security breach of mar-a-lago. new today, the president and house democrats drawing their battle lines over the fight over his tax returns. his lawyers now trying to block the official request from house democrats for six years of the personal and business returns. in a letter to the irs, general counsel, the president's lawyer argues that democrats have no legitimate reason to request the president's returns. they claim house ways and means chairman richard neil wants to use the information to damage the president politically. the president echoing that argument. >> i got elected. they keep going. when you're under audit, you don't do it. nobody would do it when you are going through an audit. i always go through audits. they audit me all the time. >> chairman neil gave the irs until wednesday to release the

returns. citing a tax law giving them the authority. after backing off the threat to close the border, the president touted the fencing that was upgraded as the first approved project under the obama administration. the president's plans to build a border wall and he sent this message to asylum seekers. >> the system is full. can't kay y can't take you anymore. whether asylum or anything. illegal immigration. can't take you. our country is full. our area is full. the sector is full. can't take you anymore. i'm sorry. can't happen. turn around. that's the way it is. >> the house of representatives and 20 states are suing the president over his emergency declaration. >> any crisis at the border is

of president trump's own making. president trump is not above the law. it's not just the law. it's the constitution. a group of democrats visited border points of entry and saw conditions in el paso, texas. >> we confirmed that people are being turned away. asylum seekers are being turned away at the ports of entry. that was confirmed here today. >> i have been to a refugee facility in jordan and i tell you that there are things i saw here today in the united states of america that were worse than what i saw in jordan. >> what we are doing to these people is the most unamerican thing i have ever seen. >> all right. we'll begin the hour with hans nichols. he is traveling with the president in vegas.

hans, lots of talk of border security. let's get to the agenda today. what is on tap today? >> reporter: the president's agenda is to raise money. he is speaking at the venetian in an effort to bring more republicans into the republican party. also make some fund raising head way. when you look at the president and what he is doing in the terms of the reelect. he is getting a lot of money from sources. a lot of sources. we can expect a greatest hits tour. that is what he will do in front of the audiences. we can expect him to talk about the strong economy. the good jobs report. he will likely repeat his claims on the border that he is sealing it down and getting his wall. on the agenda yesterday, it is clear he wants to build the wall. >> some of it is 30 feet. some of it is 15 feet. some of it is 12 feet defending

on t depending on the area. if you want to climb that, it is sharp on top. if you climb that, you deserve whatever you can get. it is called anti-climb. it is a great wall. i think it looks fantastic. >> reporter: alex, we have a new number on the mileage the president wants to build. 400 miles of wall the army corps of engineers wants to build. the head of the army corps of engineers said in the briefing with the president they will do 300 miles of wall by the end of 2020. he is using the army corps of engineers. the president is using the pilopilo military. all of that is a subject to approval from congress. that is where we stand on the wall. excuse me. it is excite loud. they are cleaning the streets in vegas. when the president is talking to

the groups, listen to what he has to say about closing the border and whether or not he is blaming mexico or congress. he vacillated on that over the last couple days. he said mexico is doing a good job the last couple days. let's see if he stays on that point today. alex. >> i don't know, hans, how would i know what is going in vegas at 4:00 in the morning? just kidding. i know. hans, thank you so much. see you again. joining me now is political reporter from politico and kevin cirilli. the president's visit to caleixico came after he threatened to back off the closure of the border last week. here is how he changed his mind in one week. >> we will close the border. we will keep it closed for a long time. i'm not playing games. >> a good likelihood i'll close the border next week. that will be just fine with me. >> it is not a bluff.

you can take the president seriously. >> we will give them a one-year warning and if the drugs don't stop or largely stop, we'll put tariffs on mexico and products in particular cars. >> okay. kevin, we go to you first. we have the president who claims that mexico is just now apprehending immigrants at the border. that is not true. we'll have you explain. also, the president's about face on closing the border. what do you make? >> it is remarkable. yesterday, president trump tweeting out earlier in the morning he was considering raising tariffs 25%. not against china. not against the eu. against mexico autos. we just heard he doubled down on that. that is being seen as largely an economic threat in terms of trying to get mexico to the negotiating table. $1.7 billion daily according to economic estimates in commerce

that exchanges along the u.s. and mexico border. manufacturing is a crucial part of the coalition coming out in full force against this. 47 points of entry along the border. trucking would be impacted by this in particular. the president facing push back not just from democrats or just republicans, but the business community and washington which is concerned about the trade of goods and services. >> hey, he would get a lot of push back from people getting to the grocery store and finding empty shelves. he knows that and heard all that in the wake of the comments of closing the border. kevin, back to the fact that he says just now mexico is working on apprehending immigrants. that's not true. they have been doing this consistently. >> in fact, the president needs to have that type of relationship with mexico's government. the problem is not with mexico's issues at the northern border. it is the southern border where

