frances rivera. yasmin and louis have the day off. we beginth with the major exit from the west wing. white house counsel don mcgahn will be leaving this fall. the president made the announcement yesterday morning saying he will stay on until supreme court nominee brett kavanaugh is confirmed. the move comes less than two weeks after "the new york times" reported that mcgahn spent 30 hours talking with robert mueller's team.ta the president seemed to brush thates off yesterday. >> all right. so weay seem to have a bit of a audio problem. we will try to get it fixed for you. according the "new york times" president trump often said he wanted to get rid of mcgahn but never seemed willing to follow through withli it. president trump reportedly asked rob porter, then staff secretary, several timesta last year if he would be willing to take over for mcgahn but porter told the president he did not believe he was qualified for the

role. meanwhile, advisers are prepared that the president is not t prepared for a possible legal storm if the democrats take over the house and pursue subpoenas or impeachment charges. that's according to interviews with 26 white house officials. within trump's orbit there's consensus his's current legal tm is not equipped to navigate an onslaught of congressional demand and there's talk of bringing on new lawyers. an official says the white house counsel's office has about 25 lawyers now, down from roughly 35 earlier in the presidency. they have confirmed that ethics lawyer will be leaving tomorrow. some lawmakers were quick to react to the news of mcgahn's departure. chuck grassley tweeted yesterday, quote, you can't let that happen.

senator lindsey graham warned the president needsah to be prepared for what could happen in november. >> if i were the president i would pick somebody that understood theck legislative branch, because if the democrats take overus the house then he's going to be subpoenaed to death and investigated to death. >> all right. switching gears to the race in florida where congressman ron desantis is facing criticism for what some c are calling racist language against his reference. if you haven't heard it, here is what he said during an interview on "fox news." >> you know,vi he is an articule spokesman for the far left views and a charismatic candidates. iis watched the democratic debates, none of that was my cup of tea, but he performed better than the other people there. so we have to work hard to make sure we continue florida going in a good direction. let's build off the success we've had off governor scott. the last thing we need to do is to monkey this up by trying to embrace a socialist agenda with

"fox news" issued a rare on-air rebuke of the republican congressman's remarks. >> a little while ago we had ron desantis, the nominee for governor on to discuss the lek. he made what some are calling an inappropriate comment about his opponent, andrew gillum. we do not con dome this language and wanted to make our viewers aware he clarified the statement. >> gillum responded to desantis's comment saying the gop nominee has taken a page out

incredible campaign. >> now tocr the fbi that's rebutting the president's unsubstantiated claim that china hacked hillary clinton's private e-mail server. the president made a claim in a tweet posted after midnight on wednesday. he warned the doj and fbi to do something or in his words their credibility will be gone forever. the fbi official tells nbc news they've found no evidence the clinton server was compromised. they pointed to a june report from the inspector general stating the same thing, that there's no evidence that the president repeated from the daily call. >> attorneys for paul manafort are looking to have his next trial moved out of the nation's capitol, n claiming media covere of his prior conviction has compromised the pool of new potential jurors. in court filings yesterday they askedin his trial on charges of money laundering, failing to register as a foreign agent and

obstruction of justice be moved from washington, d.c. to roanoke, virginia. they say don vix of president former campaign manager on fraud charges had a negative impact on pretrial publicity. >> the judge in the trial signalled on tuesday she likely would deny the defense's request on the belief an impartial jury can be found in washington. manafort's lawyers made a bid to move his trial out of alexandria, which they lost. i want to bounce back to don mcgahn and the announcement that he will be departing the white house. joining us from washington, capitol hill reporterin for "th hill" molly hooper. molly, good morning. wey, have this blindsided announcement, not surprised thad he's leaving but the manner that it was announced that came out of t nowhere even after we were discussing it on this show. talk aboutng the president's inr circle, especially when it comes

toci white house counsel, seemso be closing in with the announcement of his departure and the worry it may cause, especially with words like kbiechmentke coming across. >>. >> reporter: keep in mind he has been the president before he was a serious contender for the office. i rememberenr running into don mcgahn on the west lawn of the capitol at the rally with ted cruz and it was in the summer of 2015. don mcgahn was one of the first supporters president trump had. he has been around. he wanted to h usher in a conservative jurist, which is what he has done as the white house counsel. he's been responsible for getting so many judicial appointees to the senate which is why you see that statement from chuck grassley saying you can't let this happen, mcgahn has been taking a lot of hits from this president behind the

scenes. remember, you know, last year he was the one who threatened to resign if the president fired bob mueller. and, so, you know, there have been a few, you know, tet a tets so to speak but he stuck to his ground and said i want the see through the next supreme court nominee, and that's probably -- i mean that is why he is staying through the fall let's talk about another big storyut making headlines. paul manafort's trial, his lawyerss attempting to move hi latest trial location as we were reporting from d.c. to virginia. the thing that seems to. get i the way though is president trump himself. is hes hurting manafort's chans of a fair trial? >> reporter: well, my goodness. i mean reading about, you know, just the consideration of the jury pool in d.c., i believe that the judge said that in selecting the jury that, you know, they would be asked about their political views and what not, but it is unlikely that the

