in response to a court injunction on the administration's asylum policy. >> this was an obama judge. and i'll tell you why. it's not going to happen like this anymore. people should not be allowed to immediately run to this very friendly circuit and file their case and you people know better than anybody what's happening. it's a disgrace. in my opinion, it's a disgrace what happens with the 9th circuit. >> that happened not to sit well. john roberts telling the associated press in a statement, quote, we do not have obama judge, or trump judges, bush judges or clinton judges. what we have is an extraordinary group of dedicated judges doing their level best to do equal right for those before them. the president bushing back again tweeting just last hour, quote, justice roberts can say what he wants, but the 9th circuit is a complete and total desert.

joining me now nbc's kelly o'donnell and "new york times" washington correspondent charlie savage. let me go back to that tweet the president said a few minutes ago, dove tailing it with his concerns about the security on the u.s.-mexico border. >> reporter: well, the president is voicing a frustration here about his really unique responsibility as president for the safety and security of the country, while a very big difference of opinion on the underlying issues from his complaint about how the courts have handled some of his sort of policy initiatives. things related to asylum seekers, for example, which is one of the current issues earlier in the administration, it had to do with that ban on travel from certain countries. the president has had a kind of a road block put before him, with some of the things he campaigned on, says he wants to do, to a degree, some of his supporters back some of these ideas. then he comes up against the courts.

and in particular, he's venting frustration that a particular branch within the court system, he believes, has been unfair to him. well, we heard from the chief justice in that rare public statement given to the associated press, where he was not commenting on the specifics of the case, but defending sort of the correct of the judicial branch by saying that judges are not to be associated solely with the president whom appointed them and that they will handle cases fairly based on the evidence presented to them and not be a reflection of the president's political views of those who have appointed him, going back to, of course the presidents who still populate the federal bench, going back to clinton, for example. the bush years and, of course, now president trump has had two supreme court justices placed on the high court in neil gorsuch and more recently brett kavanaugh. so we had talked an hour ago, david, about maybe that would be it. because we don't expect that the

chief justice would comment in an additional way. but the president's got free time. it is a holiday. so he was back on twitter in just the last hour of firing off new frustrations. again, he is trying to litigate this over twitter, the chief justice was making a broader comment in defense of the integrity and the sort of judicial system over which john roberts knows a great deal. david. >> charlie savage, i want to ask you about this on the 9th circuit. i don't know how many people will be talking about the judicial in this country. the president called out the 9th circuit in california in particular. i want to pull up a couple tweets from george conway, noted husband of kellyanne conway, pointing out there is a discrepancy when you look at that reversal rate the president cited in that tweet. if you look at the 9th circuit. the supreme court reversing a

9th circuit decision with 79%. you look at the 6th circuit, ohio and kentucky, that was 87%. we're in the weeds now, charlie. help us explain why this is a point of fascination for the president. >> so, what the statistic that trump is mustering to say this circuit is out of control and a bunch of liberals is a wildly misleading one. the 9th circuit is the largest circuit in the country. so it has, because it was built or the lines of which states are in it were drawn before there was a huge population in places like arizona and so forth. so there's a large number of total cases that come out of that circuit. which means you might see in absolute terms a number of reversals happening from the west coast. >> that doesn't mean its rate is wildly out of proportion. the 79% statistic in particular is misleading. in fact the supreme court reverses the 9th circuit, less than a fraction of 1% of the time. it doesn't mean you hear appeals

the overwhelming majority of the time. it takes four votes to take up a case. once it's decided to taekt up a case about four out of five times, that can be reversed. that's about the same around the whole country. like 7 out of 10. there are a few circuits that are more. the problem with our viewing on the facts like this, there is one circuit that has a higher percentage. this is not all out of the ordinary is that it's sort of a trap. the reason it's a trap the take away frommer t the ordinary vie there is something wrong as opposed to what is going on. trump is picking a fight with the judiciary at a time in which he has his own policies and perhaps in the mueller investigations very high stakes stuff coming down the line, in which he wants to delegitimize anyone who wants to constrain him. >> we have been talking about norms eroded as well. when up look at all that's

