this morning the u.s. and china appear dead lock on trade negotiations. this as president trump's top economic adviser acknowledges that american consumers end up paying for the administration's tariffs not china. the president lashes out at don mcgahn, following reports that the white house asked mcgahn to publicly state that trump didn't obstruct justice but mcgahn refused. felicity huffman heads to court today where she's expected to plead guilty to help her daughter get into college.

. good morning, everybody. it is monday, may 13th. i'm yasmin vossoughian alongside nbc news white house correspondent jeff bennett who is in more ayman mohyeldin. stock market bracing for another dumpy ride as u.s. and chinese negotiatiors are far apart on reaching a deal. over the weekend the president issued a lengthy tweet storm beginning on saturday writing in part this, i think that the china felt that they were being beaten so badly in the recent negotiation that they may as well wait around for the next election to see if they can get lucky and have a democrat win. in which case they will continue to rip off the usa. . the only problem is they know i'll win and the deal will become far worse for them if they have to be negotiated in my second term. be wise for them to act now.

then 23 hours later. we're right where we want to be with china. remember they broke the deal with us and tried to renegotiate. we'll be take in tens of billions of dollars in tariffs from china. buyers can make it themselves or buy it from nontariff countries. we'll spend the money with our great patriot farmers which is a small percentage and distribute the food to starving people in nations around the world. great. yesterday afternoon the president added the chinese quote love ripping off america. a member of the president's own administration is publicly breaking with him over the impact of tariffs. >> our country can take in $120 billion a year in tariffs paid for mostly by china not by us. a lot of people try to steer it in a different direct. it's paid largely for by china. >> but larry, that isn't true.

it's not china that pays tariffs it's the american importers, american companies that pay what in effect is a tax increase and oftentimes passes it on to u.s. consumers. >> fair enough. in fact, both sides will pay. both sides will pay in these things. of course -- >> if it's a tariff on goods coming in to the country the chinese aren't paying. >> no, but the chinese will suffer gdp losses and so forth with respect to a mr.ing export market and goods that they may need for their own -- >> i understand that. the president says china -- they may suffer queens but u.s. businesses and u.s. consumers who pay, correct >> yes, to some extent. i don't disagree with that. again, both sides will suffer on this. >> goldman sachs says the cost of trump's tariffs have fallen entirely on american businesses and households. and with a greater impact on

consumer prices than expected. and if president trump follows through on his promise it could have a hit on gdp. last year's trump's tariffs cost americans $1.4 billion per month due to substantial price increases. trump tariffs are taxes on americans. president trump is boasting that he loves collecting big taxes on americans. china has responded to the latest u.s. actions by vowing to stand its ground also but by not taking any retaliatory measures so far. china appears to be taking time to weigh its options. china cannot match the american increases dollar for dollar since it imports fewer u.s. products than exports but it has other alternatives. what china is doing is respond being rhetorically. beijing's lead negotiator said we're not flinching.

at no time will china forfeit the country's respect and no one should expect china to swallow bitter fruit. nothing is unbearable for china to safeguard its sovereignty and dignity. the the drugs administration has been pressing former white house counsel don mcgahn to get on message with the president. officials reportedly asked mcgahn twice in the past month to say he never believed that the president obstructed justice, said two people who briefed the "new york times". along with the "wall street journal" mcgahn rebuffed the requests at least one made by president trump himself through white house counsel. the "times" reports the white house made the request to mcgahn's lawyer before the mueller report was released publicly but after the justice department gave a copy to trump's lawyers in the preceding days. reading the report the president's lawyers say that mueller left out that mcgahn had told investigators he believed

the president never obstructed justice. mcgahn's lawyer reportedly had told them months earlier about his client's belief on the matter and he shared it with investigators. in a statement he said we did not perceive it as any kind of threat or is sinister. >> the mueller report investigated president trump for ten possible incidents of obstruction and don mcgahn played a role cluing trying to stop jeff sessions from recusing himself, calling mcgahn at home and directing him to fire mueller then later telling mcgahn to correct a "new york times" report in order to fire mueller. the white house has directed mcbegan not to comply with the congressional subpoena for documents. the president has said he'll try to prevent mcgahn from testifying which the house has ordered him to do by next tuesday, may 21st.

