president. good thursday morning, everybody. it is december 5th, i'm yasmin vossoughian, and after another consequential day in washington we are happy to have nbc white house correspondent jeff bennet filling in. you must be incredibly tired. i watched you through the entire day yesterday and saw your point of view. >> just powering through. >> we begin with the eight-hour impeachment hearing on capitol hill where three of the legal scholars called to testify by democrat, told the committee responsible for drafting articles of impeachment, the house judiciary committee, that president trump undoubtedly committed impeachable offenses arguing that the president's conduct regarding ukraine is exactly what the founders had in mind when they carved out a path for removing a president. watch this. >> if we cannot impeach a

president who abuses his advantage for personal advantage we no longer live in a democracy. we live in a monarchy, or we live under a dictatorship. that's why the framers created the possibility of impeachment. >> if you conclude that he asked for the investigation of vice president biden and his son, for political reasons, that is, to aid his re-election, then yes, you have bribery here. >> the impeachment power requires this committee, this house, to be able to investigate presidential misconduct. and if a president can block an investigation, undermine it, stop it, then the impeachment power itself as a check against misconduct, is undermined completely. >> now, law professor jonathan turley who testified as a republican witness yesterday warned against impeaching president trump, because there was inadequate evidence of a crime committed. that's what he said. but those comments appear to contradict some of his previous statements and testimony. take a look at this.

>> this would be the first impeachment in history where there would be considerable debate, and in my view, not compelling evidence of the commission of a crime. this is a facially incomplete and inadequate record, in order to impeach a president. >> but in a 2014 opinion piece, for the "washington post," professor turley appeared to have a different view, arguing this, while there is a high bar for what constitutes grounds for impeachment, an offense does not have to be indictable. serious misconduct, or a violation of public trust is enough. and in 1988, during president bill clinton's impeachment, turley had this to say. >> executive power exhibits the same physical properties as a gas in a confined space. when you expand the space, the gas will fill the space. you should not be misled. your decision will define executive power and authority. if you decide that certain act

does not rise to impeachable offenses you will expand the space for executive conduct and we will have to live with that expansion. >> professor turley rejected the impeachment inquiry of president trump, arguing that the democrats' probe is moving too quickly. >> fast and narrow is not a good recipe for impeachment. that's the case with johnson, narrow was the case with clinton, they tend not to survive and they tend to collapse in front of the senate. impeachments are like building. there is a ratio between the foundation and the height and there is the highest structure you can build under the constitution. >> but peter baker of "the new york times" offers this fact check, he tweeted this, turley says this would be a record fast impeachment but it fends how you count. it in the clinton case the house voted to impeach him 72 days after it authorized an inquiry. it is now 71 days since pelosi

opened the inquiry into president trump and if you count from the date the starr report was delivered to congress, it was 101 days. and of course, trump and republicans argue that democrats have been pursuing impeachment since the day trump was inaugurated. in that sense, the inauguration has been going on 1048 days. as for johnson, it was longer only if you count previous attempts to impeach him on other charges. the house voted to impeach him for violating the tenure of office act, just three days after the specific article, nine days after it. as they did in the intelligence committee, the judiciary republicans sought to delay yesterday's impeachment hearing with a series of procedural maneuvers that were quickly shut down. >> a parliamentary inquiry. >> the gentleman, it is not an order for apartmenty inquiry. >> i have a motion. >> the gentleman is recognized for the purpose of opening statement and not -- >> a parliamentary inquiry.

>> i have a right to cast -- >> let me rephrase the question. how many of you support him? >> the gentleman may ask the question, the witnesses don't have to respond. >> how many of you supported donald trump in 2016. show of hands. >> not raising our hands is not an indication of an answer, sir. >> so nbc news is reporting that house democrats are unified on moving forward, with impeachment, this is according to multiple democrats who attended a closed door meeting just yesterday. scharn chairman of the house intel committee adam schiff reportedly received a standing ovation when speaking to democratic lawmakers. three lawmakers telling nbc news, that the articles of impeachment are likely to focus on abuse of power as it relates to ukraine and abuse of power and coverup. all three lawmakers noted they were told no final decisions had been made quite yet. and according to the "washington post," house speaker nancy pelosi asked house democrats

quote are you ready and lawmakers reportedly answered back with shouts of approval. democratic lawmakers mentioned to the paper that speaker pelosi did not announce a time line, and in a separate closed door meeting, vice president pence rallied republicans in support of president trump. nbc legal analyst danny cevallos with us, and senior staff writer for the hill, scott wong. >> danny, you had three of the four legal scholars as you saw there called to testify yesterday in front of the house judiciary committee undoubtedly saying that the president committed impeachable offenses here. what does this mean going forward? >> well, now, the public has seen the analysis, they got the facts in the previous week, and now they have the legal analysis. and they had a fourth republican witness called by the republicans, to counter that, and it was quite a contrast. but the effect was clear. the overwhelming majority, at least of the four witnesses, believe, in their legal