a host of the economic as well as criminal activity is truly being run through. the new government in mexico with the new administration in mexico. they have been working on this for some time. the president even digging deeper into the rhetoric this week, seemingly suggested as much. still threatening to shutdown the border. >> laura, the president repe repeatedly notes the border agents are overwhelmed. he is not concerned about security. what are they doing to counter that message? >> they are pointing out the inconsistencies in the things the president is saying. for instance, focusing on the idea of the wall denies the fact that a lot of the people coming in are turning themselves in at the ports of entry and seeking asylum. they are to tnot trying to clim

over a fence or sneak in un undete undetected. the democrats are pointing out the fact that the trump administration has not expanded the ports to meet the migrants who are coming in and largely families instead of the single mexic mexican men coming in for years. >> i want to get to the mueller report and fight for the release of that. the mueller investigators are expressing frustration that evidence was more damaging for the president than the attorney general released. is there any indication, laura, as to why 11 days have passed and mueller investigators heard what william barr said and he released his assessment and summary. why are they just now speaking out? >> they are not speaking directly to journalists. a lot of it is sourced to people who have spoken to people on the

mueller team. they are not allowed to speak about it. there was behind the scenes a lot of thinking about how they could get this information into the public without breaking any laws. there's so much frustration that it is finally spilling over to the point where it's reported. >> the officials telling the washington post there were summaries of the mueller report prepared for public consumption with minimum redactions required. the doj said almost every page was marked with grand jury material. why not release these summaries? you throw in minor redactions and there were some there. >> get ready. attorney general william barr is set to testify on capitol hill this week. you can bet he will get questions not just from

democrats on these particular issues, but republicans. 420-0 vote which said release the vote. it was universal. the bottom line is right now according to sources in both parties i talk with on capitol hill, alex, it is a question of when. not if. in terms of the timeline and procedures that the attorney general went through in crafting that four-page summary report that was released the other weekend in terms of being released publicly and the trickle of that developments. i think we will get those questions asked and potepntiall answered. >> mueller finds the trump campaign was manipulated by a sophisticated russian operative. laura, you have people who will capitalize on this. >> absolutely. there was no way that the

summary the attorney general could encapsulate everything we know about what has gone into the mueller investigation. it has been reported along the way. they are looking to see the report in its entirety. the summary is the least of what they're looking for. you can expect a protracted legal battle to get every detail out there. >> here is a low level interesting nugget, kevin. this is coming as "the daily beast" is reporting as the president is releasing his memoir. he says it will sell better than "the art of the deal." what do you think? >> who wouldn't want to know the president's perspective and see it? come on. we would all read it. i was talking to anthony scaramucci this week and he was saying, you know, the white

house environment was more intense than the reality show that he was on. come on. don't you want to know? even all of the ins and outs. can you imagine replicating that? >> i'll read it for sure. >> that and the mueller report. i'll read. >> absolutely. speaking of writing, laura, you wrote about mayor bill de blasio who is considering running for president. will he? should he? >> well, he argues he has his own lane to run in. that he manages a city of more than 8.6 million people. no one else who is currently in the race or mulling that has managed an organization that size. whether or not people in new york city thinks he is managing that organization well is another question. the poll came out this week that 3/4 of residents don't

about somebody's wealth with a tax return. i will absolutely give my return. i'm being audited now. every year they audit me. >> they're under audit. they are extremely complex. >> as you know, they're under audit. >> from what i understand, the law is 100% on my side. >> i'm under audit. when you're under audit, you don't do it. >> that "a" word is audit. the president's team fighting back. in a letter, the president's lawyer criticized the move as a gross abuse of power. to quote harass and official the other party because they dislike his politics and speech. joining me now is melissa. a former law clerk for sonia sotomayor. good morning. melissa, does the president's team have any legitimate points

to hold up in court? is this attempt political? the president says the law is 100% on his side. >> the law is ambiguous here. the6103, the congress can request an audit information from the irs. not requesting it from the president. it is not if the president has to turn it over, but the irs and steve mnuchin. this is setting up a conflict and if steve mnuchin is a certify ve servant of the people or of the president. >> danny, this is the only president since richard nixon who has not released his returns. they are willing to die on. that is a direct quote. what does this tell you? >> you remember president nixon said the people need to know if

