finish his investigation. the only question now is whether the new attorney general will make the mueller report public. >> and mccabe grabs the president's attention again with a dark account of his time in the trump administration and his claim that the doj did actually discuss a plan to remove the president from office. a lot has happened in the last 24 hours. good morning, everybody. it's friday, february 15th. i'm yasmin vossoughian alongside david gura and burg. a new battle for the white house as president trump barrels towards a fight with congress over national emergency to fund the border wall. the white house confirmed the president will make the declaration under the 1976 law intended for moments of disasters and security threats. president trump is using this one to re-appropriate money for

even more money for the wall. days after a compromise where barriers were needed last night the house followed the senate in approving the deal. the deal gives the president less than $1.4 billion for the wall. but at 10:00 a.m. this morning, an administration official says the president will announce he has secured $8 billion for the wall with his national emergency declaration. the president will then leave for a weekend all mar-a-lago. >> the president's action is likely to be blocked and the white house counsel office warned against declaring a national emergency calling it a high litigation risk according to a person with knowledge of those discussions.

last month nbc reported that trump is planning on a plan to erect 315 miles of barrier along the southern border. the money would be set aside to fund projects all across the country. the checks have not been written as of january and under an emergency declaration the president was told he could take the money from these civil works projects and use it for the wall. puerto rico's governor shared an old trump tweet that declared mexico would pay for the wall adding it's now puerto rico and california, american citizens that will pay for this wall. if that's the case, we'll see you in court. california attorney general also responded, we'll do what we must told him accountable, no one is above the law. >> so here's thing. president trump was no fan of executive action on immigration in november of 2014 when president obama signed an order to offer temporary legal status

to millions of undocumented immigrants. trump tweeted this at the time. republicans must not allow president obama to subvert the constitution of the u.s. for his own benefit and because he's unable to negotiate with congress. trump continued the criticism a year later as a presidential candidate. >> the whole concept of executive order not the way the country is supposed to be run. you're supposed to go through congress and make a deal and go and talk to people and get the guys in there and, you know, whether you're a republican or a democrat you're supposed to all get-together. you're supposed to make a deal. but he couldn't make a deal because it's not his thing. two days ago the court upheld a decision saying that the executive order that he signed was improper on immigration. it was a big one. it was a big one. that was a great thing. >> field of potential democratic 2020 presidential contenders in

congress was split on last night's vote to dispensary another government shutdown. the legislation passed. in the senate amy klobuchar and bernie sanders voted yes. but four others voted against the bill. beto o'rourke who is also eyeing a potential 2020 bid said he would be in favor of removing the wall in el paso. >> if you could, would you take a wall down now here, like you have wall. >> absolutely. i would take the wall down. >> that comment came in response from a fellow texan dan crenshaw on twitter who asked if o'rourke could would he snap his fingers and make that wall disappear. >> for the second time, william barr is the new attorney general of the united states. he was sworn in yesterday after noon by chief justice john roberts in the oval office shortly after being confirmed by

the senate. while that vote was mostly along party lines a few senators broke with their parties. doug jones, joe manchin, voted for barr while rand paul voted against him. barr is a justice department department veteran who served in the george h. bush administration. in addition he now oversees the special counsel investigation and says he considers robert mueller a friend. however barr also wrote a 19-page memo last summer arguing that mueller should not treat trump's decision to fire james comey as obstruction of justice. we'll hear more from andrew mccabe about his interactions with the president of the united states in an adaptation of his new book published in "the atlantic." he had two phone calls with the president in the first 24 hours as head of acting fbi.

in one instance he said the president called him on an unsecured line saying how happy people were that he fired james comey. mccabe writes the president said he thought most people in the fbi voted for him. he thought 80%. he asked me again, as he had in his office if i knew that comey had told him three times that he was not under investigation. mccabe says the president also ordered him to investigate why comey flew home from los angeles on a government plane after being fired. mccabe said he told the press he decided comey should do so after getting the okay from fbi lawyers and the existing threat assessment considered comey was at risk. the president flew off the handle. that's not right. that's wrong. he reiterated his point seven or eight times. i'm sorry you disagree, that's my decision. the president said i want you to look into that. what am i going to look into.

