this morning another possible government shutdown is looming at the end of the week. lawmakers have until friday to strike a deal on border security but negotiations stalled over the weekend. >> virginia governor ralph northam said he's staying put despite controversy over a racist photo. the embattled governor says he won resign and thinks he can help heal his state. >> another lawmaker enters the already crowded 2020 democratic field. amy klobuchar is the latest to enter the race for the white house. good morning.

it's monday, february 11th, 2019 i'm ayman mohyeldin alongside yasmin vossoughian and louis burgdorf. we're starting off the week with the threat of another government shutdown. it's looming as a real possibility as of today. last friday aides and lawmakers appeared optimistic they could reach a deal by today but now negotiations have stalled. one of the main sticking points is the number of additional beds to give to immigration and custom enforcement to detain immigrants who come across the border. democrats have proposed reducing the number of beds, the more humane policy is to let asylum seekers without criminal records to be released while they await their proceedings. senator shelby didn't appear optimistic about the chances of reaching a deal ahead of friday's deadline. >> i think the talks have stalled right now. i'm hoping we can get off the dime later today or in the morning because time is ticking

away. but we got some problems with the democrats dealing with i.c.e., that is detaining criminals that come in to the u.s. and they want to cap on them. we don't want a cap on that. >> the thought sue have to make a deal, have to announce something by tomorrow. do you feel that's a deadline and how confident are you, you can reach a deal by tomorrow? >> chris, that is a deadline. i'm not confident we're going to get there. i'm hoping we'll get there. >> so, is it fair to say whatever congress hands him he'll sign, he just may not be enthusiastic about it. we cannot definitively rule out a government shutdown at the end of this week? >> you absolutely cannot. >> president trump will weigh in with his demands for the border security deal tonight in el paso, texas where he'll hold his first campaign rally of the year

future from the u.s.-mexico border. >> virginia governor ralph northam is vowing to remain in office despite repeated calls for his resignation. >> this has been a difficult week and, again, i'm fine. it's been mainly difficult for virginia and this country. so, yes, i have thought about resigning but i've also thought about what virginia needs right now and i really think i'm in a position where i can take virginia to the next level and it will be very positive. you know, we have a number of inequities in this country right now and in virginia and we're in a position to really stop talking so much and now to take action with policy. >> northam continues to stand by the claim that he's not in a photo of a man in blackface and another in kkk robes which was displayed on his medical school yearbook page. the democratic governor said he was shocked when he saw the photo for the first time on a phone on february 1st. northam said he quote

overreacted by quickly issuing a statement and taking blame that day adding he would redo the situation if he could. he hopes that a quote independent investigation by eastern virginia medical school will clear up the facts surrounding the ongoing investigation and controversy. "the washington post" asked virginia residents what they think should happen with government north. they found a dead lock with 37 home runs saying north should stay on while an equal 47% believe he should step down. 58% of african-americans believe northam should remain in office. 37% think he should resign. virginia democrats are also in favor of northam staying in power. 57% to 40%. as for attorney general mark herring who admitted to wearing blackface in college, six in ten virginia residents believe he should stay on and 34% think he should step down. the poll found 11% of residents have either worn blackface or

know someone who has. lieutenant governor of virginia says he'll not resign in the face of a second sexual assault allegation. a woman stepped forward friday and alleged that justin fairfax raped her when they were students at duke university back in 2000. in a statement through her lawyer, meredith watson claimed the attack was premeditated and aggressive. and described fairfax and herself as friends who never dated. the lawyer also states that watson shared her account with friends in a series of e-mail posts and facebook messages and claim that watson can provide two witnesses whom she told of the assault the day after it allegedly had happened. like the other allegation, lieutenant governor claims the encounter was consensual stating quote i did not sexually assault or rap meredith watson, vanessa tyson or anyone else. both of his accusers say they are prepared to testify at any potential impeachment trial.

to that his office responded the lieutenant governor is aggressively exploring openings for a thorough independent and partial investigation of these allegations. he believes a political process is not the most likely path for learning the truth. democrats across the country are now turning on justin fairfax, the democratic lieutenant governor's association has replaced him as their chairman. the democratic party of virginia has called on him to resign as have most of his party's presidential candidates, including kamala harris, cory booker, elizabeth warren and others. >> joining us now from washington, d.c. is politico's author. daniel, great to have you. looking ahead to 2020 how might these ongoing controversies in the state of virginia impact the election for democrats? they were quite happy they picked up some key wins there over the last couple of years. now that looks like that's in yep?