as mcgahn remains silent about potential obstruction this weekend, president trump tweeted i was not going to the fire mueller and did not fire mueller. don mcgahn had a better chance of being fired than mueller. >> special counsel robert mueller is not expected to testify on capitol hill this week as many democratic lawmakers had hoped. on friday house judiciary committee chairman jerrold nadler told reporters mueller won't appear before congress but mueller will come at some point if necessary we'll subpoena him. >> joining us here on set daniel littman. good morning to you. last weekend we heard possible may 15th date. we talked about this in the last hour, may 15th date of possible testimony from bob mueller. now we're hearing that date is no longer and we don't have a date when or if bob mueller will testify. where do we stand? >> i think as long as robert

mueller is technically an employee of the justice department he won testify. that would make trump very mad that someone who works for the government is testifying. remember bill barr said it was completely fine for mueller to testify as a private citizen. so far even though trump has said he doesn't want mueller to testify, he doesn't indicate that he's actually making any moves to stop him legally, not going to court to block this. they are just trying to -- >> why does it matter if he's still employed by the doj. we had that one moment last weekend where the president said he doesn't want mueller to testify. aside from that bill barr has said it's fine with hem and the president said it's on bill barr. why does it matter he's still elm employed by the justice department? >> you would have to ask president trump. we interviewed him on friday. and we didn't ask him about that. i think it's more -- he's wrapping up his investigation. mueller would feel more candid

if he's not working for the justice department. he wants to get one part of his life over and then he can talk to -- i think the most important thing is how good of a witness mueller will be? will he slam the president? will he stick to the four corners of his report? and democrats, of course, want him to totally throw trump under the bus and say bad things about barr, but he's a really straight and narrow guy. >> i'm sorry, jeff. >> go ahead. >> a lot of individuals i've spoken to that worked alongside mueller said this is a moment where he comes out and says i believe the president did obstruct justice because of these incidents, what we heard from bill barr himself in calling the report snitty and the report were written up by people who worked for mueller. mueller has always ridden this

line. >> most americans have not seen robert mueller speak out publicly because remember he talked to, you know, mike vacaro for one minute. but he didn't have a press conference after his report which a lot of democrats, of course, wanted. so most americans, they haven't been able to judge the credibility of mueller. so if he's on the stand and looks very good, that could be really bad news for trump although it doesn't look like this is going to lead to impeachment because there's not enough votes in senate and democrats feel like a failed impeachment effort would guarantee a presidential re-election. >> democrats i talked to said they want to hear from mueller before the end of the month. they made clear the passage of time is not on their side. the trump administration is trying to run out the clock on this and many other things. >> it's very important for democrats to get him asap. if he testifies in july people

welcome back. acstress felicity huffman is due back in court today expected to formally plead guilty for her role in the college admission scandal. she agreed to plead guilty. the desperate housewives actress admitted to paying to correct her daughter's s.a.t. answers and to commit mail fraud. she can face between four and ten months behind bars, a year's probation and $20,000 in fines. joining us is our level analyst danny cevallos. good to see you. did your wife have a good mother's day? it was her first. >> yes. we heaped gifts upon her. >> a little sarcastic about the whole thing. >> we did. >> felicity huffman has been cooperative with all of this.