i just told you i made the decision. coming up he'll have much more using the 25th amendment to remove president trump from office. >> president trump also weighed in with a series of tweets writing disgraced andrew mccabe pretends to a poor little angel when in fact he was a big part of the crooked hillary scandal and the russia hoax, a puppet for leaking james comey. part of insurance policy in case i won. many of the top fbi brass were fired, forced to leave or left. mccabe's wife received big dollars from clirn people for her campaign. he gave hillary a pass. mccabe is a disgrace to the fbi and a disgrace to our country. make america great again. mccabe was fired on the eve of his retirement by jeff sessions who cited lack of candor as the cause. joining us now gaby.

thank you for joining us so early this morning on this friday. let's talk first about the president's expected announcement here at 10:00 a.m. i know there's so much stuff that took place in the news cycle yesterday in the last 24 hours or so. i feel like looking ahead to this announcement a lot of people are wondering what exactly will take place and how quickly the president's announcement of a national emergency at 10:00 a.m. which is very much expected to be, how quickly that could be blocked? >> well, i spoke with somebody yesterday who said that there could be some form of litigation or court challenge against this national emergency declaration as early as this afternoon. so hours after the president would have announced that he's secured this $8 billion from different funding streams, of course we already heard from attorney general in california who said that he's absolutely prepping some type of legal challenge to this, that if the

president moves forward with the national emergency declaration. there are other groups including the center for american progress who says this is quota direct assault on separation of powers and they have used language to indicate that they view this move as illegal. and would likely pursue challenges against it. it's something that the white house has been worried about all along. you know, the counsel's office has worked through this plan with the president telling him there are various moves he could take that would be more subject to litigation than others and he's chosen ultimately to go with the national emergency declaration. that's at the highest risk of legal challenges. that's why you have republicans on capitol hill who are extremely worried about how this is going to play out and also the precedent it will set if a democrat takes the white house in the future. >> we heard from speaker pelosi yesterday after this news came out. she basically stood on the

same color of skin as the rest of your face. >> according to his latest physical president trump is now officially obese. the white house physician and navy commander says he's 6'3" and weighs 243 pounds. a gain of four pounds since last year's physical. tough year. that puts the president's body mass index at 30.4. anything over 30 is actually considered obese. in addition trump has upped his dosage of a medication used to control his cholesterol. despite all that the doctor says trump is in very good health and should remain so for the remainder of his presidency and beyond. >> amazon has cancelled its plans for a new york city headquarters walking way r from the largest and most public subsidy in history. in exchange for a $3 billion sneft package amazon was supposed to usher in 25,000 jobs to long island city in queens

and fuel real estate development boom. after three moves contentious city meetings the deal was reafrmd by new york governor cuomo and new york city mayor de blasio only for amend to pull out on thursday morning. it cited lack of political support on amazon's website. governor cuomo railed against local lawmakers who joined grassroots against amazon's union stance. the news garnered mix reactions from business leaders but celebrated by progressives, including alexandria occasio-cortez who represents the neighboring district of the now nixed headquarters. >> i think it's incredible. i mean it shows that every day americans still have the power to organize and fight for their communities and they can have more say in this country than the richest man in the world. >> what do you say to those that

criticize them pulling out that the district now will lose 25,000 jobs. >> well, one of those things is a, we were subsidizing those jobs. so for -- the city was paying for those jobs. if we were willing to give amazon -- willing to give away dall $3 billion, we can put a lot of people to work. >> amazon says it plans to expand its smaller offices around the country without those promised subsidies. >> democratic national committee announced nbc news, msnbc and telemundo will host the first democratic presidential primary debate in june. the networks will broadcast the debates simultaneously on back-to-back week nights, should multiple nights be necessary given the potential size of the

field. the debate location and exact dates are yet to be announced. the lineups for each debate will be chosen at random and to qualify candidates will need to have at least 1% of support in three qualifying polls, will provide evidence of at least 6,500 individual donations from a minimum of 200 different donors in 20 states according to the dnc. the dnc plans to host 12 debates in total over the 20 democratic primary season with the first six scheduled this year and second six planned for 20. let's switch gears and get a check on your weather with nbc meteorologist bill karins. what have we got? >> a little bit of everything. snowstorm heading for our friends in kansas city. warm weather in texas. west coast gets a break after your deluge over the last couple of days. palm springs third rainiest day in history over three and a half inches of rain. so that storm system that was in the west, little piece coming out to the plains. you look up here this is our

