a.m., the republicans will have another chance to refute what is presented to the committee. chairman nadler says the committee will have articles of impeachment by the end of the week, a tract that could have the president impeached by christmas. >> we have a lock solid case. i think the case we have if presented to a jury would be a guilty verdict in about three minutes flat. >> the white house has declined an invitation to the hearing, it has been consumed, tweeting and retweeting more than 100 times yesterday mostly about impeachment. the republican senator ted cruz of texas on "meet the press" tried to advance the discredited theory that ukraine meddled in the 2016 election despite a briefing by u.s. intelligence officials warning the narrative is being promoted by russian security services. >> do you believe ukraine meddled in the american election in 2016? >> i do, and i think there's considerable evidence of that. >> you do?

you do? >> chuck, let me say. >> senator, this sort of strikes me as odd. because you went through a primary campaign with this president, he launched a campaign against you, went after your faith, threatened to quote spill the beans about your wife about something and pushed a national enquirer story which we now know he had a real relationship with the editor -- >> you're dragging up all that garbage, that is very kind, go ahead. >> let me ask you this. is it not possible that this president is capable of creating a false narrative about somebody in order to help him politically? >> except that's not what happened. the president released the transcript of the phone call. you can read what was said on the phone call. >> and the bidens, and you were, you yourself thought the biden plot was troubling. >> check, let me point out again that the media is playing, a question that you have asked a number of people, is you have said to senators, sort of aghast do you believe that ukraine and

not russia interfered in the election. now that, in a court of law, would be struck as a misleading question. of course, russia interfered in our election. nobody looking at the evidence disputes that. >> but the president of the united states does. >> look, on the evidence, russia clearly interfered in our election. but here's the game the media is playing because russia interfered, the media pretends nobody else did. ukraine blatantly interfered in our election. the stitting ambassador from ukraine wrote an op sed blasting donald trump. >> meantime senator lindsey graham dismissed the severity of the impeachment inquiry and issued a stark warning to house democrats. >> we're not going to turn the senate into a circus and i would tell schiff, what you're doing is very dangerous for the separation of powers here. adam schiff is doing a lot of damage to the country. and he needs to stop. mueller spent two years and $25 million looking at trump. this whole ukrainian stuff is a

joke. they got the money. they got the meeting with the president. they didn't investigate hunter biden or joe biden. there is no "there" there. >> and defense secretary mark esper declined to answer if he was aware of political considerations regarding the trump administration's hold of nearly $400 million in u.s. security aid to ukraine. >> you were the secretary of defense this past summer when a lot of these actions were going down with regard to ukraine. did president trump ever explain to you, tell you, why he was holding up u.s. military aid to ukraine, an ally, who is, and is in in a current war with russia. >> i'm not going to get into that. there is obviously an inquiry on that in capitol hill. i came to the story in late july when i assumed office. >> you had been acting as secretary earlier in july. >> i had for a couple of weeks and out of the game for a couple of weeks while we waited for my confirmation process.

>> i will tell you this much. when i came on the scene, the three things we were looking at was this, one, was the aid necessary vital to the ukraines in terms of defending against russia. number two, had the ukrainians addressed corruption and that was a dreshl congressional concern. and were other countries in the region, other allies assisting them. and given those three things we decided to support the provision of ukrainian aid. at the end of the day, the bottom line most of the aid got out on time and at no time did it have impact on united states security. >> and you did not have knowledge of congressional inquiry? >> i am not going to get into that. >> and there was a hold placed on the aid to investigate the bidens and democrats. the administration released the aid two days after congress became aware of a formal whistle-blower complaint regarding president trump's actions towards ukraine. the department of justice is expected to release a watchdog

report on the fbi's investigation of donald trump 2016 campaign, sometime today. the inspector general michael horowitz signalled to the senate that the report is ready. ahead of his testimony in front of the judiciary committee on wednesday. nbc news reported last week, that the inspector general found no evidence that the fbi spied on trump's campaign. and that's according to people familiar with a draft of the report. the "washington post" reports that the attorney general bill barr has told associates that the he disagrees with the report's assessment that the fbi had enough information in july 2016 to justify launching an investigation into members of the trump campaign. according to people familiar with the matter. "the new york times" reports that bar has recently approved the release of new details about the former fbi informant behind the steele dossier that had previously been blanked out in the upcoming report. meantime, the timing of the report's release has hurt some of the former officials

