good morning, everyone. the suspect accused of opening fire in a pittsburgh synagogue over the weekend leaving 1 people dead is due too appear in court to be formally charged as the community comes together to begin the healing process. thousands gathered yesterday to remember the lives lost in what is believed to be the deadliest attack on jews in u.s. history. among the speakers was jeffrey myers, who says he has received support from all over the world in the wake of this tragedy. >> my texts, my e-mails, my facebook overflow with love from strangers, people i've never met, people who are not from the united states but from all around the world.

jewish, christian, muslim, all with the same message, we are here for you. my cup overflows with love. that's how you defeat hate. >> 46-year-old robert bowers remains hospitalize after a shootout with police. multiple weapons were recovered from the scene. the department of justice has announced it will charge bowers with 29 federal counts. attorney general jeff sessions has said that the charges could lead to the death penalty. bowers had a history of online postings focusing on conspiracy theories and anti-semitic hate speech. he claimed that the hebrew immigrant aid society, a humanitarian nonprofit association that assists

refugees, brought immigrants into the united states to carry out violence. he also frequently posted about the migrant caravan. but he appeared disappointed with president trump for not sharing his anti-semitic and extremist views. day bowers claimed that trump was a globalist and not a nationalist. authority versus identified the victims of those gathered at the tree of life synagogue. they range in ages from 54 to 97, including two brothers and a married couple in their 80s. neighbors described them as a sweet down to earth couple. the two brothers were at

services every week out fail. they say they had love for life and for those around them. the oldest victim of the shooting was considered much younger than her age. those who knew her say she had so much energy, that she was a kind and sweet woman. last night president trump lashed out against the media, tweeting out the fak nee news i doing everything in their power to blame republicans, conservatives and me for the division and hatred that has been going on for so long in your country. president trump continued with his campaign events over the weekend, holding a rally in illinois and another in indiana where he joked about almost cancelling. >> somebody just said your hair looks different today. i said i was standing under the wing of air force one doing a

news conference earlier this morning and the wind was blowing and the rain -- and i was soaking wet. that's what i ended up with today. and i said, at least you know it's mine. i said maybe i should cancel this arrangement because i have a bad hair day. >> joining me now live from pittsburgh, my colleague david ger. bring us up to speed on how the community in pittsburgh is waking up this morning and how it's been for the past couple of hours. >> reporter: the mayor of the city described what happened saturday as the darkest day in pittsburgh's history. he quickly pivoted to the strength and resilience of this

city. the toughness of this place, the toughness of the people who live here. it has been raining off and on since i get goot here. yesterday the clouds parted a bit and you saw mourners laying flowers at the footsteps of the synagogue. you talk to people about this community and a lot of things come across. the tight knittedness of it first and foremost. everybody has bought into the project of squirrel hill, pennsylvania. we focus on the jewish community in part. that is one element of this place. but it is a very diverse neighborhood with beautiful buildings. i had the chance to walk around yesterday to talk to folks here. it's an incredibly beautiful neighborhood. people still here reckoning with what happened obviously on saturday morning. you mentioned the vigils taking place over the weekend. there was a meeting of faith

leaders as well. it was interesting to talk to rabbis after that about what happened there. there is a stark divide still in this community. is now the time to talk about what needs to change? certainly that's a debate that's going to be happening here and across the country over these next few weeks. the trump supporter who was arrested and accused of sending pipe bombs to the president's critics is due in court today. 56-year-old cesar sayoc was caught because he left a finger fingerprint on one of the packages. he was taken into custody near this van where officials say he lived and believe the bombs were constructed. the van is covered in pro trump images and right wing propaganda, including images of barack obama and hillary clinton both in cross hairs. sayoc has a criminal record. he now faces multiple felonies

including making threats against former presidents. sayoc is a registered republican who appeared to attend a trump rally in west palm beach in 2016 and the trump inauguration. his social media contains several protrump postings. just before the suspect's arrest, the president tweeted out, republicans are doing so well in early voting and at the polls and now this bomb stuff happens. notice the quotes around the word bomb. and the momentum greatly slows. news not talking politics. very unfortunate what's going on. republicans, go out and vote. a shooting spree allegedly carried out by a white gunman who took the lives of two african-americans at a kroger store in kentucky is being investigated as a hate crime. police reports state that the gunmen entered the grocery store and shot the vifirst victim

