good morning. happy thanksgiving. i'm david gura. this morning supreme smack down. chief justice roberts criticizes president trump after the president takes aim at the judicial system. asked and answered a day after trump's team deliver written answers to robert mueller, giuliani says there will be followup questions. thousands of u.s. troops spending their holiday at the border awaiting a new caravan but a new plan from the

administration could have migrants spending time south of the border. >> high winds and cold temps wreaking havoc in new york city. will the giants balloons be allowed to fly? >> president trump begins his thanksgiving morning in another public feud. this time with supreme court justice john roberts. this latest skirmic began tuesday on the south lawn of the white house with these comments in response to a court injunction on the administration's asylum policy. >> this was an obama judge. i'll tell you what. it's not going to happen like this any more. everybody thats to sue the united states, they file their case in the 9th circuit and it means and automatic loss. no matter what you do. no matter how good your case is. and the 9th circuit is something we have to take a look at.

>> the chief justice said this, we don't have obama judges or trump judges, bush judges or clinton judges, what we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them. the president came off the golf course on wednesday firing back dismissing the chief justice's point ever view while calling theth circuit very dangerous and unwise. joining me now kelly o'donnell and others. kelly, let me start with you down in florida. this is unprecedented. we haven't seen attacks like these between these two branches as we've seen it in the last 24 hours. >> reporter: so many of us have been accustomed to the president firing off on twitter or elsewhere. lots of political rivals or targets of the moment. what we have not seen before is

this kind of engagement with someone who is the head of a co-equal branch of government, the judiciary, of course, is just as important in our system as the executive branch and the legislative branch and so this is an unusual pathway. but also unusual on behalf of john roberts the chief justice, for him to comment publicly is rare, and it is sending a message. we have been told by those who have been appointed to the bench that one of the frustrations they experience is being sort of tagged with the president who nominated them throughout their career and presumption that they would somehow render their judicial assessments based on the politics of the president who nominated them. we've seen over time where there certainly have been surprises where judges who were selected by a president ended up appearing to be somewhat different in philosophy than maybe that president had hoped

for. so the message from the chief justice is that there are not judges who are aligned with the presidents who nominated them, there is a dispute, of course, because the president fired back in a way that is sort of typical for the president but, again, the adjudicatijuxtapositioadjuj president and john roberts is unusual. the chief justice has gotten the president's twitter treatment and it's a noteworthy moment. the underlying issues, there are things to debate about how the president felt that his cases related to his administration have been treated, but this is certainly notable. i was in the east room, david, when the president presented the medal of freedom recently and a number of members of the supreme court were in attendance including john roberts because antonin scalia was being given that honor so the president had opportunity to interact with members of the court.

he said nice things about ruth baden ginsburg who had just been injured from a fall. who would have thought days later we would have this dispute spill out into public. >> lynn, i want to ask you about the timing. there's other moments when donald trump was a candidate in which he talked about judges, talked about the judiciary. we think about this mexican-american judge that he called out before. why now? why did john roberts feel he had to speak up. >> i think what's different here is that trump gave him the opening by the way he criticized the judge. it was a broad side by saying it's an obama judge and that creates an opening for roberts to go through to make the point he made rather than defend one particular judge, which is harder. and the other thing in terms of the timing is not only how trump

framed his dissent, it's that for trump and his timing forgoing harder against roberts i think he sees this tough road ahead with the democratic house majority coming in just a few weeks. i think what he's trying to do is tackle another institution, the supreme court, the co-equal branch of government as kelly was saying and try to deacon struck it and delegitimize it as a political operation that could rule against him. obviously, this defies and goes against his own appointments of judge kavanaugh and judge gorsch which he praised and if they rule against him which, in time, they will. all presidents don't get everything they want from a court, it will be interesting to see how he reacts. i would say keep in mind what he's trying to do now is to call any entity that rules against him a political call, not straight and the umpires are

throwing the game. >> the attacks on the institution or the institutions and attacks on individuals as well. you covered donald trump when he was a candidate. i want to go back to 2015, to when donald trump then candidate trump was speaking at a town hall in south carolina. he talked about john roberts the chief justice and the supreme court. >> i will tell you this. justice roberts really let us down. he really let us down. what he did with obamacare was disgraceful. and i think he did that because he wanted to be popular within inside the beltway. when we talk about supreme court, we talk about supreme court judges he's so disappointing to me. but, but -- i hope i don't have a case before the united states supreme court any time soon. that's how i feel. >> i look how it played in the room. you heard the applause from what the president said about chief justice roberts. what happens next?