happened over the next few years. how significant is this? the president going head-to-head and the chief justice firing book, issuing that statement to the ap? >> it's certainly extraordinary. i haven't witnessed in my lifetime. i think it's of this long trend we have seen since the bush v. gore decision in 2000 when the supreme security decided to intervene in a presidential election. you've seen attacks on the court's legitimacy come for years and not just from people like president trump but also from the left. i think the kavanaugh hearings this fall eroded first time the less confident in the independence and impartiality of the supreme court. so i don't think president trump is alone in viewing the judicial system as a partisan actor and whether that's right or wrong, you see lot of people on the left who are very concerned about that. maybe that's why justice roberts sought to weighing in. he's worried about the court's legitimacy in a time when it's

under assault like never before. >> i want to ask you about the history here, when it comes to this dynamic. i will read a tweet from back if june of 2015, donald trump, writing this once again the bush-appointed stream court justice john roberts has let us down. jeb pushed him hard. remember. this is something that's gone on for a while. maybe in a less public forum n than in the last few days. but this has been a feud for the last many years. >> reporter: and it may take a new turn because with the new composition of the court, some view john roberts as the potential swing vote in place of anthony kennedy, two had held that role for a long time. of course, his retirement cleared the path for brett kavanaugh and so now the composition of the court is new again and it may be john roberts who is a swing vote. so it could be kind of we're heading into a different territory. but you are right. president trump has not held back his criticism of john

roberts over time. in part, there was the obamacare decision where the court knocked down parts of the obamacare law but kept it in place and so the president has certainly spoken out about that. he has still been thwarted by a congress not being able to completely replace or repeal obamacare as he said he would do as a candidate. going after parts of it. now certainly with a democratic house coming in, in january that will not happen in any foreseeable time frame unless there is a bipartisan attempt to make some adjustments to the law. so there is history there for sure. the president two has never healed back as a candidate. now we seen in office is not even sort of bound by some of the more typical constraints. in fact, those things seem to be a green light for him to want to vent on issues. and when it comes back to the issues of national security, where the president does have a unique role, his frustration is clear.

he believes -- or he at least talks about it politically that asylum seekers in some instances are fought properly being put through the judicial system, the new policy where they want to change that process requiring people to go to ports of entry, changing potentially the process of how between being greeted by the united states and being adjudicated through a process where asylum seekers would remain. there is the president's view that if they are allowed into the united states and have some later court date as he says they never show up again so a lot of volatile political rhetoric there, mixed with policy. and then now criticism of the court so the president is frustrated because he says he wants to do certain things on national security going back to the travel ban from a predominantly muslim country. those sorts of things he argues are for the safety of the country. yet, courts view it differently in certain instances, that's

. welcome back. after nancy pelosi moved to side line her only potential challenger for house speaker the democratic house leader's opponents consistent they have the votes to block her from regaining the speaker's gavel when the full house meets in january. with marsha fudge withdrawing after cutting a deal with nancy pelosi to chair a new subcommittee on elections, another challenger has not yet emerged to take on the long-time democratic leader. joining me now is donna shalala under president clinton. great to have with you me on this thanksgiving morning. let me start by asking you about the fight for who is going to be speaker. your reaction to it. the contours of it such as they are here a few weeks out before the election. >> reporter: well, you know, we're a big tent democratic party. so there are always going to be dissenters. i actually think it's been overrated. there are some serious objections from some of my

colleagues to nancy being the speaker, but she's going to get elected. no one has her skillset. and no one has come forward, but more importantly, no one has her skillset. deep knowledge of policy plus the political skills to be able to pull our caucus together in one voice for real change from the current administration. >> you describe the party as big tent this incoming class is certainly big and diverse as well. how best represent that in leadership? what is your prescription for that? how do you represent the young new members of the class, those from different background in leadership in the democratic party in the house? >> well, we're all going to get an opportunity to run for some of the leadership, the other leadership positions and already my colleagues, the newly elected class that flipped republican seats are vying for some of the