trial will be moved. still, i don't know if necessarily trump is k getting the way,tr but there's a reason why manafort's lawyers don't want it to be in this area. i mean this next phase of the prosecution is really going to hit home on potential ties to russia and this question of collusion. so the manafort folks are hoping to get this moved outside of the district where president trump, let's say,di did not do well in the election. >> meanwhile, there's a question of the other ten counts and what to do c with those. >> reporter: exactly. >> yeah. interesting developments there. mollyve hooper live in washingt, d.c. for us. we're going the talk to you in a bit. stick around t for us. president trump is blaming china forstalled talks with north korea, and he says in the meantime that things between him and kim jong-un couldn't be better. >> i think china probably has a great p influence over north korea. i have a fantastic relationship with chairman kim as you probably know, and we're going to have to see how it all ends up.

circle, white house counsel don mcgahn. the president tweeted mcgahn will be leaving in the fall after the confirmation fight for supreme court nominee brett kavanaugh. nbc correspondent pete williams has the latest. >> reporter: it's been an open secret that don mcgahn planned to step down at the senate votes on kavanaugh. but it was a trump tweet that revealed he will be leaving in the fall. later, words of praise. >> don mcgahn is a really good guy. been with me for a long time. >> reporter: a white house official said mcgahn didn't know the tweet was coming but was not angry about it. he's been the primary white house contact for the mueller investigation. it was revealed mcgahn spent nearly 30 hours answering questions from mueller's investigators. the president said he wasn't upset by that. >> i knew he was going also, i had to approve it. >> reporter: but it is unclear how much the president knows about what mcgahn said. now 50, mcgahn has been part of the trump inner circle over two years. >> it has been a privilege to be

part of a presidential campaign that was successful and to have the honor to be named counsel to the president of the united states. >> reporter: he's behind the administration's wildly successful effort to get confirmations on the court. among possible successors is a member of his staff, emmet flood, who 20 years ago advised president clinton during his impeachment. pete williams, nbc news, washington. >> joining us, danny cevalas. i think a lot of people are finding surprise in the way the announcement was made, perhaps not unexpectedly for this president on twitter. what do you make of don mcgahn's departure? how significant is it for the president and his legal team going forward? >> two things can be true at the same time. first thing is that don mcgahn sat down for 30 hours with the

special counsel's office, and you don't typically do that unless the special counsel is interested in what you have to say. the second true thing is that donald trump may actually believe that don mcgahn has nothing damaging about him to say. those two things may be true. however, what trump may be ignoring is as an observer and as a lawyer don mcgahn may have seen and heard things that are significant to him but not significant to the president, who doesn't seem to take a tremendous amount of interest in the minutae of legal dealers. >> that's interesting when it comes to the role of don mcgahn in this. it is no secret that they butted heads in the firing of manafort. but when it comes to the president versus the personal donald trump, is that where you see it is leading up to, the 30-hours of voluntary testimony? do you think it is that role? >> until two years ago trump's

lawyers represented trump. they may have represented the organization, some other entity, but at their core they represented the man donald trump and took orders from him. don mcgahn is different. he represents you and i. he represents the presidency, the people of the united states. that duty of loyalty may be different than what donald trump has expected and commanded from his personal lawyers. >> we talked about it in the past, that he can't claim attorney/client privilege in this case. betsy devos is proposing new sexual misconduct rules for colleges. what is the significance of that? what is behind that? it is getting a little bit of buzz. >> reporter: at first glance it may be a concern for many, but as somebody who has defended the cases against students the only thing this new guidance seeks to do is raise the minimum protections for college students closer to the minimum protections we demand in our

criminal justice system. as it stands now since 2011, the office of civil rights has required a preponderance of the evidence. these are all things that are very concerning because an adjudication by these tribunals that are not designed for criminal justice at our universities can have very serious effects for accused students who are wrongfully accused. if you believe that 100% of all accusations against students at college are substantiated, then you have no concerns. but if even one student is wrongfully accused, these lower protections should be a cause for concern. >> so a net positive for you, this story? >> well, many people will cite size this move as a biassed criminal defense attorney i think it is a positive move. any move to get to our minimum standards that we expect in our criminal justice system as a parallel for our college students is to be a good thing.