john roberts made this unprecedented step of making this statement. president fired off in twitter in response. we won't have a lot of back and forth and how does that handicap the supreme court justice and the judicial branch as a whole? >> well, public relations wise i think it presents a challenge particularly as the president now turns his fire and fury against the supreme court. from an institutional standpoint the supreme court is very much well protected. this was a president who campaigned, david, on the notion of appointing supreme court justices to the supreme court. he's already appointed two. there's openings now for even more potentially in the conclusion of his first term and if he were to be re-elected for more judicial appointees. that was the trucks of his campaign argument. you talk to the base of president trump's political movement and nominations to the

supreme court was a key at the net of their political calculation. the question becomes as robert mueller begins to conclude his investigation as the president has respond and written responses to robert mueller's investigation team, democrats seem poised to take control of several gavels and now the situation where cases could ultimately end up in the supreme court. you're seeing the president, whether it's chipping away with arguments at the supreme court or even jockeying for ranking memberships at the subcommittee level in the house of representatives by aligning himself with key conservatives such as congressman jim jordan, a republican from ohio, a member of the freedom caucus to help him bolster and defend himself number one from the democrats who will use subpoena power in their investigations in the house of representatives, but also ultimately chief justice roberts could have a final say or some type of very influential

say in this president's term. >> kelly o'donnell, walk us through what we can expect from this president from this vacation. it was a busy day yesterday, played golf with jack nicklaus. what's on his agenda today, what can we expect during the rest of this vacation down in the florida? >> reporter: one event on the president's schedule that will be public in the sense of the president participating in a teleconference with members of the military where from his mar-a-lago home he's able to extend thanksgiving greetings to service members who are based around the country. we've seen him do this kind of thing before. presumably then there will be a trump family and extended friends thanksgiving meal at some point. we always ask the white house for some of the details of that. what kinds of things will be served, who will be in attendan

the middle to end of next week. your reaction to this the developments of this last week. rudy giuliani has been the prism through which we see how this process is unfolding. what's your sense of where things stand now that this questionnaire centering on collusion not obstruction has been tended to the special counsel. >> it seems like they know that mueller doesn't want to get involved in the election and the mid-terms so used structural impediments to delay and accelerated at other points. why didn't we get written answers before the election or a month ago. that's because they didn't want it before the mid-terms. now he's basically saying we won't have a subpoena. why? we have kavanaugh there. they've masterfully pieced together the timing and structural moves. my one caveat to this is that

they are making a lot about some things that necessarily true. you saw chief justice roberts come out and say we're independent and i think that is a signal that for some reason trump's world view is that everybody is on a side or is part of a team or they are going to help me out in some way. that's not necessarily the case. that was the issue with obamacare and chief justice roberts. he said no this is what my opinion is. what we could have in all of this, let's say mueller does go for a subpoena. it goes to the supreme court. they will go with the rule of law. this is where the president makes missteps. he thinks everyone will play based own a team when actually these institutions play by the rules. director wray is another investigation you should investigate hillary clinton. director wray is like there's no case for me to move forward on. i'm not a partisan tool of the president, i'm the chief law enforcement officer for the country. >> let's talk a bit about what we've learned from rudy giuliani

about the questionnaire itself. he said there were questions about the speech that the president gave when he was a candidate in florida, called upon the russias to release the emails and said there were questions about that trump tower meeting as well. does that -- your reaction to that. are there other things in there that rudy giuliani hasn't mentioned? >> that's probably the case because these are things -- what's interesting about this case it played out in public. the sfeech peech in russia, if t those emails, it's alarming. did you know about emails when you stood on that stage that day? there's also, you know, everyone seems to get that feeling because they answered in writing the president can get away with things. this is not necessarily the case. we've seen the president be fairly inconsistent on a routine basis about his answers to any given question. imagine you're trump's lawyers and ask him what happened at

this moment we have to document on paper. we don't know what all the other witnesses said in the mueller investigation. a question about are you on stage did you know about the trump tower meeting. who knows what the truth is going to come out and shake out as? these other witnesses may have told mueller something and if it doesn't jive with what is in that written statement they could go for a subpoena saying we need to clarify this and talk to him in person. >> help me understand the magnitude of that piece in the "new york times" about the conversations that the former white house counsel had with president trump, suggesting that hillary clinton should be prosecuted, james comey should be investigated. in this interview rudy giuliani said it's disgraceful she wasn't prosecuted. if anyone else did that they would have to go to trial. dove tailing those would things how important a moment is that? >> i constantly ask myself what it must be like to be don mcgahn in the white house.

you get these queries does he understand what he's saying. the truth is i don't think he does. what consistently comes up the president doesn't understand how the functions of government worker and that the judiciary is supposed to be nonpartisan, somewhat separate and should be no undue command influence. no leadership pressure on where the investigations go. he does not understand natural. and consistently even after firing comey you would think he would sort of pull back and say okay i'm pushing too far. he continues to pursue which is just striking that he puts himself in that danger which tells me he doesn't understand even to this day that those aren't really his people that are there, authors the servants of the united states and the american people and that he's the one who selected them. it's just confusing why he would continue to put himself in that danger. i'm sure don mcgahn was alarmed when he had the question and to don't write me bhos the same reasons why this is a bad idea and present it to the president

>> it is a record. that happened just moments ago as the temperature dropped down to 20 degrees. it's the coldest thanksgiving day parade officially. temperatures are at 20. wind chill factor in the teens and some places even in the single digit. feeling colder than it is. cold and windy for forecast. notice how close we come to the parameters of having to lower those balloons when parameters say they have to be stronger than 23 and gusts have to be above 34 miles and we expect them to 2k3w0e9. close call. hopefully they will stay below those standards. temperatures though, so cold. by account maybe one degree more than where we are now. it's the coldest. wind chills in the low teens. even by noon we're expecting temperatures to stay so cold in the 20s. no warm up in store. in fact, looking at the forecast, if you're heading out