other leadership positions. but what's more important is nancy's leadership in listening to the new voices in the party and to new ideas. she's always done. that that's a part of her own skill as a political leader. but i want to emphasize that she's not just a political leader. she really does have a deep knowledge of policy and the interface between policy and politics. that's the nancy pelosi we all know and she's just going to be a world class speaker. >> i wonder how much you thought about the degree to which democrats should wield their investigative power in the early days of this new congress, since you have been elected and what you would say to the leader and leadership of these communities and the futures they're weighing, how all in to go when it comes to investigating this white house? >> what we said to the leadership is we got elected to get things done for our communities. >> that we have a responsibility as the majority to do proper

oversight of the corruption in this administration, of the president, himself, and hills policies. but, meanwhile, while that's going on, that cannot dominate the news. what must -- what we must do is to get things done. we have a lot of work to do in health care. we want an infrastructure bill, hopefully, both of those things can have bipartisan support. we want to deliver for our communities. we want to demonstrate as democrats and as leaders of this country that we can improve the lives of the people in our communities. that's what we're going to washington to do. >> i want to ask you about what it's like to have left washington almost 20 years ago after serving in the clinton administration, gone down to message, headed up the university of miami, now plotted your return back. you will be going back to washington, d.c. how recognizable is it to you? and what is that experience in a different washington. how is that going to shape how you approach it this time

around? >> reporter: well, it's far more partisan than it was when i left, but the policy issues are the same. we're still struggling with issues of the environment, with issues of health care to try to get everybody cover with decent, affordable health care. we're struggling with pharmaceutical costs, for example. and we've got to make an investment in our infrastructure. we have been talking about it for so long. but it's time to do that. and, of course, immigration reform, i come from a community of immigrants, we're a nation of immigrants. we have to have a fair approach to immigration. in my community, sea level rise is a life or death situation and so my hope is that we'll be able to deal with some of those issues through the infrastructure bill. i hope it's flexible enough so that miami and south florida can

welker, my colleague. he said this, i'm expecting they'll say we're done. that's his sense, give me yours. >> reporter: david, happy thanksgiving to you. when we hear guiliani say things like you know we're not going to answer any questions we deem irrelevant or unnecessary. i think what the american people should hear is that the president is not going to answer any questions they deem incriminating. it becomes pretty apparent when i look at this from the perspective of a former career prosecutor what mr. guiliani is trying to do here. when we hear that they won't answer questions about, for example, obstruction of justice, that is plainly because the president would be boxed in by such questions. for example, mr. president, did you participate in drafting the narrative on air force one of what happened in the meeting at trump tower between your son and your son-in-law and the russians?

if the president were to answer, yes, well, now he has admitted potentially to obstruction of justice. if the president answers no, he has probably earned himself a false statements charge. sos it is pretty transparent that the reason that the president's defence team is not letting him answer questions about obstruction of justice is because he would be boxed in, he would incriminate himself. it has nothing to do with an exercise of any legitimate executive privilege. >> in that interview, rudy guiliani said if they were reasonable, they would answer them from robert mueller. he said robert mueller's team, they're very circumspect. let's talk about the subpoena battle that might be shaping up. rudy guiliani expressing confidence if robert mueller were to threaten that, president trump wouldn't comply and they would win that victory

presumably in the supreme court eventually. give us the read of where that process would take us if we were to see the back and forth of a subpoena. >> sure. on the law, mr. guiliani is wrong. i sa i that, because the supreme court twice has taken up issues in the nixon case and clinton v. jones, both times the supreme court has come down in favor of saying, you know what, no president is above the law. i think if they were to fight a subpoena battle trying to acquire the president's testimony before the grand jury via a subpoena, the supreme court would side with the prosecutors. again, what mr. guiliani says and means are two different things. when he says the president wouldn't cooperate and that he believes that they would win the subpoena battle. what i think we should all hear is that if the president was subpoenaed, he would invoke his fifth amendment privilege against self-incrimination.