interviewed by the inspector general, who told "politico" that the standard review period seemed rushed so that it would be made public in the middle of the impeachment proceedings. joining us now from washington, managing eder to of the washington examiner jay caruso, good morning to you. thank you for joining us this morning. >> good morning. >> talk to us about how it is that republicans are preparing for this watchdog report, this inspector general report, being released today, which the president teased over the week, saying it is one of the most important things to watch this monday morning. what is expected here? refute some of what has been the republican's main talking points up until now. >> well, i think it will refute the talking point that the entire investigation was a political operation initiated by this rogue element within the fbi that wanted to see donald trump go down. in the 2016 election. however, there is going to be some troubling aspects for that, for the fbi, and i think that

the "washington post" story, talked about the issue of the fiso warrants and particularly the steele dossier. the steele dossier the fbi said, we had used christopher steele before, and he was a reliable witness, but the report says something about well, this time, he wasn't the actual witness to anything, he was getting secondhand information, was that information checked out, so while i don't think there is, there is not going to be a smoking gun for republicans in, there i think they're going to find enough that they're going to overplay their hand, as they've been doing a lot of times with these reports, in going after little bits and pieces to say ah-ha, we were either, donald trump has been vindicated in his attacks and this is nothing but a witch hunt. >> as we prepare for this hearing today, which we expect to be the final arguments in the impeachment process, you have jerry nadler the chairman of the committee saying that presumably by the end of the week, articles of impeachment could be introduced and voted on by the committee. so help us understand what gets us from here to there.

>> this seems to be a forgone conclusion since this started. i don't think there is anybody who doubts that there is going to be a situation where democrats were not going to present articles of impeachment. and i think what we saw yesterday with ted cruz, particularly on his appearance on "meet the press," you will have some of the louder defenders of donald trump, including lindsey graham, cruz and others will make the case that trump did nothing wrong, he was seeking out corruption, and they got the money, and nothing got held up, so there is no "there" there. but today, you're going to see the democratic lawyers in the judiciary, i think on the intelligence committee, lay out their case forry donald trump should be impeached, and again, i think it goes back to the fact that i don't think there was anything, this is a foregone conclusion, they were going to do the articles of impeachment. the question is, the big thing you're going to see is how many democrats are you going to get in the house that will vote for him? are there going to be any who will vote against them?

welcome back. president trump said over the weekend, that his personal attorney, rudy giuliani, wants to deliver information he's gathered on ukraine to congress and attorney general bill barr, the president told reporters giuliani has not told him what information he has found yet but he has heard there is a lot to go through. >> well, i just know he came back from some place, and he's going to make a report, i think

to the attorney general, and to congress, he says he has a lot of good information, and i have not spoken to him about that information. but rudy, as you know, has been one of the great crime fighters of last 50 years, he has not told me what he has found, but i think he wants to go before congress and say, and also to the attorney general, and the department of justice. i hear he's found plenty. >> nbc white house correspondent kirsten welker asked giuliani about trump's comments and whether he plans to give information to the attorney general and lawmakers, and he texted this, all of my conversations are privileged and he can disclose what he is comfortable with. i am in the process of analyzing what i have received. the "washington post" is reporting that during several conversations in recent months attorney general william barr counselled president trump in general terms that giuliani has become a liability and a problem for the administration, according to multiple people familiar with the conversations. in one discussion, the attorney general warned trump he was not

being well served by his outside lawyer. officials tell the post that white house aides to giuliani have used his role as the president's lawyer to promote the interests of private clients, and they fret that they don't know who he actually represents. giuliani's conversations with trump are protected by attorney-client privilege. the post notes that the former white house chief of staff john kelly tried to limit giuliani's reach scheduling his meetings with trump at the white house residence so he would not interact with other white house staff. former administration officials say kelly also told others he did not want to be part of calls or meetings with giuliani. and the justice department and the white house both declined to comment on the post's reporting, and giuliani did not respond to multiple calls and messages and his lawyer also declined to comment as well. joining us here on the set, mbs nbc legal analyst, msnbc legal analyst danny cevallos and we know that giuliani was traveling in ukraine while everything was happening here at home with regards to impeachment

and the phone call with the president of ukraine. do you think that these findings that the president is speaking of, that they could help the president, or do you think that they could further implicate him? >> yes, they could do both. and here is why. yes, giuliani's activity in ukraine and in europe is very risky. not just for rudy, but for trump as well. but there's a chance it could actually end up helping the president, here's why. this defense in the impeachment investigation is win knowing down really to one. and it can only be that the investigation was warranted because there was corruption in the ukraine, and that corruption included hunter biden. that's the only defense really left for the trump team. and so rudy giuliani -- >> it still wouldn't explain the quid pro quo. it wouldn't explain asking a foreign government for help in investigating your political rival in domestic elections, in a domestic election. >> to the trump team, it could,