>> great to have your insight and you here with us. >> thanks, danny. appreciate it all right. so we have reported on the warning from president trump to evangelicals there would be violence if republicans lose the midterm. he told evangelicals during a closed door meeting that they were violent people that would overturn the gains made during his administration violently. yesterday the president struggled to clarify those remarks. take a listen. >> i just hope there won't be violence. i can tell you -- i can tell you -- because that's the way, i guess, if you look at what happens, there's a lot of -- there's a lot of unnecessary violence, all over the world but also in this country, and i don't want to see it. >> meanwhile, it seems that congressman o'rourke's punk rocker past is resurfacing. the twitter page for the texas republican party began circulating photos of o'rourke in his 20s. also, when he made a bid to

unseat ted cruz, he was arrested twice in his 20s but never convicted of a crime. the political attack goes after two weeks of both sides going back and forth to a possible tee bait schedule. an emerson college online found cruz and o'rourke in a statistical ties. other surveys have found o'rourke close to cruz. if cruz loses to o'rourke it could jeopardize republican's hold on the senate. i want to bring in capital reporter for the hill molly hooper. great to see you back here again, molly. >> reporter: yes. party on, right? >> just like that, rocking on. >> reporter: just party on. >> with the air guitar with it. >> reporter: that's right. >> on twitter, at least the gop planned to embarrass o'rourke. so the strategy here is to try to make him look cool? what does that signal about what voters are looking for ahead of

the mid terms? we know those images have been circulating on social media, even using excuses like he's drunk or on a skateboard or rocking out, you know, too busy doing that to attend the debate? >> reporter: it just so happens it was 20 years ago i guess. the thing o'rourke is not too busy to do is visit 254 counties in texas, which if you talk to, you know, republicans privately is what they basically want their members to be doing this election season. o'rourke is putting in the work. he's raising a lot of money to run for this seat. as the election -- you know, as these results show in the polls, he is really coming close to ted cruz. they both have raised about the same amount of money, $23 million, and, you know, this is one of those instances where you look at how members are going to get re-elected, how members are going to get elected. you know, this is a guy who is tireless. he's 45 years old. you know, you see him riding

skate boards, out with the people. he's sweating through his, you know, his collared shirts at town hall meetings, and he's all over the place. ted cruz, while he has -- you know, he has a high profile nationally, and texas is a republican state, it is a red state, you know, sometimes that can be dangerous if you're not at home doing the ground work. >> right. >> reporter: which beto o'rourke has been doing. >> who can forget the viral video of beto o'rourke talking about the national anthem protests in the nfl when he was asked that question at an event, and i believe it has gotten something like 44 million views. >> yeah. >> it just shows you the power of social media and how his reach can go far beyond what we're seeing sometimes in the national media. let me ask you quickly, molly, about evidence, any evidence, have we seen any evidence to backup this claim by the president that democrats could become violent after the midterm election results? i mean he said this in closed doors. obviously it was going to get

out in a city like washington, d.c. we've been reporting on it. now he has been trying to kind of walk it back, some of his, you know, surrogates and advisers in the media saying no, he didn't actually mean violent, but he was clear about the language that he used. >> reporter: well, again, that's unclear and, you know, talking to republican sources up on capitol hill it is probably not something that they would believe. i think that probably he's better served talking about potential impeachment proceedings. the idea of violence is something that, you know, given the situation we are in right now with our politics in this country, things are very divided, heated. you know, no need to incite any type of, you know, upheaval for no purpose. i mean -- and republicans don't want to be seen as doing that. >> and what is sad about it as well is it comes on a day and during the week that senator mccain, who many scribbled as a very gracious and magnanimous loser, and with his concession speech. >> molly hooper, time to rock

er. after blind siding canada with a trade agreement president trump announced that a nafta agreement could be reached after an intense round of meetings yesterday. what are the issues that still need to be hammered out there? >> certainly some issues there and some of the major sticker points include dispute settlements in which they could bring claims to an international tribunal and the news apply more than 100% tariffs on certain dairy products. but both u.s. and canada expressed optimism that they could get a deal done by friday.

facebook, we'd move all of our followers on to it. i don't think that will happen in the short term, but i do think this shipping away at the creditability of the companies is what the companies have to worry about. we talked about a lot on this show about regulation. the threat of regulation is real. more real than these companies are calculating at this moment. but it's short-term political damage because you saw what happened to all of us in the media. when half of the country turns against you, it makes it a lot harder to be able to penetrate a big segment of the country when you have real news to tell them and you want to have their trust in the reporting that you're doing. >> let's go back to an interesting point you made about regulation for a moment. we, obviously, the know the tech giants will be on capitol hill and interesting to see a little bit of cooperation between kements and republicans on this perhaps for different reasons, but how likely are we going to see the president's frustration,

some of the democrats' frustration lead to some kind of regulation of social media and these big tech companies? >> in the short term, i don't see any possibility whatsoever of this divided congress regulating through law what is happening on these platforms. long term y think it could. you made an interesting point. both sides here are frustrate would the platforms. whether you can trust what they're pumping out. for democrats, it's a little bit different. the russians were able to use facebook to help tip an election. they worry about the tone and then some of the stuff that is happening on the right on these platforms and, by the way, conservatives are more skilled at using it than liberals are. so, yes, they're going to get squeezed from both sides and that's why these companies that were the darlings of america and darling of the world are in for a rough couple year because the mood in politics is changing and when the mood in politics
