continuing, but escalating on four young minority female members of congress, calling them unamerican and anti-american and continuing to suggest they should leave the country and leave the united states and go back to where they came from, even though they are all proud american citizens and duly elected citizens of congress. within the last hour, the president upped the ante dramatically at an all white rally he held in greenville, north carolina. even though greenville, north carolina is about a third african-american by population. this is an all white or almost all white rally that the president is holding. at the rally tonight, he continued pressing attacks on these young minority congress women, attacks he is so delighted as racist attacks, tonight he escalated and this is what he whipped up in that

every word because our moral fiber will be shredded if we let this go without protesting? the president today in an interview expressed satisfaction with how his go back to your country racist attacks are playing. in an interview with the conservative tabloid, the president excitedly recounted the accusations of racial an muss flying between factions of the house democratic caucus and his own role in stoking the fire that ultimately resulted in democrats' vote to rebuke him last night in congress for his racist remarks. he expressed delight. he excitedly recounted that. that makes it seem like okay, maybe this is not an organic spontaneous thing. this at least makes it seem like this is deliberate from the white house. the president likes to do this. he will keep pushing it. maybe this is just what the donald trump reelection strategy looks like. find something racist to say or

do that stokes outrage and stoke it every way you can, hope that it engenders a response that calls out an actual rebuke of the president which then keeps it going longer for him and gives him another lily pad to jump from which he can further escalate from which he can further escalate. you do all white rallies between now and november 2020 and it will be alternating to lock her up and send her back and whatever comes up next. but if this iteration of racist demagoguery from the president is being done deliberately and right now because he is trying to distract from something else in the news, not just because he likes doing this now and this is how he is running for reelection and make us not pay attention to somebody else, that's not an unprecedented thing. that's on brand. he does this a lot. less than two months into his

presidency when news coverage snowballed about undisclosed meetings that trump's attorney general and others in his administration had had with russian officials during the campaign, that they had lied about and kept secret and the news snowballed, the president launched the infamous and debunked allegation that president barack obama had wire tabbed him in trump tower. boom. news cycle hijacked. he bragged at an event about what a rocket that was for him when he made that up. that diverted everyone. it was great. he lamented he was not able to send off rockets like that. he can't quite manage the same interaction and outrage as he could in the early days, but boy, those were the days. another one when his lawyer, michael cohen was about to give explosive public testimony to congress. at the time that happened, the president was in vietnam where

he nevertheless embarked on an epiiment tweet storm that the democrats had just voted to execute babies at birth. that was what he thought would be a better topic of discussion than michael cohen's testimony. when they scheduled this rally tonight with the all white crowd yelling send her back when they scheduled this rally for tonight. this was going to be the day that robert mueller was scheduled to give public testimony to congress. as soon as mueller got in his testimony. the president would be in place immediately afterwards at a big rally live on fox news to say whatever he thought was outrageous enough to bring the attention back to himself and tilt the news cycle back. now that robert mueller's testimony is not happening until next wednesday, we are all betting tacos on the fact that they will have reason to schedule another rally for the

actual day of mueller's testimony. we shall see. we know he cranks up the outrage and the crazy for distraction purposes when he thinks there is something they need distracting from. here's the thing tonight. there are two really good candidates for what might be freaking the president out right now. for what might be causing these radical distraction efforts. there are two candidates for what might be driving that panicked reaction and what he doesn't want people to pay attention to. both of those things are actually going to unspool within 30 minutes of each other tomorrow morning in the same building. in the federal courthouse in lower manhattan. one of them is going to happen tomorrow at 11:30 a.m. when we will find out whether the pedophile, jeffrey epstein, is going to be granted bail. he awaits trial on federal charges of sex trafficking girls

as young as 14 years old. he could be bailed out or he could be staying in jail while he awaits that trial. the judge is going to announce his decision on that matter at 11:30 a.m. tomorrow. federal prosecutors in the southern district of new york made the case to the judge that epstein should not be granted bail because he poses an extreme flight risk because of his memes and his motive to flee the country and flee prosecution. in terms of motive, he is looking at spending the rest of his life in jail. 45 years in prison if he got the maximum sentence. that's motive enough. in terms of his means and ability to flee, he has at least one home abroad and his own private island in the u.s. virgin islands and access to two private jets and prosecutors said records indicate he has $110 million sitting in one bank