she pled guilty. she expressed remorse. what's the likelihood she would get the maximum sentence. >> zero. her maximum sentence is 20 years and that's why in the federal system the statutory maximum is a terrible metric for figuring out what a defendant is actually going to get. to give you and idea her expected sentencing guide lanes is somewhere between four to ten months and even zero to six months. so the statutory maximum not a good indicator, even the sentencing guidelines have been advisory for over a decade. that means the judge will calculate them but doesn't have to stay twin guidelines. he or she can go below the guidelines. felicity huffman, maximum 20 years, still could get a probation only sentence. >> what about lori loughlin. she and her husband did not plead guilty. is that a mistake >> it's a risk.

they have to believe they a truly defensible case to go to trial. there's a trial tax in the system. you lose bonus points for accepting responsibility and cooperating. a crime that could have been a probation only sentence could result in jail or prison time if they are convicted at trial. >> for both? >> when you look at the facts of loughlin and her husband, it seems that the husband has much more problematic facts than the wife. if you look the at the history of communication with the cooperating witnesses, you mostly see loughlining copied on emails. her defense is massive ignorance and her defense may be my husband knew about this, i didn't know. >> what about the amount of money you paid when you see

felicity huffman paid $15,000 but lori loughlin half a million dollars and some paid upwards of $2 million. >> a jury can infer they knew what they were doing. this was not tuition, this was a bribe. on the defense side hey we were making donations to charitable organization. we didn't understand what was going on. we were a little ignorant. and become a grouch people that makes donations and then their children get preferential treatment. >> danny cevallos, thanks so much. let's get a check on your weather. over the weekend significant flooding issues in areas like new orleans. much of louisiana, mississippi and even portions of texas too. here are some of the aftermath and some pictures we saw. this is in the new orleans area. a power failure with the pumps. couldn't get the water out. some vehicles stalled out.

some businesses and homes did get water in them too. as we go into today, we're clearing out the south. finally getting out of this soaking wet pattern in the south and now all of our wet weather is up here in the northeast. miserable enough yesterday. temperature in the 50s. chilly rain. steady rains now developing in areas over top of baltimore. that spread up to the northeast later today and rain back here in northern indiana. here's an interesting thing about how wet it is. we just finished the wettest 12 month period we ever measured in this country. that could be part of the whole climate discussion too. added moisture in the atmosphere, more flooding events. right now we only have 2% of the united states in drought. five, ten years we were talking about constant drought. this is the lowest we ever measured since we've been doing this. a lot of rivers in flood stage. wet spring in the east. that's why we hardly have any drought conditions in the week. here's our rainey day in the

east. travel delays. steady soaking rain from philadelphia, baltimore to new york city, right during the day. this evening that goes up to areas of new england. above average temperatures in the west will be moving to the middle of the country this week. that's nice. no severe weather or heavy rain in the south so hopefully we can get those river levels down. by friday a little bit of light rain comes into areas of the mid-atlantic. not a horrible friday like the last couple of weeks. weather pattern will change as we go throughout this week we start to see the flip. by next week be prepared for hot summer-like in areas of the east. >> finally. >> you will complain about the heat by ten of next week. >> i won't do it. >> you refuse? >> i refuse. still ahead president trump comes up with a new nickname for mayor pete buttigieg but one that took some googling.

welcome back. in a recent phone interview with politico president trump compared former vice president joe biden's early success in a crowded 2020 field to his own entry in the republican campaign. trump told politico this, i look at it like my race in 2016 and

welcome back, everybody. i'm yasmin vossoughian alongside nbc news white house kroert jeff bennett. it's the bottom of the hour. the stock market is set to start the week on a low note as u.s. and chinese negotiators appear far patient in resolving a twrard. as the president continues to needle china via twitter. nbc news correspondent has more

from beijing. janice, what is the feeling in china surrounding all of this? >> reporter: 11 rounds of talks and things have ground to a halt. today president trump is expected to give instructions to start the process to have tariffs on all chinese goods. beijing has already said it will retaliate. it hasn't said how. it has a number of options before it. there's every expectation they will follow through on them. farmers and farm exports are likely to be first target because they know it can cause some political pain for president trump as well. while president trump is saying that it will be china that will bear the brunt of the trade war his top economic adviser larry kudlow suggested on fox news yesterday that both sides will pay the price. for americans that means paying more for everything, luggage, sporting equipment, food and seafood. and officials here are saying that there can be no agreement until all tariffs are cancelled.