expertise, that what we saw in the previous weeks by the house intel committee, rises to the level of an impeachable offense. and it was a law school seminar for those who may not have been familiar with the history and traditions, not only of england, but of the colony, pre-dating the constitution. and that was designed to guide us in understanding what exactly is a high crime or misdemeanor. >> scott wong, we were both in that hearing yesterday. i was struck by jonathan turley's comment, in part because he didn't seem to say that impeachment was sbir, enti unwarranted. his main point that republicans are moving, democrats are moving to quickly and that president trump should be investigated for a longer period of time and that is not what president trump wanted and do you think the republicans did enough to support their guy in the white house, or in support of. >> that sort of speaks to the

fact that democrat, or i'm sorry, republicans, were at an extreme disadvantage throughout this entire hearing, right? democrats and jerry nadler controlled the process. nadler could gavel down any sort of interruptions. democrats were able to approve all of the witnesses, including the republican-called witness jonathan turley who you just identified. and to, you know, this is why you saw the trump campaign, and republicans on the diet, sort of going after professor karlan of stanford when she invoked the name of the president's son, barren's son when she tried to crack a joke about the president's son, not named as a king or a true barron. >> and even turley, the republican-called witness, as you mentioned, said that these were in fact impeachable offenses that he saw, he just

didn't think that the impeachable offenses had been proven yet, by the democrats. >> danny, i want you to expand on that a little bit from your legal perspective. turley's comments that this is moving to quickly. glenn kish ner who appears on the air quite frequently says he supports turley and what he had to say saying it is moving to quickly and slow down the testimony of mcgahn, and mulvaney and pompeo and others as professor turley has said, we don't want to move too quickly or investigate too narrowly, all of the abuses should be investigated and exposed. so what do you make of this argument from a legal perspective, that in fact, the democrats have pushed this too quickly? >> what made jonathan turley very credible in many ways was that he didn't argue for innocence, if we're going to compare this to a criminal trial, he didn't argue that the defendant here was innocent. instead, he argued two different points, which is there is insufficient evidence, which is

very different than innocence. and he also argued that the procedure was flawed, that it is moving too quickly, or that it is moving too narrowly, which in many ways, both alienated republicans and democrats alike, because he was a republican witness, and republicans are probably not too thrilled with him today because it was certainly less than a full-throated defense of the president. and in that sense, he came off very believe able. because he was giving what appeared to be an objective opinion. now, glenn's point is a little different than well, look, if we're going have a longer investigation, then let's hear from the people we really want to hear, from the mick mulvaney, the john bolton, the other folks who have refused to testify so far. that is a slightly different argument but a compelling one all the same. >> one of the reasons that house democrats say they have to move quickly, president trump according to the theorist case is trying to, or was trying to cheat in the next election and

that's why he has to be held to account right now, so quickly. so yesterday, you had a couple of lawmakers tell our team, that they walked away from that house democratic caucus meeting yesterday morning with the understanding that they would take a vote by the december 20th christmas break. so help us understand what steps come between now and then, when the house is expected to, at this point, it seems, vote on these articles of impeachment. >> well, i was told yesterday, yes, things are moving full speed ahead. the judiciary committees said that they had been told to stay in, and work through the weekend here, in washington, and not to return home to their congressional districts. what that says to me is that they realize every day counts, there's only ten or 11 legislative days before christmas, and they're dismissed for the holidays and so if they want to get this done by christmas, they're realizing they have to work 24 hours a day

here, and so you know, what's going to happen at this point, is that they're going to probably hold one additional hearing and hear testimony from the intelligence committee, and adam schiff's people, and then i think they are moving right to votes. we could see a vote on impeachment on the house floor, as soon as late next week. >> wow, unbelievable. >> danny cevallos, thank you. scott wong, thank you as well. we will talk to you both again in a little bit. stick around. senator elizabeth warren tears into presidential candidate michael bloom ber on his own turf and her new comments on his 2020 bid. >> and joe biden gets asked about a possible running mate and who he says we consider for the job. those stories and a check of the weather when we come back. k. ♪everybody

believe his fate should be left for voters to decide in the 2020 election. one of president trump's talking points that happens to be debunked is not landing well with americans. just 30% believe that ukraine interfered in the 2016 election. when in fact, it was russia. but at 44%, the key part of trump's base, fox news viewers believe the false talking point to be true. while yesterday's hearing was taking place, u.s. senators were preparing for the likely impeachment trial of the president. senate republicans met with white house counsel pat cipollone to discuss strategy in a closed door lunch and yesterday, minority leader chuck schumer gave a presentation about the mechanics of a potential senate trial and jeff, you were part of the hill team that nailed down the reporting, and great reporting at that. talk us through some of the details of this, and the strategy that you're hearing from, from both sides? >> it is interesting, right, because the senate yesterday released the calendar for 2020