account alone. on top of that, fbi agents found a that contained a expired foreign passport with his picture on it and somebody else's name. he had the wherewithal to get a fake passport from another country and tens of thousands of dollars in cash. he also had a pile of four dozen diamonds which in addition being a cartoon villain to find in someone's safe, it's a very efficient way to carry easily ickifiable wealth. a pocket full of diamonds is easier to go on the land with than multiple duffle bags worth of $100 bills. he is accused of wiring large sums of money to witnesses to keep them quiet. witness tampering is one of the things that judges are often

worried enough about that it weighs heavily on a bail decision in terms of whether somebody should be in jail awaiting trial or can be at liberty. if what they are going to do is tamper with witnesses, that can so interference with a fair trial that judges don't look kindly on. you put all of that together and the very serious crimes he is charged with that bring with them a presumption that a defendant for these crimes should not be let out on bail. you put all that together and it seec seems likely that jeffrey epstein is not getting out. he will remain locked up awaiting his trial. it is possible as of tomorrow, jeffrey epstein is going to realize he's maybe never going to see the outside world again. he's not going to see it between now and the trial and he may be sentenced to up to 45 years in prison. he would be, what, 100?

as he realizes that tomorrow when that judge probably tells him no, you are not getting out, jeffrey epstein may be more motivated than ever in his life to try to change the circumstances of this case, to try to change the relationship he has with prosecutors. if he has anything to tell prosecutors about anyone else that could make an important case for them, tomorrow morning is the time when jeffrey epstein may be more motivated than at any other time in his life to tell prosecutors that information and provide to them whatever it is he can provide about anybody else who may have been involved in these crimes. tomorrow morning. the epstein case has been a lurid and nauseating case. it is made more lurid by the fact that he has ties to the president of the united states. they are well-known, but more

about them is coming out every day, including tape un-earthed by msnbc that you might have seen. that's the president and jeffrey epstein socializing. at a party with a crowd of young women at trump's mar a lago club in the early 90s. you may have seen that footage on msnbc this morning. we will add with more footage, including an interview with donald trump that accompanied that footage when first air and the interview i will warn you may curl your hair a little bit. you have the tape that you most likely have not seen. the epstein thing is happening tomorrow. we don't know how unsettled the president is about his relationship with epstein and what may emerge from the case, especially as that continues to attract more cooperating witnesses and more victims and more people talking about their time with epstein in the initial non-prosecution agreement that

he benefitted with in florida. part of that non-prosecution agreement signed off on by alex acosta who lost his job because of the epstein scandal. one of the elements is that federal prosecutors would not go after alleged coconspiritors of epstein. this is a different prosecution now. they are not bound by that agreement if there are other people who were aware of or involved in or doing things adjacent to epstein's crimes that would be of interest to prosecutors, the president's long relationship with epstein may be weighing on his mind. so, bail announcement about epstein tomorrow at 11:30. 30 minutes before the bail announcement, something else is coming in that same building. and the judge in that case also in the federal courthouse in lower manhattan tomorrow morning is basically telling the whole country to brace ourselves for

what he is about to get out at 11:00 a.m. tomorrow. in april the president's long time lawyer, michael cohen had the fbi search his house and safe deposit box and cell phones and electronic communications. the material seized in that raid eventually became the indictment to which michael cohen pled guilty. to crimes included two campaign finance felonies in which cohen admitted to setting up a quarter million dollars in payments to two women to stop them from going public with claim thas had affairs with then candidate donald trump. those payments by definition were intended to help trump's campaign by keeping the women quiet ahead of the elections. the payments were not disclosed for payments designed to help the campaign. you can't spend that money to benefit a campaign and not disclose it. there are rules governing what

you can spend on a campaign and who you have to tell. the campaign finance felonies is why he is serving a several year sentence right now. now, after michael cohen got raided and pled guilty. news organizations went to court in new york in new york federal court to ask the judge to unseem the search warrants for the raids on him and the fbi's affidavits about what they found when they executed the search warrants. the motion by the news organizations was basically by the court should release the evidence that was collected in the cohen case now that he plead guilty and was going to jail. the judge in the case last spring ruled that yes, that material could mostly be unsealed. the judge in the cohen case ruled there was still material in the cohen stuff that pertained to ongoing open

investigations. that stuff would have to be held back, but he did release other material. here's what it looked like in practice. lots of stuff about cohen's tax evasion and scams and more material than you ever might want to know about michael cohen's own financial situation and whether or not he was honest with his banks. when it came to the finance felonies that he plead to, that was blacked out. that was a leading. the illegal campaign contribution scheme. here's the section that explains that. after that, there are 20 fully redacted pages. tomorrow morning at 11:00 a.m., all of those black boxes will go away and this stuff is released. that's fascinating because michael cohen is already in jail for the felonies and there have been lots of not just question marks, but question marks with exclamation marks after them. why is he the only person who