the sticking point appears to be subsidies. the u.s. has a problem with the way that china will give grants and cheap loans to chinese companies. the u.s. says that this muddies competition. but china is saying it's not going to let any foreign country tell it to change its laws. thank you. let's turn to one of china's allies north korea. president trump is down playing the dprk's latest ballistic missile test. despite his claim from february that kim jong-un promised him there would be no more tests of any kind, north korea conducted two series of tests in the past week and a half and three in the past month. regarding last week's launches, trump says in an interview with politico quote they were short range and i don't consider that a breach of trust. these were short range missiles and very standard stuff. very standard. multiple outlets reported experts who analyzed photos from

north korea state media said it's clear the test was of new solid fuel missiles, modeled on an advance russia system. donald trump's personal lawyer, rudy giuliani, has cancelled a trip to the ukraine in which he planned to urge the country's incoming president to pursue investigations that he sees as helpful to president trump's re-election. now one of those cases involves former vice president joe biden whom giuliani accuses of thwarting an investigation into a company his son did business with. when reports of the "times" showed biden was part of a western coalition to remove a corrupt prosecutor whose office had chosen not prosecute the company tied to biden's son. nevertheless giuliani made his accusations againsted by enclaiming an even wider conspiracy. >> i'm not going to go to the ukraine. >> you're not going to go? >> i'm not going to go because i

think i'm walking into a group of people that are enemies of the president, in some cases enemies of the united states. i'm convinced from what i've heard from two people tonight that people are surrounded by people who are enemies of the president and people who are in one case clearly corrupt and involved in this scheme and it's really a shame. the reality is this has nothing to do with the election of 2020. the election of 2020 is a long time from now. if i want to meddle in that election which i don't i could have held this for a year and dropped it right before the convention. >> in an interview with politico on a friday afternoon president trump said he's thinking about whether to ask attorney general bill barr to investigate biden. certainly it's a very big issue. >> less than a week after treasury secretary steve mnuchkin said he wouldn't hand over president trump's tax returns the house ways and means committee issued a formal subpoena for the documents. the escalating fight for trump's

tax returns could test the balance of power between the white house and congress, especially considering trump's vow to fight all subpoenas from house democrats. last monday secretary mnuchkin rejected the committee's request to turn over the documents arguing that it lacked a legitimate legislative purpose. president trump weighed in on twitter over the weekend writing i won 2016 election partially based on no tax returns while i'm under audit i still am. voters didn't care. now the radical left democrats want to genre litigate this matter, make patient of the 2020 election. house ways and means chairman has given the treasury department and irs until 5:00 p.m. this friday to comply with the subpoena. >> democrats in the house have taken the first step to hold a sitting president accountable for crimes they have may have committed. jerrold nadler along with two other congressmen introduced an act on friday pade pause the statute of limitations for i had

federal offense committed by a sitting president. it's an attempt to make sure presidents don't become immune to criminal charges all together because they can't be indicted in office. the justice department has previous decided that a sitting president is immune from criminal prosecution. >> joining us here on set is daniel littman. good morning. >> so how will this bill go over in a divided congress, do you think? >> i don't see much chance of it getting passed in the senate, obviously, because senate republicans do not want, to you know, get on the bad side of president trump. also many democrats might think that do we really want to press charges against president trump after he's out of office? that would put pressure on whoever is president then to pardon him, like after nixon type situation to avoid tearing the country apart. the fact that trump is not