multiple times. minutes before the attack surveillance video recorded the gunman trying to enter a nearby predominantly black church unsuccessfully, according to police and officials. officials are investigating the attack as a possible hate crime. the son of a witness reportedly heard the gunman make a racist comment during the shooting. let's talk a little bit about how prosecutors go about charging suspects with hate crime. how difficult is it to prosecute a hate crime? i know when we speak in legal terms, sometimes it's important to get the conviction even if the charges they're going after are not necessarily the easiest ones. >> that's right. when it comes to hate crimes, hate crimes present a special

challenge for prosecutors. the vast majority of crimes require a showing of intent. that means that the defendant intended the outcome of his actions. normally criminal law doesn't concern itself with motive. that's a different thing. however, motive, while it's about why you did what you did, can still be used as evidence of intent. hate crimes are unique in that they criminalize motive, the why of what you did. in the case of crimes motivated by an animus against people's religion, their race, their ethnicity. hate crimes do present an additional challenge for prosecutors in demonstrating not only that a defendant intended to do something bad, but additionally that it was motivated in his or her mind by the victim's ethnicity, religion or something else. >> is there ever a risk that in

the early stages of prosecutors something like, it could run up against the first amendment and freedom of speech? where do you draw the line between what constitutes hate expression and what constitutes an expression of disdain. >> as detestable as it is, hate speech is often legal. however, speech is not protected when it crosses that line into something like threats or when the speech is accompanied by a violent act. of course placing something in the mail is a violent act. so hate speech when it's accompanied with some form of violence or when it constitutes a threat will not be protected. hate speech itself with nothing more often is protected under the first amendment. >> is it possible that despite the charges that have already come out, that more charges

could be added down the road? is that common practice? >> it's always possible in the federal system that you might see a superceding indictment as federal or state authorities investigate further. they may add charges on as they see fit. the investigations are in their very, very early stages. it's important to understand that in the federal and state system, successive prosecutions for crimes arising out of the same acts are certainly possible. there's no double jeopardy bar in that situation. often times in normal cases the federal government might back off if they feel that the state adequately vindicates the rights of the victims. in large case like this, you're frequently going to see both federal and state crimes. still ahead, the latest on the indonesia passenger plane that crashed shortly after takeoff with 189 people on board. later with the midterm elections next week, jeff sessions may not

search and rescue crews have found debris from the plane, including passengers, their personal belongings, but they have yet to pull anyone alive from the water. the boeing 737 plane's black box has been located but not retrieved. the cause of the crash remains unclear. so far right politician has been elected president in brazil. pretty significant news in that country. the pop you l populist made der remarks about women, gays and minorities. earlier this year brazil's attorney general even charged him with inciting hatred. he said he would not accept the results if he lost while threatening to jail his political opponents or force them into exile and often

♪ welcome back, everyone. i'm amiyman mohyeldin. the suspect who opened fire in a pittsburgh synagogue on saturday leaving 11 people dead is due to appear in court later today to be formally charged. 46-year-old robert bowers remains hospitalized after being hurt during a shootout with police on saturday. the department of justice has announced it will charge bowers with 29 federal counts. attorney general jeff sessions has said the charges could lead to the death penalty. joining me now live once again from pittsburgh, nbc's david ger. what more do we know about the shooter's background?

and talk to us about the identities of the victims. >> reporter: i'll start first with the defendant who is named in that federal criminal complaint. he's been in the hospital since the shooting took place. law enforcement says they have been able to talk to him and that led them to his apartment in baldwin, pennsylvania, which they searched and to his vehicle as well. they've searched that. there is that physical evidence they're interested in. on the other hand they're interested in this digital trail he left behind before the shooting. that is of particularly keen interest to law enforcement as they investigation continues. the hate speech that he spewed, the evidence of that is something they're going to be taking into consideration for a motive. the victims were first listed yesterday at a wrenching news conference in pittsburgh. the oldest 54, the oldest 97 years of age. this is an incredibly close-knit