>> a lot of those 2020 candidates want virginia to get off the news radar because it really hurts the party going into 2020. i don't think that the average voter in virginia will think well because these top officials in that state's politics have had these scandals, that means i'm going to vote for trump again if they weren't going to already. so, if there's a strong 2020 democrat, especially someone who is more moderate, not like a bernie sanders type, then i don't think that they will worry about winning virginia. the demographic trends in terms of making it more blue and purple, those are pretty clear. >> let's switch gears and talk about a possible government shutdown at the end of the week. obviously on friday things seemed optimistic, people in washington. optimistic. over the weekend things have stalled with regards to that. so what is the likelihood that

we could see ourselves in another government shutdown come friday? >> i agree with richard shelby, the senator from alabama who is saying that it looks like it's 50-50 because no party in washington want to have another shutdown and hurt both of them. if you look at the polls. so i think if they are arguing about detention beds and a couple thousand of them i think they can split the difference because that doesn't seem like an issue that should have, you know, both democrats and republicans not pay hundreds of thousands of federal workers and have the nation in a government grinding to a halt because they can agree on a small little issue. so, i think -- i don't see another government shutdown happening. >> thank you. we'll talk to you again in a little bit. still ahead the very latest on amazon jeff bezos blackmail

that deal between the ami and the feds stems from the committee admitting it paid a former playboy model $150,000 before the 2016 election to keep quiet about an alleged affair with donald trump. the agreement required ami to commit no crimes whatsoever for three years to avoid prosecution. if it broke the term of the deal, ami could be charged with campaign finance crimes. yesterday the lawyer for ami ceo david pecker rejected the allegations by bezos that the "national enquirer" publisher tried to blackmail him with explicit photos and would not confirm whether the sour of the photos was the brother of bezos' girlfriend. watch this. >> i can't discuss who the source was. just that it's a confidential within ami, so i'm not going to answer who the source was. it was somebody close to both bezos and miss sanchez.

>> saudi arabia's foreign minister is weighing in on the controversy after jeff bezos aalluded to the kingdom. he denied any connection between the saudi government and ami. >> he personally said, though, that the "post"'s essential and unrelenting coverage of the murder of columnist gentleman ma'am khashoggi was unpopular. did he have anything to do with the leaks? >> absolutely not. this is something between the two parties. we have nothing to do with it. >> can you say, though, that the saudi government and any of its employees or its contractors that it works with definitively that he had had no contact with david pecker or ami. >> as far as i'm aware. i believe i would be aware. we have absolutely nothing to do with this. >> okay. let's talk about this.

how are you doing, danny? >> great. i'm not aware of any communication with david pecker. >> the big question is did ami break a law here? did david pecker break the law here in his interactions with bezos and what are the next steps that the southern district of new york taking? >> first demand by ami arguably violated by state and federal extortion laws but doesn't fit neatly into the traditional idea of extortion which is you give me a bag of cash and i won burn your store down. that's the original idea behind extortion. here you have a very different contract. you have a demand and the demand is for a thing of value which is favorable coverage or a statement by bezos. that's not the traditional bag of money. then on the other hand the threat is not to do physical harm, but to release photographs and that raises two additional questions. was the news gathering lawful

that obtained those photographs because if it was, part two releasing them might be legal. but it's an old rule in criminal law that with extortion and bribery two independent acts that might be legal become illegal if they are accompanied with a demand that's corrupt. >> what severe is the penalty for ami if it's deemed they are involved in extortion or violated the law by engaging in this? >> if the southern district of new york determines am ivy lated it's nonprosecution agreement which by the way is the gold standard for criminal defense attorneys to get your client a phenomena prosecution agreement because most of the time the federal government requires that you at least pay some penalty for your sins. but a nonprosecution agreement is a complete forgiveness of sins. if am ivy lated that by committing future crimes, present crimes in the form of making a demand that amounted to

extortion then the government can consider that nonprosecution null and void, they can prosecute them for the new crime and they can come back and prosecute them for everything they agreed not to prosecute them for before. >> does this leave both entities vulnerable, both david pecker and ami because ami had their nonprosecution agreement in september, david pecker made the agreement in august. david pecker could also be a focus as well. >> that's right. it leaves them both exposed. but i want to be clear it's not for investigating jeff bezos. not for publishing photos of him in public with his girlfriend walking to the theater or to a restaurant. the key will likely be the demand made by ami's lawyer. on ami's side they will argue look this is what lawyers do all the time. i've done it hundreds of time. you send a letter or e-mail saying tomorrow we'll file this attach complaint, start a lawsuit against you unless you resolve this case today.

that's something lawyers do every single day. >> that's much different from what we've read. >> that's right. that's where it probably breaks down. lawyers are demanding settlement otherwise they will file a lawsuit, something they are legally privileged to do. on the other hand, if, for example, ami got these photographs in an ill-gotten way and threatening to release something harmful and embarrassing it falls closer to the definition of extortion under federal and state law. >> this is one of those days where you need a good defense attorney. he makes something so completely illegal legal. it makes you question everything you've known up to this point. >> that's right. >> if i ever get in trouble -- >> we got about three or four cases, we're looking for a nonprosecution agreement. >> thank you.

