iowa caucuses and the democratic presidential candidates are ramping up their attacks on each other. and the super bowl is all set, next month the san francisco 49ers will face off against the kansas city chiefs after both teams won their reference championships yet. ter reference championships yet. after both teams won their conference championships yesterday. good monday morning, everybody. it is january 20th. i'm yasmin vossoughian. ayman is out today. we begin with president trump's long awaited impeachment trial beginning tomorrow. the process is expected to kick off with majority leader mitch mcconnell introducing the organizing resolution that outlines the rules that will govern this trial. there will be up to two hours of arguments between the democratic prosecutors and the white house defense team after that. minority leader chuck schumer is expected to introduce an amendment that would take up the issue of witnesses and documents. last night, schumer vowed to

force a vote on the issue and criticized mcconnell for not yet releasing the organizing resolution. >> we are going to demand votes, yes or no, up or down, on the four witnesses we've requested and on the three sets of documents we requested. we will force those votes. mcconnell has still not come up with his proposal. that's unheard of. we don't know what it is. i as democratic leader don't know what it is, even though it's going to the floor tuesday morning, most republicans don't know what it is. why is mcconnell being so secretive about his proposal. >> all right. so once the organizing resolution is actually laid out, opening arguments will take place, republicans are considering a plan that would give each side 24 hours to present their case followed by 16 hours for senators to ask

questions in writing. meanwhile, democratic prosecutors in the president's defense team already trading sharp attacks ahead of the impeachment trial. on saturday, the seven democratic congressional leaders that will try the case against trump outline their arguments in a 111-page briefing to the senate. they argue that the president's conduct in office is the founding father's quote worst nightmare, and called trump quote a danger to our democratic process. they write in part this, president donald j. trump used his official pouwers to pressur a foreign government to interfere in a united states election for his personal political gain and then attempted to cover it up. his scheme, by obstructing congress's investigation into his misconduct. in a six-page statement president trump's defense team hit back calling the impeachment charges brazen and unlawful. they write in part this, the articles of impeachment submitted by house democrats are a dangerous attack on the right

of the american people to freely choose their president. they go on to say this, president trump categorically and unequivocally denies each and every allegation in both articles of impeachment. democratic prosecutors slammed trump's defense team with another statement writing in part this, rather than honestly address the evidence against him, the president's latest filing makes the astounding claim that pressuring ukraine to interfere in our election by announcing investigations that would damage a political opponent and advance his reelection is the president's way of fighting corruption. it is not. rather, it is corruption itself, naked, unapologetic and insidious. this is precisely why the president must be removed from office. >> the white house legal team sent their response last night to the articles of impeachment, abuse of power, obstruction of justice. they on the first argue that there was no violation of any law, and on the second point, they argue that the president had the right to refuse to

produce documents and witnesses due to executive privilege. how are you going to prosecute this case? >> well, both of those statements are errant nonsense, there is ample evidence, overwhelming evidence, any jury could convict in three minutes flat that the president betrayed his country by breaking the law. >> all right. let's get to the president's impeachment defense team. white house counsel pat cipollone and jay sekulow will be playing leading roles. with the addition of alan dershowitz and ken starr, hardly the most high profile members, two of the biggest legal names of the '90s. dershowitz helping with o.j. simpson's murder case, and starr, the independent counsel who investigated bill clinictop. in t -- clinton.

dershowitz, a friend of epstein until his suicide sued a victim for defamation after she claimed she was traffic to the attorney while under age. starr meanwhile played a role in the controversial plea deal in which epstein avoided federal charges and served only 13 months in jail with a work release. starr defended his role in a march 2019 letter to the editor of the "new york times" in which he and other lawyers for epstein argue that the deal was fair. also on the impeachment defense team, former florida attorney general pam bondi, and former independent counsel robert ray who succeeded starr in the clinton investigation. "the washington post" reporting that starr, dershowitz, bondi, and ray were selected personally by the president for their celebrity, and vocalness in the media despite their baggage. alan dershowitz is arguing the put should not be removed from office even if he is guilty of the house charges. >> as you know, the house