so the entire subpoena battle, even if the mueller team won it would be a hollow exercise. it might look like a public relations victory because everyone would look at the president and say, it's unconscionable he is invoking a fifth amendment privilege. bob mueller is not playing for publish i lick relations victories. he is playing for ultimate court hearings or impeachment hearings. >> i want to ask you about matt whitaker. you have been following him. he was up here in new york this week and he gave a speech in which he talked about a man involved in the chelsea bomber and matthew whitaker invoking in a speech that there were co-conspirators. pacific, there western in that days. your reaction to him giving what were basic facts wrong in a speech to his colleagues here in new york? >> you know, david, if you have to undertake to head up the department of justice, you should at least be right on your facts with respect to some of

the most consequential prosecutions that the department of justice has undertaken to try to protect this country. the other thing i will say about matthew whit keaker, when i see filed these financial disclosure statements and repeatedly five times now had to correct them. you know, this is somebody who is a u.s. attorney in the mid-2000s in iowa. he knows how to fill out those forms. he knows how important they are to see if he is conflicted out of any matter. for example, if you own stock in at&t and you come in and take over the department of justice, you can't oversee any matter that involves at&t. he knows better than to carelessly, recklessly or inaccurately fill out those forms. not a good sign and not a good start for mr. whitaker. >> rick, great to talk to you always, thank you for joining us from washington, d.c. . >> thank you. in just moments from now the macy's thanksgiving day parade will kick off in new york. hundreds of thousands are

braving the frigid temperatures to witness that parade. ron allen is stationed along the parade route. we are about what? 30 minutes out from the start of this thing. what are you seeing there? are the crowds getting deeper than they were an hour ago? we are having trouble getting to ron. let me go to bonnie schneider first, of course, weather has been a huge issue leading up to this parade. there was some question, bonnie, about whether throws balloons would be able to fly because of the winds and the temperatures here in new york. >> well, it looks like the temperatures are holding steady, if not getting colder. they've dropped down to a current temperature of 19 degrees. this is officially the coldest day ever for the macy's thanksgiving day parade ever on record. now the winds, that's something else, very closely watching it. we can measure the wednesday along the parade route to see if there is any fluctuation. the main thing is those gusts stay below 35 miles per hour. that's the forecast.

we anticipate them to stay sustained as well. it will be cold and wendy, but i think the balloons right now look good to fly. we are only 30 minutes away from the start of the parade. i can tell you that the temperatures will not be remember whatling u -- warming . the brisk wind, the wind chill will feel like it's in the teens in new york city and around the area. if you are wondering, well, will tomorrow, black friday bring any relief? no, more record lows, that will be all across much of the region for black friday. elsewhere, that's not the case. many people enjoying the warmer weather. there is a storm that will be beneficial for the fires burning there. another warm spot on the map, the own place is florida. it's 80 degrees in miami. the rest are definitely dealing with frigid conditions for the parade, especially. >> thank you very much for that update here and across the country. let's try to go to my colleague along that parade route 30 minutes out before the start of

the macy's thanksgiving day parade. there you are, ron, i see the lines thickening as more and more line up to see the parade. donny said, the temperature is not getting much warmer here in the last hour. >> reporter: no but the wind are not really bad. the winds are fought gusting. although, in these canyons in new york, you can never techl look across t -- tell. they're taking down the streets lights because the balloons drift off. that's what's caused problems in the past. they hit street lights or lamp posts or that sort of thing so they're taking a last-minute precaution before the braid begins promptly at 9:00. can you see the route is completely clear. the crowd are probably oh ten or 12 deep or so. but we have been fortunate enough to find some folks here in the front row. and first we have the ramsay family. you are from ohio? you are used to ohio state