because it comes down to motive. yes, it may be true that hunter biden, the investigation could help president trump, but if the overriding concern was a real concern, about hunter biden, and corruption, and there is a connection between burisma, hunter biden and corruption, then the president will argue that my article two power as the chief law enforcement agent for the entire country overrides the fact that i might have also gotten some benefit from investigating hunter biden. i have been saying for a long time, it is an argument that i don't think a lot of people will buy. i see from your expression that you're not really buying it. and i tend to agree with you. but that is -- >> then go to the fbi. >> but they've closed off every other escape hatch, and this is where the defense is leading to. it is leading to, i was warranted in doing it. because he has already made the admission in his statement that he adopted as his own, that he asked for an investigation, and he asked for someone to look into hunter biden. and so the only escape hatch is

that hunter biden was in fact, a corruption threat. the problem is, it is just not credible that it just so happens that hunter biden is a corruption concern and greatly benefit trump's election chances. >> danny, the last time that rudy giuliani made evidence as he calls it, or information available to the trump administration, that we know of, it was when he gave that state department a packet of disinformation that had to do with smearing marie yovanovitch. so the question here is, and president trump has said that giuliani intends to go before congress and william barr with this information, doesn't he run the risk of presenting fall information to the congress and to the d.o.j. which is a crime? >> absolutely. and it is important to know that whether sworn or unsworn, false statements to congress are federal crimes. so this is a tremendous risk. so if rudy giuliani is bundling together a package that includes too much false information, information that has been publicly debunked, then look for democrats to say that not only

welcome back, everybody. following breaking news this morning. new zealand police saying at least five people are dead after a volcano erupted off the coast of new zealand. the eruption happened on white island off of the country's east coast, sending an ash plume, 12,000 feet into the sky. you can see some video there of people on a boat watching this volcano erupt. it is incredible. and devastating to see. now, the deputy commissioner of the police say that rescue operations have been stalled because it is too dangerous for police and rescue services to go to the island, at least 50 people were believed to be in the area, at the time of the eruption. both new zealanders and overseas tourists are among the missing and injured. some of those involved were guests on the royal caribbean international cruise ship owe sation of the, ovation of the

seas. the associated press is looking at why tourists were still being able to visit the island after scientists recently detected an uptick in volcanic activity. a check on the weather no you with nbc meteorologist bill karins. >> we're about to learn something, because those scientists are called what volcanologists. >> did they have any heads up? was there shaking of the ground? interesting. as you head out the door today, a lot of rain moving up the mid atlantic and through the ohio valley. and snow on the backside of the storm. one of those travel delays and days in areas of northeast. i think we're up to significant delays especially the second half of the day and all of the new york city airports, philadelphia, dc worse, early today, boston the rain will move in, especially hard this afternoon and even detroit could have some rain, maybe some fog, and snow in areas of minneapolis, and it is not horrible, but snowing now, and another inch and then clear it out later. if you're driving, especially

the evening drive, from new york city, up i-95 heading through connecticut and massachusetts and into maine, that is going to be a soaking slow drive, as we go throughout the evening. the timing of all of this mess, during the day today, there is the rain we showed you this through this evening with the travel delays, and then as we go into tomorrow, that was part one, and part two comes through the southeast. and if you notice, the backside of this, at the same time this storm is moving to the south, cold air is pushing in. with a narrow band of snow in the north side of this. maybe northern portions of mississippi. and even nashville could get a little bit of snow on the backside of this. and as we go into wednesday morning, that's when it looks like the cold transition moves into dc, philadelphia, and new york. this is the radar for 8:00 a.m. wednesday morning, showing snow in southern new england and new york and philly and dc and the temperatures on the surface of the roads will be warm enough that they will stay slushy or wet but we will see accumulating snow, the secondary roads and the bridges and the cars and the

grass. minneapolis, northern wisconsin, snow. and here is the snow, as we go throughout wednesday morning. the first accumulating snow of the season. back up through philly and new york. not a big snow event but minor travel days possibly. >> and we will talk about the volcano once again. as i was reading through some of the reports this morning, the last time this thing erupted was back in 2001. and some of the video that we have been seeing and showing throughout the last couple of hours has been from people, tourists who were visiting the volcano, literally minutes before they boarded this boat, and left the island and saw the volcanic eruption but you can't help but think when you hear from the volcano ologists, these scientists, how they could not have known that this thing was about to erupt. >> yes, i read one thing from the people of new zealand, they can't believe tourists were allowed to go there. and growing up as kids, they

welcome back, everybody. i'm yasmin vossoughian, alongside nbc news white house correspondent geoff bennet. amin is back in the chair tomorrow. today marks another key moment in the impeachment push, ha what could be the democrats' final chance to argue publicly that donald trump committed impeachable offenses before charges are drawn up. at 9:00 a.m., democratic investigators will present their case to the house judiciary committee, and republicans will have another chance to refute it. the white house has declined an invitation to participate mount nothing defense against impeachment in the house opting instead to make the case for acquittal in the senate. chairman jerry nad ler expects the committee will formally introduce charges against the president by the end of the week. >> do you have any idea of how many articles you think you're going to draw? you're in the ready yet? you seem to be hesitant? >> we are still -- >> the speaker --