community. >> i know you've been on the ground there now for a couple of days. what is the sense in terms of how folks there are responding to the national rhetoric that has gripped this country? i'm sure it's not lost on anyone there the connection between what has happened there and the heated vitriol and rhetoric that takes place in our politics? >> reporter: i spoke to a state senator yesterday who represents this ward. we talked about it as a microcosm of sorts. you have people from all different backgrounds getting along, living together here in this community. we talked about discourse. i asked him what the nation could learn about what happens here. he said the way people that listen to each other and respect one another. that continues to be something that people here are talking about. a little earlier you played some clips of the president of the

united states. that's something folks here are engaging with. the president talking to reporters on the tarmac on saturday, bringing up the death penalty, bringing up the prospect of having armed guards in churches and synagogues. without exception, everyone here is not enthuse i can't teiastic. >> we're going to talk a little bit more about the president's rhetoric coming up. thanks, david. so the synagogue rampage is putting a spotlight on the uptick of anti-semitic incidents in america. there were nearly 2,000 incidents motivated by anti-jewish bias in 2017, marking a 57% increase kpakreec to the year boyfriend efore in . the number of cases recorded in

2017 were the highest since 1994 according to the adl. the organization's research found that u.s. schools and colleges were particularly affected. between 2016 and 2017, there was an 89% increase in incidents on college campuses. researchers say they have seen an increase in anti-semitic postings online. so president trump says that one way to prevent america's mass shooting epidemic is by making the death penalty more fashionable. a belief he has propagated repeatedly since saturday's shooting.

>> i think i've been toned down, you want to know the truth. i could really tone it up because as you know the media's been extremely unfair to me and to the republican party. >> the social media account of mail bomb suspect cesar sayoc shows a disconnect with reality. sayoc was obsessed with george soros, the jewish investor and philanthropist who has served as a republican punching bag. at one opponent sayoc painted the 88-year-old as a literal child eating fiend. he accused him of paying parkland shooting survivors david hog to help fake the massacre. joining me danny cevallos and matt miller. great to have both of you with us. the suspect here on one hand is saying that his bombs never

intended to hurt anyone. he didn't want this to kill anyone. but then you also have the director of the fbi saying these bombs were not a hoax. they meant to kill. how does that factor, the narrative coming out of the defendant play into this? does it have an impact at all? >> not in this case for the most part. that's your short answer, because the crimes he's charged with, some of which don't even require that a final explosive bomb device be the thing that was sent through the mail. for example, one of the crimes he's charged with is just mailing nonmailable items. those can be things that are flammable, drugs or something else. you don't need a completed, fully operational bomb for some of these charges. there are federal charges that require a destructive device. as long as you have all the component parts of a bomb, then that is going to have enough.

it doesn't have to be a bomb that actually goes off or a bomb that has all of the wires perfectly connected and it has the capability of going off. as long as you have the component parts, a hoax defense is not going to be available. >> sometimes when we talk about bombs, we consider or at least the government considers a charge of weapons of mass destruction. it's a common charge certainly for terrorists. why did we not see that charge littled again leveled against the mail bomber? >> urinsually that's related toe quantity of explosive material. i believe the amount is 4 ounces that gets you up to that weapons of mass destruction level. remember, federal prosecutors have to be mindful not just of what they can charge but what they can eventually prove beyond a reasonable doubt. so it's not surprising that they don't try to lead them up on charges that they're not confident in if they believe

they can get him on all these other charges. the fact that his intent was to mail it, that's enough. >> the timeline of the bombing suspect's arrest and how quickly the fbi movemoved, what does th tell us when you juxtapose it with the president's reaction? >> i think the fbi did an incredibly job finding the suspect. as it relates the president, there is this strange question. we know that the fbi was onto the suspect sometime on thursday. by thursday night they sent his record to the florida department of law enforcement to try to track him down. you would assume in a normal administration they would brief the white house in realtime. i know in the obama administration when we were on the hunt for a bomber on the loose, we were keeping the white house notified every time there was a new development. you would think the president was informed thursday evening, certainly by friday morning,

