on this busy news night. we're going to show the entire discussi discussion corsi was join on "the beat. "find it sunday wherever you get your pod cast. the beat is done but what a night to be watching msnbc. "hardball" starts right now. caveman. let's play "hardball." ♪ good evening. i'm crus rr matthews in new york. we're covering two smashing news stories tonight. the arrest of his long-time dirty trickster in the russia probe, raunler stone. and trump's big cave in the shutdown. reopening the federal government without getting a single penny for his prized wall.
4:01 pm
the president now faces the rath of his far right base like ann coulter who tweeted trump is the biggest wimp ever to serve as president of the united states. wimp. much more on that crushing trump headline coming up. we begin with the predawn raid of the fbi in florida where he was later hauled before a judge in shabales. he's been charged with several criminal counts including ubstrubz, and five counts of making false statements to the conress. most significant is it draws the russia investigation a step closer. it indicates mueller has evidence directly related to the core of his mandate which is to investigate quote any links and/or cord between russian government and vinyls associated with the ampain of on the don closed quote. in other words today's
4:02 pm
indictment appear to be exhibit ashes. in defailing his alleged lies, the white house established stone as a key link beand a front for russian intelligence which can played a crucial role in the kremlin's campaign to screw with the american government. asauchg who released 50,000 stolen emails all hacked by russia in an efrtd to inflict maximum damage on hillary clinton during the 2016 lebz. tlrs indictme >> the indictment suggests he knew what was happening. quote around zun and july of 2016 stone informed senior trump campaign officials that he had information indicating wikileaks had documents damaging to the clinton campaign closed quote. in late july, quote a senior campaign official was directed
4:03 pm
to contact stone about any additional releases and what other damaging information wikileaks had. and told the trump ampain about future releases by wikileaks. as of tonight we don't know the identity of that quote senior trump campaign official. or the person who directed them to contact stone. here's what told reporters after his appearance in shackles before a florida court today. >> after a two-year inquisition the charges today relate in no way to russian collusion, wikileaks collaboration or any other illegal act in connection with the 2016 campaign. at the crack of dawn, 29 fbi agents arrived at my home with 17 vehicles with their lights flashing. when they could can simply have contacted my attorneys and i would have been more than willing to surrender voluntarily.
4:04 pm
as i have said previously there is no circumstance whatsoever under which i will bear false witness against the president, nor will i makeup lies to ease the pressure on myself. >> joining me is texas democratic congressman a member of the house intelligence committee, former federal prosecutor kirschner and senior vice president for social justice and legal analyst danny. tell us how this gheets heart, i believe it does, of the russia probe. >> you look at all the conduct that roger stone isn't actually charged for. he's charged with lying, for persuading witnesses corruptly. that relates to everything after the investigation began. but far more compelling is what
4:05 pm
happened before roger stone committed those crimes. and does the special counsel have enough information about roger stone's conduct with wikileaks or whatever the organization is to charge him or do they not yet have it and they're waiting until they get an air tight case to charge him? because then and only then when those dots conup will we have evidence of russian collusion. >> i have a different view. i think roger stone knew dam well it was coming from russia because everybody on the planet knew it was coming from russia and as being a link, is the key word, in the mandate of this probe. get all the links between russia government people and the trump campaign. he clearly is a link. your thoughts. >> this is an incremental step towards a bigger conspiracy indictment that is coming. this indictment reads like a conspiracy indictment. has the building blocks of a conspiracy indictment but
4:06 pm
doesn't yet charge the conspiracy. that's obviously for tactical reasons. this is one incremental step that mueller team will use to try to break roger stone and bring him on board because goodness knows he would be a treasure trove of information on donald trump, having a decades long association with him. either roger stone will break or he'll die in prison. but this is just one incremental step and thugger is probably an over arching conspiracy indictment. >> i've known roger stone somewhat of a distance, luckily, for years. he had the weirdest look on his face. it looked like he was enjoying this whatever. >> he absolot was. he said it's better to be talked about than not. and he doesn't care if that means being talked about as he stairs down the barrel of a prosecutor's gun. and it's rather staggering. i want to go back to the point that glen made. you know, we're talking about a
4:07 pm
