my thanks to you for watching. th that does it for us. mtp daily with chuck todd starts now. if it's tuesday, house democrats ratchet up their fight against the president. so do senate republicans. they are gearing up for a fight potentially to block his tariffs on mexico. despite the president's warning that they would be foolish to try to stop him. plus amid all the talk of impeachment on the left, the white house decides to stone wall congress yet again.

if it's tuesday, it's meet the press daily. welcome. i'm chuck todd. i'm here in dallas. we begin with a brewing reb rebellion facing the president as a growing number of senate republicans, including two from this state, signal they may block the president's sweeping new tariffs against mexico. the number of senate republicans publicly breaking with the president is growing despite this warning from him today in london. >> what do you think of republicans who say that they may take action to block you imposing those tariffs? >> i don't think they will do that. i think if they do, it's foolish. there's nothing more important than borders. i've had tremendous republican support. i have a 90%, 94% approve railirail i -- approval rating in the republican party. >> we should quickly note, we

tried to find a poll with that 94%, we couldn't find it. we have it between 85 and 90%. that's fine. which makes what happened on capitol hill so remarkable. after the president put up that red light, that warning, a number of senate republicans blew right through it. >> well, there is not much support in my conference for tariffs. that's for sure. >> i think it's a mistake. >> we may have enough to override a veto on this. >> have you discussed a revolution? >> i've discussed it in several ways. >> our members have a lot of concerns. they are very concerned about it. >> senate republicans met with white house lawyers today about the legal basis for imposing these tariffs and it did not go well. here is what apparently happened according to a new report out of the new york times. quote, i want you to tyke a message back to the white house texas senator ted cruz said. he told the white house attorneys, quote, you didn't hear a single yes from the republican conference. his fellow texan said we're

holding a gun to our own heads, according to this report. nbc news has learned a lot more about what went down in that meeting. we're going to go to capitol hill for a moment. will republicans have the stomach to actually take their rhetoric and actually pick this fight against the president? we don't that know that for sur. on the one hand republican voters might rally against the president if there's an economic shock caused by these tariffs. on the other, republican voters might rally around the president if it looks like congress is under mi undermining him on immigration. republicans responded with a warning of their own. they don't want to fight him but they will if they think it's politically smart. let's bring in some experts on this topic. a terrific weekend with the

different facets. let me start with you. i know you've been doing some reporting out of that meeting as well. is ted cruz right? not a single senate republican told the white house, we're with you. >> reporter: chuck, that's exactly what my sources are saying. i'm told that more than has a dozen republicans stoods up to speak in this meeting where there's two white house lawyers coming to brief them and not a single one of them said this is something that republicans could support. they said this is a bridge too far. there were a lot of concerns that were raised. they questioned the legality. they questioned the stutute that the president will use for this new national emergency saying it hasn't been used in 40 years.

ron johnson stood up and said it's going to be extremely embarrassing for the white house if you go forward with this and the congress can override potential presidential veto. they offered tremendous warning signs to these white house officials saying don't mover forward with this. chuck. >> i do want to play what mitch mccon nenel said. >> if president imposes the tariffs, will you try to block them? >> we're hoping that doesn't happen. we appreciated the opportunity. we spent almost our entire lunch talking to representatives in the white house about this issue. i know the mexican delegation is here. apparently these talks are going well. i think our hope is that the tariffs will be avoided. >> matthew, i throw it to you on this one because this feels like

this is an issue that actual glactually gets at the heart of the divide of the republican party that donald trump is trying to build and the republican party that mitch mcconnell and a carl rove built over the last ten years. this seems to be one of those issues that gets at this divide. >> absolutely. trade and immigration are the two key issues that are separating the republican establishment from the nationalist trump conservatives. i would say a lot of trump supporters, including members of his own administration like trade representative lighthouser were taken aback and opposed to the plan for unilateral tariffs on all mexican goods, ratcheting up to 25% over the course of the summer. republicans are desperately hoping that somehow an accommodation can be reached between the trump administration and mexican delegation in order to prevent the tariffs from taking place next week.

