remember from presidents past. all of them on days we would rather forget. that's our broadcast for this thursday night. we thank you so very much for being here with us. good night from nbc news headquarters here in new york. ♪ the investigation into the pipe bombs turns to florida. what investigators are saying and not saying as a tenth device is being examined. plus, new reaction from the president overnight, not on the investigation but about the news coverage. what he posted in a tweet less than two hours ago. and trump vows to, quote, bring out the military as he warned migrants headed to the u.s. to, quote, go back to your country. ♪ good morning. it's friday, october 26th. i'm ayman mohyeldin. we begin with the latest on the nationwide manhunt into the pipe

bomb investigation. senior law enforcement officials tell nbc news that investigators are now looking into whether some of the packages passed through the same mail facility in florida, possibly those addressed to president barack obama, hillary clinton, john brennan, eric holder and even maxine waters. officials are now dealing with ten separate packages that are all similar in nature. in fact, the latest was a second package addressed to former vice president joe biden, which was intercepted at a mail facility in delaware. early yesterday morning a similar package was discovered at robert de niro's production company in lower manhattan. all of the devices are being examined by the fbi in quantico, virginia. investigators say at least some of the devices were poorly made and had no possibility of exploding. we're also told that it is unclear if the flaws were intentional to make a convincing hoax or just bad design of construction. >> were these devices rigged to explode, or you think they were

more sent to intimidate? >> we're not going to give you 100% accurate description of what the devices were, but we have to treat them as live devices. this has a protocol that our bomb squad people use and it keeps everybody safe. >> joining us onset danny cevallos. this is all very, very serious, but legally speaking, where does this put us? >> there are several different categories of bomb when it's mailed like this. it could be something that would have gone off but law enforcement got to it in time. in this case, it's definitely a destructive device as defined by federal law, which actually subsumed destructive devices and bombs under the definition of firearms, strangely enough. moving forward if it's a dud, what does a dud mean? does this mean that all the component parts were there but something went wrong and the bomb didn't go off? in that case, it's still considered a firearm, and by

that i mean a destructive device under federal law. let's say instead it's something that looked like a bomb but never had anything explosive in it, never had any ability to detonate. in that case, it won't be a firearm or destructive device under federal law. but if it contains something like butane or something potentially flammable, it's at minimum something that's illegally non-mailable that was placed in the mail. so the component parts ultimately will be very important. a defendant will not get a hoax device or a hoax defense. the court won't even allow it if this is a device that was simply obviously a weapon or obviously intended to scare the heck out of people. >> when you take the hoax off the table for a moment, let's focus on the fact that these are real bombs intended to kill. when you take a look at the intended recipients, all of them political figures, most of them anti-trump figures.

does this open the door for this to be a terrorism-related charge in, in fact, the individual behind this is using, as you just mentioned, real explosives with real intent to harm? >> when you look at the legal definition of terrorism, this appears likely, because terrorism is defined -- and i'm paraphrasing -- as acts that are intended to intimidate or change policy or intimidate large groups of people. so with that loose definition of terrorism, it's highly likely that somebody, depending on what the investigation yields and what the intent behind sending these devices was, this could be considered an act of terrorism. >> i just want to double check. so firearm, it has to have something that would have been flammable, something that would blow up, or not necessarily? >> it does. you need the component parts for it to be considered a destructive device which is part of the definition of firearm under federal law. but as long as those component parts are there, a fusing

system, a charge. i've been hearing there was shrapnel of some kind in the form of glass. that's the kind of thing that will take it out of a defensive, hey, these were just fire crackers, these were something that would just go pop, but wouldn't actually hurt anybody. those facts like glass and other shrapnel indicate that this is out of the realm of a normal device that you might find in commerce and a destructive device ended for use as a weapon. meanwhile, president trump continues to take digs at the media. at 2:48 this morning, the president was up apparently. he needed, funny how lowly rated cnn and others can criticize. that post was quickly deleted. then he completed his thought 30 minutes later tweeting, funny how lowly rated cnn and ors can criticize me at will, even

blaming me for the current spate of bombs and ridiculously comparing this to september 11th and the oklahoma city bombing. yet when i criticize them, they go wild and scream, it's just not presidential. the white house says the president has spoke to new york governor andrew cuomo. he has not reached out to former president obama, one of the people targeted. trump did take a dig yesterday at the department of health and human services. >> i understand it's been decades since the last president came here and i'm very surprised that president obama didn't come here for obamacare. explain that one to me, but he didn't. >> several prominent republicans backed up the president's response to the mail bombs by criticizing news organizations. here's rnc chairwoman row that mcdaniel, senator ted cruz and newt gingrich. >> we have seen the media be unprecedented in their negative

has been the rhetoric by president trump on that migrant caravan that's heading to the united states that's currently more than a thousand miles away from the u.s. border. yesterday president trump tweeted he's bringing out the military for what he calls a national emergency and that immigration laws must be handed there -- >> i think he meant to say changed. >> anyway, later adding to those in the caravan, turn around, we are not letting people in the united states illegally. go back to your country and if you want apply for citizenship like millions of others are doing. it all comes after jim mattis is expected to order around 800 troops to the border with mexico. the troops are expected to be in place by the middle of next week. in addition, the trump administration is considering an executive order which would close mexico's southern border to migrants.