man who says he doesn't want to bear false witness, who literally -- we have email exchanges in which he's fabricating lies about hillary clinton's health in the context of the indictment and we know from jerome corsi himself, asked jerome corsi to wlie. >> or be punished physically by him. it's "godfather" stuff the way he threatened this witness. >> and called him a rat. >> jerome ocorsi and radio host about making contact with wikileaks. while at the same time he kept can in touch with people close to the campaign. stone wrote to a supporter involve would the trump campaign saying spoke to my frind london last night. the pay load is still coming. later that day a supporter asked tebst stone if he had heard anymore from london. sto
4:08 pm
stone replied yes. went to talk on a secure line. quote an associate of a high-ranking cam35i7b official sent a tebst message to stone saying well done. his boss, the high-ranking campaign official has been identified as steve bannon. i don't know. you have to decide whether to impeach this president and i'm wondering how close this gets to getting to the heart of the matter, the belly of the beast, which is was trump directly or indirectly working with the russians to beat hillary clinton? >> i think right now we still don't know that conclusively whether he personally was. i believe his campaign was the indictment today shows that, that there was basically a chain of people that went from the trump organization to wikileaks that had stolen or received stolen emails and dumped them. i think we will find out ultimately before this is all
4:09 pm
over whether donald trump knew or didn't know and whether he participated. >> if you found out that a whole bunch of them were working together to work with mosque eos to defeat an aponent, would you feel responsible? it seems extraordinary that the fish wrauts from the head. >> you tell it's getting harder for sarah sanders to keep denying that this has nothing to do with the president as it gets closer and closer to the president and i'm not surprised that roger stone has been indicted for making false statements. of all the interviews we were in, the one interview where when the interview was done, everybody a was pretty sure that he had lied to the committee. because he took contradictory -- he made contradictory answers or gave contradictory answers to
4:10 pm
questions and so we knew both things couldn't be true. >> roger stone has said he never spoke to trump about wikileaks. there's a great case can of hiding from the truth by saying certain things. i never talked to him quote about wikileaks. he may have just talked to him about getting dirt on hillary from this interesting source. >> i can honestly say that candidate trump, president trump and i have never discussed the wikileaks disclosures before, during or after -- >> well, that's hard to fathom in light of today's indictment which alleges stone lied about discussing wikileaks with several members of trump's campaign. further more he was frequently in touch with trump. >> how often do you talk to him? >> from time to time, not on a daily basis but from time to time. >> when is the last time you talked to him? >> saturday. >> we talk from time to time. i decline to characterize the
4:11 pm
content of those conversations. >> i speak to donald trump yesterday. he's in good spirits. >> can you divulge to us, raunler, i respectfully answer this question, some of those middle of night phone conversations you had with mr. trump? >> i can't and it's been my policy not to discuss personal conversations or it will end, honestly. >> he seem 250z want to tease the idea he's on the inside and if asked a legal question give i don't see a careful denial. >> he's teasing ininformation, getting everybody excited but he has a very legal ease type answer. the reality is speaking as often as he did, some of his statements, not just to congress but to us were inconsistent and it becomes very not credible to actually believe that he never spoke with donald trump about wikileaks when we have that montage of donald trump discussing wikileaks on an
4:12 pm
almost ongoing basis. it stretches the imagination that donald trump in all of his conversations and his close relationship with raunler stone would never have brought up wikileaks, which apparently was trump's favorite conversation. >> and of also the president is notoriously known for having asked the russians to give him any information they have on hillary's email. i think that might come up in conversations with with roger and the president. >> he literally is asking what we now know as jerome crsi to get the emails from julian asauchg two days before he said if you can find, get us those 30,000 emails. it's a two-day break in time. going back to the way the campaign worked. but we do can know this cam35i7b
4:13 pm
was a family run business. >> as i mentioned stone is also charged. for witness tampering for allegedly threatening and pressuring randy not to contradict his, raunler stone's testimony before the house of representatives. among other things, stone said to fleed fifth like the fix character "godfather ii" who was intimidating into keeping quiet. you are a rat, a stuly, you back stab your president, run your mouth for lawyers. are you dying to rip you? i think lawyers are dieing to rip you in shreds. he also said let's get it on, prepare to die, expletive. this is mob talk. he's threat thing guy physically or whatever. i don't know how you describe it. >> it's ridiculous and stone may like the parse words.