>> there's also an art to how do you -- it's been interesting over the last 48 hours to watch republicans walk this line in the senate on the issue, i think they wish they could support the president on the wall and oppose the president on tariffs. here is rod portman. i support what he's doing in ter terms of border security. i support the need for com comprehensive border security, this isn't the right path. chuck grassley. i support nearly every one of his immigration policies but this isn't one of them. a blanket tax increase on everything americans purchase from mexico is the wrong remedy. is that smart politics by these republicans or does that send a message to trump that he can roll them? >> i think republicans are eagerly hoping this will go away

and they do not have to confront this. they are hoping president trump can be dissuaded from this. it's a very different thing for republican senators to express agreement with the president versus for them to have to cast a vote that confronts him and blocks him on a major priority. they do not like confrontation with the president. i go back to the national emergency declaration where the republicans said that posed it and warned him and warned him. when push came to shove, they voted with him to sustain that veto. the question for me is how serious is president trump on this? one republican senator i spoke to, john kennedy of louisiana, said the president is deadly serious about it. he said he's as serious as four strokes and a heart attack on this. if the president goes there, this will push republicans to a pretty serious place. >> if you're advising the democratic leadership in the house, do you call the senate

republicans bluff and go for this disapproval? >> i think there's a few things happening here. i think they should push for disapproval. what i would say is what's fascinating about this whole debate is, it's essentially republicans who are amplifying democratic talking points. they have been saying that tariffs are a tax increase. you see pat tumey, a range of senators saying this is a ftax increase. it will wipe out the gains to the middle class and working class people. if you think about the only thing that is really passed has been a tax cut which is being wiped out for most people by these possible tariffs. i imagine that they are really hoping by beating their chest, republicans will dissuade the president from issuing these and there will be some sort of face saving mechanism with the mexicans but i think this is

really an opportunity for democrats to make the point that trump his policies have been hurting working class americans all throughout our country. the senatorers are making the argument this is a tax increase is making the democratic argument that trump is bad for working class people when it comes to tariffs. >> while i can see a potential veto proof majority in the senate with enough senate republicans joining senate democrats. explain to me where it is in the house are rp the hou. >> reporter: the house is a little more tricky on one side. on the democratic side, they control and the house speaker nan scy pelosi told me this morning that not only is this a bad policy but it also complicated the new nafta. there's negotiations going on

between the white house and the congress on the usmca. she said there was progress. republicans in the senate also have the same stance on this. they're saying we don't like tariffs as it is. now you're trying to put tariffs on an unrelated issue. this is going to be bad for the committee a economy and you could blow up the trade deal. his two biggest campaign issues are trade and immigration and now he's completely intertwined them and it's really unclear hold up he ghow he gets out of this and succeeds on one point. >> i believe that nafta 2.0,

this isn't a popular trade deal on the left or the right. nobody wants to own it so any little thing can blow it up. >> many have found their way to supporting it. they are strongly supportive of that. it's not a massive difference from nafta. it's a few things here and there that the president can tweak and rebrand as his own deal and say he fulfilled a campaign promise. they are using this as leverage. this new tariff threat to mexico as a way to tell the president they will not considerate fiing the new trade deal if he goes there and it could complicate it in all sorts of ways. we know that immigration is an issue that president trump is willing to scorch the earth for. he fought for his muslim ban. he proposed shutting down the

entire u.s.-mexico coborder for while and then backed off. he got an enormous amount of push back and backed off. he's willing to do what it takes. >> all right. i want to split this in two arguments. first matthew, on the right here, explain to me, can john cornyn spread the needle without looking like he's against the president? is that possible or does this political environment make it impossible to thread that needle? >> i think it is possible because he's the senator for texas. mexico has emerged in recent months as our largest trading partner. to slap these tariffs on every product and ratchet them up will have real economic impact. trump can argue a combination of

overall economy and maybe a fed cut in the summer will lessen the impact in america but the problem is the impact on mexico just like tariffs on china are really have a kind of boomerang effect on our own supply chain. that worries a lot of reps a republicans and should worry trump. a recession would prove lethal to his hopes. >> do you think he's saber rattling a bit on tariffs to encourage the fed to lower rates? >> i think that may be part of his calculation. the comments from jerome powell let the possibility of cut rally the markets. the supply explains in mexico and china could have effects that can't be calculated right now. >> are democrats that excited

a about the new nafta? how precarious is support for the new nafta? >> i think there's a fair amount of criticism of the new nafta as not sufficient on labor standards. i think there's been a fair amount of conversation between the white house and democrats to strengthen some of the standards. i think there's a big interest in hurry of pushing it forward. the real problem for donald trump is he could be a three time loser. he's giving democrats an excuse to push the ball forward. push the ball down the field. the argument will be it's in presidential politics. he is giving them that. at the same time tariffs are a problem for the economy. we see lots of data points about how the economy is maybe slowing