before we came on. i actually think this is a dichotomy of what people think of america and trump. i think people are beginning to understand trump does not represent the american values. he doesn't represent the values of most people who voted for him. so i think there is this, i think people don't consider trump a legitimate president. he was obviously elected and all this business, but he does not represent american values. george w. bush did represent american values. our numbers went down as a result. trump is so far off the screen about what people know about americans that i actually don't think he is -- he is doing damage to our place in the world and our economic clout for sure. i don't think people divorce donald trump from the united states of america. >> i was going to say the message in some sense. yeah. >> how do you expect a person without any core values to represent our country's values? is how i would put it. >> right. >> i think when you look at the asylum issue, i think it's also

important to look where he is preventing people from? where are they from? he doesn't like people from that part of the world. he is only concerned about making, doing what is in his best interests and to help himself. and that i think goes to the governor's point about how we are viewed around the world. he only cares about making a dollar. so, therefore, it's okay for saudi arabia, according to him, to take actions that they had because we had a deal with them based on financial need. that's not what american values are about. look at all the people giving moen to the folks two have lost everything in the fires in california. people are going into their pockets for very dlift i 50 million. that's what the president does not represent. >> great to see you both on this thanksgiving. susan del percio and howard

with mid-terms in law makers rear view my mirrors, some are on board with a biden from thetial bid if the former vice president were to throw his hat in the ring. to joe biden's 2017 memoir. he offers a glimpse into his family's glimpse into dealing with the death of his son bo biden, how that would determine his decision to run. mike, let me start with you and this paramount issue for the vice president. understandably, how this will affect his family. i want to play a bit of tape from craig melvin's interview with joe biden and back in september in which this came up. let's take a listen. >> dr. biden, let's say hypothetically come january, this fellow sitting next to me, he has been criss-crossing the country, campaigning for a lot of people.

anyone whose heard him recently knows he has this fire in his belly f. he says, sweetie, i think i want to be president of the united states again, you say what? >> i say joe, you would make a great president. but let's think about it. >> that sounded like an endorsement. >> to what degree are they thinking about it at this point? i mention he's selling the paperback volume of his book, he's spending time with his family innen in tucket this weekend. what's that status in the biden family and biden world more broadly? >> reporter: last we heard from joe biden was election day. he said he basically has time to make the decisionles. the holidays is an important time for the large biden family to get together and sort of take stock of where they are and go through the emotional and physical grueling of a presidential campaign. that enter view with our colleague there i think with craig melvin, it's so critical

in terms of understanding where the family is. i point it to all the time. as one major political operative in one of the early states told me, people under estimate the jill factor. whether she wants to go through that campaign again. i will say his political kitchen cabinet have been doing everything they can to lay the groundwork, should he decide to run. as i reported this week, there are people calling up his political advisers saying, we're ready to work for him. i'm getting offers from other campaigns. is there a biden campaign to work for? right now they don't want to get ahead of the vice president's decision. >> let me ask you about the outgoing congressman from texas who created quite a stir during the mid-term campaign. certainly in the speech that he gave at the end of it, it doesn't sound lying liss i his political fooe future by any means was done. what is the conversation like in texas where you are now about his future and to what degree

are folks speculating he might be considering running in 2020? >> that's the central question in texas politics right now. one thing is we don't know. it's similar to the biden situation. i biden situation. the most influential people in his life is his wife. but he's also hinted at the future. so we don't know. i think that's a fascinating situation. >> how does he look at beto o'rourke? his popularity during the midterm campaign? how does he see him as a potential rival as 2020? >> i spent a lot of time with joe biden. he was one of the most active surrogates. we would talk to his advisers about beto. beto was running his own

campaign. but there was some talk on election night with at least one biden adviser about a biden/beto ticket. the strength that biden thinks he brings will obviously his experience, his appeal to working class voters. in beto, that offsets the main liability, which is his age. he just turned 76 this week. obviously the oldest president if he were to win. eyes on wbeto and biden as the biggest wild cards. >> the footage of him walking alongside trying to ask questions. abby, year in texas today. you're often in washington, d.c. what's the lnc, what are the