materials have cited crimes that were committed as well. >> they weren't elements. the articles of impeachment are two noncriminal actions, namely obstruction of congress and abuse of power and those are what have to be voted on by the senate. >> is it your position that president trump should not be impeached even if all the evidence and arguments laid out by the house are accepted as fact? >> that's right. >> wow. joining us, msnbc legal analyst, danny cevallos, and white house correspondent, checking his messages for sources, jeff mason as well. thank you for joining us this morning, guys, very much appreciated. jeff, i'm going to start with you on this one. let's talk about this back and forth we're seeing. i think this is a precursor for what we're going to see over the next couple of weeks and the senate impeachment trial. the back and forth between the president's defense team as well as the house prosecutors. what do you make of it? >> well, i think it's a case of both sides really having the

same set of facts and interpreting them entirely differently, and that was, you know, very much on display by the fact that you've got the white house not really disputing anything that the house managers have been arguing but saying as in the clip that you just played, that it just doesn't rise to the level of impeachable offenses. the president wants very much to be vindicated in this trial. he has chosen the team that you have just laid out to do that, partially because of the fact that they are familiar on television and can do so there. but also because he believes that they can do so in the senate. but in general, this is a strategy not just on a legal level but also in the court of public opinion and the president wants to win there. >> danny, let's talk about the president's defense team here as we are seeing some pretty high profile names. we have ken starr, alan dershowitz, we have pam bondi, pretty big names to say the

least. what do you make of the defense team in general? >> they are huge draft picks. kenneth starr was a huge pick, alan dershowitz as well. they are perfect for the mission. they are very trumpian in that they are well known commentators, good at getting their message on tv. they will be familiar to people. the mission is not a traditional criminal trial in an article iii court. this is a trial of convincing not only a hundred senators but also the entire country who's going to be watching and in a way they are playing a kind of prevent defense. the republicans know they don't have the votes, as it stands to impeach and convict and remove the president, so at this stage, i think this is a really good and a very accomplished team in dershowitz and star for this defense. >> do you think that this defense team, danny, is a type of defense team that's going to allow the president to be the president, ie, you can treat as much as you want, because it can

help your case or stay quiet, and let us take care of it. >> they can tell him to stay quiet. he's not going to listen. you're right in bringing up a common problem we lawyers have with clinents, the client that doesn't listen. any lawyer that works for trump knows that at this stage, he's not someone that you can order to stay off twitter no matter what. >> jeff, talk us through what we're going to see playing out tomorrow. >> well, number one, it's really the kickoff to the trial itself. we saw last week the chief justice coming in and swearing, being sworn in himself and swearing in the rest of the senators. tomorrow, i think, you're going to start seeing the actual trial kick off. you'll see the attorneys there. you'll see the senators start getting into some arguments, start actually listening to the oral follow up to what was submitted in written form over the weekend, and it will start to begin to feel like an actual trial. >> danny, what do you think about dershowitz's argument here

that no matter what, even if he is guilty of the charges that have been brought forward that he should not be removed from office, that this does not rise to high crimes and misdemeanors? >> i'm going to give you such a legalese answer to that, it's a little more nuanced to that of course. the constitution mandates if he is guilty, adjudicated guilty, he must be removed, there's no option, there's no probation. there's no anything else, you must be removed. instead what he's arguing is more like a yeah, so what. we call it a rule 12 b 6 motion. the bottom line is he's saying if he did everything he's alleged to do, he's still not guilty and he wrote an entire book based on this premise which is that the constitution requires the text of it appears to require a crime, therefore, unless criminal conduct is alleged, then he can not be convicted. he can not be found guilty.

it's an interesting theory. it's in the minority among academics, but it's an interesting con textual element. >> is this the only option the defense team has considering up until now he said it's a perfect phone call, and we see the evidence laid out and it was not a perfect phone call. is this the only option that the defense attorneys have as to say even if the committed all of th crimes you guys say, this does not rise to an impeachable offense. >> even if he did all the things ux, yes, and this is a common motion in civil and criminal context. even if all the things alleged in the complaint are true, you still don't have a case, and that's exactly the argument here. they were sort of cornered into this argument back in the summer because once they released that tripl transcript or memorandum or whatever the case may be, all of the facts largely were out there. the defense was always going to be, all that stuff he admitted to saying, there's nothing wrong

welcome back, president trump over the weekend told donors at his mar-a-lago resort details about the strike that killed iran's top general. in audio obtained by "the washington post" and cnn, trump can be heard delivering a dramatic retelling of the drone strike at a friday night prooif private dinner.