ordering people to do just that. the white house is instructing former administration officials hope hicks and annie donaldson not to turn over any documents to congress to find the house sjudiciary subpoena. the democrats announce the full house will vote to hold bill barr and don mcgahn in contempt. that's just one of the contempt votes pending against barr in the house. we'll have more on the other one later. that has to do with the census story. today texas congressman lloyd dogett became the 58th democrat to call for the opening of an impeachment hearing. they are urging members to stay the course. >> we don't work for donald trump. we work for the american people. we need to serve as a check and balance on an out of control and increasingly lawless administration. we're going to find a pathway to do that consistent with the

principal th principle that no single individual is above the law. that is the united principle in terms of how we will move forward. >> joining me now is a member of the house democrat leadership. it's new mexico congressman. i've got a bit of a satellite delay. unless you're going to change your mind here. up until today you've stayed with the message of most of the top leadership saying not yet on impeachment? a, are you still there and if you are, what is your trigger? what are you waiting for to make that decision? >> well, chuck, you're absolutely correct. i stand with speaker pelosi and in the words that were shared by our great chairman jeffreys, next week we'll be voting to hold not only attorney general

barr but mr. mcgahn in contempt. there's also other folks that may be held in contempt if they do not cooperate and work with the congress. no one is above the law. neither is the president. it's also important that we continue these investigations to get to the bottom of the facts and present them to the congress and the american people and again, i would just encourage every one to read the special counsel i counsel's report. read the mueller report. let's make sure we are using every tool in the tool box that we are insuring that we will continue to develop the strongest case possible to present the facts to the american people and to congress. >> it sounded like with your plea to get the american people to read the mueller report and go ahead and correct me, here is how i sbrinterpreted what you s. read the mueller report and you'll agree with us there's an impeachable offense. sounds like you don't have the will of the country behind you

on that? >> i think it's important for people across the country to read the special counsel's report so they understand the severity and the importance and urgency of investigating to everything that we are doing as well, chuck. that's the reason i'm encouraging people across the country, across new mexico and in my district to also read the report. it's critically important we all do it as a country. we're all on the same page when it comes the our constitutional responsibility and oversight to making sure we're investigating not everything included in the report but the concerns with the financial ties to russia, the documents that's been requested from deutsche bank, including the president's tax returns that have been requested. we want to make sure we get the documents and we get to the bottom after all of these concerns that we all have. >> what is a contempt vote do, realistically? i feel like these are empty penalties. kind of empty gestures.

>> i would disagree with that. this is holding people accountable with the tools that we have as the legislative branch of government. no one is above the law. >> how does this change bill barr's life? how does this change his behavior? >> i'm hoping that mr. bill barr as the attorney general for the united states of america would understand that he has a responsibility to work with the co-equal branch of government, the legislative branch of government. this is one tool we have with the contempt vote. i'm open the finding these vinls and ma -- individuals and make sure we pursue everything we have. >> kwhawhat's your case against starting an impeachment inquiry? >> we have several ongoing investigations. invest gags that are continuing to gather evidence. we have a few wins in course recently as well. i think the work and the ideas that have been laid out not just by the chairman of the judiciary

committee but by speaker pelosi have been at work. we're continuing to see how we're able to uncover answers to questions and present them not just to members of congress but to the american people. an inquiry into impeachment is one of those tools. i want to exhaust every tool that we have as we lead up to the consideration to what could be an inquiry into impeachment. i'm just not there yet. >> it's interesting. we've had some members of congress describe opening and impeachment inquiry as the ultimate political act and some say we can't let it look like a political decision if we open an impeachment inquiry. is there any way to avoid it looking political no matter what decision you make at this point? >> look, i don't believe this is political. this is about carrying out constitutional responsibilities as members of congress, as the legislative branch of

government. as a country we understand the urgency of carrying out this oversight responsibility. >> do you believe -- it seems as if speaker pelosi believes unless there's votes in the senate from republicans, to vote him out of office, you shouldn't bother with impeachment. that feels like a very political analysis. a political decision. do you not believe that if you did this, that the record itself, the case itself couldn't convince people? >> it's guided by the constitution of what we must do for the good of the american people.

