for this monday night as we start off a new week. thank you for being here with us. goodnight from our nbc news headquarters here in new york. another round of impeachment hearings begin today. >> plus, president trump says he is strongly carrying an offer from house speaker nancy pelosi to provide written testimony about whether he pressured ukraine to investigate joe biden and his son. new polling shows that a majority of americans think president trump's actions towards ukraine were inappropriate. we're digging into those new numbers.

good tuesday morning, everybody. it is november 19th, i'm yasmin vossoughian, alongside ayman mohyeldin. today kicks off week two of public testimony in the impeachment probe. there are two hearings scheduled for today. the first starts at 9:00 a.m. with two officials who were on the phone call that sparked the formal impeachment inquiry. top ukraine expert on the national security council, lieutenant colonel alexander vindman and top russia aide to vice president mike pence jennifer williams. both officials are expected to challenge president trump's claim that his july 25th phone call with the president of ukraine was perfect. williams characterized it as politically motivated, unusual and inappropriate. and vindman was so concerned that the call undermined national security that he reported it to the nsc's top lawyer. the president has attacked both witnesses as quote never trumpers. however the latest attack on vindman, a decorated army officer, is coming from republican senator ron johnson. in a letter to jim jordan and

devin nunes dated yesterday, johnson writes this. a significant number of bureaucrats and staff members within the executive branch have never accepted president trump as legitimate and resent his unorthodox style and his intrusion on to their turf. they react by leaking to the press and participating in the ongoing effort to sabotage his policies and if possible remove his from office. it is entirely possible that vindman fits this profile. >> another hearing is scheduled for this afternoon, where we will hear testimony from president trump's former special envoy to ukraine kurt volker as well as tim morrison, a former white house national security official. volker was the first witness to testify in the impeachment probe. in fact, he denied participating in an effort to pressure ukraine but text messages he gave to congress show that he had talked to ukrainian officials about launching investigations in exchange for a meeting with president trump. according to "the new york times," he is expected to tell lawmakers that he didn't realize

that others in trump's orbit were trying to secure, tying security aid, excuse me, to a commitment to investigate the democrats. meanwhile, former white house national security official tim morrison's testimony could help confirm trump's efforts to orchestrate a quid pro quo with ukraine. in fact, he previously testified that eu ambassador gordon sondland had told a ukrainian official that military assistance would probably be unfroze physician the government announced investigations into democrats. morrison listened to july 25th phone call of the president with ukraine and thought it could be damaging to u.s./ukraine relations. >> house impeachment investigators have released the transcript of last friday's closed door deposition of state department official david holmes who overheard the july 26th cell phone call between the u.s. ambassador to the european union gordon sondland and president trump. when holmes joined sondland at a restaurant in kiev. according to the transcript, holmes told investigators that quote during the lunch,

ambassador sondland said that he was going to call president trump to give him an update. ambassador sondland placed a call on the global phone and i heard him announce himself several times along the lines of gordon sondland holding for the president. holmes explained that quote while ambassador sondland's phone was not on speaker phone, chi hear the president's voice through the ear piece of the phone. and the president's voice was very loud, and recognizable. and ambassador sondland held the phone away from his ear for a period of time presumably because of the loud volume. >> holmes testified that he heard sondland tell trump that he was in ukraine and went on to state that president zelensky quote-unquote loves your ask, and so he is going to do the investigation, unquote, and ambassador sondland reported that he is going to do it,

adding that president zelensky will do anything you ask him to do. and a candid impression of the president's views on ukraine, in particular holmes asked sondland if it was true that the president did not give an expletive about ukraine to which sondland agreed. holmes claims sondland that the president only looked at quote-unquote big stuff, like the biden investigation that rudy giuliani was pushing. holmes yesterday was added to the list of witnesses who will testify publicly in the house impeachment inquiry, and is scheduled to testify publicly on thursday. >> so a house committee has also released a transcript of the november 6th deposition of under-secretary of state for political affairs david hale. according to the "washington post," hale described a nebulous effort advanced by rudy giuliani, and conservative media outlets and eventually endorsed by president trump himself, to sear and then remove marie yovanovitch from her post as u.s. ambassador to ukraine.

