facilitating the ukraine effort while bolton was among those objecting to it. not only did the motion filed by bolton and kupperman's attorney try to keep mulvaney out of the lawsuit, it also advanced an argument that mulvaney may have to testify in the impeachment probe. the motion specifically notes that mulvaney appeared to quote admit that there was a quid pro quo during a white house briefing last month, which many of us remember, meaning he may not be able to defy a subpoena by democrats since he has already discussed the matter publicly. mulvaney signaled last night that he will file his own lawsuit, challenging this congressional subpoena. joining me here on the set, msnbc legal analyst sefb serve. quite a tick tock of events yesterday, between bowlton and kupperman here. >> that's right. >> what happens if mulvaney's lawsuit, that he is going to do on his own now, gets dismissed and he is actually asked to comply with the subpoena, could this further implicate the president? >> it could. but a lot has to happen.

mulvaney will certainly file his own lawsuit, that will be determined, it will take time, but ultimately, at the end of the road, it is possible that mulvaney would be forced to testify. but in this case, for the immediate moment, all that has happened is the existing lawsuit, the plaintiff, kupperman, say this is our lawsuit, go get your own lawsuit, and that's exactly what mulvaney is likely to do, he has withdrawn his motion to intervene as another plaintiff, and he's probably going to be filing his own complaint for declaratory relief very shortly. >> were you surprised at all that mulvaney tried to attach himself to bolton and kupperman, considering how much on different sides of the issue they are when it comes to ukraine? >> here's the thing. mulvaney's attorneys wrote a well-written motion to intervene. but from the outset, observers recognized that there were some dissimilar interests involved. and in fact, mulvaney is probably more aligned with trump as a defendant than he is with

the plaintiffs, who are seeking to have their rights and responsibilities determined. after all, mulvaney is, or the existing plaintiffs, have no interest, they don't care what the outcome is of the constitutional debate. where as mulvaney is very much aligned with the defendant, the president. so just from the outset, there are some misalignments of interest that really stood out to even the casual observer. >> i want to talk quickly about the department official katherine croft's testimony essentially saying that ukraine knew that the aid was being withheld, which has been much of the republicans defense here. what do you make of that? >> it is more evidence of not only a quid pro quo but at least a demand. and this has been problematic from the outset. this is exactly the way everything is going to line up. and my prediction is, as it has been for several weeks, is that ultimately, the president's team's defense is going to

winnow down really to even if this happened, even if there was a demand, a quid pro quo, a withholding of aid in return for an investigation of corruption, and specifically an investigation of someone that is related to a political opponent of mine, even if all of that is true, it's perfectly allowable because as the president, i was rooting out corruption. if it just so happens to also benefit me personally, well, then, that doesn't matter. and that's really what this comes down to. it is going to come down what to what criminal law -- >> from the president specifically in the last couple of days. >> that's right. in federal criminal law, there is the idea of corrupt intent. the same act, if done with a proper intent, may be lawful. if it's done with a corrupt intent, for example, for personal gain, by an official, a government official, that takes an otherwise lawful event and makes it unlawful. >> danny cevallos, thank you, always good seeing you my friend. >> thank you. a check on the weather now with nbc meteorologist bill karins. >> good morning. and everyone else, if you're on

duval patrick is considering making a late entry into the 2020 presidential race, less than three months before the iowa caucuses. "the new york times" reports patrick has confided in some democratic officials that he does not think any of the current candidates have established political momentum and thinks there is an opening for someone who can unite both liberal and moderate voters, according to democrats who have spoken to him. alert them that he just may run the "times" notes that patrick of the trump campaign issued a started states to statement after hearing of patrick's potential 2020 run, saying in part this, late entries into the democratic party just mean that the existing cast of characters can't get it done, not one of them can beat donald trump, and the new ones can't either. and new york mayor bill deblasio is speaking out about former mayor michael bloomberg's potential run for the 2020 democratic presidential nomination, after marching in yesterday's veterans day parade in new york city, deblasio told reporters, bloomberg is quote a billionaire who epitomizes the

status quo. he went on to say this, would he be better than donald trump? of course. should he be the democratic nominee? no. although deblasio has not shied away from panning his predecessor, he did praise part of bloomberg's record including his work on gun control, climate change and on public health. meanwhile, more than half of new hampshire's democratic primary voters said they would not consider backing bloomberg if he were to actually run. 54%, just over half of the queen pea ak university poll, 37% said they would consider voting for him, just 2 said definitely. bloomberg is also the second choice among 9% of biden voters. 2% of buttigieg supporters. 1% of warren's. and none of sanders' new hampshire voters. joining me now from washington once again, senior staff writer for the hill, scott wong. i want to talk about the interest of more of these democrats looking to jump in to the race, patrick, bloomberg, former mayor, do you see here a

