and nation's capitol resuming normal operations for the first time in 35 days as members of congress try to avoid another shutdown, the clock ticking 20 days before another shutdown deadline, the president threatening to declare a national emergency if a border deadline deal is not met by february 15th. and the president backing down without getting any funding for a border wall. here are the senators with the daunting task of finding a bill the president will support and house speaker nancy pelosi, the democratic speaker emerging as the clear victor in the stalemate with some warning democrats may be declaring victory too soon and 800,000 workers still on the line, vowing to pay back as soon as possible those two paychecks

the workers missed during the shutdown >> some have said we go right back to where we were 35 days ago. not really, not for those families who had this uncertainty. this will have a long lasting effect on those lives and long lasting effect how this country is viewed by those people and people across the world. >> i think we will come to some kind of agreement and you do need comprehensive immigration reform let's invest in something that works, not just a wall people can climb over or under. >> now, to make on capitol hill for us, as usual, as we look at this next week, tell me what it will look like we mentioned some meeting but what exactly are they hammering out? >> there's no question, new hampshire and democrats won round one of this and won a round and won it rather convincingly there are more fights to be

fought and battles to be lost and that clock is now clicking towards february 15th. those people you put on-screen, house members sit on the committees that dole out money to all the federal agencies. if they get their work done, they send it to the floor, passed by the house and senate and goes to the president for his signature. there are a lot of ifs in there. while those folks are in charge of hammering out the details, it will be up to nancy pelosi and mitch mcconnell and chuck schumer and those in the house to make sure their rank and file will go along with it, either fight for it or against it odds are once the president put on the table the possibility of declaring a national emergency, we talked for weeks about this being the most likely off-ramp from a political perspective because democrats have won this battle there is no incentive for them to budge

you heard the congressman talking about border security and immigration reform that does not mean they will spend dollar one on a wall if nancy pelosi called it all along immoral, it's not likely she will be in any mood to give the president money for a wall immigration reform, yes, daca reform, yes, a wall probably not, alex. >> practically speaking, what's open now and what's closed and when will those employees get paid >> the 800,000 employees furloughed, more than half that had to work anyway as we've been documenting the past week. the federal government put out a memo saying they will be paid by the 31st that is january. it could happen before then. meanwhile, there are still entities trying to capitalize on this i heard on the radio coming in today an ad from a bank, federal

workers we will give you a loan for 2.5%, while lower than their usual rate, still speaks to the situation here and what brought us politically to this point on friday when the president suddenly appeared in the rose garden it was an untenable position politically after the commerce secretary suggested people take a loan, after the top economic advisor said some things insensitive towards the anguish many ofthose folks were feeling. while the federal government is re-opening, some $2.3 billion and not talking about contractors, lost in small business contracts, open questions how those contractors, millions of them, will recover. >> thanks for starting us off. joining me now, nancy and jonathan allen welcome to you both. jonathan, in your analysis piece, you describe a singularly brutal week for the president.

usually the loser in washington gets a policy fig leaf to cover up for the fact they were defeated trump got not-a. what about this border security, what does that amount to >> good morning, alex. basically, what the democrats agreed to, a house and senate conference committee, what mike was just talking about nancy pelosi gets to appoint a majority of the house's side of those negotiators, and in order for anything to come out, a majority of senators and house members have to sign off on it because of those rules in congress, nancy pelosi still controls completely whether or not they get a bill that has a wall in it as you heard her say time and time again, she thinks the wall is immoral. >> that's not happening. >> realistically, is anything tangible going to happen between

now and february 15th and avoid another shutdown why would the parties find compromise now when they couldn't for 35 days >> nancy pelosi has the compromise here. is the president willing to go for border wall fencing or technology or beefed up border agents at the wall for that $5.7 billion price tag. it's unclear at this point after the flak he has gotten from his conservative base. i think this ends with him declaring a national emergency he has said he would do, even though conservatives don't want him to go down that route and probably tied up in legal challenges and ultimately result in a wall and he can save face >> ultimately, are the forces that drive this president, in particular some extreme types in his base, are they likely to