as far as the snowfall forecast goes this is primarily tonight and tomorrow. this area from iowa through wisconsin. you got nailed a couple of times. six up to nine inches of snow in this area, northern michigan too. in the northeast one of the bigger snow events we had for areas from new york city to hartford to boston to providence, possibility of four to six inches of snow. this will be tomorrow morning and then tomorrow afternoon and evening for northern new england. easily a foot of snow in areas in the mountains, guys. as far as the bottom line for i-95 cities go the worst travel time will be tomorrow from about now to about 2:00 and then it changes over to ice and then rain. a messi tuesday in the northeast. >> we should have had amy klobuchar reach out to bill karins to give the weather forecast. >> that was impressive. were you impressed. >> courage. no teleprompter. out in the snow. >> no gloves. >> a couple of extra votes for toughness. >> can't imagine president trump giving a speech like that in

♪ optimistic optimistic . welcome back. i'm yasmin vossoughian alongside ayman mohyeldin and louis burgdorf. it's the bottom of the hour. we're getting another look at president trump's private schedule via new white house leak. axios has obtained four of the president's schedules from last week. they show that the president spent 50% of his time from last monday through thursday in nonstructured executive time.

the president's secretary is calling the leak a disgraceful breach of trust. axios has confirmed the white house has launched an internal hunt to find the leaker. president trump tweeted about his schedule yesterday writing the media was able to get my work schedule something very easy to do but should have been reported as a positive not negative. when the term executive is used i amgen rally working. i had no choice but to work very long hours. here's what the president's acting chief of staff mick mulvaney had to say about executive time. >> there's a report the president spend a majority of his time in executive time. he's off tweeting away and gossiping and not working? >> i read that. i get those schedules. that's probably the closest thing to a public schedule we put out. it's not very sensitive. 400 people get that schedule. it's not that valuable of

good amount of praise from her fellow senators, especially on the republican aisle. we have a political story, republicans gush over amy klobuchar because they see her as a bipartisan voice. she in 2016 was the senator who got the most amount of legislation passed, so she's very productive. the rap on her is how poorly she treats her staff according to a number of reports. for elizabeth warren she's getting over that native american stuff that's dogged her. harris and booker don't have those controversies that's preventing them from doing well. >> let's talk a little bit about the white house another sensitive issue for them. somewhat embarrassing constant leaks coming out of the white house involving the president's personal schedule there. how does this much executive time look to those lawmakers trying to dodge another looming shutdown? mick mulvaney tried to downplay it. the reality is slightly different than that, right?

>> yeah. and he is talking to senators sometimes during that executive time. and if you talk to people on the hill they would probably rather have him in that executive time than interfering in negotiations. in fact, that hasn't worked that well in the past. it's ironic that white house officials leaked to me about the leak investigation into this and so it's kind of -- looks like a career government employee stationed in the white house and they promise by the end of the week that they will try to find that leaker. they are pretty close. but, you know, obviously trump is not like other presidents, no presidents previously had these wide blocks of time compared to trump. he, you know, only gets into the oval office around 11:00 a.m. >> he can't hide how much the president has spent at his golf

courses in his first two years and definitely the most president -- >> is that executive time too? >> i don't know. good question. >> tee times. >> tee times. >> thanks. not for first time the trump administration has missed a congressional mandated deadline. watch this. >> on friday there was a deadline for the administration to provide a report on the death of "washington post" columnist jamal khashoggi. the administration did not meet this deadline. why hasn't that happened or did you meet a deadline and we don't know? >> i honestly don't know. not familiar and worked ins on negotiations. there are some requirements placed upon us by congress but i'm not aware of the status of the report. >> none at all? you're not prepared to answer whether the president believes the saudi government was behind the assassination of jamal khashoggi? >> i think it's the state department supposed to do that. >> a senior administration official tells nbc news quote the president maintains his discretion to decline to act on

congressional committee requests when appropriate. however, that appears to be contrary to the requirements of the global act. that comes as adel al jubeir who said mistakes happen. he warned about any linking to saudi arabia or to the crown prince to khashoggi's murder saying quote our leadership is a red line. he reiterated the latest saudi explanation for the murder that it was a quote rogue operation which is an idea that president trump actually first floated several days before the saudis publicly did last october. the crown prince had nothing to do with this. there was northward to murder jamal khashoggi. >> is that what the secretary of state told you? that the crown prince had nothing to do with it? >> i believe the positions of the president and secretary of