>> welcome back. i'm david gura. 5800 troops are spending this thanksgiving along the u.s.-mexico border. this comes as "the washington post" reports central americans arriving to the u.s. have to wait in mexico for their asylum claims to be processed. central american asylum seekers who cannot establish a reasonable fear of persecution in mexico will not be allowed to enter the united states and be turned around at the border. hans, i want to ask you about a couple of tweets. talking about john roberts once again and talking about border security. i'll read from these two tweets in part. he writes judges must not legislate security and safety at the border anywhere. they know nothing about it and making our country unsafe. our professionals must be allowed to do their job. if not only bedlam, chaos,

injury and death. we want the constitution as written. your reaction to that tweet and how it's ringing along the u.s.-mexico border. >> reporter: no immediate reaction. they are focused on the task at hand which is deep frying. what the president is trying to do on the border it's so clear everything will be litigated in the courts. that's clear in trying to funnel everyone to points of entry. whatever he does with asylum claims whether on this side of the border or other side. in similar ways what he did on the ban of primarily muslim countries that ended up to be decided by the courts. in the view of the white house they have broad prerogative to make these decisions. we live in a democracy, we live in a republic where courts have the final say. >> you say the task at hand is deep frying. i see deep fryers going on

behind you. how do these troops and general mattis 5,700 of them have been deployed to the mexican border. how are they spending this thanksgiving day? >> too muddy for a turkey trot. there may be pickup football. here's what they are doing this morning. they have deep fryers. been going since 4:00 in the morning. these are tents all set up. they are trying to turn them around, make them more homely. transforming the insides, putting up banners, hanging things. they will have tvs going here as well. they have 800 pounds ever turkey that they are deep frying here. it's being run with military precision. on top of that they have 3,000 servings of roasted turkey, 14,000 pounds of steak. they are cooking those in those kitchens over there. they got 300 pounds of potatoes. 350 pounds of mashed pots to,

your family? >> i love you. miss you. hopefully i'll see you soon. >> with that we'll send it back to you guys. our thanks to the sergeant for joining us on this thanksgiving morning. i want to bring in colonel jake jacobs. your reaction to the scene on the ground at that camp base in texas. your reaction to what we heard from the secretary of defense yesterday. initially there was some thought this mission would be complete by december 15. now the secretary saying it could be longer than that. >> general buchanan said he would like to see everything closed down soon and certainly before christmas. but, secretary mattis has said that's not going to happen. even if the mission itself stops now, it would take quite a bit of time for the remainder of the troops and most of them are support troops to close down and get back home. when you deploy anywhere, there's an advance party and

they go there weeks in advance and when you close down the trail party takes weeks to come home too. this mission won't end any time soon, it doesn't appear. >> the secretary of defense said this cost $72 million thus far. that number is likely to go up in the coming days and weeks. your sense of how clear the mission is at this point now that we're a few weeks init. >> if you're down there on the ground you can see that the mission is not for the active duty troops, is not to stop people from guatemala and el salvador from coming into the united states. it's to support the border patrol. and to support the national guard troops who are down there to do that. the large majority of the effort for the active duty troops is support. to construct barbwire barriers to support with helicopters,

military police, logistical support for the border patrol and for the national guard. they are not armed and not going to be standing guard on the border and prevent migrants from coming in to the united states. so purely in a support role, david. >> i want to go back to that tweet that i read to hans a moment ago the president talking about the threat of bedlam, chaos, injury and death. none of which seemed remotely visible from the vantage where hans was standing. help us understand. >> the lot of this is political. there's a large number of migrants coming to the border. there's a large number of them actually tijuana at the moment. some people say as many as 6,000. it's causing some problems, of course, for the mexican government. but the likelihood that we're going to get overrun by a huge

number of migrants at the border at multiple locations is very unlikely. the biggest problem there is not for the united states but is for the incoming mexican president because he's going to get sworn in soon and has two big problems in addition to the other problems he has. one is the number of migrants on his side of the border and the other is dealing properly with the american president, both of them are challenges, david. >> i mentioned that change in policy when it comes to asylum. there was another change ever policy announced as well, that having to go the ways in which the troops down there could use force if they needed to do to protect border and customers protection. i want your read on that if that's a wise idea to authorize troops serving in the mexican border to use force if necessary. >> well, what that order means is that the decision to use force, and there's always a

decision to use force one way or another in difficult circumstances, that decision has been delegated down below the white house. so the commander on the ground and there's a general officer down there to make that decision can decide whether or not either his troops or the border patrol troops or the national guard are in trouble and need to defend themselves. remember that the active duty troops are not armed. what general mattis does not want is to have a repeat of the 1970 kent state massacre. that's not going to happen. and i think it's just a minor change in the rules of engagement down there. but the decision will be that of the general on-the-spot. >> thank you very much. happy thanksgiving. >> and to you. >> coming up a growing number of republicans blast the president, his praise of saudi arabia.