got in trouble for the felonies. we are committed for the sole purpose of benefiting trump's campaign. there was the media company and the "national enquirer" that was involved in conducting a fake cover story. the president's business, the trump organization that was the pass through for the money. michael cohen made the payments initially himself and the trump organization cut him a bunch of checks to cover his cash outlay and a nice cushion for his trouble on top of that. cohen has released copies of the checks that he got to cover the illegal hush money payments which he made before the campaign. they are made out to michael d. cohen, esquire on trump organization funds. they are signed by alan weisselberg or by donald trump, jr. they are signing checks, reimbursing cohen for the

illegal payments he made. the trump organization also agreed they would call for the purpose of these payments legal expenses. they would list it as legal expenses on their books even though that's not what they were for. they didn't have a line item for hush money so they called it legal expenses. don't they get in trouble for that. doesn't the trump organization get in trouble for that if only for knowingly allowing the business records to be improperly falsified to cover up a couple of felonies and then the man for whom the felonies were committed. they told the judge in this case there is an individual one who directed the commission. that's the president. this is a crime that michael cohen did not commit alone and he did not commit for his own benefit at all. so far he's the only who has been punished or even pursued. now tomorrow at 11:00 a.m. when these do you means are unsealed, we will find out more about why

that is. the more interesting part about that, we will find out more about this case at 11:00 a.m. tomorrow. for a very specific reason. we will have all this stuff about the campaign finance felonies finally unsealed tomorrow at 11:00 a.m. the campaign finance felony investigation the ended. with only michael cohen getting in trouble. sdny is not pursuing this despite all the other people involved. they said publicly we are involved in this crime. this is from the judge's order. the government in the prosecution represents that it has concluded the aspect of its investigations that justified the continued sealing relating to cohen's campaign finance violations. and here's what's amazing. the prosecutors have told the

judge they are done with this case. they now represent they concluded the aspects of the investigation that justified the continued sealing of these materials related to campaign finance violations. the ongoing investigation and sdny said unseal this. here's what's more amazing. the prosecutors have told the judge that they are done with this case and no more ongoing investigation to justify keeping the colors redacted. they also told the judge that nevertheless they would still like some of this material kept under wraps for what they call third party interests. although the government agree that is the majority of the campaign finance portion may be unsealed, the government requests limited redactions to those portions to protect third party privacy interests. so this is a big turn in this

whole criminal law scandal. today we learned that the campaign felony case is coming to an end. no one is apparently getting in trouble for it except michael cohen. we are going to learn more about what happened in the commission of those felonies when all of this stuff is unsealed at 11:00 a.m. but the judge is letting us know that prosecutors nevertheless wanted stuff held back because of third party privacy interests. here's how the judge responds to that. it's a legal maneuver, a legal dynamic in which the judge says are you freaking kidding me? no way! you are not getting that. after reviewing the government status report and proposed redactions, this court denies the go's request and in particular the ramifications of the conduct described in the campaign finance disclosures. they are a matter of national importance.

now that the government's investigation into those violations concluded, it is time that every american has an opportunity to scrutinize the materials. indeed the right of access so enshrined that it preidates even the constitution itself to monitor and respond actions of their representatives and representative institutions. government wanted this stuff held back and the government said heck no. so we will find out tomorrow at 11:00 a.m. just what exactly it is that this judge thinks is nationally important that has weighty ramifications that every american has a right to know about as part of the long standing or preconstitutional right to learn of, monitor and respond to the actions of their representatives. president trump is the only representative of the american people involved in this case. so it sure sounds like this material that prosecutors wanted kept secret that the judge ordered released, it sounds like

this pertains to the president and his involvement in these felonies. what is slightly harrowing here is that the judge is having to authority stuff disclosed against the objections of prosecutors in this case. why would sdny prosecutors want to keep the material about the president from being publicly disclosed to a judge overrules them and waxing eloquent about the public's right to know and holding leaders accountable. cnn has been pursuing this for several days and said something weird happened in their investigation of the trump organization earlier this year. they said for months, federal prosecutors in new york examined whether trump organization officials broke the law including in their effort to reimburse michael cohen for hush money payments he made to women alleging affairs with his former

boss. in january, sdny prosecutors requested interviews at the trump organization, but prosecutors then never followed up on that initial request according to people familiar with the matter. the interviews never took place. in the more than five months since then, there has been no contact between the sdny prosecutors and officials of the trump organization. that's weird, right? why would prosecutors pursue this case? this is the month after he was sentenced to prison. the month after that, they were looking at the business entity that reimbursed him, that happened to be the company. they go to the business and request interviews with executives at that business. and then they just forget about that request? they drop it and never say another word to the trump organization? that's odd. why would they do that. what happened after prosecutors made those requests to trump organization executives in january?

