investigate. >> the request from flake was truly surprising because this puts this up in the air for another week for both republicans and democrats. coming up, what the fbi will be looking for and whether agents can figure out the truth. jeff flake made last-minute call for an investigation. there's a behind-the-scenes tug-of-war snf between the parties with jeff flake at center. h was con fronted after he said he would ultimately vote to confirm kavanaugh. here's senator flake last night. >> this is a limited time and scope and i think it's propose. when it's a lifetime appointment andgations this serious, we ought to let people know they're serious about. >> it did the protesters you encountered play a role in it at all? >> i think everything i've

experienced in the last couple of weeks has had an impact. it's been everything. >> let's go now live to capitol hill and nbc's mike viqueira. >> they're beginning the procedural process to confirm brett kavanaugh to the supreme court as early as today, that's all on hold per the request of jeff flake. he was asked, what was it that changed your mind. he felt like it was an explosive hearing. he had actually said he was going to vote to confirm. a sudden change of heart in the middle of that proceeding yesterday. you saw the protesters there.

jeff flake went further and explained what was going on in his mind. >> well, yeah. the republicans were yelling at the democrats and the democrats were yelling at the republicans an we can't go on like this. we've got bring people together a little and do something that republicans and some democrats at least can agree to, and that was to reopen the fbi investigati investigation. so that's what chris and i were talking about. i think we had a good outcome, and i hope next week we have a process people can be proud of. >> flake leveraged here. after all, there were others sitting on the fence. if they jumped behind kavanaugh, flake wouldn't have made any

difference. they would still have the full senate. but afterward susan collins and lisa murkowski stood behind him. they want to hear the results of the fbi investigation. for now the process is on hold and election day draws ever closer. dara. >> thank you so much. joining me now, julia manchester, congressional reporter for the hill. great to have you all here. molly, i want to hear from you. how unexpected was jeff flake's moment? does this all stem from the elevator moment or had this been sort of percolateling before then? >> keep in mind there were four republicans on the fence essentially until yesterday after the hearing. jeff flake, bob corker, lisa

more cow skirks and susan collins. i haven't seen them being so vocal until this issue. even with the daca debate, there were a lot of protesters but not quite in your face as the anti-kavanaugh folks. number two, jeff flake is ons he way out. he's retiring and not seeking re-election. he did have concerns about this nomination moving forward, and after thursday's hearing he was one of the first to call -- to hear from dr. ford when the allegations came public. after that hearing listening to both dr. ford and to brett kavanaugh, he said, i came away with as many questions as not. so what was more surprising was hearing friday morning when it was announced he was going to vote for the confirmation. in fact, e was listening to some folks. i overheard anti-kavanaugh folks.

i heard one word, and i hurricane, oh, my gosh, jeff flake, turncoat, and this happened two hours later, so i wasn't surprised. >> i want to turn to you. did senator flake do the right thing or did he potentially derail the nominee? >> no, i think he did the right thing. it's surprising he did it. he's good at giving floor speegs but this was action to back up what he had said on floor, looking for a way for getting bipartisan support. that's not to say democrats are all of a sudden going to change their mind as f the investigation but i think he did something important to allow everything to cool down and have a real conversation about this. >> and, julia, is there a clear scope what will be done after this with regard to the investigation? >> yes. there's less than a week to discuss this according to the

president who announced that, but we'll really have to see what plays out with all of this. we saw there was an fbi investigation back in 191 before the anita hill and clarence thomas testimony, however, it's a very short time. i think this is mitch mcconnell and the president kind o f realizing they might not have had all the votes they needed. we'll have to see how it plays out. >> molly, what would come up in the investigation to get anyone to vote against kavanaugh? >> here's the thing, something that was negotiated be chris coons, the delegate from delaware. that was key for republicans, key for jeff flake, and from what i understand, murkowski and collins as well, and those are votes that they need on the senate floor. you know, after this week-long

investigation, which actually doesn't necessarily need to take a full week. i mean these fbi agents can go out and investigate each individual person, get a report back by early next week and a vote could happen conceivably sooner than that. but it gives them cover to say, look, i've given it due diligence, we're not going beyond that, and we're confident we can vote now. >> susan, could. something come up that could derail him? >> it could. but there's more than investigation. there's now a lot of time on the clock for people to come out and look at more accusers or not necessarily in sexual assault, but based on his testimony on thursday, there was a lot of talk about drinking. we've heard rumors that maybe that testimony was a little overexaggerated as far as never drinking and being not able to remember things the next day. i think that's going to be the

bigger danger is what happens in the headlines starting as early as today versus the outcome of the investigation. >> and politically -- >> so, julia, you wrote in the morning consult there was a poll and suggesting it could have an impact on the midterms. how could it aaffect the midterms? >> it's been quite a week. we've seen that a lot of undecided voters have watched this hearing and saw really two sides to the story. you saw two different stories. you saw a lot of democrats watching the hearing, you know, really praising christine blasey ford's testimony, talk about how composed she was and criticizing brett kavanaugh's angry charge. however, i think he appealed to them and riled them up in the

hopes of confirming another conservative to the court. however, i think one thing that's really at play here is college educated white women, which republicans have been using and have been increasingly going towards democrats in polls. i think a lot of those women watching this week, that could play a major role in this. susan, your take on what it's going to do? is it going to help with the med terms? >> it's a double-edged sword. if he gets confirmed, it will help his base turn out. again, it will go to that polling of suburban women, especially suburban white women. if he doesn't get concerned, i think you're going to sew a lot of the base stay home, and that also will hurt. it's been a difficult time for republicans running for election or seeking office and being able to figure out how to thread that needle. it will be tough.