the post reports that hale testified that he thought that the effort was unfair and that yovanovitch was doing an exceptional job. he said he advocated for the state department to issue a robust defense of her work. but was ultimately overruled. most likely in quotes by secretary of state mike pompeo who he determined twice had called giuliani in the time frame when the statement was being considered. according to the transcript, hale said that pompeo reached 0 tout fox news host sean hannity about pushing quote the narrative about yovanovitch, hannity on his show last night denied the conversation even took place. regarding withheld security assistance to ukraine, hale announced that the skepticism was global in nature and he had no issue with the so-called irregular channel or of the diplomacy. hale is expected to appear in open hearings tomorrow. joining us on the set, msnbc legal analyst danny cevallos, good to have you with us.

how incriminating do you think the state department official david holmes testimony, based on what we have seen from the closed door deposition, is likely to be in the public forum. he is given a very accurate account, at least by his own words, of what he heard on that phone call between sondland and the president as we just recapped there. it may sound like a minor thing but there is a major piece of homes' testimony that will affect the testimony of gordon sondland coming up this week. and it's this. gordon sondland largely testified that hey, i was told to go talk to rudy giuliani, i was told to ask ukraine to investigate corruption. that would have been fine. but i didn't know anything really about this whole biden burisma stuff. i never would have been behind. that that's how sondland appears to be threading the needle, that corruption investigation, fine, biden, not so fine, but i didn't know about that. now, now you have holmes saying essentially after this phone call that sondland turned to him

and said, as you almost said the very bad word, that the president doesn't give a bleep about this stuff, he cares about biden. that's really compelling testimony. and it contradicts directly sondland's testimony. and then sondland's testimony is the keystone that brings together trump's only complete ignorance about what everybody else was doing and only knowledge about his phone call which he says was perfect. >> and we know that sondland has direct access to the president, at least based on that account, that he is speaking to the president directly, couldn't just say this is what i heard from giuliani because at the end of the day he had that phone call with the president. >> exactly. i have to say that there has been a lot of talk about hearsay in the last few weeks, and it's true that holmes is what we call a precipent witness, he saw or heard these things firsthand. but i don't want to give that much credit to the word hearsay in this investigation. because investigations commonly rely on hearsay and it is a rule of court that only applies in

court and even then i can tell you having dealt with this personally, it often has so many exceptions they swallow the rule. the reality is hearsay is unreliable unless it is reliable. >> could kurt find himself in hot water, since he revised his story once and could he be revising and recollecting things that he didn't remember the first time around once again during his testimony this week. >> the amazing things about these witnesses, we have hundreds of pages of sworn testimony to look at and the theme that emerges from sondland's prior testimony, this is someone who is trying to give too many right answers to the questions. in other words, there is a lot of what we call cya in this transcript, in that he is saying yes, i was given essentially an order by the president, go talk to rudy giuliani, i didn't really trust what giuliani was up to, it didn't seem right but i did it, you know, the code red was ordered and i went and did it, i followed the rule, but if it had been about biden and burisma, i didn't do nothing

about it and i wouldn't have done it if i did. >> just in general as you well know, kicking off week two of the public testimony, major player, sondland included, volker included, colonel vindman included as well. what are you going to be looking for? >> again, for me, the entire week is sondland, he is the star, vindman is important, some of the others, volker is important, because sondland essentially says that trump told me, volker, and others, to go talk to giuliani but i sort of let the others take the point on that. that wasn't really my job. so it is going to be really interesting to see how these testimonies shape up. and to what degree they conflict, as they already have, with what sondland said in his sworn transcript. >> when you look at some of the defense strategies of the president, and his surrogates, to try and attack these witnesses, they're going after somebody, a decorated war hero like alexander vindman, does that strategy legally work to attack the character of the person and try to say he is a never trumper, he has bias, in this, his words --