4:14 pm
he doesn't parse them well or credibly. president trump talked about loving the wikileaks but he didn't talk to stone about it. again i think stone will probably fold like a cheap lawn chair and come on board and join team mueller. when i read what's in this 24-page indictment, every word you know bob mueller can bab up with three pieces of evidence and convicting stone at trial on this will be a cake walk. >> i made a sim return. were you concerned he could be a bad dude in every possible way. were you happy with the way they picked up with 29 agents, put them in shackles. i think criminal justice should only be administered by a jury.
4:15 pm
don't do perp walks to humiliate a guy. if the person is guilty, they get the penalty set by a jury and judge. what do you think of the way this guy was picked up at dawn? >> i missed a lot of the coverage because i was on my way back home. i know there was a debate whether there was a media tipped off. yes, people should be judged in a court of law. there has been a lot of media speculation and discussion about this. so i think that's all fair. >> does it concern you as democrat, a person of public life that people get picked up this way. a friend of mine got picked up like this. the agents want said all the neighbors to see this guy was under investigation. >> i don't think we should go
4:16 pm
utof our way as a government to humiliate people. i don't know what dangers or concerns the fbi may have had. but i don't think we should go out of our way to publicly humiliate somebody on their way to tabing them to the station. >> i think ends don't justify the means but the ends were certainly valid. and thank you all. much more on this huge story tonight, including a unique look at roger stone's history as a washington dirty trickster. i've got video of stone who shows how important and intimate a figure he is in donald trump's world. he was in the belly of the beast. well, you're not going to miss what's coming up. watch where getting to the heart of where who raunler stone really is. the other big story, president trump has caved. get that word caved. it's going to be all the headlines tomorrow in a big way.
4:17 pm
the government is reopening for now and some of trump's friends on the far right are not happy. they'ralling hame wimp. he won't like it. he won't like it -ah, the old crew! remember when we all used to go to the cafeteria and just chow down midday? -you mean, like, lunch? -come on. voted "most likely to help people save $668 when they switch." -at this school? -didn't you get caught in the laminating machine? -ha. [ sighs ] -"box, have a great summer. danielle." ooh. danielle, control yourself. i'd like to slow it down here with a special discount for a special girl. danielle, this one's for you.
4:18 pm
with a special discount for a special girl. so again, using "para," you're talking about something una mesa para dos personas. that is for someone.
4:19 pm
pretty good. could listening to audible inspire you to start something new? download audible and listen for a change. and the army taught me a lot about commitment. which i apply to my life and my work. at comcast we're commited to delivering the best experience possible, by being on time everytime. and if we are ever late, we'll give you a automatic twenty dollar credit.
4:20 pm
my name is antonio and i'm a technician at comcast. we're working to make things simple, easy and awesome. after five weeks and two missed paycheck cans, an end to the longest government shutdown in history is ammicome cannin c. agreeing to open the government without the wall. >> i'm very proud to announce today that we have reached a deal to end the shutdown and reopen the federal government. as everyone knows i have a very powerful alternative but i didn't want to use it at this
4:21 pm
time. >> the president tried to paint the announcement as a victory but the deal notably includes not a nickel for the wall. instead it funds the government for three weeks and leaves the question of border wall aside for further negotiations. what the president left on the table the prospect of taking another drastic action. >> so let me be very clear. we really have no choice but to build a powerful wall or steel barrier. if we don't get a fair deal from congress, the government will either shut down on february 15th again or i will use the powers afforded to me under the laws and the constitution of the united states to address this emergency.
4:22 pm
>> in just a short time ago the house zoined thesont in passing legislation to temporarily fund agencies. it now goes to the president for his signature. the blowback was swift and released one hard right commentator. ann coulter tweeted that president was woquote the bigge wimp ever to serve as president of the united states. this marbs the second time this week president trump capitulated to houses speaker pelohse a. the speaker and senate majority leader. >> thid president underestimate politically and can you insure the public there won't be another impasse in three weeks? >> i can't asure the public on anything that president will do but i to have to say i'm optimistic. i can't characterize the president's evaluation of me.