what happened to make them just drop it without another word? i do not know and neither do you, but i know william barr was sworn in february which was the month after they made those requests to the trump organization that they never followed up on. barr sworn in february and not recused from knoanything having do with this case. we know from interpreting he interseated to try to get whitaker to install trump's preferred prosecutor to oversee the cohen case. he is quoted as telling personnel that sdny needed adult supervision on the case, but it's not known if he did anything to get the case diverted. matthew whitaker was replaced by bill barr and we know the case was diverted. the requests to trump organization executives should submit themselves to interviews,

those requests were dropped into thin air in a file. now today we learn that the case is being closed by sdny and they are asking for all the cohen case materials to stay redacted to protect third party privacy interests and we know the judge is outraged at that and saying no, i'm not keeping that secret. it's a matter of national experience and weighty public import and something every american should see this material that you wanted kept secret. as you close this case. thanks to that judge, we will all get to see it, whatever it is, tomorrow at 11:00 a.m. brace yourself. once we got that stuff, we are left with the question of whether the prosecution of the president and or his company and elder son who were all clearly involved in the commission of this crime, we are left with the question of whether that investigation and potential prosecution was shut down from

washington by new attorney general william barr. he left the interview requests dangling with no follow-up and telling the judge to protect someone involved in the criminal matter that is a matter of national experience. why is that happening? hey, sdny, are you okay? we have been led to believe you would squawk if you were under pressure and you are the sovereign district of new york and they couldn't cut you off with criminal matters. sdny, you would squawk, if that's what's happening, wouldn't you? at least for now, it's only the judge who is squawking that there is something wrong here. we are going to find out why he thinks that tomorrow at 11:00 a.m. stay with us. at 11:00 a.m. stay with us let's be honest, you need insurance.

to shoot a profile piece that preceded that interview, showcasing his life as a newly divorce man when he just split from ivana. in the footage, a lot of the women were cheerleaders for the buffalo bills. they were in town for a game against the miami dolphins and trump is the host of the party. there is footage of him grabbing a woman by her waist and patting her on the rear end. one of the reasons this is appearing now and they dug it up all these years later is one of the guest who is can be seen in this footage is jeffrey epstein. the same jeffrey epstein who just this past week was charged in federal court on child sex trafficking charges. that's epstein in the jean shirt in this tape. trump is seen.

nbc aired? footage of donald trump and jeffrey epstein together at a party in florida praising the assets of a bunch of women dancing at the party. this was in the early 90s in the same year he hosted that party, a florida business man said he was tasked at organizing a calendar girl competition and they told the times he was surprised to learn there were only two extra guests who were

invited to invite them to the party. 28 girls or women from the competition and only two other people at the whole party. donald trump and jeffrey epstein. over the past few weeks, pictures emerged of donald trump and jeffrey epstein hanging out at mar a lago. here's them in 1997. here's them in the year 2000. in this later photo, donald trump is alongside melania who was his girlfriend at the time and would become his wife and a british socialize who stands accused of having recruited the underage girls who were groomed to have sex with epstein. she denied wrong-doing. then the profile from jeffrey epstein in 2002 in which donald trump talks about what great pals they are and how great jeffrey epstein is as a buddy. i have known jeff for 15 years. terrific guy. a lot of fun to be with.

he likes beautiful women as much as i do and many are on the younger side. no doubt about it; jeffrey enjoys his social life. golf magazine recounted the time that epstein showed up late for a ride on his plane. a rolodex of his contacts shows no fewer than 15 ways to get in contact with donald trump. 15 different numbers for trump and people who worked for trump. and then the more serious allegations. in a deposition that accused him of child sex trafficking, epstein declined to answer a question about whether they ever socialized. in the presence of females under the age of 18. he was asked about this and this is how he responded. no, i would like to answer that question. today i'm going to have to assert my 5th, 6th, 23rd and