which i do think raises the question of why he was sending this tweet at 10:00 on friday morning where he was putting the word bomb in quotes. if the president was already informed that these were real bombs, this person who they found was a trump supporter and he was trying to spread this conspiracy theory that we'd seen in some of the cesspools on the right, that really raises concerns about his motivations. >> it's a lose-lose for the president either way you cut it. either he's out of the loop with the fbi or he is ignoring it and trying to push forward this false narrative. why have we not heard from kirstjen nielson? >> we haven't heard very much from her. we haven't heard anything from the white house homeland security advisor who is usually the person in the administration

kind of on point for this. we have a pretty serious domestic terrorism problem in this countery. i think you need to see an administration-wide response to it kind of like the response of the obama administration. it's very hard to do that when the president is kind of the chief propagandist who's out endorsing the conspiracy theories and fanning the flames of hate. it's hard for the administration to take on that ideology when you see the president not willing to do it and kind of endorsing it and being the person these people are rallying behind. >> i've seen a lot of commentary to whether the u.s. should tackle domestic terrorism. still ahead, attorney general jeff sessions' future at the helm of the justice department potentially nearing an end with the midterms. the new details on when sessions

all right. welcome back. joining us now from washington, d.c. with a look at axios a.m. editor in chief for axios nicholas johnston. great to have you with us. >> good morning. >> what is axios' one big thing? >> our one big thing this morning is trump's last ditch road trip. we're eight days away from the midterm elections and we have the latest details on president trump's travel schedule. he will be doing 11 rallies in the final six days. what's noteworthy that all the rallies are in trump country and trump states. he's hitting places like indiana, like montana, like the gulf coast of florida, like georgia, like west virginia. these are all areas that president trump won by 20 points or more in the last election. it's definitely a strategy to help boost the base, something we've been talking about, this white house has been focusing on for the entire campaign, trying to get the most hard core republicans out to the polls next tuesday. >> taking a look at the route

there and where the president plans to go, as you mentioned he's going to places where he has a strong foot hold, strong support. what kind of signals can we take on in terms of what the administration expects the terms of the outcome of the midterms to be when you look at where he wants to go. >> we showed this schedule to a couple really smart political analysts and they said it looks like the white house is conceding the house. all of these trips looks like they're boosted -- they're there to boost senate candidates, particularly in florida, particularly in indiana, but there are very few, only two, in fact, competitive house races number so of the districts that the president is traveling to. as we reported, sort of last week, republicans have gotten down in the dumps about the house, expect to lose it, expect house democrats to take the house, but the senate is still very much squarely in their cross hairs. republicans think they have a chance there. two other outliers, the president is taking a trip to ohio where he's going to be boosting a gubernatorial candidate because the governor can be so important during presidential elections in that state. >> i know that you guys have

been taking a look at this, that is, congressional republicans are lacking a key financial supporter this year, the big pharmaceutical industry. they've uls a been big supporters of the gop, but this year, though, big pharma is not behind the gop. how do you explain that? ? pharmaceutical companies were surprised last week when president trump unveiled his proposal for drug pricing control. this is something that was very much lifted from what they do in europe and how to keep drug price controls down. in prior elections pharmaceutical industries are given over $10 million to republican candidates and they were shocked this time when the president came out against this. this is something that republicans have had a lot of difficulty messaging around the politics on it in the midterms, this he needed something strong to have during the midterms on healthcare since with the popularity of the affordable care act, but of course one thing to note about the trump proposal on the pharmaceutical industry, it's a plan to create a plan about a plan. so there's still a lot that the lobbyists can do to put a stop to it.

>> switching gears, we are getting close to the halfway point of the nfl season. i know you are looking at the super bowl and the how the national anthem protests may impact the big game. we have talked about some celebrities not performing there at the super bowl halftime show. what do you know? >> pop stars are saying they don't want to perform in the halftime show, other celebrities are saying they don't want to be in the ads. it's the politicization of football spilling over to the super bowl. the last super bowl game the commercials there were some specific political messages on immigration and other things. expect that kind of trend to continue and intensify, some marketers have told the "wall street journal" they are sort of worried about being in the big game because they have become so polarized. people still love football, ratings are great this year. >> it's monday, what are you guys looking forward to this week? >> keep an eye on what democrats are starting to say they will do if they were to take the house, something nancy pelosi has already announced, legislation on increased protections for
