use of e-mail. what's the latest on all of this? >> hello from west palm beach. gowdy is the out going republican chair. he said republicans are going to do their due diligence when it comes to investigating ivanka trump's personal and private e-mail account to connect in her capacity as a senior adviser to the president. he seemed to disapprove on the attempt to rejudge all of this. we have seen because of all of the obvious parallels between the ivanka trump issue and hillary clinton e-mail saga we have seen them do their level best to highlight is the key differences. they say he didn't have a private e-mail server in her basement and she only used this private e-mail to adjust scheduling issues.

both clinton and trump both used private e-mail to conduct private e-mails for a time. they both pleaded ignorance about the government rules that dictate e-mail usage. so here is what gowdy had to say about how he seals his role in taking a look at all of this. >> i have always talked to trump's attorneys. we have already written a letter to the white house. they have a right to make sure that the records and presidential records act is complied to. we have taken steps. we have down more in the last week than some of my house democrat colleagues did the entire time we were looking into benghazi. i'm at peace with what we have done. the public can judge whether or not those two are similar.

they went after hillary clinton back in 2016. >> i think gowdy's comments here are representative. he is out going. he will not be in congress when the new group of members are sworn in. so it makes sense they would scrutinize. that said of course this congress is very trump friendly as the republican conference in the house has shrunk many of the members who are most critical of the white house, members who are more moderate and independent voices, a republican from florida who lost his reelection bid, many of these people, dozens in fact are now gone. the remainder, the bulk will be

as a body a lot more trump friendly and a lot more skeptical to any effort wes on the part of the democrats to scrutinize this white house. >> i'm curious about optics. do you think republicans don't expect to find a lot? they wouldn't be so enthusiastic about investigating. >> that's an interesting question. right now the only thing we have to go on is ivanka trump's lawyer has said and what the president of the united states said, that her case is not in any way similar to hillary clinton's case. until we get some conclusions from congress, whether it's the outgoing congress or democratic controlled house that will take over in january we really won't know whether or not she was communicating with world leaders as jeff bennett speculated in your earlier piece or the extend to which she was connecting

government business on that e-mail account. >> i will just say that to me it shows such a lock of common sense given the way her father went after hillary clinton to think really? couldn't you have just used a different e-mail? you have exclusive incite. tell us about that. >> my colleague and i spoke with a number of sources at the end of the last week that told us that members or democrats on the house intelligence committee are currently looking for money laundering and accounting experts to do investigations of potentially troublesome

transactions. a basic fact is that luxury real estate is one of the biggest vectors for taking money that's tainted by criminal activity and laundering it to try to get it into the legal financial system. did that happen with any of trump's properties is still an open question and something that will require row bebust investigation to understand. where do you see the president as being most vulnerable?

>> obstruction of justice is one area he could be vulnerable. they are very interested in the run up to the president's decision last year to fire james comey as fbi director. that's something, that's an area that hasn't been explored yet. it is something congress will want to dig into. >> hawking about handling of the case. he outright called him out on it. take a listen to this. >> the president is not being honest with the country about the murder. whether it is driving it? i don't know. is his personal financial interest driving u.s. policy in the gulf? is it driving? by don't know. it is a way to find out. >> we have congress on both sides of the aisle.

where do you see this going? >> one of the major questions that's going have to be answered is the extent to which democrats in congress decided to do oversite. the killing will be a central question but not the only thing we expect them to be looking at. on the foreign policy side democrats have been open about the fact that one of the biggest questions they have is the united states involvement. it is prosecuting a war that lead to extraordinary levels of suffering and death. they estimate 14 million people are at risk of starvation. united states made bomb was used to destroy a school bus full of children. a key question is to what extent is the united states behaving response whether i or irresponsibly to push forward this war. >> do you see given there is a