chart. pink is ice. sleet shown in areas of the orange. blue is the snow. a little bit of everything if you're driving north from oklahoma city to wichita and this will happen over the ozarks. winter weather advisory goes from tulsa to st. louis parks did you okay, evansville to louisville and lexington and all the way back up to rapid city. how much snow? kansas city doesn't usually get big blockbuster snowstorms. they are in the sweet spot for this one along with some areas here in south dakota. near rapid city see that six to eight inches of snow. omaha two to three inches. kansas city we have you about four to possibly maybe getting as high as six inches of snow. that will continue interstate 70 today in the middle of the day. st. louis about an inch or two at most. mostly springfield southward down to the ozarks. couple days ago looked like a little bit of the snow would head to d.c.

welcome back, everybody. i'm yasmin vossoughian alongside david gura, and louis burgdorf. republican lawmakers are weighing in on the president's pending use of a national emergency to get his border wall. raising their concerns for the precedent the move would set. in a statement congresswoman kathy mcmorris rogers of washington said that if elected president, how would elizabeth warren or bernie sanders use this precedent for a national disaster declaration for the green new deal on the american people? and here's senator lindsey graham. >> what about the precedent it sets. some said what if it's a b. y sanders who declares climate change. >> if it's bernie sanders we'll have more problems than this. >> the phone call i'm getting while on camera. meanwhile senator marco rubio slammed the anticipated move by the president saying in a statement that no crisis justifies violating the constitution. his comments are similar to the

opposition that they've expressed in recent weeks. >> i don't think it's a good idea. i think it would be a terrible idea. i hope he doesn't do it. >> would you fight him on it? >> sure. i think it's important. >> i think it's a dangerous step. one, because of the precedent it sets. two, the president is going to get sued and it won't succeed in accomplishing his goal. and third, because i think miss pelosi may well introduce a resolution of disapproval that will pass the house and come over here and divide republicans. to me it strikes me as not a good strategy. >> i do not see the grounds for declaring a national emergency. the law that was passed in the 1970s was really intended to be used if we had a catastrophic natural disaster or an attack on

our country. >> now there were multiple republicans who came out in support of the president's national emergency declaration. first being senate majority leader mitch mcconnell. >> i just had an opportunity to speak with president trump. and he, i would say to all my colleagues indicated he's prepared to sign the bill. he will also be issuing a national emergency declaration at the same time. and i've indicated to him that i'm going support the national emergency declaration. >> the president feels very strongly we have a crisis at the border. i agree with him. trump's only sin is that he's enforcing the law. and if you don't like the law you ought to change it. >> he's committed to finishing the job and he's going to use whatever constitutional and statutory authority that he has to do it.

house democrats could soon put senate republicans who are opposed to the president's action into an awkward position as "the washington post" notes the national emergency's act has a provision stating congress has 15 days to pass a joint resolution of disapproval. house democrats are gearing up to pass such a resolution, a move that will force senate republicans to vote. president trump could veto the action unless congress passes it with a veto proof majority. if the resolution fails the house would be in a better position to sue. nancy pelosi says democrats are reviewing their options and she's also connecting the issue to gun violence one year after the mass shooting at florida's stone man douglas high school. >> i know republicans have unease about it no matter what they say because if the president can declare an emergency on something that he's created as an emergency, an illusion he wants to convey,

just think of what a president with different values can present to the american people. you want to talk about a national emergency let's talk about today, the one year anniversary of another manifestation of the epidemic of gun violence in america. that's a national emergency. why don't you declare that emergency, mr. president. i wish he would. but a democratic president can do that. >> all right. now to that stunning claim from former acting fbi director andrew mccabe confirming a past report that after the president fired james comey justice department officials discussed invoking the 25th amendment to remove the president from office. in the spring of 2017 deputy ag rod rosenstein suggested he secretly record president trump in the white house to expose the chaos consuming the administration. the report says rod rosenstein also discussed quote recruiting cabinet members to invoke the 25th amendment to remove mr.