it's the allegations into the sabotage that we have seen with the affordable care act. the are not cooperating with any subpoenas. they are not cooperating in any form or fashion. that's why we must carry out these constitutional responsibilities to the best of our ability. in the case of looking into donald trump is we have to get to the bottom of every one of these questions. every one of our committees have jurisdiction and have the ability to get answers to these questions. that's what we must do for the american people, chuck. >> why is john dean testifying before robert mueller and why john dean testifying at all but let alone before robert mueller? is that something that helps you get to the bottom of this. a white house council from the

'70s? >> i think many of our chairs have put together parameters with what they believe are strong oversight responsibilities in how we carry out these investigations. i have faith in jerry nadler and adam schiff and maxine waters and elijah cummings. it'si voted them to be the leaders of those committees. ? you're not worried that the john dean thing looks like the democrats are looking for a television spectacle? >> i do not believe the democrats arie looking for any television spectacle. we're getting answers for the american people. that has to be job number one.

welcome back. tonight in 2020 vision we're just about three weeks away from what will be the first major deciding moment in the 2020 race, at least the first hurdle. the first democratic presidential primary debate. two new national polls make it pretty clear that at least until the debate, the democratic race is probably in a bit of a holding pattern. a new poll out from cnn has joe biden on top leading bernie sanders by double digits. followed by kamala harris and e lhis -- elizabeth warren. everybody else is at or below 1%. a poll out today, this one is

exercise our responsibility under the constitution. that number is growing. >> welcome back. the number of house democrats in support of beginning an impeachment inquiry is up to 58. as you just heard a moment ago, they don't want to seem know about what to do. they don't know what to do about this increasing call for impeachment. let's bring back the panel. you can just hear it in the sort of response trying so hard not to talk impeachment to try to show they are not obsessed and they can do other things. are they -- is he still reflecting a majority of his caucus? >> i think he's reflecting the fear of the critical mass of the caucus. i don't know that it's the majority. there are plenty of members who

don't want to go down this road. i was in san francisco over the weekend for the california democratic convention and saw for the first time democrat candidates like kamala harris and cory booker use calls for impeachment as an applause line. this gets voters riled up. we saw a new poll that showed three outimpeachment. this train is getting very fast. it's getting tougher to say no and make a substantive case for why he shouldn't be impeached. >> with the president candidates using it as , at least some of them, but most of the other ones are starting to shift into calling for impeachment on probably because they realize biden isn't. there may be some of that. is this becoming the a point

where the base of the party will push the house leadership into this whether they like it or not? >> i mean it feels like we have been having this conversation for months. democrats are increasingly angry about the president's stone walling of any oversight. very legitimate anger at the president thumbing his nose at house democrats and their ability to do any oversight at all. on the other side of this, is nancy pelosi spine and her interest in defending her most marginal districts. the people who won the house. i think that's the conversations that are taking place every day in halls of congress which is a lot of democrats.

i don't think they are at 218 for impeachment yet. i think that is a really important issue which is why her argument is why go down an inquiry if we're not going to go to get to 218 or we don't know. the other side of that is the president seems to be basically doing everything in his power stop the element of their job which is to have some accountability over the president. he's basically pushing this caucus towards supporting at greater levels impeachment. i think the real issue, and this is my view. i think mueller should testify. i think most americans would like to see the prosecutor make the case and i think that will be a determinative aspect of the fork in the road of whether impei

impeachment gains support or not. >> i get the sense from trump world if democrats are going to continue to sort of have whiplash over this issue, that's the preferable political spot they want democrats to be. that they love the indecision. in some ways the indecision is the easiest thing for them to pick at politically. it does seem as if the trump white house is not afraid of itch peachment. they are touching the stove. is there risk there? >> there's certainly risk. starting an impeachment inquiry can lead to all sorts of things. we look tot the clinton impeachment in 1998 and we see the republicans were hurt in the midterms in 1998. i think pelosi is extrapolating from that. whose to say history will be repeated? i think what the trump administead administration understands is