probe targeting his motives in the case that the president could clang his tone as it relates to all of this? >> i don't think so. i think if you have listened to the president and everything that he has said about the killing of since october 2nd in the seven or eight weeks since that crime occurred he has been pretty consistent in saying that saudi arabia is a great ally. he talks often about the promise of u.s. military weapons by saudi arabia and what it means to the u.s. economy and jobs. last week he talked about it being america first for him. so i don't see -- i think it would take something very dramatic for the president to change his line of thinking or his thoughts on this situation. >> all right. thank you so much. good to talk with you both. >> thank you. two days to go before

i know the president's team is working on a response to the report. >> the anticipated reaction to special council's report. joining me now is legal analyst mimi roka. he has been defending the president. what do you think about what he said there? >> for one it is right. here is my concern. i think i read a little bit and listened to the full piece of what he said this morning and he

tried to sort of caveat it. he is not going to actually get accused of a crime. he has no idea whether he will be -- whether the facts would constitute a crime once mueller comes out with his full report. no one knows for sure. when i say i hope that he is right, what i mean is i hope that the report, however it is written and however it comes out is able to come out in its full being, the way that mueller writes it and that it isn't cabined or cut short or something like that by the new acting whi acting wl acting whitaker. >> do you think it will be politically focused? >> i think it will be spin.

mueller is going to put facts in his report. facts are something prosecutors seek out. they ri lie on things they can prove in court particularly something like this. i do believe he will put things in that report that if he needed to he could prove in a court of law. that's a very high standard. that's very different from spin. i believe that what trump and his lawyers are going to put in their report is going to be largely spin. it is going to be, you know, intended to confuse the issue and make us think that we can't clearly decide sort of what the facts are. i don't know what the facts will be but i know that however mueller lays them out, if they are allowed to come out in the full way he lays them out i would have faith in those no matter what he finds. >> we do know that the

president's legal team has and the report is saying special council still wants to question the president over his actions while in the white house. those questions, mimi all about obstruction, is that what the topic would be? >> yes. i think that anything pertains to why he is in office should focus on obstructionov of justi. if there was collusion conspiracy between members of the trump campaign and russians, it is possible that that did not end once he took office. i actually think we can't know for sure the topics. it is more complicated to question the president about any topic once he is in office because of executive privilege which would not apply during the campaign or transition. it is very dependent on the

circumstances and i think there would be good reason for a court to rule there mueller's favor fn it comes to that. >> does it give you any sense of how close a special council is to wrapping this investigation up? >> that's the big question. you know, look, i think that was something that had to happen, in other words trump answering questions in some format had to happen before mueller could come out with his report. i don't think we know what else there is left to do. we keep hearing things. we heard that stone and corsi were going to be charged. we are hering hae may be cooperating. now if corsi does cooperate, you know, maybe that changes the time line. you know mueller can have a plan but things don't always go according to planned in an investigation like this. i think they surmounted a hurdle

that's what we have been hearing for months now on background from white house officials and people close to them. i think it is striking they both seem to say that on the record it shows you the deep level of divisions created between kelly and the outside circle of advisers. it's all out in the open. >> what about saying that president staffers are failing him. do you think there's a sense that the president feels that way? >> clearly sit a view shared by others. you flow, the president is fondover leaning on others outside the advice and council. there is a war in camps between the people on the inside and the people on the outside.

this is what donald trump prefers, to keep everyone offer balance. >> so looking at the article you wrote recently it is vicious. it is the struggle following the midterms. you heard about him being the air apparent to john kelly. you say it has hit something of a snag. what happened here? >> it has all been playing out over the last several days. it gained steam after the controversial trip to paris ch it looked like john kelly, the chief of staff would be moved aside and mike pence's chief of staff would be elevated. they have been supporters of and have been pushing him on the president. spent election night with the president and the first lady.

what happened is there is a very intense pushback from kelly's allies inside the west wing and others who basically said they could not work in that position and there could be a staff revolt if he got job. as we have all seen nick has not been promoted into that job. once again, we are back where we started where john kelly is holding on as chief of staff but really with sort of a very shakey hold on that position. he turned it into an influence in republican politics.