>> especially from ron johnson who is directly attacking colonel vindman who was defended by many republicans just a couple of weeks ago when the president first launched his attacks. >> this is exactly why these public hearings are so important, and such a clever move by democrats because the reality is, most citizens really don't know how the state department diplomacy, the foreign service corps works and we're learning through the hearings and seeing people and evaluating them with our own eyes and they are credible, they have incredible character, they're career public servants who have served under republican and democrat administration, and the theme i think, for people watching, is that no matter what you think about the reliability of the information they're receiving, whether it be hearsay or whatever else, these people generally have impeccable credentials, their care is unquestioned and i think that is a major strategic benefit for the democrats. >> quickly, cya, is that a legal team? >> that is a latin term, yes,

the trump administration is preparing to publish a rule that would send migrants who pass through guatemala, el salvador or honduras back to those central american countries to claim asylum there instead of the united states. the rule would allow asylum officer the authority to determine if one of the three agreements the u.s. has recently assigned with those countries applys to the immigrants they vet. if they do, asylum seekers could be fast-tracked for deportation back to those three countries to

claim asylum. >> there the new rule comes on the heels of two other tough asylum policies implemented the past six month, the agreements were negotiated this past summer by former acting security secretary kevin mcaleenan, in return for the asylum rule, the countries receive assistance for security according to the dhs. the supreme court put a temporary hold on a house subpoena yesterday for eight years of trump's financial records. the house oversight committee subpoenaed the material back in april, after former trump lawyer michael cohen testified that the president quote inflated his total access when it served his purposes, and deflated the access when it reduced his rel estate taxes. the move known as an administrative stay does not mean the court might rule on the legal merits of the dispute but it stopped the clock to give the lawyers time to file papers. after losing in the lower courts to have the subpoena thrown out, trump's lawyers asked the supreme court to put the subpoena on hold while they pursue an appeal.

and in a two sentence order the house must respond by 3:00 p.m. on thursday. and jerome powell met with president trump yesterday to discuss the economy for the first time since february in what the president called a good and cordial meeting. the fed says the president requested the meeting and they discussed interest rates among other things. the fed released a statement yesterday saying that powell did not discuss the outlook for interest rates with trump. except to stress that the path of policy will depend entirely on incoming information that bears on the outlook for the economy. trump again tweeted later in the day saying quote i protested the fact that our fed rate is set too high relative to the interest rates of other competitor countries. in fact, our rates should be lower than all of the others. we are the u.s. too strong a dollar hurting manufacturers and growth. president trump has long been a critic of jerome powell. since he assigned him to his role in february of 2018. in recent days, he has called powell and his colleagues quote boneheads, and has asked on

twitter who is our bigger enemy, jay powell or chairman xi of china? >> to be a fly on the wall for that meeting. congressional leaders reached a deal yesterday, to extend government funding for four more weeks to avoid a government-wide shutdown. the continuing resolution was unveiled by house democrats and does not include funds for president trump's border wall, trump has demanded money for the wall along the u.s. mexico border in exchange for his signature. the stopgap bill would fund a 3.1% military pay raise, provide extra cash for the commerce department to conduct the 2020 census, and would allow state highway programs to avoid a $7.6 billion cut this summer. the president's border wall remains an issue in budget negotiations but as "politico" is reporting, during a meeting last thursday, between speaker nancy pelosi, pelosi, treasury secretary steve mnuchin and congressional appropriators, the two sides agreed to set aside the border wall stalemate for

warnings but but there are winter weather advisories mostly in the high country of new england. as far as additional snow, one to two inches. not a lot of school delays or cancellations because of this. but another kind of rude wet damp morning that you just don't want to be out in. the next weather story is developing in the southwest. later today. this one is good. no fires going on in california. some areas of southern california getting their first rain in six months. so they go through the dry season and this is the beginning, finally, of their wet season. and it also reduces the fire risk once we get the rain. in the meantime we have 11 million people that could experience minor flooding and mud and debris flow, with the washes in the desert areas, you can see those moving through. that's what we expect. the heaviest rainfall in arizona. north of phoenix, near prescott and sedona. two to three inches in the next couple of days. the forecast for today, a lot of negatives but let's be positive, and let's look at 75 in dallas today. absolutely gorgeous.