4:23 pm
>> to you think that he thought he could get what he wanted? >> i think he thought no one should ever underestimate the speaker as donald trump has learned. >> as a politician, what to you think of this stand off? it looked like the president caved in, it's all loss for him. >> nancy pelosi is the master negotiator. she said all along we need to get back to the table only when the american cpeople get back t work. we could have avoided all of this if he just listened to nancy pelosi in the beginning. >> he listened to rush limbaugh and ann coulter. >> and they don't know how to run the government. and they had lost the american people because of the trump shutdown in the beginning and now, as nancy has said. because we want border security but we want sensible and reasonable border security and i
4:24 pm
think format they're putting together, wliek it like a confe committee with six democrats, six republicans in both house andsont sit down with the experts so we can talk about how do we really secure the border and hire judges and law enforcement and make sure we have electronics that's up to date. that's what you do. that's what nancy pelosi was talking about from day one. >> do you think trump would buy a smart solution like that or he just wants the symbolic brick wall? >> i think he's now backed into the corner. >> he's not going to get the brick wall. >> sometimes the con is up. he started coning the american people when he said he's going to build a brick wall and mexico is going to pay for it. >> thank god we have video so you can watch some of these meetings. in the oval office itself he started to talk again. i know the tricky situation nancy's in right now.
4:25 pm
she can't really speak with the house democrats. and he calls her nancy and she just called him on it. eshe said don't talk to me about my political situation and leadership. now he's got an object lesson from her. >> there's no question her power has only increased. as an equal to him in washington which drives him, privately sort of insane. >> the workers are going to start getting paid again but this is a loss for the white house and they know it. if the art of the deal had been this negotiation, nobody would have bought the book. nafr two dueling bills passed, they knew they had to move towards this. it was just a question of trueing to spin it in some sort of victory, sell it to republicans that it's not an entire cave but we're seeing media on the right not buying it. >> early this month senator
4:26 pm
lindsey graham had a warning of what it would mean to trump if he gave in on his it mand. >> that's the end of 2019 in terms of him be withing an effective president. that's probably the end of his presidency. >> some headlines bolstered that point. breitbart "government open and border no wall still no sotu" and a conservative paper says "trump blinks. waets and one a move was a total cave unless healls national security emergency when he doesn't get the wall fully funded. at the end of the three-week cooling off period. if the president goes on television and gives one of these john f kennedy kind of things. we have to secure the wall. i'm doing it with available funds from the defense
4:27 pm
department. what would the congress do? >> because of the negotiations between democrats, republicans, house and senate put sthin on his desk. then, if he tries to go against his republican senators, i think what was significant yesterday six republicans voted with democrats. in fact the democratic alternative had more votes than republicans. that showed him he's losing -- >> do you think mitch mcconnell has been obdurate in defending trump? would let them agree to a compromise that didn't include a physical barrier. >> mitch mcconnell is in trouble too. you understand the behind-the-scenes meeting, they're trying to protect their own you know what. >> the national security threat, one that doesn't have much in the way of teeth. the white house seriously considered and sort of backed away because they don't feel
4:28 pm
they're going to get much support from republicans. they're afraid they're not willing to give up that sort of power and they're afraid of setting a precedent to come can in and declare a national emergency for some sort of liberal cause. >> can you identify who gets credit for this deal? >> i mean mitch mcconnell's reemergence is what broke this. because he engaged in the process the white house realized they had to move. and speaker pelosi deserve as ton of credit for claiming what is unquestionably a win for her. her power has increased. she out maneuvered the president. >> let's talk theatrics. i know you're a serious politician. trump walks out with that usual strut of his. the open coat, the big, long over coat. the tie eight-feet long and swagers out. he comes out and swagers out as if he wonner.
4:29 pm
>> he's a salesman. that's what he does. >> salesman, conman. that's what he does. you talk about the art of the deal. he's gone bankrupt six times and on the financial service commit canny there's going to be people looking at those dealings. >> sorry to interrupt. there's nancy pelosi speaker of the house signing the bills to get the government back open. is he going to call her nancy anymore? that's his nickname for her. >> earlier today he said nancy pelosi or as i call her, nancy, which can is not a devastating nickname. he felt like he could deal with her, that he did respect her. she's been a useful whipping girl for republicans for a long time. they've raised a lot of money off of her name but privately he thought i can negotiate with her and go on a rally stage and bash
4:30 pm
her. but he has been utterly out played by the speaker. >> low energy, low iq. >> they don't apply. >> coming up between raunlroger arrest at dawn and trump caving in the wall funding, it's been a pretty rough day for trump. and senator amy of minnesota. hi there, this is a commercial about insurance. but let's be honest. nobody likes dealing with insurance. see, esurance knows it's confusing. i literally have no idea what i'm getting. i don't know either. i'm just the spokesperson. but that's why they're making it simple - so that even actors, like us, can understand it. i'm not an actor. i'd love to tell you more but i only have thirty seconds. so here's a dramatic shot of their tagline so you'll remember it. when insurance is simple, it's surprisingly painless.