the democratic base is enthused about impeachment. if pelosi gives in to the calls for impeachment, then the republican base will start getting very excited as well. i think democrats look to that huge enthusiasm advantage they had in 2018. they want to complete threpeat 2020. you'll have a lot of reps supportive of the president and some independent who is oppose impeachment saying why dild we vote for the democratic house and all we got was an impeachment vote that doesn't lead to anything in the senate. >> i totally hear about the clinton experience. i was in the white house during that process. this is a very different time. bill clinton was very popular. the republicans were rushing to

impeachment. i think it's a very different thing p after mueller testifies, i do think you may have a situation where you get close to a majority for impeachment because he has moved public opinion. >> the democrats keep voting on contempt. what does contempt mean anymore to the public? >> i think it's a way for the democrats to blow off some stem. it's an outlet. it's an out justice of the peace let for democrats who feel the need to do something. >> it's meaningless. >> it's speciessentially meanin. there are democrats in the house who believe a contempt vote against william barr, the attorney general could strengthen their hand in court to get legal documents to continue their investigation which is what they plan on doing

welcome back. house democrats are moving to have wilbur ross and william barr in contempt again. this time related to the decision to ask about citizenship on the 2020 census. last week we told you about newly discovered evidence from a dead man's hard drive that appears to show that the trump administration's push to ask about citizenship on the 2020 census was really about increasing the pow of white republican voters in during the

process. that evidence directly contradicts what the trump administration has said under oath. elijah cummings is accusing the administration of a cover-up. the supreme court could rule any day now whether to allow the citizenship question to the census. the aclu notified the court of this evidence last week. this was evidence they didn't have when they first argued this case. that it is not clear whether the high court will consider the evidence before making its decision. i want to bring in the director of the aclu voting project and he voted against adding the question before the supreme court in april. he joins me now. a simple question. you got new evidence. you had your opportunity to say your peace. you don't have it. what happens if the supreme court agrees the justice department today which said hey, this is just trying to, they shouldn't need it. this evidence is frivolous, et cetera. if the court won't view this evidence in deciding this

decision. what do you do next? >> well, right now this evidence is not in the formal record before the supreme court. i think it would be a mistake for courts to, for the supreme court to pass judgment on what has happened before the truth comes out. we have a revelation that the administration's purpose in adding a citizenship question was not as it has been saying to enforce the voting rights act. but rather to reduce the political clout of minority communities. and we need to get to the bottom of what has happened here, i think, rather quickly. >> by the way, let me ask you on the merits on this. there was a study that said it would undercount by as much as $4 million is there any middle ground where it is an optional question to ask or there's no

penalty for saying you're not? is there any middle ground that makes this a feasible idea at all? >> i don't think so. you are required to respond to the census and you're required to answer all questions accurately and completely. so the issue before the court really is whether or not this question can lawfully be a part of the census. up until now, the legal argument has been a pretty technical dry question about whether or not the administration has followed proper procedures under the administrative procedures act. but i think right now, in light of this new evidence, it is time that we all just got real. i don't think there's a single person watching the show who thinks the administration is going through all of this trouble. is big to spend tens of millions to change the once in a decade sentence. go all the way to the supreme court so they can enforce the voting rights act. what we now have are the receipts that show their goal was in fact the opposite. to undermine the political power

of minority communities. >> i hear you on this. do you accept the justice department's argument that because this evidence might not have been allowed in a trial, it would have been seen as hearsay? >> i don't think so. what we have at this point already demonstrated is that at least two trump administration officials testified untruthfully. you have the acting head of the civil rights division saying he was the author of the department of justice's request to add a citizenship question of the census. we know that is not true. it was a man named mark newman who has been described as trusted adviser to wilbur ross who has oversight of the census. mr. newman testified that he got the idea for a citizenship question from thomas hoffler and he said that adding the question would maximize hispanic voting rights. we now frng dr. hoffler's files that he concluded exactly the

opposite. he wanted to add a citizenship question because would it in his words be ativdvantageous for republicans and nonhispanic whites. that evidence is now clear. these witnesses have made misrepresentations to the district court. we have a hearing tomorrow to try to get to the bottom of what happened. and that's really what we need to do here first. let's let the truth come out. once we establish what the truth is, we'll take it from there as to what if anything needs to happen to the actual record in this case. >> is there an avenue via congress that you can go if the supreme court upholds the trump administration's ability to add this question? >> congress has a hard time right now passing legislation on almost anything. we've had a hard time just paying our bills as a government. i think the notion congress had take action on this. i would love to see it happen but i'm not holding my breath. >> he argued this case in front