clear pathway to the presidency for these pretty late additions? >> definitely not a clear path. i mean bloomberg has obviously, he has taken a look at jumping in at this late stage, because he sees weaknesses in this current field of candidates. he's keeping his options open. but you know, bloomberg really, he has, he does have name i.d., i'll give him that, and he has $50 billion in his bank account. so he has a huge war chest. that will certainly be beneficial. but i just don't think right now that democrats believe that nominating another septuagenarian billionaire from manhattan is the answer to trump. and so i think there is a lot of people scratching their heads in washington, as well as in new york, saying is this really the right candidate that we want to

put up against donald trump. >> it is interesting, because you have spoke an lot about bloomberg. obviously, there has been a lot of criticism with regard to bloomberg being a late addition to the democratic primary race. but deval patrick interesting and not necessarily a name we have been hearing and now jumping in and the top tier candidates while the wide swath of candidates is a pretty diverse tier, the top tier is not necessarily diverse and deval patrick could add to that diversity at the top and could feasibly be an interesting ad add. what are your thoughts on him and the traction he could have. >> right, that's an interesting point you make. kamala harris and cory booker, two african-american, very popular senators, from california, and new jersey, have not gotten a lot of traction in this democratic primary field, as people had expected. i think a lot of people were looking to kamala harris as somebody who could be a front-runner in this race, and that simply has not panned out.

she's scaling back. and so i think perhaps deval patrick sees a lane here that, you know, democrats are looking to be the party of diversity, to be the party of inclusion, and they want somebody like deval patrick, who is another african-american, former governor of massachusetts, who could step in and fill that lane. so i think there is something to that. i will say that kamala harris and corey book ver been running for the past year or so and deval patrick has a lot of catching up to do. >> yes. >> he has been off the public stage for a while. and so he has a lot of catching up to do, in terms of getting his name out, and driving up his public i.d. >> scott wong, thank you, as always, my friend, appreciate it. good seeing you. >> thank you very much. multiple sources telling nbc news that house democrats are carefully planning this week's public impeachment hearings to emphasize a simple abuse of power case against the president. now, their strategy will reportedly rely on two key component, the witness list, and

the hearing format. the first three witnesses, ambassador bill taylor, diplomat george kent and sbasz dor marie yovanovitch, all gave impeachment investigators ukraine a democratic aide telling nbc news devote this quote this, they are all strong character witness, all three bring credibility to the impeachment inquiry, adding that ambassador bill taylor will lay everything out on wednesday and ambassador yovanovitch will tug at america's heart strings on friday a second democratic aide says taylor's exquisite note taking will lend credibility to his testimony which will quote corroborate the whistle-blower's complaints. this week's hearings will begin with opening statements from the house intel chair adam sif and ranking member nunes and the witnesses, but a 90 minute questioning period split evenly between democrats and republicans and once that time is up chairman schiff will

decide if more time is needed for additional questioning. and a third democratic aide say, if the american people only will watch the first hour, they will hear plenty. the first hour of each areaing is designed to be a block buster. >> and the disjointed response by the white house to the impeachment probe has been fueled by a dispute by acting md the white house counsel. mulvaney has urged aides not to comply withand budget which mul led have fallen in life. the post reports that mulvaney's office has blamed cipolione for blocking others. and cipiollone, released a letter from trump early last month saying the white house would not be cooperating with the impeachment inquiry. at the same time, two officials telling the post that trump has been complaining about mulvaney. blaming him for his political

troubles. and has toyed with the idea of replacing him. and president trump has yet again pledged to release a transcript of his first call with ukraine's president from back in april. he tweeted last night, this, in order to continue being the most transparent president in history, i will be releasing sometime this week the transcript of the first and therefore most important phone call i had with the president of ukraine. i am sure you will find it tantalizing. on saturday, trump said

eliminated, the president tweeted his support urging 66 million twitter followers to vote for the former press secretary, however that tweet was deleted after spicer was voted off. european car makers are trying to negotiate with the trump administration as the president is trying to impose tariffs on companies. talk to us about this, with regards to the president. he is actually going to impose these tariffs? >> i've got to say it is a tough thing to come up after sean spicer, it seems like it happened the last time, but as far as tariffs are concerned, the political reporting that the white house is going to delay the decision on whether trump will impose tariffs on german automakers by six months, this is the second time they have delayed, they already pushed it back once, in pay so it's been pushed back once.

democracy do they want snink ? u and i think you can argue that house democrats made a precondition like this before but will do it again. >> i know they there was some reporting by some social media companies to improve their users' well-being. what more do you know on this? >> so now big tech wants to make us sane after years and years of trying to engage us as much as they could, to make their platform so attractive, addictive, that we would constantly want to be on our screens, to constantly give us that dopamine hit. now the companies are recognizing that some users are burning out. if too many people burn out, ultimately that's bad for their business. so we heard for a while about the company's talking about well-being, but now there's new ways to go at it. instagram says it's going to be begin testing in the united states the idea of hiding how many likes you get for a