it worked his way into his inner circle. what they see is someone who understands deeply the republican base who is a strategist and operative. we are in campaign season, we are looking ahead to 2020. john kelly is many things. they don't understand the way an operative or strategist would. i think that's the key value that they see that he would bring to that job. >> it could mean trouble for the

front and not be discouraged by people saying oh, it is political. they will say that no matter what they pursue. they have to pursue any angle that smacks of abuse of power. there are many many such avenues for investigations. so will you see the names of adam schiff and cummings in the news almost every day? yes. should you? yes. they are pursuing very very necessary constitutional oversite. the most important immediate thing is to make sure that wl whitaker because it issi improp. he needs to be pinned down on whether he should be in that job. >> do you agree with that? is that something you would agree with? >> no.

i agree with that. i think it's one thing to look at. i think looking into president trump's business dealings and whether or not his influence to side over our own cia intelligence is another thing to look at. at the same time he is exactly right. there are a lot of people that will say you know, democrats want to get in and investigate. it is actually something that is incumbant. the house of representatives is the only oversight provided going into this next congress. they do have control of the house. democrats will make sure we are focusing on lowering the cost of prescription drugs, working on raising the minimum wage. there's a lot of other issues they voted on democrats to take care of. >> how about you? does any of this worry you? where do you think the president is most vulnerable?

>> look, i think the elections have consequences and what the voters gave us is a recipe for gridlock. it is going to be familiar. the fact is that the democrats will be very very aggressive and i think the president will be as nimble as the obama administration was in protecting his administration and hillary clinton on benghazi. at the end of the day i think the president needs to make sure he allows the democrats to overreach. he focuses on the things that were just mentioned. getting a deal on the price of drugs, getting a deal on infrastructure, protecting our borders like all of the 193 nations of the united nations have done, you know, stay focused on a growth job creation agenda and with the democrats

just as obama fenced with republicans. >> what about lauren, look, we know republicans have been strike that jazzing for what is coming down the pike here, this potential for a new wave of investigations. what do you think they can play? is it about just trying to create distractions? how do you see this playing out? what's your best bet? >> i think what the white house needs to be mindful of are things that can get done. what struck me this morning during meet the press with congressman cummings interview, he mentioned prescription drug at least three times. so i think that there's a built of a delicate dance that will go on between the oversight economy and administration because that's a shared priority they both have. as the congressman said this morning on pleat the press, you

know, he is not going to be -- and he said it recently, he is not giving out subpoenas like halloween candy. there is something to be determined about what they can actually do for the american people and what investigations really do merit a further look. >> speakingov of meet the press he was on the show. he said what he wants to see in terms of the democrats prioritizing, let's listen to what he said about that. >> if you were cummings you would start drawing up the articles? >> i think there's no question he has met the grounds for impeachment and it's urgent to get him out of aufrtoffice. is there anyone in the united states who can tell you the president is acting on saudi arabia not because they paying him money? >> democrats have been dismissing this kind of talk. do you think impeachment is in

the back of their minds? >> it could be. it depends what public schooler finds and what they unearth. that's what they are for, to find facts. if the facts lead to impeachable offices -- and i think he is out a little ahead of his skis on this because we don't flow that to be the case there but it will be very much on the table and the democrats will have to make a political decision. i think it will be determined by how republicans react. if enough republicans go i didn't think there was enough evidence here. now that it's been laid out really you can't remain in office then that changes everything. but we are a ways away from that right now. the first thing that -- the first crisis is not going to be over impeachment. it will be overresisting subpoenas. i think it will be tested.

the trump people will resist these subpoenas until the cows come home and there will be court cases over that. >> with regard to impeachment do you think the president is facing a threat of that? >> i don't think we can determine that until the mueller investigation is over. i would agree he is out ahead of his skis here. i saw it impreachieaching the president. i don't think it's time to think about that at all. never mind the fact that if the house were to do that it is a republican controlled senate that would have to, you know, give two-thirds of a vote to actually, you know, convict. i think we are really far away from that. it's not something we can consider until the mueller investigation concludes. >> so he also pointed to the questions surrounding the president's questions with saudi arabia. he talked about the remarks that they will get to the heart of those question. take a look at this everyone.