welcome back, everyone. saudi arabia's ever-evolving explanation for jamal kashoggi's death has changed once again after initially claiming for weeks that kashoggi left the saudi consulate in istanbul on his own, the kingdom later said that kashoggi died during a fistfight while rogue agents tried to bring him to saudi arabia. now the saudi attorney general is saying that evidence suggests that kashoggi's murder inside the consulate building was actually premeditated. cia director gina haspel has returned from turkey and she briefed the president yesterday on her findings and discussions. it's unclear if she listened to audio turkey says it had on kashoggi's torture and murder. one of kashoggi's sons who was forced to meet with the crown

prince earlier this week and who was reportedly banned from leaving saudi arabia has actually been allowed to return to the united states. the head of the senate judiciary committee has referred attorney michael avenatti and one of his clients to the justice department for a criminal investigation over their allegations against supreme court justice brett kavanagh. committee chairman chuck grassly alleges that avenatti made false statements about kavanaugh during his confirmation process. last month avenatti tweeted a sworn declaration from swetnick in which she claimed kavanaugh was present at gang rapes. she also claimed that kavanaugh tried to get several women drunk at gatherings.

it we have rainy weather back through northern illinois and indiana. we just have a little bit of issues with coastal flooding. we have new coastal flood warnings out for the jersey shore, new york city and long island. minor flooding is expected with the high tide saturday morning. could be high enough that we get some beach erosion. here's the timing of this mess. this as we wake up saturday morning. the rainfall all through the northeast spreading northwards quickly during the morning. not a lot of snow, only the highest of elevations will get snow out of this. by the time we get to saturday evening the storm is almost right over the top of new york. the rain is done in washington, d.c. saturday afternoon, but still kind of rainy philadelphia to new york. the rainfall forecast does have as much as 1 1/2 inches of rain

♪ ♪ welcome back, everyone. it is just about the bottom of the hour. >> so the nationwide manhunt for the suspect behind the pipe bombs sent to democratic leaders is focusing in on florida. officials say they're actually looking at whether some of the ten packages intercepted actually went through the same mail facility in that state. pete williams has all the details. >> reporter: new york police hauled away an eighth package

similar to all the others addressed to actor robert de niro and delivered to the building where his restaurant is located. then two more found in postal facilities in delaware, both addressed to joe biden. that brings the number of virtually identical packages to ten, with two of them addressed to congresswoman maxine water passenger. investigators say they now believe all were sent through the mail, including the one delivered by kcourier to cnn eat headquarters. some were postmarked, suggesting some may have been mailed from the same state, florida. investigators are working to narrow down which post office was the first to handle them. at the fbi lack outside washington, an evidence windfall because it's extremely unusual to have so many intact devices in a bombing investigation. only one found monday in the mailbox of george soros was

damaged. police conduct add contred a co detonation to render that one safe. all so far appear to be made with one-inch pvc pipe capped at the ends and filled with explosive powder. broken glass was added to act as slapper. taped to the side was a timer, though it's not clear what its exact function was. police say they found no wires attached to the envelopes that would trigger the bombs when the packages were open. it's unknown for they made to be convincing hoaxes to cause fear or if the bomb maker's design was simply flawed. but first responders are treating them all as potentially dangerous. >> we have to treat them as live devices. this is a protocol that our bomb squad people use and it keeps everybody safe.

k >> reporter: fbi lab analysts are now taking the bombs apart bit by bit. everything that went into them is a potential clue. >> you've got pvc pipe for example. perhaps there's a bar code on that that might tell what store it was sold in. >> reporter: fbi and the new york police urge people anywhere in the u.s. to call in tips if they believe they know something that could help crack the case. federal prosecutors in new york confirmed thursday that the investigation which led to the guilty plea of president trump's former attorney michael cohen is still active. as part of the ongoing investigation, prosecutors are opposing requests to unseal documents related to the fbi's april raid of cohen's office and residences. earlier this month, the "new york times" asked to have the search warrant findings unsealed due to their particularly high public interest level. prosecutors responded on

thursday with their own filing, arguing that the request encompasses materials that if disclosed would reveal a substantial amount of nonpublic sensitive detail about a grand jury investigation as well as information about uncharged numerous third parties. cohen also implicated trump by alleging that the illegal actions were, quote, in coordination and at the direction of a candidate for federal office. although cohen had no formal cooperation agreement as part of his plea deal, he has been in talks with state and federal prosecutors including some from robert mueller's office. michael cohen is scheduled to be sentenced in december. joining us onset, danny cevallos. how could unsealing sensitive court documents related to the ongoing investigation actually help a prosecutor's case in this situation? >> generally they're going to oppose it because they don't want this information revealed. on one hand, court records are