force him to declare a national emergency for the wall >> i promise you, the country would be run much better if i had a veto over donald trump i'm crazy that i expect a president to keep the promise he made everyday for an 18 months. >> this president said there would be a border wall and he just reversed himself. >> how much will the president be listening toextreme right voices and the potential of declaring a national emergency >> he is listening to the views they are sharing because they're shared by a lot of the president's constituents i believe the president knows it's impossible for him politically to give up on the wall idea. he has retract from his position

of a full concrete wall and we heard all the variations now for him to give up completely is to watch his conservative base and basically folks focused on immigration mostly crumble from him. i don't think he will do that. melanie is probably right, he will do something extraordinarily like declare a national emergency there are logistical legal hurdles. he may not be able to do it, transferring the money logistically he may claim he will do something along those lines. he painted himself into a corner and no easy option out >> melanie said it was an unusually brutal week for the president. what was worse having him cave on the shutdown or indictment of roger stone >> all together, it was a bad week for the president he was outmaneuvered by nancy

pelosi with a "state of the union" address and had a former aide with an unflattering picture of the white house and another aide saying, i don't know why they -- it could have lasting implications for 2020. when it comes to the roger stone indictment, most of his allies at this point, no matter what comes out of the roger mueller probe go to their corners and say this is a witch hunt and has nothing to do with the president. i would look at the mueller report he is connecting the dots but roger stone will be on the final report when it comes out >>which do you think makes a more lasting impact of those

two? >> i think the wall fight, crumbling here is the big story of the week. obviously, the mueller investigation has much bigger potential broadly but roger stone himself is a smaller deal than the wall. >> did you get a sense when the mueller investigation wraps up, based on this roger stone indictment >> clearly, there is a lot of other information roger mueller is sitting on. he said in the indictment someone said a campaign official contacted roger stone about these wikileaks e-mails. we have been hearing a long time mueller is wrapping up we had expected roger stone to get indicted at some point so they could be getting near the finish line but we don't know what mueller knows we have to wait and see. >> does the roger stone indictment give dems in the house greater license or inclination to consider

impeachment proceedings? do you get any sense of that >> i think the roger stone issues have much more to do with what happened before the election obviously, that's part of what the house will look at they're also looking at obstruction of justice issues along the way, things the president has done while he was the president. i think that set of things may be more the domain of the house or earlier domain to the house it's hard to tell right now. obviously, all of the drip drip drip contributes to the larger narrative the house is looking at whether the president has committed high crimes and misdemeanors we don't know whether roger stone will be convicted of anything or will testify against the president or if he has anything to testify against the president about. we have to wait and watch that

taken against the trump organization for this? >> unfortunately, there's no legal action that can be taken for firing these workers at this point. but looking at the humanitarian side of this, look at the actual people working for him, people who served him for years and help him build this empire and working for him and perhaps did not have documentation maybe look at him and say, there has to be a definitive way than firing these workers and washing your hands clean of it >> isn't it incumbent upon the trump organization to check documents? if they are handed documents that are false, that's irresponsible to not check it, so they're not held liable for this at all? >> right it is irresponsible. they're not held liable. what they've done is they've essentially turned a blind eye all these years. they possibly knew these documents were illegal they did not verify these documents were illegal

until now, until they were under a microscope they did not care now, they're blanket firing folks they think their documents are actually fake. it would be different if their documents were accurate, then they would have a cause of action to come back and say this was an illegal firing but they have to prove their documents are accurate in legal documents. there's a statement from eric trump that the organization is making a broad effort to identify any employee who has given false and fraudulent documents to unlawfully gain employment and some claim the organization has provided them with fake green cards. what about any implication that was going on if that was the case >> it depends what those employees actually did the reports we're getting if the employees were told, these documents aren't good enough, get a better document so they

actually knew that whether higher-ups knew these lower level employees were directing people to get better fake documents, there's not a legal cause of action but whether trump is being honest and things he's been saying about the immigration policy and how we're documenting workers in this country let's go to roger stone because we don't know whether stone will end up cooperating with mueller and how damaging might his information be damaging to those closest to him? >> he is by far the closest to trump mueller has actually gotten whether he will come forward and assist, we'll see. every person thus far has turned state's evidence and said we will cooperate and testify against donald trump, however, stone is saying he will hold fast i think that says he is looking for a pardon or something like that and will play into the