welcome back. justice department inspector general michael horowitz will appear before the senate judiciary committee next month to testify about a forthcoming report surrounding the fbi's surveillance of president trump's 2016 campaign. chairman lindsey graham made the announcement yesterday. in anticipation of the report's imminent release. the d.o.j. has been investigating whether the fbi violating laws by obtaining a foreign intelligence surveillance act warrant to look into the trump campaign adviser carter page's ties to russia. in a statement graham called horowitz a quote good man who will deliver a detailed report on the probe's findings along with quote recommendations how to make our judicial and investigative systems better, the hearing is scheduled for

december 11th. secretary of state mike pompeo at a news conference yesterday avoided multiple questions about why he has declined to offer public support to state department employees involved in the house impeachment inquiry. >> the state department is actually supportive of not only what we've done but our ukraine policy moving forward. >> but no defense of your employees? >> i always defend state employees, it is the greatest diplomatic court in the history of the world. very proud of team. >> ukraine policy, i'm curious if you think ambassador taylor has been an effective envoy of that policy and he will remain in that job or if the president has lost confidence in him. >> the state department has done a fantastic job. i think we have delivered in a way that the obama administration has not delivered on ukraine. >> pompeo refused to comment on president trump's tweet attacking former u.s. ambassador to ukraine marine yovanovitch as she testified publicly on friday. >> ambassador yovanovitch was on the hill on friday, the president made a tweet, appearing, saying that everywhere she went turned bad.

welcome back, everyone. i'm ayman mohyeldin alongside yasmin vossoughian. as week two of the impeachment hearings public hearings begin this morning, house speak yer nancy pelosi sharpened the democrat focus in a letter to colleagues saying it is extortion and bribery and deemed the facts in the impeachment inquiry are quote uncontested as she asserted that trump abused his power for his own personal political benefit, at the expense of our national security interests. the house speaker went on to argue that it would be quote dangerous to leave trump's fate to voters next year, because the president is quote jeopardizing the integrity of the 2020 election. >> new reporting from the associated press suggests democrats may have evidence to contradict republican arguments that ukraine's president never felt pressured to investigate the bidens. two people with knowledge of the matter, telling the a. p. that officials at the u.s. bem daembn kiev including ambassador yofbz

american people. what is president trump hiding and why is he personally afraid to confront the facts? >> could i ask you your opinion about whether president trump should testify in any way, even if that included just answering some questions, you know, by pen? >> that is totally up to the white house, totally up to the president. whether he does, it i don't anticipate him testifying in an open hearing, but if he wants to provide answer, that is completely his call and the white house legal counsel. >> mitch mcconnell suggested yesterday that the house impeachment inquiry could last until the end of the year, possibly pushing the state of the senate trial up against the democratic primary season. >> it looks to me like the house is going to be on this until christmas. and it come over to the senate. and it displaces all other business. the chief justice of the united

states is in the chair. senators are not allowed to speak. they listen. and i'm not sure how long it will go on. it looks to me like the house is determined to impeach the president. i can't imagine a scenario under which president trump would be removed from office, with 67 votes in the senate. so i don't know how long senators will want to continue the trial but i'm pretty confident at the end, it will not, impeachment will not lead to ouster. >> so let's get to some of the new polling number, the latest abc news ipsis poll puts issues on the issue, 70% think the president's actions on ukraine were wrong. 70%. 25% say they were not wrong. among those who think his actions were wrong, 51%, just over half, think he should be impeached and removed from office.

6% said they think he sh be impeached and not removed and 13% say he should not be impeached or removed from office. the news hour maris poll out this morning showing 50% think the president should be impeached, and 43% do not. 70% think that it is unacceptable for a president to ask a foreign leader to investigate a political opponent. 22 think it is acceptable. 65% say that new information that comes from the impeachment inquiry could not sway their position. 30 say it could. and 63% of people say they are following the news of the impeachment inquiry very closely, or fairly closely, as opposed to 37% say they are not following closely or not at all. joining us now from walk washington, white house and washington reporter for "politico," mr. daniel litmann, let's get to the latest impeachment poll, and nancy pelosi said it would be