presumptively open to the public, but there's an exception where the criminal investigation requires secrecy not just because there are targets out there that might abscond if they know they're targets, but also unnamed third parties who are simply tangential to the investigation. they might be damaged by the release of information. so this is one of those circumstances that over comes the presumption that court records should be open. the implication is clear. if the document is arguing there are still uncharged third parties out there, you can fill in the blanks and they may be talking about some of the people that michael cohen mentioned in the course of his guilty plea. one of those people is the president. you remember that was a huge revelation when in open court he admitted to conduct that was criminal, conduct that had been reported as requiring another person, the president, because it was part of a cover-up

allegedly. >> or a candidate running for federal office. which i guess could be anybody that ran for office, but i think we all know who it was. that was an example of in the spirit of nixon an unindicted coupc coconspirator. going back to the type bomb, if and when this person or persons are caught, what are the charges they face? nothing was exploded but it had all the mechanics of being an explosive device. >> one of the most serious crimes under federal law is using a firearm in connection with a crime of violence. now, a firearm is not typically what you think of as a bomb, but that is the definition of a bomb. it's under the definition of firearm under federal law. and the crime of violence, a defendant might argue, hey, a

crime of violence is stick em up, give me all your money, but courts have held that the act of placing a bomb in the mail while itself is not inherently violent, falls within that category. you asked about the components of a bomb. as long as all the kpaecomponen are there to make the thing explode, if it was ready capable of exploding if just a couple of things were different, then yes, it's a destructive device. if it's a true dud that never could have exploded no matter what, then it may not be a destructive device, but it will probably fall within several other federal statutes, criminalizing the kind of behavior that terrorizes the public at large. there are just 11 days until the midterms. new numbers show that early voting has already outpaced the votes cast at this point in 2016. more than 8.1 million early or

we've been waiting for it all hour. joining us now, national political reporter for axios, jonathan swan with a good morning to you. >> it's not every day we get you jonathan swan. >> get to it. what is the one big thing you guys have this morning? >> the murder of jamal khashoggi has thrown a significant wrench into the white house's middle east peace plan, such as they are. we've been hearing about this

peace plan for quite some time. we don't actually know any details because it's been kept so secretive inside the white house. but president trump imposed an artificial deadline in september saying they would reveal the jared kushner peace plan within two to four months. the khashoggi killing has thrown a wrench into that and the white house is now having to deal with a situation in which they have invested a huge amount of capital in mohammed bin salman in saudi arabia as a leader in the middle east and also for help in their economic portion of the plan. >> so, yeah, help us understand and help our viewers he, as well, understand why the killing of a saudi journalist at the hands of a saudi arabian government would necessarily derail the white house's efforts to impose a peace plan on the israelis and palestinians. connect the dots for us. >> you should be clear. i don't think it had will actually end up derailing. i think they will end up releasing this plan. but it will damage it because

what they have been rehad lying on under the jared kushner and jason greenblack theory of the universe is that the saudis would be a really important ally in the region to rally arab states who are not necessarily friendly towards israel, you know, to sort of put pressure on the palestinians to agree to the plan. and also, frankly, to put up money for the economic development part of it. when you hear jared kushner talk about the plan and he's done so publicly, it does sound a little bit like a real estate deal. it's -- you know, they haven't been talking to the palestinians. the palestinians cut off all contact after they moved the embassy. but it's going to be here is the plan and here is a -- basically a cash bonanza and real estate development, you know, sort of here is this awesome opportunity for you economically. that's going to be a pretty major component of the plan. >> okay. you know, the president has spent so much time, jonathan,

out on the road. he's at these campaign rallies. he sometimes does two a day. so there's some data you guys have on what the president has in terms of the strategy here. what is this? >> so our teams has crunched the data on all the rallies the president has done, both done and that we know have scheduled ahead of 34, only 9 were in districts, congressional districts that hillary clinton won, which tells you -- i mean, we already know this, but it really puts a spotlight on the fact that this is not about persuasion. this is not about changing anyone's mind. the president is a very, very blunt tool being used to energize the republican base. and he's very effective at that. he's incredibly popular among republicans. but there ain't going to be any minds changed as a result of this campaigning. >> so what are you looking for in the final days ahead of the

midterm elections? >> well, we scoop that he is going to be -- the plan is from about wednesday next week for him to do as many as two states a day. >> wow. >> which is an incredible blitz leading into election day. frankly, this is what he loves doing the most. he loves the crowds and the adulations and being out there on the trail. part of the problem is he was asking for four a day earlier in the year and the secret service were not so hot on that idea. >> i can imagine. >> he found out there's no air force one miles, probably. >> you could pupil put him in a dodge caravan. >> but the bottom like is he doesn't want to see what happens to most presidents in the midterms. he's doing everything he can to make sure -- >> this is a referendum about him, i would say. >> he says act as if you're voting for me. >> the challenge is, of course, when he goes somewhere, he revs up republicans, but he also revs up independents and democrats.