trump at times in a subdued and conversational tone explained his motivation for the attack and recounted the final minutes before the strike. watching and listening from the situation room. he told donors that he heard almost two weeks ago that the u.s. had soleimani under surveillance and that he was talking about bad stuff. however, the president did not mention any of his previous reasons for justifying the military strike including a quote imminent attack on u.s. interest or threats to four u.s. embassies in the region. trump said quote this, he was saying bad things about our country like we're going to attack, we're going to kill your people. i said listen how much of this expletive do we have to listen to, right, nbc news has not reviewed these audio tapes. and laura trump, president trump's daughter-in-law is being slammed for mocking joe biden's stutter. watch this. >> i feel kind of sad for joe biden, and you know that's when it's not going well for him, right, because i'm supposed to

want him to fail at every turn. every time he comes on stage or they turn to him, joe, can you get it out, let's get the words out joe, you kind of feel bad for him. >> sully sullenberg known for landing a commercial jet on the hudson river wrote about trump's comments in a "new york times" op-ed where he recounted his own struggle with stuttering as a child. this issue goes beyond politics, regardless of how you feel about joe biden or his chances of becoming the democratic nominee, whether you are a republican or democrat, stuttered as a child or laughed at one who did, whether as a parent you try to protect your child from taunts such as though made by the president's daughter-in-law, these words come without hesitation, stop, grow up, show decency, people who can't have no place in public life. lara defended her remarks, yet another example of the egregious

welcome back, time now for sports and the nfl playoffs, the super bowl 54 match up is set after yesterday's conference championships, we begin last night in santa clara, california, and the san francisco 49ers hosting the green bay packers and the nfc title game. the 9ers going from a four-win team last season to now being one of the final two remaining as they head to the super bowl in just two weeks. for the 7th time in franchise history, shutting out the packers, 27-0 in the first half, san fran did not need to rely on star quarterback jimmy garoppolo but instead were carried by running back rahim moster who scored four touchdowns, 29 carries, that is the second most rushing yards in a post season game in nfl history. final score 37-20 on that game. to kansas city and the chiefs hosting the tennessee titans

yesterday afternoon in the afc championship game after going three and out in their first possession, the chiefs would score on the next five, outrushing the titans, 112, led by patrick mahomes, 53 yards on the ground, and a 20 yard scramble up the sideline, for kc's first lead of the game. at the end of the first half, mahomes tossed three touchdown passes in the game connecting with tyreek hill for 8 and 20 yards and sammy watkins for 60 yards, 440 total yards of offense for the chiefs. kansas city finds its way to its first super bowl since 1970 with a 35-24 victory over the titans. let . let's turn now to the uk, prince harry speaking publicly about he and his wife's meghan markle's decision to step back as members of the uk royal family. watch this.

latest on impeachment. as the senate trial is set to resume tomorrow. nbc news correspondent hans nichols has more. >> reporter: president trump touching down in texas to tout his china trade deal before a friendly audience. after the president's legal team formally responded to the senate impeachment summons calling the articles brazen and unlawful. democrats dismissing that argument. >> there is ample evidence, overwhelming evidence, any jury would convict in three minutes flat. >> reporter: alan dershowitz distanced himself from the legal team he's joining. >> i did not read that brief. my mandate is to present the constitutional argument. >> reporter: aside from knowing tuesday's start time there's still uncertainty if new witnesses and evidence will be allowed during the prose. >> senator mcconnell prevails and there are no witnesses, it will be the first impeachment trial in history that goes to conclusion without witnesses.

>> reporter: some of the rules are known, no cell phones, no standing, no talking. senators are commanded to keep silent on pain of imprism. and senate republicans suggest that the house may want to consider a redo. >> maybe they ought to withdraw the articles of impeachment and start over again. >> reporter: with one of the president's closest allies saying that mr. trump wants the trial wrapped up by the state of the union address on february 4th. >> but his mood is to go to the state of the union with this behind him and talk about what he wants to do for the next rest of 2020. >> reporter: and on sunday night, the president weighed in on impeachment saying he was being impeached by radical left lunatics but insisted that farmers would stay with trump. as for that tuesday's trial, when it starts, the president plans to be in davos, switzerland, meeting with foreign leaders and touting america's economic strength. >> thank you to nbc's hans nichols for that. joining me once again from washington, white house