their president is a crook. well, i'm not a crook. but he ended up owing half a million when he was eventually audited. it is an interesting tradition. it is not required. the president is simply not going to do it. he is really likely relying on advice from tax attorneys telling him don't release your tax returns. it could result in personal consequences. the law doesn't require him to not release his returns under audit. he can if he chooses to, but he isn't going to because it would be devastating to his personal income and personal financial situation. so, go the other route and that would be the tax code which allows the three different committees of congress to obtain the samedacted from the irs. they are allowed to disclose if they are under audit. the only person we can rely on

for that answer is the president. >> being under audit. its do does not matter. returns can be released beings correct? >> they can be released by the individual. the irs cannot release them. under a separate avenue, yes, congress can seek those returns. that tax information under 6103. then the president can do battle on that front. there is nothing in the law that prevents a person, including the president from releasing tax returns, even if they are under audit. >> there is a virginia law firm, melissa, retained by the president to represent him against congress and requests for taxes. the president, again, says 100% the law is on his side. legally speaking, where do you think this goes and how protracted is it? does this thing go all the way

to the supreme court? does this take years to get through so it is irrelevant when it comes to 2020? >> not clear when it is irrelevant to 2020. optics will play out regardless if it is settled or resolved by any court. the question of whether a congressional committee can sue the president for failing to disclose or failing to have a cabinet member to disclose, might go as far as the supreme court. under 6103, the irs is supposed to furnish to congress the information when requested. it is not discretionary. the question is whether mnuchin is going to comply with that request. that, to me, is the issue. >> let's pick up on that with you, danny. if mnuchin does not comply. could he be held in contempt? >> yes, he could. congressional subpoenas are broad. arguably more broad than

judicial subpoenas. what we usually see is congress negotiates the release of information rather than enter into protracted legal battle over the information and producing it. ultimately if pressed, i would give the benefit of the doubt to congress because the subpoena power is so broad. >> what about, melissa, if democrats win and they are able to review the president's returns? do they get protected by any sort of confidentiality law so the public can't then see the documents? >> to the degree there is information in the tax returns that are sensitive or relates to other people. there may be a possibility of redacting it. that is certainly on the table. again, i don't know this is going to be an easy fight for the democrats. the president seems to be particularly dug in on this issue. again, i think the real thing to press here is something an earlier guest said. what does the president have to hide? that he is unwilling and has

been unwilling for so long so reveal the taxes since every president since richard nixon. >> the new york attorney general has begun investigating the taxes following the bombshell report that he benefitted by $400 million in tax screhemes. is it possible new york state has gained access and considering charges now, melissa? >> certainly possible. we would not know until they would come forward with charges. we are in a federated system. not just congress, but state governments. he has been doing business in lots of places. particularly here in new york and we have seen that the attorney general that seems particularly bent on focusing on misconduct that is happening in new york state. >> all right. danny, melissa, thank you for the conversation. i appreciate that. four cell phones, laptop,

a chinese woman charged after carries a thumb drive with malicious software. joining me now is the chair of the finance committee and ambassador to china from 2014 to 2017. big welcome to you. perfect person to talk to about this. i'm curious how you perceive all of this in terms of china's perception of mar-a-lago. does china look at mar-a-lago as a soft target? >> i think it does, frankly. i think it is amateur hour for the secret service. this is not the first time there have been breaches. many in the past several years. >> wait a minute. you say amateur for the secret service. the secret service is not doing its job the best of its ability? >> no reason this lady could have gotten as far as she did. >> why is the secret service going soft, if you will, on this potential? >> it is a large institution. they mean well. like most bureaucracies, they

get oscified. when you are protecting the president, you have to be on top and i think they went off. >> do you think anything has to do with the physical manife manifestation of mar-a-lago? it has so much ground cover. >> the secret service has covered a million locations. they know how to do that. i don't want to be critical on the secret service. i'm surprised this lady got through as easily as she did. i'm not surprised she is there. i don't know that she is at the direction of the chinese government. i doubt that. a lot of independent operators in china. >> who try to curry favor. >> i think that is what happened. the deeper question is the summit with president xi and president trump. they want to get together and sign this trade deal. the chinese do not want to go to

mar-a-lago. they are saying -- >> why not? >> it looks bad. it is a golf course. they want a state dinner in washington, d.c. they want a big deal. that is very goo fmality much m americans. >> what is interesting is since mar-a-lago is a private residence/club, it is difficult to know exactly what the president does and says within the confines of that property. he's not talking just to advisers or people who have certain levels of security clearance. we know the president will go flipping from table to table, sir and goodness knows what he is saying. we saw president xi sitting with the president shortly after he took office. people could overhear conversations. what kind of concerns does that bring up for you? >> generally, i think mar-a-lago should be a place for relaxation for the president. not there for state business. >> okay.