and the entire month of january was missing from the calendar. that's the month that they expect that if the house votes on impeachment or votes to impeach president trump that the senate would have its hearing. on the democratic side, you had chuck schumer i'm told, he showed video clips of the 1999 senate trial for then president bill clinton because you only have about seven senate democrats among the 47 who are there now, seven who were there in 1999, so for the rest of them, this is an entirely new process. over on the republican side, as you mentioned you had the white house counsel talking strategy with senate republicans and i'm told that the white house counsel, pat cipollone, told those senate republicans that he expects the white house to mount a defense if or when there is a senate trial. so president trump says he will not participate in the house proceedings. he says he wants his people to testify in the senate, because he thinks they will get a more fair hearing. we will see as it comes to pass. >> we will see back and forth as the time line and if the january

i'm yasmin vossoughian. lingside nbc news white house correspondent jeff bennet, in for amin, as the house judiciary committee moves forward with the impeachment inquiry, president trump's personal lawyer rudy giuliani was in europe. "the new york times" reports that according to people familiar with the matter on tuesday, giuliani met with former ukrainian prosecutor in budapest and travelled to kyiv and hoping to meet with other ex-ukrainian prosecutors including viktor shokin, fired in efforts to crack down on corruption. and the times notes that the former new york city mayor is reportedly helping right wing news network with a documentary series promoting his arguments against the impeachment inquiry. now to more of the key moments from yesterday's impeachment hearing, we heard

from four legal scholars, three told the house judiciary committee that there is no doubt they say the president's actions regarding ukraine are impeachable but the fourth witness did not defend the actions at the heart of the inquiry, but instead argued against the process. watch this. >> it is not wrong, because president trump is right, this call is anything but perfect, it is not wrong because the house has no legitimate reason to investigate ukrainian controversy, it's not wrong because we are in an election year, there is no good time for impeachment. no, it's wrong because this is not how you impeach an american president. i've been critical of the president in terms of crossing lines with the justice department. i think that has caused considerable problems. i don't believe it is appropriate. but we often confuse what is inappropriate with what is impeachable. you know, many people feel that what the president has done is on knocks, contemptible, and

contemptible is not synonymous with -- >> on the basis of the testimony and the evidence before the house, president trump has committed impeachable high crimes and misdemeanors. by corruptly abusing the office of the presidency. >> when president trump invited, indeed demanded foreign involvement in our upcoming election, he struck at the very heart of what makes this a republic to which we pledge allegiance. >> if left unchecked, the president will likely continue his pattern of soliciting foreign interference on behalf of the next election. and of course, his obstruction of congress. >> joining us here on the set, msnbc legal analyst danny cevallos and also back with us from washington senior staff writer for the hill, scott wong. danny, i want you to weigh in on the most recent news from "the new york times" with rudy giuliani still working with the ukrainians to help the president. i can't help but think that this is in a way giuliani starting to

mount his own defense in that he would be saying, look, i'm doing it out in the open, ie, i have been doing nothing wrong. >> it is an interesting pr defense. the one approach might be hey, rudy, stop doing anything with ukraine, but the other approach, just as you suggested might be oh, you think i'm doing something wrong in ukraine, i'm not going to super do things in ukraine, just to show that i'm doing absolutely nothing wrong. it is a bit of a risk, because every day, he's involved in ukraine, he could be committing acts that other folks think are unlawful, even though he may think they are warranted. and certainly, he's got considerable background in knowing what is and is not lawful but it just may be that folks in the d.o.j. might ultimately disagree with that. >> good point. scott wong, what's the word from republicans on the hill that you talked to rudy giuliani, not just "the new york times" but the revolutions in the house intel report that giuliani is

not an administration official had repeated and lengthy phone calls with the white house budget office. >> well, ever since rudy giuliani became, or was revealed as a central player in this ukraine scandal, i think there has been heartburn from republicans, whenever we're discussing rudy giuliani. i mean remember, he was giving tv interviews, almost every night, talking about his, talking about this episode, trying to defend the president. there is really i think a sense of exasperation on the part of republicans that they feel they can't control rudy giuliani, especially at this stage in his life, i mean he is going to be who he is, and nobody feels like they can control it, and then in respect to him traveling to ukraine, i think there is just, you know, it is sort of a page out of the president's own play book, right, when there is something that he is being