the charges today relate in no way to russian collusion, wikileaks collaboration or any other illegal act in connection with the 2016 campaign. >> i am very proud to announce today that we have reached a deal to end the shutdown and reopen the federal government. >> tonight the white house is suffering huge casualties on two fronts. both are very bad for the president. roger stone was arrested, placesed in shackles and indicted by the special counsel all this morning. his indictment says he was in touch with senior trump campaign officials about the release of the wikileaks documents. then news trump cave canned on the shutdown without money for the border.
4:35 pm
i'm joined by u.s. senator of minnesota. put it together this is a historic day, senator and i don't know how -- they both seem bad for trump. what's in it for the country what happened today? >> what's in it for the country is finally these workers are going to be able to go back to work and i was listening to the praise of the work that speaker pelosi and senator schumer and the rest of us did in standing our ground and not giving in to the president because every time he gut punches you. 800,000 federal workers doing their jobs without pay. avr within saw them at the airports, the prison workers, the people -- you name it. all of these security ageens, the fbi -- i served some of them lunch today in the food line just a few blocks from the white house. it was an unbelievable thing that president let this happen and those workers are back to work.
4:36 pm
>> i think it's stupid and i wonder if the democratic party, which you remember would be willing to say no more government shutdowns. this shouldn't be a tool and part of the art of politics, shutting down our government as an angry tantrum. can't the leaderships of both parties say never again. we're not going to do this anymore? actually senator warner has a bill, interesting name to it. the stupidity act which looks at doing that and i know he's going to do work on that bill and there should be a way tootoo this. because these work withers shouldn't be a pawn and that's what this president has allowed to happen to this country and the other thing about this is i think when you've heard about the deals hoe made in new york, he wouldn't pay people. i think he found out today you can't do that to an entire country thoor country and you can't get by
4:37 pm
without paying american workers. >> we're looking at the picture in the cross screen of trump walking out to the rose garden at the white house and got that ridiculous red tie about eight feet long and he's strutting. he says a minute ago he put out the word that he didn't lose today. what do you make of that claim? >> the only people that lost really in this last 35 days were the american workers and the american people and just to look at it as a win/loss game is typical of things that he said. but what we have to look at now is what are we going to do over the next three weeks? because this thing is over the day after valentine's day, right? and the hope is that we can look at these security issues in a sensible, smart way. look at the technology, some of the border crossings and not do what he was suggesting, which made no sense. many security experts have said
4:38 pm
that. but instead look at what works best at the border and stop this chaos and start governing from opportunity. what i'm really worried about is what we're not doing. pharmaceutical prices rising. we've got proposals. we have to get them through. the ice sheets melting in greenland reaching a tipping point. we have to start moving on clime cant change. it becomes harder and harder for the country to move forward and compete in this international economy and that's what we have to get fwoob doing and that is looking out and having the backs for the american can people and not allowing him to create more chaos. so if there was any win today it was that finally someone said to him enough is enough. we're going to back to work. >> congratulations on being the first positive voice in this country. by the way roger stone join as growing list of people in trump's innercircle charged.
4:39 pm
you have the president's long-time lawyer and fixer who pled guilty to lying to congress. manafort guilty, rick gates pleaded guilty to similar charges. michael flynn pleaded fwiltguil lying to the fbi. this list is watergate lint. >> in another way today, talk about an i told you so day was for those of us who have been fighting to protect this investigation but also making the point that this is a nazzal security issue. this is about another country trying to hack into campaigns and do things unbelievable in any other election we've seen in american history. this indictment really got us closer to the truth because in this case you have an indictment, sworn under law which says clearly that someone in that campaign, a senior
4:40 pm
official asked roger stone to go over there and start communicating on the release of these emails. it showed what they were doing to hillary clinton. that they were trying to undermine her by attacking her health and making things up about her memory and other things. it influenced the american people and again our main goal in the senate right now is and should be to allow investigation to complete its course sothe american people can have the whole story and that's why it's so important the report be released so we really know what happened. the only way to reprent it from happening again. >> i think that nails it. up next who exactly is roger stone? by the way stick around for this one and how did he become the scariest person in american can politics today. tracing the ties between a man notorious for his dirty tricks and a man currently occupying the oval office.