correspondent for reuters, jeff mason. good to talk to you once again. >> you too. >> let's discuss this impeachment trial getting under way 1:00 p.m. not sure why they're starting so late in the day. >> i think that's partially to do with when the senators and the lawmakers get back in town after their recess. >> of course. >> that's a fair question. >> right. >> let's talk about the president's legal strategy here, we saw quite a progression with regards to the defense of the president over the house impeachment investigation. in the beginning they said it just didn't happen. there was no quid pro quo, the president didn't engage in this type of conversation, and that has progressed to where we are now, which it seems as if there's more defense of, even if he did do this, it does not rise to the high crimes and misdemeanors as laid out by the founders in the constitution. it does not rise to an impeachable offense. talk to us about the president's legal strategy here going forward. >> sure, i think it boils down to a couple of things very specifically, one, the defense attorneys in this case, the president's attorneys are

arguing that the president did nothing illegal. that he did nothing wrong. they will repeat the fact that they believe or the president believes that his call was perfect, the one with president zelensky of ukraine, and that basically he's done nothing wrong, and number two, with regard to the second article of impeachment, that he has the right to executive privilege, he has executive privilege and the right to not send over the documents and not allow some of the witnesses that lawmakers were trying to call and trying to get during the initial process in the house, so those are the two main legal arguments there, basically that he did nothing wrong on a legal level and that he was allowed to do what congress is saying or at least what democrats in congress are saying has been obstruction. >> so now let's talk then about the political strategy here. we are in an election year, which is incredible, all that we are facing in the barrel, considering we have a presidential election ten months or so away from now.

what is the political strategy here for the president going forward, especially when you hear from people like senator lindsey graham, he says the president says so him he believes he has been bolstered politically by this impeachment process. >> there's some evidence to support that, just if you look at the money that sort of has been flowing in to president trump's campaign, at least according to them, and the rnc, they have done extremely well since this impeachment process and the entire impeachment process has begun. so there have been some political benefits there. there might continue to be some. certainly it's given president trump a lot of fodder to discuss on twitter and at the rallies that are a key part of his campaign strategy. i think broadly politically, he is working to continue to keep his base ginned up and impeachment has done that. and he will continue to show, both by going to davos tonight,

switzerland, and by holding that state of the union address in a couple of weeks that he can contrast what he wants to show of him doing his job as president with what democrats are doing with regard to impeachment. >> and of course then there's the question of witnesses, will we actually see people like john bolton testify during the senate impeachment trial. >> tvd. >> thank you so much, great talking to you, jeff. >> you too. in a sharp break from standard election protocol, "the new york times" editorial board has endorsed two democratic candidates for president, senator elizabeth warren and senator amy klobuchar, in explaining their decision, the opinion side of the paper argues that among 2020 democratic presidential candidates quote, an essential debate is underway between two visions that may define the future of the party and perhaps the nation. both the radical and the realist models warrant serious consideration. that's why we're endorsing the most effective advocates for each approach. citing elizabeth warren's medicare for all plan and tax on

the wealthy. the editorial board argues, the board writes that the lack of a single powerful moderate voice in the democratic race is the strongest evidence of a divided party. amy klobuchar has emerged as a standard bearer for the democratic center. and the democratic national committee has announced two ways candidates can qualify for the next presidential primary debate to make the stage for the february 7th debate in new hampshire. candidates can qualify by winning at least one pledge delicate to the democratic national convention in the iowa caucuses or by collecting donations from 225,000 people and earning either 5% support in four qualifying polls or 7% in two polls, new hampshire, nevada or south carolina. so far all six candidates in last week's debate appear to have qualified for the next debate. and former vice president joe biden is demanding an apology

from senator bernie sanders' campaign for circulating what we called a quote doctored video, which he says misconstrues his record on social security. in the video, biden during an april 2018 speech at the brookings institution said that then house speaker paul ryan was quote correct in trying to dismantle social security. his campaign said he made the remarks sarcastically. the video was posted by an unverified twitter user and re-tweeted this month by a senior sanders campaign adviser at an event in iowa biden responded to a question about his record on social security by a woman who said she received a call from a campaign questioning his position on it. >> it is simply a lie that video that's going around. and ask anybody in the press, it's a flat lie. they have acknowledged that this is a doctored tape, and i think it's beneath, and i'm looking for his campaign to come forward and disown it.