>> she will have a role. as the other members of the caucus. >> republicans are far outpacing democrats by blitzing americans with impeachment-related ads on social media and television. the "washington post" reports that the onslaught of ads has actually worried some democrats in swing districts, who are being painted as do nothing pro impeachment radicals. those democrats have reportedly been urging party leaders to strike back with their own counter messaging for weeks and told that the calvary have been coming but not a firm date. over the past month, republicans have launched roughly $10 million in ads aimed at democrats in districts that president trump won in 2016. according to an analysis by the post, more than 100 gop congressional incumbents ran anti-impeachment facebook ads, roughly three times of that the democrats. joins us is jay caruso. what do you make of the spending spree by the gop on

impeachment-related ads. they must sense and the polls sort of bear this out that impeachment at least works for them politically. >> right. >> you're right about the polls. i've been saying this for, you know, over a month now, if you saw the polls getting to support for impeachment up into the upper 50s, 60%, then you would see republicans running for the hills. but what we're seeing now, and i think the latest 538 polling has impeachment at 47% pro and 4i%, 47% opposed, and 43% support, so you're not getting above 50%, so republicans sense, okay, we can go all in, this is not going to get any worse for donald trump at this point, unless something out of the ordinary happens. so we can go along and we can defend him and actually go after the swing districts in the house, that i talked about earlier, that there is going to be, some of these democrats may choose to sit there and say, okay, politically, we just can't do this, and if democrats don't

strike back, with their ads of their own, going into this, and it could spell trouble for some of those democrats in the swing districts that trump won in 2016. >> some prominent republicans have outright denied that the president had even asked ukraine to investigate his political opponent. is that going to be the gop's primary message going forward, on impeachment? we have heard so many varying defenses of the president, up until now. >> right. well, the president unfortunately hasn't allowed the republicans to make any other defense, other than to say that he did nothing wrong. because that is all he says. with the republicans, the wiggle room to say what he did was wrong, she haven't done it but it is not something that is worthy of removal from office. he hasn't done. that if you saw ted cruz on "meet the press" yesterday, he isn't in on the whole thing that he did nothing wrong, investigating corruption, as laughable as it may seem,

republicans believe they have the political capital to go ahead with, that especially the louder defenders of trump, such as cruz or lindsey graham. republican congressman devin nunes yesterday down-played the communications with lev parnas an indicted association of rudy giuliani, suggesting that it was limited to a call with parnas's wife, despite phone records from the committee last week listing two calls from nunes to parnas. >> somebody concocted this story in order to try to get this parnas guy, who i have never met -- were you ever on the phone with him though? because there is a phone call. >> i said this yesterday. i went through my records on friday, and very clearly, i got a call from a number that was parnas' wife, and i remember talking to someone, and i did what i always do, which is that if i don't know who they are, you put them to staff and let staff work with that person.

>> the fbi is investigating the shooting that killed three people at a pensacola florida naval base florida as an act of terrorism. officials want to know if the shooter, a 21-year-old second lieutenant in the royal saudi air force acted alone or part of a larger network. law enforcement sources say investigators believe the shooter returned to saudi arabia, after starting his u.s. training back in 2017. and when he came back earlier this year, he was more pious and refrained from socializing. officials say he recently showed veries of mass shootings to others and authorities believe a tweet posted just before the shooting claiming that america was anti-islam belonged to him as well. in addition to the three young men killed eight people were injured including two local sheriff's deputies who exchanged gunfire with the shooter and killed him. law enforcement sources telling nbc news, that noncitizens are typically prohibited from buying handguns, the gunman had a valid hunting license which allowed

him to legally purchase his weapon. just hours after the shooting at a naval base, president trump attempted to salvage his relationship with saudi arabia by responding to the attack in a series of tweets. the president wrote in part this, king salman of saudi arabia just called to express his sincere condolences an give his sympathies to the families and friends to the warriors who were killed and wounded in the attack that took place in pensacola florida. the king says the saudi people are greatly angered by the barbaric actions of the shooter and this person in no way shape or form represents the feelings of the saudi people who love the american people. on saturday, while leaving the white house for a republican fundraiser, trump spoke to reporters but refrained from calling the attack an act of terrorism. >> i spoke with the king of saudi arabia. they are devastated in saudi arabia. we're finding out what took place. whether it is one person, or a number of people. and the king will be involved in taking care of families and