accused of doing wrong, the president just sort of says it or does it out in the open, i think rudy is taking a page straight out of the president's play book. >> you can't help but think about the split screen here, with rudy giuliani meeting with former officials, in ukraine, at the same time as an impeachment inquiry with regards to a phone call to the ukrainian president between the ukrainian president and president trump, happening here at home. i want to concentrate again on the testimony from yesterday. because there were so many astounding moments. you had three witnesses, democratic witnesses, arguing basically that trump's conduct regarding ukraine is exactly what the founders had in mind, when they carved out a path for removing a president. what do you make of that argument? >> that's exactly why we got such a good history lesson yesterday, from all the witnesses. and it is important to understand that high crimes and misdemeanors were understood to mean not felonies misdemeanors but crimes of abuse of the office and framers put in very

important safeguards of foreign influence such as the one we're, natural born citizen, must be president, you can't be foreign born, that was designed, that's an example, of the fear the founders had, of foreign interference. so in a sense, the witnesses yesterday were correct, that this is arguably exactly the kind of thing they feared, that a foreign influence, that a president would seek foreign influence, in an election, for personal gain. you look at the two exemplar crimes, treason and bribery they're corruption crimes, not the worst crimes in the books, it is clear that the founders feared exactly this conduct. >> and scott, to danny's point, to tell you, the democrats i've talked to, the house democrats i've talked to, they have in mind two, potentially three, obstruction of power, obstruction of justice, and the mueller report, and help us under why the third article of impeachment connected to the russia investigation is a little controversial. >> there is a debate happening right now, as you know, in the

democratic caucus, about which articles of impeachment to bring forward, how large that scope should be. you know, the democratic leadership, those close to nancy pelosi, believe that the narrower focus they can focus on, meaning ukraine, the better they're able to make the case to the american public. once you start to broaden it to a emoluments and the mueller report, or russia report, from the 2016 re-election, people start to think you're trying to relitigate that election, which has been a talking point for republicans, and so this is the debate we're seeing right now, in the party. and nancy pelosi, i believe, wants to keep this narrow and focused. >> danny cevallos, scott wong, thank you guys both. >> thank you. still ahead the latest in the race for president, joe biden discusses a future spot for kamala harris, in a biden administration.

saturday, and we will see it moving onshore, very typical, heavy rain event, and high elevation snow and not a lot of cold air with this storm so even as it travels across the country, there is not going to be a lot of big huge snow amounts but on sunday, we will get some snow here, montana, into the plains, and then the storm really races quickly, as we go through sunday, into monday, into the eastern half of the country and the green on the map shows you where it will be raining and monday, a rain-out in possibly areas of the northeast and tennessee valley and ohio valley. not a lot of snow but a little bit on the backside of the storm and areas of wisconsin. so today is kind of chilly and cool but as that storm moves across the country, it is a pacific storm, so we will actually see mild air ahead of it. and we will see a nice little warmup into next week, in areas of the east, and some spots getting into the 60s, even into west virginia, so yes, enjoy, this could be one of the last warmups we get for a while. it looks like cold after that. >> thank you, bill. all right, still ahead, after being called two-faced by president trump, canadian prime minister justin trudeau admits

chief for axios nicholas johnston. good morning to you. >> good morning. >> talk to us about axios' one big thing today. >> today's one big thing is the end of the trump manufacturing renaissance. the manufacturing industry got a big boost at the start of the trump administration due to the strong economy and expectations on the trump administration's regulatory policy. but we're starting to see those gains begin to stall and even erode because of uncertainty around the trade war, china, and around increased tariffs. why this matters is simply because trump made rebuilding the manufacturing industry a centerpiece of his campaign. what we're seeing say lot of actions on trade are hurting some of the people he pushed for most during the campaign, particularly manufacturers and also farmers who have had to receive aid because of that. you go back to the beginning of the trump administration, the job growth manufacturing was double what it was at the end of the obama administration. but this year as trade uncertainty has increased, we've seen increasing pressures rachet up, increasing tariffs, those numbers have turned negative.

and when economists we talk to tell us what to expect, they think it will get worse as it gets better as these trade uncertainties grow. >> and axios is reporting that there's a new leading candidate among college students to become the next president of the united states. i'm guessing it's bernie sanders. you tell me, who is it? >> you guessed correctly. bernie sapders is taking the lead in our college reaction polls of university students. we're seeing that elizabeth warren had fallen among many of the people in universities. that's a fall that mir arerors the general populous. but as pete buttigieg rose among older folks, it was bernie sanders who rose among college kids. the way to look at that is the concern among older folks, they were worried about warren's medicaid for all policies and her support has begun to erode. it's the exact flip for kids in college. bernie sanders wrote the medicare for all and now he is