president's hand we've seen that before and mueller has been successful turning other folks. it will be interesting to see if roger stone holds fast to his position he will not become a snitch >> let's listen to harvard law professor dershowitz's words >> they're not crimes of substance. they're interested in squeezing him, getting information from him about the real target, that's donald trump. >> as a criminal defense attorney, do you agree the president is the real target according to dershowitz? >> i agree these are process crimes and the types of crimes the federal government is able to prove. they're proving lying and not the original substance they were being investigated for they're knocking down one by one and getting these individuals

are you concerned some democrats may be declaring victory a bit too soon >> i think we're just excited that the shutdown has temporarily ended and hopefully permanently ended. we have a window of time to hopefully come to a comprehensive solution in the interim we have americans back to work and taxpayers being served by government services. all of us should be excited and happy about that outcome >> that's a very positive outlook. what do you think has changed to make what you're hoping for actually come true within 20 days >> let's look at this. 35 days for a shutdown that accomplish nothing but creating misery for federal workers, federal contractors, their families, the many american families that rely on those federals services, for no reason whatsoever other than a national emergency the president created by the false pretense mexico would build a wall and now he

expects american taxpayers to do it what am i hopeful for? the next 20 days we see members from both sides sit down and work with the cbp as to the areas they have specifically outlined, every inch of our border outlined what needs to be done, whether fencing, technology, feet on the beat, we have an opportunity to come to a comprehensive solution to provide appropriate protection let's not forget, ports are more important than the border to make sure we have the right resources in place that's pretty universally accepted >> your location has hatem rarely protected status. what would you give in exchange for permanent daca and pts protections. >> let's get off the venacular of a wall.

if experts believe the existing wall needs to be repaired or new wall provided in certain areas, i'll support that. to suggest we're going to take a wall down the middle of the rio grand is ludicrous we all know it has been since day one. we have better technologies than that to your point, yes, we need to be working with how do we provide a pathway to citizenship for daca to be more specific,it should really be dreamers, about twice that number of individuals i'm hopeful in these negotiations that is on the table and we can come to some sort of resolution >> congressman, i want to talk about the exclusive reporting from nbc news about the security clearances of the president's son-in-law, advisor, jared kushner. two officials rejected his application for a top secret clearance and had concerns about foreign influence on them but then a supervisor overruled them kushner was one of those which

that same supervisor cleared top clearances despite recommendations. in order to clear up this matter, what exactly are you looking for. the truth. that's the purpose of this committee. what frustrates me because i'm a middle of the road individual is the hypocrisy. the republicans have held the chairmanship for eight years including two years under the trump administration if this had been a democratic president's administration, allowing these clearances coming through we know exactly what they would have done yet here they stand identically by on the sidelines and allow it to happen. the american public deserves more than that and with the chairmanship here i'm sure we can get to the bottom of it. as to roger stone, this alleges a senior trump official was directed to contact stone

about any additional releases about the hillary clinton campaign stone is saying that campaign official was not donald trump. does this indictment potentially contribute to making a better case for starting impeachment proceedings? >> what's interesting about mueller's investigation we have now over 30 indictments and about a half-dozen convictions as we have seen, the circle gets tighter and tighter around the president and his family where it will ultimately lead, we need to make sure mueller has enough time to do that the breadth and depth of his investigation it deserves. let's see what it says if there are grounds for impeachment we have grounds under article i to take action >> your reporting from the "washington post" about a week ago when the shutdown was under way, about a dozen of trump's employees at the westchester golf club were fired because

strategist and republican strategist good morning to you both expectations for the negotiations we saw the president's tweet about 21 days going very quickly, brian, what do you think is going to happen? >> not much. i know they will have a bipartisan bicameral conference and meeting to try to work out an agreement if the democrats weren't going to give the president his wall before, why would they give it now? there's no pressure to do so i assume what you will see at the end of this continuing resolution, there will be no resolution to the issue, the wall will not be part of any appropriations bill and the president has to look to his emergency powers which have been delegated to him in the past the president does arguably have the power to start building the new wall right now, or in 20 days or 30 days or whatever, and he might invoke that if the house and senate, as expected,