president any more do we really want to make sure he goes away for life? will that solve the concerns of trump voters about their daily lives? probably not. >> is this a bit of political theater. >> demonstrate don't want trump to agree with it. they disagree with that justice department policy about whether a sitting president should go to jail. or should get charged. but also we should remember that trump could face some potential criminal liability from new york state prosecutors, so he's not out of the woods yet. >> you had quite an interview on friday with the president. >> my first interview with the president. >> how do you feel it went? >> i thought it went great. we made a lot of news. you got to see a side of the president who most joufrnalists don't get to see. knees how to flatter journalists. he makes news. you can see his personality shine through where we asked

collar voters. biden is working on the middle ground approach which will most likely face opposition from green activists. his plan will include the u.s. rejoining fairs climate agreement and preserving regulations on emissions and fuel efficiency. the second source said the policy could also be supportive of nuclear energy and fossil fuel options like natural gas. congresswoman alexandria occasio-cortez responded to biden's potential climate plan writing this. this is a deal maker. there's no middle ground. a spokeman for bidden's campaign declined to comment but said the former vp takes climate change seriously and has called it a threat. let's get a check on your weather now with nbc meteorologist bill karins. >> good morning. i hope you had a wonderful mother's day yesterday. i know the weather didn't cooperate. >> it didn't cooperate but a good day nonetheless.

>> unfortunately in dreary weather. some rain now beginning to pop-up over the top of philadelphia and southern new jersey. still lingering rain back here in the ohio valley. one or two days before we get rid of this mess. steadiest rains today will be found in the i-95 corridor. this is 7:00 a.m. then we watch the rain blossom here eastern pennsylvania, washington, d.c., philadelphia, new york city by noon. by 6:00 p.m. pouring rain through southern new england. overnight tonight the blue on this map, that's snow. it's going to get about three to six inches of snow above 2,000 feet in higher elevations in the white and green mountains of northern new england. very cold weather pattern. as far as the airports go today, i don't think we'll get a lot of cancellations but definitely delay. not too rainey. but low visibility will cause delays. new york city airport, philadelphia, d.c. airports early this morning and maybe later this afternoon to this evening in boston. driving will be the same thing.

wet roadways will cause some slow downs but not too many cancellations. here's that snowfall map. it snowed over the weekend in the berkshires in areas of western mass. tonight mountains of western new hampshire, maine, eight inches in the higher peaks. very cold unusual air mass. no surprise that temperatures are about 10 to 20 degrees colder than they should be. only 53 in new york today. cleveland at 51. that's it. even areas of kentucky, that's chilly with only 64. gets a little better in some spots tomorrow. 64 in d.c. still very raw. ugly day in boston tomorrow. by the end of this week is when things finally start to turn. d.c. goes back up to the 70s. areas of the midwest go almost into the 80s. it's coming. but this will be one of the coldest, rawest beginning part of the week until november. >> you asked how my mother's day was and how we fared with the weather. this was yesterday morning.

welcome back. u.s. stocks are facing a rough start to the new trading week later this morning as markets don't watch for developments in the ongoing u.s.-chi china trad war. d dow futures are down. what can investors expect to see this morning? >> reporter: if you look what's happened in asia where markets are closing almost all of them down. here in europe they are all lower. you can imagine that occasion you're g -- indication you're getting will happen in new york. some good news on the oil front. they had a rough week last week because of reduced trade and u.s. and china didn't reach a deal and those new tariffs kicked in on $200 billion of chinese goods. over the weekend there was an

a pitch on this? >> they're going all in and appealing to his ego. the top advocate for corporate america, the u.s. chamber of commerce, thought it was develop telling. they used to have signs out of front of their building that were advocating for dreamers. they've replace those with a sign that compares donald trump to eisenhower and reagan with respect to infrastructure. they're trying to get this idea in the president's head that he can be these historic president similar to eisenhower. the big sticking point is how you pay for this. the president has shown no willingness in the current talks to raise taxes and himself team are looking for spending cuts. that's going to be the major sticking point. democrats want a list of tax hikes. >> we know a group of swing voters in iowa may be the key to a trump viktry in 2020.