trump from office for being unfit. the "times" said several people briefed on the event or by memos written. rod rosenstein disputed the report and yesterday the department of justice released this statement. as the depp ag previously has stated, based on his personal dealings with the president there's no basis to invoke the 25th amendment nor was the doj in a position to consider invoking the 25th amendment. >> congressional republicans are speaking out. georgia congressman doug collins the ranking member of the house judiciary committee is one of several lawmakers calling for a hearing with mccabe and rod rosenstein and the chairman of the senator judiciary committee lindsey graham also addressed the situation. >> would you subpoena rod rosenstein? >> i would like to know what happened. you're having a conversation about whether or not you're going to invoke the 25th amendment. i would imagine if the shoe were on the other foot my democratic

colleagues would want to know about that conversation. >> senator, back to mccabe for a second. were you surprised he admitted this in an interview and do you think it's evidence of overreach by the department of justice? >> i don't know what you would call it. if you're not interested in how they sit around and talking about to get votes to invoke the 25th amendment you do hate trump. that to me is an interesting moment in our history. >> interesting indeed. joining us again from white house washington reporter from politico. we know the basic details of firing of comey. you read what andrew mccabe has written about that. what does that tell you about the president's frame of mind? >> the president had already admitted in that now infamous interview with lester holt that the russia investigation did play a role in his firing of james comey. it seems that may have been brought up in a conversation he

had soon after firing the former fbi director when he spoke with andy mccabe. he talks about in the excerpts from his new book that he met with president trump days after he fired james comey and the following day approached his team at the fbi who was investigating president trump's ties to, possible ties to russia and their interference in the 2016 election because he was concerned based off that conversation he wanted to reinforce this investigation and prop it up so that if he were ever to be fired or terminated in anyway that it would still survive that situation. i think that's really important here. it indicates that there was something that was so concerning in that conversation with the president that mccabe thought to do this. >> let's quickly talk about the president possibly declaring this national emergency. time and time again we have seen republican lawmakers come out against something the president may or may not do. the question s-and especially a

lot of people have been on record saying that they are against the president declaring national emergency here. the question is if, in fact, the president declares a national emergency at 10:00 a.m. this morning, if these republican lawmakers will come out against it. if they do what type of a relationship will that create between the gop and the president? >> you know, i've been covering this white house for about two years now and during the presidential campaign for trump as well and there have been so many moments when republicans have publicly condemned something he did or criticized what he's done but then they retreat and support the president. this time seems different. there are a number of republicans who said that this is not a good move. that they have ideological concerns about this. they are concerned about the precedent that this sets. they oppose taking money from the defers budget and using it for the construction of a border wall. they are worried about what this will do in 2020 impacting border states.

there's so many different concerns that republicans have outlined that if they are forced to do an up or down vote on this, if a joint resolution passes through the house it could divide the republican conference and create a huge problem for this president. >> we have every indication mitch mcconnell was against the president declaring a national emergency. but mitch mcconnell came out yesterday saying he's on board with it. >> that's true. there's quite a few people who had their concerns. they voiced them publicly and privately and have since come around. i spoke with mark meadows who said he had concerns about a national emergency and he was privately urging the president to look elsewhere for funding for a border wall but that if the president did take that route the freedom caucus would support him. although they have these concerns they are still backing president trump on this because

returned. what that means we measure the temperatures of the water out here in the pacific. here's south america and here's central america, here's mexico up here. we measure this. it has been warming up. now we're weak el nino. that will continue through the spring. now, the impacts here in the lower 48 are very typically an active southerly jet stream which brings wet weather into california, sound familiar. that's what we've been doing all winter long. usually continues wet and active spring pattern even severe weather flooding in the southeast. we'll see how that plays out as we head into spring. now even gusting going in the next seven days we look for significant wet weather in the south. a very wet winter. over the next seven days we're predicting up to seven inches of rain in alabama, tennessee. if this comes true we'll see serious flooding concerns next week in area of the southeast. bringing it back just for today. warm on the east coast.

opportunity for spain to move forward with a less fragmented landscape. analysts say that's not at all likely. >> what's the broader european context here and how will this all impact the u.s.? >> well, i spent a lot of my time focused on brexit. you see what that's done to politics in the u.k. with the parliament deeply divided. you have a populous in italy unsure how they're going to break out of the continued deficit in society. and in france, they're unhappy with how they're trying to reform their economy. now here in spain, no new idea, no new budget. when you look at that time from the perspective of the u.s., very difficult to see who are the clear partners in europe.