you said a deal was reached. what did the president get >> he got the deal that was passed back in december that he turned down. ultimately, he didn't get anything what we got was almost $6 billion as a country of wasted funding. we had 800,000 workers and their families that were without pay for over a month ultimately, he didn't get anything to brian's point about the use of a national emergency to reallocate funding, i'm in cred due louse. i think he will find many difficulties legally if he wants to do that he sets a new precedent and he will see a new democratic administration could potentially choose to select climate change as a national security and reallocate funding or choose to use immigration reform as a national emergency. it opens a brand new door for a lot of new opportunities >> you make a very good point,

bishop brian, respond to that you said it looks like the president has the ability to do this how strongly do you think those looks are actual reality >> there are so many laws on the books right now that delegate emergency powers to the president. i believe the brennan center calculator something approximating 30 emergencies right now. what we would consider real emergency under the law is very differently defined. >> isn't it about getting money for his wall isn't that where there are a lot of hurdles for this president to take money for fema funding or military and re-route it to putting up a wall? isn't that the biggest problem >> it's a problem, but he can do it yes, there is a legal debate whether he can or cannot do it what there is not a debate about is congress isn't going to stop

him. what will happen is the democrats in congress will have to go to the courts and ask the courts to stop him there is no way congress can pass any sort of resolution stopping the president from taking these actions so this will all be fought out in the courts >> the president took pretty big hits at the poll in this shutdown and hits from his base. what does this signal for the next three weeks >> i think the running joke in d.c. right now is the president has a wall and her name is nancy pelosi we had the speakers truly out here defining what leadership looks like ultimately, the american people are seeing that and disapproving what the president is doing. ultimately, democrats have the wind at their sails. at the end of the day, this isn't about who wins and loses politically, about protecting our foundations and establishment, ensuring our government is properly taken care of and it is affording opportunities it needs to for

the citizens >> in terms of numbers, nancy pelosi's approval ratings are higher than in decades does this change the dynamic >>. >> democrats won the battle but may end up losing the wall remember, nancy pelosi was saying walls are immoral i don't think that's a winning message for the american people. i don't think the american people want to see us tearing down walls in the southern border i don't think that's a winning strategy for democrats i think they will regret digging in so hard and taking aen streaks position on that issue >> look at how nancy pelosi handle the shutdown solution she refused to let the president give the state of the union in the house chamber. doesn't it look like she's controlling him now? >> we have a separation of powers she won. the power of the purse resides in congress and appropriations bills traditionally started in

the house. she has immense power when it comes to spending power of the federal government and the president just found that out. >> to the point of emergency declaration, is this inevitable, do you think, with how badly it went the last time around, nancy pelosi appearing to have the upper hand and hits in the polls. is that's what's going to have to take place for the president? >> i think speaker pelosi continues to be the adult in the room, what americans need right now. brian said, the president can do it that defines what this administration is all about. we're going to see speaker pelosi do what's right by americans and not be as concerned politically at the polls. we're at a time we have never seen in modern history with this type of president. it's important leadership is above party and we do what's right to protect our interests

and not simply will get us the best academic marks with the electorate >> leadership above party, brian, i'm sure you've seen this "new york times" article about trump fearing a 2020 fight do you see someone else coming in and trumping president trump? is that going to happen? >> no. i don't see any republican, john kasich or jeff flake, bob corker, if any of them were to come in, let's be honest, one thing that happened in the shutdown fight is president trump angered a little bit of his base because he didn't dig in and fight they don't believe he fought high enough. no conservative will challenge president trump. he has the highest rating of republicans in recent history. if some moderate more squishy republican tries to challenge him they will lose badly

the obviously arena for president trump is in the general election >> challenging the president from the other side, i want to talk about kamala harris, launching with a rally today, town hall tomorrow and formally entered the race this last week. how does she fit with respect to other potential democrats? >> i think we're blessed to have some of the most incredible talent that have already taken it upon themselves to put their name out and go through what is a slugfest in terms of a presidential race, i've been a part of the last two cycles myself seeing that from a staff ride and knowing how hard it is for candidates to navigate this, my heart goes out to them and appreciation senator harris is an incredible thinker and authentic. another fantastic representative, person of color that can truly help unify our country who has proven leadership skills and proven