so this woman was arrested. she was found with four cell phones. a laptop, hard drive and this thumb drive with the malware. you said you don't think this is intentionally launched by chinese intelligence or government? >> i don't know. i think it is unlikely. it is so amateur-ish. >> is this the kind of thing, though, that a chinese spy? having a thumb drive with malware. you insert that and all bets are off. >> the crazy way she approached authorities there. the story didn't hold up. >> going to the pool. >> her name was wrong. she was there for the united nations. she didn't look good. >> let's go to trade negotiations now and get your thoughts on that. listen to the president who is discussing this latest round of talks. here he is. >> the china meeting was a big success. we really negotiated probably

the two hardest points very successfully for our country and china understands. china has taken advantage of our country for 30 years. we can't do that anymore. not with me. >> is that true? has china been taking advantage of the country for the last 30 years? is the president taking the proper approach when trying to negotiate trade? >> there is something to what he is saying. no question. past administrations had gotten deals and china has not lived up to them. that is standard operating procedure. it comes down to trust. the problem is on both sides. we don't trust the chinese for not living up to their agreement. they don't trust us. they think president trump keeps changing his mind. that goes into enforcement. if they get a deal, it is hard to enforce. enforcement is based on trust. that is difficult. >> can trust be compromised by the rhetoric this president uses when talking about china? he puts it in such a negative

position. who truthfully or not. is that diplomatically speaking the best way to handle things and establish trust? >> the chinese are smart. they have been around the track. they see a guy like donald trump and they think whatever he says with a few grains of salt. they know it is tactical. they know he is pursuing a bargain. they know all that. the question is what's the deal. that's what it comes down to. >> before i let you go, i want to talk about the situation with the former vice president and potential 2020 candidate biden finds himself in. i'm sure you know him. i'm sure you watched the way he observes or the way he relates to people in crowds. the way he relates his friends and the like. how do you perceive the situation and if you were to offer any advice to the vice president. >> i have known joe for a long time. i'm a huge biden fan. he is smart.

he's intelintelligent. i think he would be a great president. i think he is caught up on the allegations. he should say i'm sorry. i apologize. i'll respect space of people from now on. i think he should apologize. >> okay. although we should say nothing has ever risen to the level of sexual harassment. nancy pelosi may have said this properly. it doesn't matter your intention. whether the vice president said i never intended. i don't think i did anything wrong that way. she said it is how the reception is. how you make people feel. >> that's true. this is more between men and women. biden will come up to me many times and put his hands on my shoulder. i like it. we're talking. if i were a woman, i think it would be different. >> well, okay. let's hope he heard you and takes the advice. senator, it is good to see you.

just three months until the fi first democratic debate. this week, tim ryan announced his dan as his candidacy. still noticeably absent from the field is former vice president biden. joins me now to discuss is former representative for the dnc. welcome. good morning. we will start with biden. he had this to say after facing allegations from women who said he had encounters with them that make them feel uncomfortable. >> i want you to know i had permission to hug lonnie. by the way, he gave me permission to touch him. >> i realize my responsibility is to not invade the space of anyone who is uncomfortable. >> sorry i didn't understand.

i'm not sorry for any of my intentions. >> your take on his apology, lauren. he was saying it was a friendly crowd. he felt comfortable. he comes out and faces the camera and does a grand mea culpa. was it appropriate? >> i don't think it is appropriate to make light of the women's feelings in regards to their allegations of improper touching. this is a conversation that as a country we are having to have and create new limits and new rules around the way we engage with women. especially women in a professional setting. he diminishes these women's feelings. i don't know it is the right move. he needs to take this seriously and offer a sincere apology. by joking about it, he creates another news cycle. >> did you hear him say? i heard him utter the words i'm sorry.

>> i think he is apologizing for not understanding social norms and acknowledges the social norms have changed. >> jess, what do you think of the vice president in that clip? >> i think what we want from the elected officials and candidates are people that are evolving. i think that his video response to this was really important. i wish it had come sooner. i think he needed to respond directly. i agree we shouldn't minimize anything that women are saying and what they are feeling. i think he is earnest in his intentions and he feels like he knows people. people feel like they know him. if he runs for president and gets out on the trail, there is a lot of opportunity to get this right. i think he will. >> okay. let's more on to stacey abrams. she will make a decision this week on whether or not to run for senator presidee or preside.