dangerous to let voters determine his faith saying he is jeopardizing the impact of our elections. what do you think the impact on voters will be in 2020. >> i think many voters are focused on tabletop issues, health care, college tuition, and jobs and the economy. they're not as focused on impeachment. and it's not going, you know, people are very dead set in their ways, they're supporting president trump or they're not and he could very welcome out of the senate trial if he defeats it more energized with his base feeling like he was a victim and wanting to renew his presidency in 2020. and so that could backfire on democrats. but democrats of course feel like they have no choice and that they're going to do this no matter what. >> president trump claiming he will quote strongly consider

testifying in the impeachment trial. i have very strong doubts that is not going to happen. >> can you imagine sitting at the desk writing the answers to the questions? >> is this at all a plausible possibility? >> i'm not holding my breath. because you know, he could send some answers in. but remember, testifying, many times during the mueller probe and he only sent in written answers and the written answers let's be clear, you know, those might have had problems where he said he had no idea that wikileaks was going to release any damaging information. when in fact, his former deputy campaign manager rick gates, his former campaign manager paul manafort, and robert mueller, they all have said under oath or in court that he did not, was not completely truthful.

welcome back. the white house is trying to tamp down speculation about president trump's health following an unannounced visit to walter reed medical center over the weekend. the president spent two hours at the medical center on saturday for what white house officials called routine tests. but the trip has not been listed on the president's public schedule. the white house released a memo from the president's physician last night that reads in part this. despite some of the speculation the president has not had any chest pain, nor was he evaluated or treated for any urgent issues. specifically, he did not undergo any specialized cardiac or neurological evaluations. in that memo, the president's physician said the visit has not been announced in advance because of quote scheduling uncertainties. and in a snub to president trump, north korea rejected yet another one-on-one meeting calling it quote fruitless. a senior adviser to north core's leader kim jong-un said we are

no longer interested in such talks that bring nothing to us. as we have gotten nothing in return. we will no longer gift the u.s. president with something he can brag about. meanwhile, north korea state media went after former vice president joe biden describing him as a quote rabid dog that prompted the president's response on sunday tweeting, mr. chairman, joe biden may be sleepy and very slow but he is not a rabid dog. he is actually somewhat better than that, but i am the only one who can get you where you have to be, you should act quickly, get the deal done, see you soon. the president trump and north korean leader kim jong-un have met three times but so far failed to reach a deal about north korea's nuclear program. the trump administration announced yesterday that israel's settlements in the west bank do not violate international law. the announcement reverses 40 years of u.s. policy that declare the settlements an obstacle to addressing israeli/palestinian conflict.

and they shared some of those results with axios today. they said there's one big takeaway from all of it, a lot of voters no matter how they feel that president trump don't feel like impeachment is the answer. this will fold into the 2020 campaign against democrats. what they say is that no matter how these voters feel about president trump, and many in fact dislike the way he behaves and his personality, the way he acts on twitter and even feels that he probably did something wrong regarding ukraine, they don't think it's an impeachable offense. that's the one big takeaway that trump supporters are getting from these undecided voters. >> what are you reporting about the actual focus on some of these public impeachment hearings, this being week two? >> i think that also speaks to the other issue, sort of what democrats have been struggling with what they can get to break through. we talked about this last week, what's a big singular moment that can capture the public's attention. we've seen a little bit of a

dropoff? viewership from last week. i think the real thing to look at here, you had some of this polling on earlier in the hour, how set people are in their ways. people see this as a prefixed conclusion, that the democrats are going to impeach, the republicans are going to acquit, and we're going to be right back where we started. a really big issue that we write a lot about on axios, the way people can live in filter bubbles, depending on the television shows you watch and the twitter followers. these are two completely different stories. either the democrats railroading the president or the president deserving to be impeached. neither side is breaking through. >> and what can we expect from democrats in this week's round of public testimony given the witnesses that are going to be in front of the panel? >> yeah, what the democrats want to say is really kind of paint a picture of how this was a, quote, pressure campaign by the president and his allies on the ukraine, pulling away from the quid pro quo claims but still being able to say this was inappropriate actions by the