forced the president to call for an fbi investigation into supreme court justice nominee brett kavanaugh. the new probe will be, quote, limited in scope and be completed in less than a week. joining me now is nbc legal analyst danny s. >> i don't think they're given a choice. they're going have to run it through friday. once the facts have been obtained within that seven-day period, they're going have to report those back to the committee and we will all know in terms of what's discover. what's key is the following. it's not a typical fbi criminal investigation. it a is not like the agent is going to run with that lead. what they're going to do is take that information back, report it back to supervisors, and after

it's been made, they'll look at it. >> they call ee eed christine b ford's testimony. >> there was no burden of proof necessarily on the prosecution because you didn't really have it, although it wasn't unusual have a sex crimes prosecutor to ask questions of dr. christine blasey ford. but at the end of the day because you didn't have to prove it beyond any proof beyond a reasonable doubt, it was up to their discretion. it really wasn't an indictment necessarily whether dr. ford was credible but whether they wanted that actual confirmation process to proceed. >> danny, how about you? what was your takeaway? >> from thursday's hearing, the

takeaway is this is a difficult process. it's not a courtroom, although we've all developed our way of looking at evidence as you look at evidence in a courtroom. looking at the calendar, assuming it could be in evidenc -- actually they have to decide whether it's relatable that someone would have a calendar from 36 years ago. most are thinking i don't have a calendar from that long ago. this is an airy i've never been in. so thursday's hearing in total was a sad day for america. difficult to watch on both sides. >> and, katy, let's talk about what danny just brought up, which is his calendar. what's your takeaway on your daryl? >> listen, i have stuff from sixth grade, so maybe he did

have stuff from that long ago. but i find itse self-serving. i think the thing for brett kavanaugh, he's resting his laurels too much on this calendar. it's not something that will say he's a man of integrity because the calendar says he didn't actually attack anybody. it's something he can point to as, quote, exturin sick evidence, objective evidence, but i don't think it carries him past the finish line. >> and, danny, he invited these investigations but he pushed back when senator dick durbin told him to show his cards. let's take a listen. >> when this allegation first arose, i welcome any kind of investigation. i know that any kind of investigation, senate, fbi, montgomery county police, whatever, will clear me.

>> will you support an fbi investigation right now. >> i will do whatever the committee -- >> personally, do you think that's the best thing for us to do? you won't answer? >> you know, look, senator, i've -- i -- i've said i wanted a hearing, and i said i was welcome anything, i'm innocent. >> danny, what do you make of that exchange? >> i think it's fascinating because many people assume that because judge kavanaugh has been a judge for 12 years, he would be able to keep his emotions in check while testifying, but the reality is judge, lawyers, we often don't testify ourselves. we have lots of opinions about how to testify and whether or not people are credible, but we simply don't have the practice of testifying ourselves. you know who does? fbi agents and police officers. they're excellent because they

do it every day. judge kavanaugh let his emotions get the best of him and probably what he wanted to say is i don't want any more investigation period. instead he said, yes, i invite whatever you want, yes, fbi, yes, montgomery county police department, police department, yes, bring it on. he let his emotions get the best of him, and he wants it to be over period. >> danny cevallos and kati katie phang, thanks so much. we'll be back with the week ahead as the fbi wraps up its investigation. ahead as the fbi wraps up its investigation.

rise there? >> it's almost certain to, dara. it's about 24 hours since this devastation happened, and it was a day when there were actually as many as ten foreshocks and aftershocks surrounding the earthquake and then the tsunami hit. it hit at a time when there were hundreds of people attendinging a beach party in that area. it's affected two significantly sized communities. the rescuers are still having difficulty getting to the other big city. that's why it's almost certainly expected to go up. you're right. it happened in an area of the world known as the ring of fire. indonesia is very prone to quakes. there was one last month that killed 500 people. as they try to get through the debris and the missing, the death toll rises. it's becoming night there, again, which complicates things

even further. very difficult situation there, dara. >> ron allen, thank you so much for that. we're going to go back to judge kavanaugh. this is a holdup. president trump is ordering an fbi investigation at the request of the judge with the senate judiciary committee. back with us now is molly and susan. is it going to clear things up or muddy the waters? >> i think it will clear things up as it is muddy for the republicans who are on the fence who will put this nomination over the 51 mark and get it to the desk and that's the most important thing. >> and, julie, if the investigation comes back clean, will they vote for him? >> i don't think they have much of a challenge. jeff flake put out the idea of

doing the investigation in order to bridge a gap, but i think republicans feel like politically they need the supreme court judge up there. i don't see it helping democrats. and, soon, looking ahead, what does next saturday's headline. will judge calf gnaw be on his way to becoming justice california gnaw? >> i actually think it will lead to more questions than answers. we'll see. >> do you think any of the democrats might cross the line? >> joe manchin -- it depends what the investigation shows. if it shows there's nothing more compelling to come out and he comes out clean if you will, cavanaugh, then you may see heidi heitkamp or joe manchin y manchinovers for sure. >> molly hooper, julia manchester, and susan del
