possible as

well as hail. we will watch out for heavy rain, particularly into northern minnesota and michigan as we get into the evening hours. by tuesday the front pushes eastward so we will see the storm working its way toward the east. also, excessive heat. it is the final week of august. 70 million people at risk for excessive heat. there is a warning in st. louis because temperatures will feel like 105 degrees, so incredible heat to deal with in st. louis. notice the high is 95 but it feels hotter. all of the heat in the center of the country will push to the east, so we will see a heat wave in new york city and philadelphia. in boston temperatures will be in the 90s. we are looking for the heat to build in for the middle part of the week, but the good news is this heat we are dealing with across much of the country will start to subside and we will see better conditions towards the end of the week. you can see this pocket of blue where we have colder air. there is actually much cooler and more wet conditions coming

♪ welcome back, everyone. i'm ayman mohyeldin. it is the bottom of the hour. let's start with the morning's top stories for you. this morning the world is remembering senator john mccain. the 81 year old passed away over the weekend from brain cancer after two presidential rain and 30-plus years in the senate. he leaves behind a political legacy. kelly o'donnell has more on how he is honored at home in arizona and in the nation's capitol. >> reporter: under the blistering phoenix sun, flags are lowered. respect is shown in the small

u.s./vietnam relations after the war. russian state media had a different take. they called mcclain an opponent of russia. arizona's governor says he will wait until after memorial services have been completed for senator john mccain before naming his successor. an aide to governor doug doocy told one paper over the weekend he would hold off on the process of filledi filling mccain's seat out of respect to the senator and his family. he is required to appoint a republican to fill the seat. he would serve until the 2020 general election. u.s. senate canned kelly ward is facing backlash after suggesting that senator mccain's announcement to stop his medical treatment was timed to hurt her campaign. in a comment made on a facebook post by one of ward's campaign staffers who questioned the timing of the statement, which was released the same day ward kicked off her campaign bus

tour. now, it was deleted, but in the comment ward did not dispute the notion and wrote, quote, i think they wanted to have a particular narrative that they hope is negative to me. mccain died just hours afterward's post. in a statement on her campaign facebook page, she expressed her condolences for mccain and his family but did not address her comments. mccain's one-time rival, ward is in a three-way race for the republican nomination to replace retiring jeff flake in arizona's primary on tuesday. joining me, white house reporter for the "associated press", jill colvin. good to have you back with us. let's talk about these comments from kelly ward, absolutely head scratching there, her comments criticizing john mccain hours ahead of his death, being viewed in arizona probably in some negative light. how is it playing out politically? >> reporter: this underscores the ferocious relationship

they've had for years. you can see the differences between them, the distinct tensions in arizona between more conservative members of the state and republican voters and john mccain. people in that state were pro trump, felt mccain was doing a disservice by speaking out against him. think that comment, obviously she wound up with egg on her face suggesting it was somehow politically motivated, but it is a deeply divided state and many people agree with kelly ward and in her criticism of mccain. >> let's talk about doug doocy, he has announced he's not filling in the senate seat until after the memorial services for the sen tr and his family. who are some of the possible contenders for mccain's senate seat? we know that obviously there -- as you mentioned there's the race to replace jeff flake. could a loser or runner-up in that race be appointed for senator john mccain's position? >> reporter: just because doug doocy said he is going to hold

off until after the ceremonies are over does not mean there is a tightly- watched race going on to try to figure out what doocy is going to do. what is interesting is that doocy has to appoint a republican, but that person will serve until 2020, which means it is a republican who will vote on the supreme court nomination, who will have a pivotal role as we have a very closely divided senate. at this point there are a number of names being considered. at the top of the list is mccain's wife, cindy. there are other folks, john kyle, the former senator is somebody who is under consideration. former congress members, former chief of staff to mccain, doocy's former chief of staff, a bunch of names in the mix right there. but what the key questions are here include whether doocy is interested in having somebody who will fill out the term until 2020 sort of as placeholder and then you can have a primary and they'll pick someone new, or whether he is looking for somebody who can maintain that seat and run and continue to

hold it. so he has a number of different, you know, political factors under consideration at a time now when he is facing a primary, when this very contentious primary to fill flake's seat is also happening. >> i'm sure it is weighing heavily on him as well to have somebody with the kind of moral fortitude john mccain had in the senate. that might be hard to find these days. let's talk a little bit about mccain's legacy. it is being highly praised by world leaders, really except for the president of the united states, donald trump, and russia. how is that being perceived when you have heard the senate personally praise for his accomplishments, his personality, and yet you don't get that same tone or sentiment from the president, nothing more than a tweet and an instagram post that showed a picture of the president. >> it really is exquisite that the president has not weighed in in any other format. "the washington post" reported over the weekend there had been a statement that had been prepared by press secretary

sarah sanders and chief of staff john kelly and others on staff, but that the president chose not to release that, instead deciding to tweet. notably, his tweet talked about the family of john mccain, sending them his well wishes but didn't talk about the senator. it said nothing about his legacy, said nothing about him being a hero, about his life, his work, none of that. i think that, you know, you can read for yourself what that means. >> yeah, indeed. as i mentioned earlier, he was such a towering figure in foreign policy as well that the reactions from around the world speak for themselves. jill colvin, great to have you with us this morning from washington, d.c. >> thank you. democrats have an eight point advantage over republicans when it comes to which party voters want to control congress after the mid terms. that's according to a "wall street journal" poll. half of voters want to see democrats in control, up one point last month. 42% said they would like republicans to stay in charge,

the week. the once he made against the advice of the advisers and many in the republican establishment, everything from negotiating with the nuclear madman in north korea. thinking he could bet that his friends, michael cohen, wouldn't flip on him. they did. in every one of those cases, those bets look riskier and riskier and more difficult to win than ever. those were all the things that he did that a lot of people internally thought you don't need to do, you shouldn't do. last week really broadened the stark relief how in every one of those he's doing worse than he hoped. >> do you get a sense that all he'll be changing his position on some of these things or double down? >> in most of these cases he'll double down. take china, we were reporting last night that a lot of people in the experts think this trade war could drag for another year if you look at the incentives

that both have. the chinese are showing no desire to compromise. trump is showing no desire to compromise. he just cancelled pompeo's visit to north korea. you were talking about it in the segment before. he said he's tying that to trade in which could take a year. you give the koreans another year to do what they're doing, to build weapons that could potentially hit our shores, carrying nuclear payload that's obviously contrary to what he's trying to pull off. the big one is this war against mueller. he's betting that he can sew muddy mueller if this comes down to impeachment he can survive because he has a republican base. mueller is more pop ewe than ever according to a fox poll, 57%, that's 12 to 14 points higher than donald trump. so all these big bets aren't looking so wise right now. and one smart republican said put it all together in the biggest bet was because the