24th amendment rights. >> a woman sued drums alleging that 13 years old when trump rained h raped her. trump denied doing anything wrong. all of that has been hanging in the public record for years, but it was catapulted into our consciousness last week when epstein was charged with sex trafficking in a federal court. anybody with ties to epstein may be freaking out. at monday's bail hearing the case is only getting stronger. after seven days of this case being public following months of a covert investigation, the evidence is significantly stronger and getting stronger every day. many individuals identifying themselves as victims and witnesses contacted the government and we are in the process of receiving and corroborating this evidence. as i mentioned at the top of the show, tomorrow morning at 11:30,

the judge will rule on whether or not he should be allowed out of jail. there is no way to predict what the judge will do. there is good reason to think it's not going to go epstein's way. in federal law, there is a presumption to defendants accused of sex trafficking. it's rare, but it applies here. on top of that, prosecutors have made the case for the means and motive to flee. $110 million. tens of thousands of dollars in cash in a in one of his houses. 48 diamonds which is an efficient way to carry around liquifiable wealth. they have been back and forth over the last few days about this odd fake passport with a picture of him with a fake name. all of that on top of allegations that he has been tampering with potential witnesses.

all of that adds up to low expectations that judge will release him rather than keep him locked up. when he is about to spend months in federal lock up and may never get out of custody again, we don't know what that does to his approach. there is a general sense that the blood pressure in the white house is higher than normal since epstein was arrested. it's impossible to know if this is the new crazy or an effort to try to distract from something. could this be the president hitting the panic button to distract from something else coming down the pipe? >> some people have an ability that they really don't worry about things too much. i have that ability. if i did, i probably would have been in a corner with my thumb in my mouth going mommy, take me home. >> you aren't doing that. we saw evidence of that. >> somebody else's thumb in my mouth. else's thumb in my mouth.

hangar and a landing scrip. the attorney general said his office interviewed epstein's potential victim who is visited and his office has been in contact with the u.s. attorney's office in the southern district of new york prosecuting the case against epstein right now. noini i joining us now is new mexico's attorney general. appreciate you being here. >> great to be with you. >> you have said you are actively investigating whether crimes are committed at epstein's ranch. what led to that decision? >> we actually became concerned as we monitored the florida case. when the federal judge determined that victims were left out of the matter in the plea agreement relating to florida, we became concerned because we were aware early on that there was a nexus related to the new mexico ranch. in march of this year, we began to kick up the investigation.

>> what are can you tell us about the investigation. obviously it's an ongoing matter. is there anything you can tell the viewers in terms of the scope or you had communication with women who said they were victims from the type of behavior we see charged in new york? >> i can confirm that it involves individuals that were underage and so that's a major concern. it's involving an area that was seclude and high risk. most importantly a course of conduct that needs a thorough accounting. because florida didn't inve investigate and handle this initially, we go back many years and secure a thorough accounting of facts. we have confirmed there are survivors that we want to make sure we refer this evidence to the prosecutors. >> one of the reasons i wanted to talk to you, you said your investigation is going to include review of epstein's business dealings related to his

new mexico ranch. your office acquired hundreds of pages of stand land office. i didn't know if that related to the investigation or if you can explain here tonight. >> sure. in new mexico, we have a high portion of public lands and they are supposed to be leased to ranchers and other business leaders through a process. we just discovered recently that he also had very important land leases surrounding his private property. we want to make sure all rules and laws were followed. it does raise a concern that in this investigation, we want to make sure his dealings were above board as well. concerning that we have an active investigation. >> there have been local reports that epstein purchased the land for this ranch from the governor of the state. obviously with you looking into

the business aspects and conduct at the ranch, one of the things that has been one of the great tragedies is that he seems to be able to do these thing fist are years and get out of it again and again and again. is there a question that he might have avoided scrutiny in new mexico before now because of his pli his political connections like buying this land? >> absolutely. one thing that is regrettable is there were multiple system failures both in local prosecution and investigations and state and federal prosecution and investigations failed these many victim who is were really children. this was never handled as a proper child abuse investigation as it should have. we are going to make sure we understand that further laws or rules were not bent in favor of the powerful. >> attorney general for the great state of new mexico.

dying in the custody of the federal government. the latest is courtesy of npr about a 3-year-old girl from honduras in the custody of the trump administration along with her parents. listen to how bob moore described what happened. >> the border patrol agent they were with said okay, one parent will go back to mexico then and the other parent will keep the kids and be allowed to stay in the united states. the agent then turned to 3-year-old sophie and told her to make a choice. which parent did she want to go with? >> i can't stress this enough. this is a 3-year-old child. a toddler. we saw her. she is tiny and being told to pick a parent? >> yes. she is very close to her mother so she picked her mother and then when it became clear that they were going to separate them
